Introduction.

In contrast with previous rolls, the licences to transport wheat from England are not numerous in this roll. 1 None the less, Bernat Angevin, one of the leading men of the Anglo-Gascon administration obtained one of them. 2

Bernat was gradually becoming the most important Gascon officer of the duchy. He was a member of the king’s council at Bordeaux with annual wages of 15 m.st. . 3 A yearly sum of 10 l. from the wine custom was granted to him. 4 More importantly, he received at the king’s pleasure a very significant grant of the lordship and town of Lesparre which had been previously only been granted to the seneschals of Aquitaine. 5 Bernat obtained from the king letters of protection for himself and his elder son Johan. 6

Being at the head of the king’s council as protector in England, the duke of Gloucester Humphrey strengthened his interest in the duchy by obtaining in 1433 for himself and his male heirs, the lordships of Médoc previously owned by the late Pons VIII, lord of Castillon-de-Médoc, having had their keepership from November 1430. 7 Gloucester was also now granted the lordships of Médoc previously owned by the late Bernat de Lesparre, lord of Labarde and at this point occupied by the captal de Buch, the lord of Montferrand and the latter's wife. 8 Using the opportunity created by the death of Carlos de Beaumont, alférez of Navarre, who had participated in the English wars in northern France from 1415, Gloucester also took over the castellany of Soule with the castle of Mauléon and the baylie of Labourd, situated in the Basque Country, with all its revenues. 9 Indicative of Gloucester's growing interest in the revenues of the duchy is the general protection granted to all his officers, servants, serfs, possessions and goods there. 10 Bidau de Bayse, a Gascon of his household, was granted the writing office of the prévôté of Dax. 11

John Aloff, an English captain present in the duchy since 1413, was granted the lordship of the castle of Conac, an isolated stronghold in ‘French’ Saintonge, with right to give (in fact to sell) safe-conducts to circulate on the Gironde estuary. 12 This was in reality official acknowledgement of a de facto situation since Aloff had been captain of this castle for eight years and already given such safe-conducts. Gadifer Shorthose, an Englishman who arrived in Aquitaine at the same time as Aloff and who had been captain of Bergerac since 1431, was appointed mayor of Bordeaux (1433), a position he was to keep until the first conquest of Bordeaux by the French in 1451. 13

Yet it would be a mistake to assume that all of the local offices of the duchy were granted to Englishmen, as several Gascons and Basques obtained prévôtés, baylies and other revenues. 14 Only Gascons were appointed as judges of the superior court of Aquitaine. 15 The great lord Galhart III de Durfort, lord of Duras and Blanquefort, was even appointed seneschal of the Landes as replacement for the lord of Lescun Fortaner de Pommiers, who had died recently. The Basque Johan d’Amézqueta, lord of Saint-Pée (in Labourd), to whom the king had given the prévôté of Dax and the baylie of Hastingues, was accorded the legitimation of his son Augerot de Saint-Pée for his good service. The latter became one of the main leaders of the Anglo-Gascon resistance against the ‘French’ in the south of the duchy until his death in 1450. 16

One entry mentions an Englishman born at Bordeaux appointed as serjeant-at-arms in the duchy of Aquitaine, and another a Gascon vintner who was a citizen of London. 17

Full pardon was granted by the king to several citizens of Bordeaux accused of leading riots at Bordeaux in 1428. It appears that trouble continued over the following years, but the exact nature of these riots is unknown. 18

War is also present in this roll: exemption from tolls and taxes was granted for three years to the town of Saint-Sever in order to carry out repairs to its derelict walls and to maintain its military equipment; and several forfeited revenues awarded to the city of Dax also to repair its walls. 19 The city of Bordeaux claimed to have repaid the expenses it had expended in the capture of the town of Rions (in 1420) and the castle of Castelnau-de-Cernès, previously held by the lord of Albret, a leader of the French party in Gascony. 20 A ban on taking any fee or wage or taking oaths to the counts of Foix and Armagnac was proclaimed in 1433. Aside from the fact that they were lords of the French party, this measure was probably taken in order to avoid Gascons of the English side rallying to them. 21

The situation created by constant fear of war, and the subsequent lack of money, explained why an order was sent to pay before anything else the wages of the king’s officers in the duchy of Aquitaine. 22 Apparently, no coins had been minted for several years at the castle of Bordeaux and the lack of a ducal coinage had caused economic problems, the Gascons having to use other currencies, and a loss of revenues for the king. 23

We find in this roll licences to transport precious and valuable objects, which may reflect the lack of specie because of the lack of minting. The Navarrese lord Luis de Beaumont was allowed to bring into Aquitaine his gold and silver dishes and his jewels. 24 The count of Longueville and captal de Buch, Gaston de Foix, was allowed to bring to Aquitaine various silver vessels from England and France. 25 The dean of the cathedral of Bordeaux, Tétbaut d’Agès, obtained a licence to take valuables with him to the general council of Basel. 26

Worthy of note is the request of the Franciscans of Lesparre presented by a professor of canon law who was one of the members of their convent. 27 We also see a grant of two preceptories of the order of Saint John 'of Rhodes' to a brother of this order. 28

Grant, at the request of Master Arnaut Combes, professor of canon law , and one the members of the Franciscan convent of Lesparre, with the advice and assent of the king's council, to the Friar Minors of this convent to receive the alms and annuity according to the will of this convent's founders without impediment from the receivers or the officers of the town or lordship of Lesparre, as the founders of the Lesparra convent of the Franciscans of Lesparre 1 buried there had granted to the Franciscans certain perpetual alms and annuities paid on the revenues of the land and lordship of the town of Lesparre , on which two tuns of wheat and two tuns of wine were used to be received each year as it appears in the letters sealed by Clyfford William Clifford, then constable of Bordeaux , Tiptot John Tiptoft, seneschal of Aquitaine , and Radclyff John Radcliffe, kt , constable of Bordeaux, then seneschal of Aquitaine. The king has learned that the Franciscans have not been paid these alms and annuities to their great damage.

Grant for three years, with the advice and assent of the king's council, to the burgesses, citizens ( vicini ) and inhabitants of Saint-Sever , to be exempted from the payment of any toll, taxation and assizes ( assise ) pertaining to the king for whatever goods they sell or buy even if it is wine, any grant done by the king or his ancestors to the cities of Bayonne or Dax notwithstanding. On 30 May 1427, 1 the king had granted to the Sanctus Severus, de jurats and community of the town of Saint-Sever to be exempted for two years from the payment on any tolls pertaining to the king and on any taxation or assizes ( assise ) on their goods in any town or city of the duchy of Aquitaine, but some king's officers in the cities of Bayonne and Dax did not permit the men of Saint-Sever to enjoy this privilege and they are requiring day by day payment of these tolls, taxations and assizes , to their great damage. And as Guilhem-Arnaut was impeded, Henry V granted him by his letters patent confirmed by Henry VI on 2 March 1423 to have Langon as he held it before the count of Armagnac. 5 And on 2 March 1423, the current king has ordered Menaut de Habas , 6 who was unlawfully occupying the lordship and town of Langon to the detriment of Guilhem-Arnaut de Lamothe, to return them to Lamothe and to permit him to enjoy them according to the king's letters, but Menaut and Guilhem-Arnaut died before the execution of this order. They should not fail to do this so that Bérart de Lamothe does not complain again to the king. 7

But Lamothe has returned this year 2 to the king's obedience in order to obtain the return of his lands, and the seneschal, the king's council in Bordeaux and the most part of the Burdeloys Three Estates of Bordelais have requested Angevin to return Noaillan and Salaunes to Lamothe, and Angevin has returned them into the seneschal and council's hands, and the latter have passed them to Lamothe who is currently fighting against the king's enemies and rebels.

Privileges for merchant vintners of the duchy at their request:

  1. Safe-conduct everywhere in England or anywhere in the king's lordship, along with licence for wholesale trade with Englishmen ( indigene seu incole ejusdem regni ) and foreigners ( alienigene extranei ), for goods brought in or out of the king's lordship, paying customs, except for wine brought from Aquitaine which they cannot carry out of England without special royal licence.
  2. Licence to dwell where they wish with their goods.
  3. Validation of contracts between these merchants and anybody else, as soon as God's penny has been paid, evidence being provided in case of dispute according to the customs of the fair or town where the contract was made
  4. Release of the right of ancient prise ( prisa antiqua ) of each 2 tuns of wine unloaded in England or in the king's lordship for each ship, and of any other increase, without paying the market price.
  5. For each tun of wine gauged, the seller has to pay for what is missing and the buyer for any surplus, at the price at which the wine was sold.
  6. On the arrival of new vintage in each town of England and of the king's lorsdhip, a sworn commission of vintners from the duchy and of good men of this town has to test the stock of old wine and if it has deteriorated, they have to destroy it.
  7. The seller and the buyer each have to pay one half penny for every gauged tun.
  8. The officers of fairs in merchant towns have to do speedy justice to the vintners according to merchant law, the king punishing any default to do so.
  9. Except for crimes punishable by death, inquiries for lawsuits involving vintners of the duchy will be made by a mixed commission of such vintners, if they are numerous enough, and of good men of town.
  10. No other tax or exaction has to be requested for this wine.
  11. Grant in perpetuity to vintners of the duchy alone not to be prejudiced by any further grant, the vintners of the duchy paying to the king 2 s. for each tun of wine paying freightage, within 40 days after the first unloading of this wine in the king's lordship, in addition to ancient customs.

Pardon granted, with the advice and assent of the king's council, to Achart Pey Eyquart otherwise known as Lassalle, Olyver Mathiu Olivey , Guilhem de Gayac otherwise known as the Bougès 1 , Guilhem Bidau and their accomplices, stopping any prosecution, returning to them their good reputation and all their goods, the sentences given by the king and his officers notwithstanding. They have not to enter the city of Bordeaux before the king orders about it, except with licence of the mayor or the [town] council of Bordeaux . It has been shown by the king's council in Bordeaux, the lieutenant, jurats, thirty and three hundred councillors and the community of the city of Bordeaux represented by Brother Fonquentin Arnaut de Saint-Quentin, master in theology of the Augustinian Order , and Bernat de Garos , burgesses of Bordeaux , that Eyquart, Olivey, Gayac, Bidau and their accomplices have committed six years ago 2 several great insurrections, riots, fights and conspiracies in the city of Bordeaux, and some of them have withdrawn to the kingdom of England, and the king has made these charges be examined. 3

The exact nature of this turbulence is not known as the Gascon Rolls are almost the only known source mentioning them. It was probably an internal strife. See some mentions of these men in the Registres de la jurade : délibérations de 1414 à 1416 et de 1420 à 1422 , Archives municipales de Bordeaux, (Bordeaux, 1883). But sadly, the registers of the community of Bordeaux are lost for the period concerned by these riots and conspiracies. It is to be noticed than the men involved in this unrest were apparently not of a very high status. Mentions of these riots were found by Étienne Baluze (1630-1718) in an 'old manuscript of the Church of Bordeaux'. According to this text, three clerks of Bordeaux were jailed by the king of England's judges because of the 'tumults' that took place at Bordeaux, then they refused to deliver them to the archbishop of Bordeaux David de Montferrand who claimed to have jurisdiction over them because of their ecclesiastic status. Consequently, the archbishop had placed Bordeaux and its suburbs under interdict. Finaly the king's judges delivered the three clerks to him and lifted the interdict. Later, Montferrand received a letter from Henry VI summoning to appear before him about this matter (1429). David de Montferrand died during his stay at London on 31 May 1430.
