Physical condition of the roll

The roll consists of seven membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

Introduction.

Most of the entries of this short roll deal with licences granted to English merchants permitting them to buy wheat in England and to bring it to Bordeaux and Bayonne to sell there in order to supply these cities. Worthy of note is mention of Paolo Miliani, a merchant of Lucca dwelling at London. 1

A commission of oyer et terminer , an ad hoc judicial committee made up of three Gascon prelates and three Englishmen, was appointed by the king’s council in order to make judgment about the succession of Pons VII de Castillon (14 September 1425). Despite his political and military importance, Pons VIII, the grandson of Pons VII, still had difficulties in taking possession of his inheritance as his first cousin Johan de Lescun continued to occupy it. 2 A similar commission was appointed in 1426, and was made up of two Gascon abbots, the lord of Labarde, Pey Berland, the future archbishop of Bordeaux, and the English mayor of Bordeaux, Laurence Merbury. They were to come to a decision about the possession of the town of Langon, which was claimed by Bérart de Lamothe, lord of Roquetaillade, the legitimate heir of this lordship. The lordship was then occupied by Johan de Habas, the son of the captain Menaut de Habas who had recovered the town from the French. 3

The king’s council also confirmed (28 July 1426) the possession of several places by Gaston de Foix, count of Longueville and captal de Buch, who had previously conquered them from French partisans and the Albret family. This council also elevated the vicomté of Benauges, one of the main hereditary lordships of Gaston de Foix, as a county. 4 Certain possessions at Bordeaux and in its vicinity were granted to the Navarrese knight Luis de Falces who had fought and carried out diplomatic missions for Henry V. The properties had been owned by the recently deceased Thomas Beauchamp who had been an active English captain in Périgord. 5

Two entries deal with the claims, accepted by the king’s council, of Nicholas Bowet, great-nephew of the late Henry Bowet, former constable of Bordeaux in the early part of the reign of Henry IV, later bishop of Bath and Wells and finally archbishop of York, about the properties and revenues which his great-uncle had owned in the duchy. 6

Commission of oyer et terminer , with faculty to use a summary procedure ( summarie de plano ), to the abbot of Sainte-Croix of Bordeaux ; 1 the Insula, Medok abbot of l'Isle-en-Médoc 2 doctor of boths laws; the prior of Saint-Jacques of Bordeaux ; 3 Croweford William Crawford, kt ; Master John Norton, doctor of canon law ; and Master John Gentill, doctor of laws , or at least to the two abbots and the prior, about the case of Pons [VIII], kt , lord of Castillon , 4 as he complained to the king that he was the heir of the baronny of Castillon with la Marque Lamarque , Moton Mouton , Sanssacum Sensac and a part of Castrum Novum in Medulco Castelnau-de-Médoc which belong to him by hereditary right, through the will of his grandfather Pons [VII] by replacement and by hereditary institution by his kinsman Pons de Castillon 5 who were lords of Castillon, and by the gracious grant of the late Henry V when Pons [VIII] came back to the king's allegiance, whereas Henry V was the true heir of the lordship when Pons [VIII] had not yet returned in his allegiance, so Henry V had given to Pons [VIII] some goods forfeited by rebels and ordered his grant be enforced by summary procedure by his letters patent, and it was ordered to deliver to Pons VIII the barony of Castillon and the other lands by subsequent letters of Henry V which have not yet been implemented. 6

But Pons VII's codicil, written in London on 22 December 1417, did not mention his grandson Pons VIII but instead named his nephew Johan de Lescun as his universal heir (TNA, Prob/11/2B). According to Pons VIII, Pons VII's codicil was a forgery and Johan de Lescun and his mother Johana de Castillon occupied without right the lordship of Castillon-Médoc (TNA, E 28/39).

Philip Delywe of Hereford in Herefordshire , gentleman , Thomas Delywe of Barbron Barbourne in Worcestershire , yeoman , Hulle John Hull of Bampton in Oxfordshire , gentleman , and Richard Grove of Haggeley Hagley in Worcestershire , gentleman , became mainpernors before the king for Pavy under pain of the loss of the true value of this wheat and broad beans that these goods be brought by Pavy to Bayonne and not elsewhere; and they will give in chancery letters testifying the unloading of this wheat under the seal of the mayor or the governor of Bayonne within a term of one year. Order to the seneschal of the duchy of Aquitaine and constable of the castle of Bordeaux to permit Nicholas Bowet to have, receive and enjoy without impediment the gauge and the money coming from the exchange mentioned below which were owned by Henry Bowet, former archbishop of York , at the time of his death, according to the hereditary right of Nicholas. Previously, Henry IV had granted to Henry Bowet for him and his heirs the gauge that is received for the king at the castle of Bordeaux , that is one sterling of Aquitaine corresponding to 5 d. for each tun customed in the castle of Bordeaux. 1 And subsequently Henry IV learned that Edward III had granted by his letters patent to Bertran II, Montferant lord of Montferrand 200 m. of English sterling to receive annually from the revenues of the duchy of Aquitaine, and later this lord exchanged with Master Henry Bowet, then lord of Ornon, 100 m. by year on this annual sum of 200 m. granted by Edward III, with the parishes of Marinnhac Mérignac , Pessac , Illac and Bolac Boulac with any right pertaining to the castle of Ornon , an agreement confirmed by Henry IV. 2 It has been shown to the king by Nicholas Bowet, kt, that all these things should have been owned by him by hereditary right, as he is the closest relative of Henry Bowet. This has not been acknowledged until now, to his great damage. In an inquiry made by John Tailboys , former escheator in Lincolnshire , by the king's order following the death of Henry Bowet 3 and then returned to chancery, it is shown that Nicholas Bowet is the closest kinsman of archbishop Henry Bowet, as he is the son of Elizabeth , daughter of Adam [Bowet] , brother of Henry.

Pedewell Richard Pedwell of Welles Wells and Henri Burton of Bristoll' Bristol , merchant , became mainpernors before the king under pain of 100 l. for each of them that these goods will be brought by Alberton to Bordeaux and Bayonne and not elsewhere. Commission of oyer et terminer , with faculty to use a summary procedure ( summarie de plano ), to the Lysle en Medok abbot of l'Isle-en-Médoc , 2 the Bornet abbot of Bournet , 3 Bernat [de Lesparre], le Bard' lord of Labarde , Laurence Merbury, kt , mayor of the city of Bordeaux and Berlani Pey Berland , 4 or at least four, three or two of them, about the complaint of Bérart de Lamothe . 5 They have to act so that Lamothe's complaint does not reach the king again. The king has ordered to the captain of the castle of Langon , the prévôt , the burgesses and the inhabitants of Langon to deliver the castle, lordship and town of Langon to Bérart, obey and attend him and permit him to enjoy them. Formerly the late Guilhem-Arnaut de Lamothe owned the castle , lordship and town of Langon by hereditary right until the Armaniacum count of Armagnac 6 took them, and later they were retaken by some liege men of the king. Henry V had granted Langon by his letters patent, confirmed by the current king on 2 March 1423, to Guilhem-Arnaut de Lamothe . 7 Although the king ordered to the then seneschal of Aquitaine and the constable of Bordeaux on 1 July 1425 to deliver Langon to Bérart de Lamothe, son and heir of Guilhem-Arnaut de Lamothe, 8 Bérart has complained he did not obtain Langon.

Order to the seneschal of the duchy of Aquitaine and constable of the castle of Bordeaux to permit Nicholas Bowet to have, receive and enjoy without impediment the things mentioned below which were owned by Henry Bowet, former archbishop of York , at the time of his death according to the hereditary right of Nicholas. Henry IV had granted on 18 February 1400 to Henry Bowet, 1 clerk, because of the great sums of money he expended for his service, of the lands, tenements, revenues, possessions granted by Prince Edward of Woodstock and Richard II to the late Stretton John de Stratton, lord of Landiras , to wit:

  1. all the goods, lands and revenues, houses of Bordeaux ( hospicia burdegalia ), vineyards, mills, woods, fisheries, pasture and commons ( paduagia ) that were owned by Champerryon Arnaut de Camparian, former burgess of Bordeaux ; 2 ;
  2. the gauge of the wine in the city of Bordeaux that the Moucedane, de lord of Mussidan 3 held by hereditary right and which was seized by the king because of his rebellion; 4
  3. the three parts of the market of Bordeaux formerly held by Collom Johan Colom, kt , and seized by the king because of his rebellion; 5
  4. the office of door-keeper ( janitor ) of the castle of Bordeaux formerly held by Goot Galhart de Got, Roiallac lord of Rouillac ;
  5. the lands of the late Johan Colom, kt , at Vessan Bessan and within the Marque jurisdiction of Lamarque ;
  6. all the lands formerly owned by Galhart de Preissac 6 in Burdeg' Bordelais ; the Barsak prévôté of Barsac formerly owned by the lord of Budos ; 7 the castle and town of Lengon Langon with 4 d. for each pound of the current money of the duchy to be received on all the goods coming through this town;
  7. the gauge that is received for the king at the castle of Bordeaux , that is 5 d.st. of Aquitaine; the land of the Destanx lord of Estang 8 and the Condak land of Condat , of Barbane Barbanne which were owned by the daughter of the son of Fussac Galhart du Foussat ;
  8. and also the house where the heirs of Fumell' Johan de Fumel live in Bordeaux together with le Trave [the house of] La Trau .

Grant to Arnaut [III de Durfort], son of the late Duro Forti Arnaut [II] de Durfort the toll of Sancti Macharii Saint-Macaire to have, hold and receive, for himself and his heirs, on land as well as on water, to the value of 400 m.st. per annum until the lands and places with their appurtenances, granted to his father according to the tenor of the king's letters, be fully returned, any grant made by the king or by Henry, duke of Lancaster, former king's lieutenant in the duchy to Loryng Nigel de Loring or anybody else notwithstanding. The king wishes the allowance Loring received in the toll of Saint-Macaire to be satisfied in another location. Previously, the king granted by his letters patent to the late Arnaut de Durfort, for his good service, for himself and his successors if they deserve it, the land called la Borne Born with the places of Herba Faveria Labouheyre and Memysan Mimizan , and the land of Guosa Gosse and Seynas Seignanx , as well as the land and baylie of la Bourd Labourd with the place and parish of Monte Strugo Montastruc , and the parishes of Guyssen Guiche , Bardos , Durt Urt and Bruscos Briscous being in the duchy of Aquitaine, to have and hold, with jurisdiction of high and low justice with both complete and shared authority, and all reliefs, fees, homages, rights, customary payments, baylies, castellanies, prévôtés and customs and their appurtenances which the king has, for liege homage and fealty to be made to the king and his heirs by Durfort, and by his heirs, in part of satisfaction of 500 m.st. of lands and revenues per annum which the king granted to the late Durfort and his heirs in the duchy of Aquitaine, as more fully appears in the king's letters. Grant in perpetuity to Bertran [II], Montferant lord of Montferrand and to his heirs, of the all the goods owned by the late Labrit Bérart [III] d'Albret, Legoyran lord of Langoiran at the time of his death, if it is not to the prejudice of others who had received previous grants from the king. Bertran II de Monferrand holds the main part of these goods because his wife is the full sister of Bérart III, 2 and as he and the children he had with his wife should succeed to Bérart III's goods, but the Labrit lord of Albret 3 unlawfully holds a part of these goods, and John of Gaunt had granted in perpetuity to Montferrant and his heirs the goods of Bérart III. 4

Grant and confirmation for this count and his male heirs of the following places:

  1. the half of Sanctus Basilius Sainte-Bazeille which had pertained to the rebel la Bret Francès d'Albret, kt , uncle of the former lord of Albret , 1 the other half pertaining to Gaston de Foix;
  2. the half of Landerron which had pertained to the rebel Francès d'Albret, the other half being owned by Gaston de Foix;

  6. and also the places of Sore and Castelnave de Sernes Castelnau-de-Cernès which were owned by the lord of Albret and the value of which does not exceed 100 l.st. ;

The king furthermore grants him 300 l.st. of revenue to be received each year on the conquests he makes or he will make against the king's rebels and adversaries. The king confirms all these grants, with the proviso that these places are not from the king's domain, that Gaston de Foix will render them to the king at his request, and that he made these conquests at his own costs and not at the king's costs, and that this grant does not set a precedent for others.
