Gascon Roll for the 6th to 8th years of the reign of Henry VI
Physical condition of the roll
The roll consists of seven membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.
C 61/123, 5, 7 and 8 Henry VI (1427-1430) .
Introduction.
Apart from the usual entries on the letters of protection and licence to transport wheat, there are several entries on this roll concerning justice. The king’s council had granted on 8 February 1428 the possessions of the late Amaniu Béguey to the seneschal of Aquitaine John Radcliffe. 1 There was a commission of oyer et terminer appointed on 1 April 1428 by the king about the allocation of this inheritance as a result of a complaint by Guilhotin Andron, lord of Lansac. 2 Another commission was appointed on 8 March 1428 by the king’s council concerning a conflict between the lord of Castillon Pons VIII and the captal de Buch Gaston de Foix concerning the possession of a part of Castelnau-de-Médoc. A previous commission had given a final sentence in favour of Pons VIII without possibility of appeal. 3 Nevertheless the captal de Buch had appealed to the king and sent to England his proctor Henric Cavier in January 1428. He remained there without the matter having been heard by the king's council until March 1429, but he obtained for the captal a delay to appeal of this decision. 4 There is another commission which was appointed because the carters of Bordeaux, represented by Bertran Fau, complained that the community of Bordeaux levied on them 20 s.b. more than on the other citizens of Bordeaux. 5
Several entries deal with ‘several unlawful riots, fights, tumults, meetings of people, plots and conspiracies’ that took place in the city of Bordeaux. Proclamations had to be made to forbid them, but must have proved ineffective since we still find entries about the matter in the following rolls. Sadly, the exact nature of these ‘riots and plots’ led by some Bordeaux citizens are not known. 6
Various entries concern Bayonne. An English mayor of Bayonne was directly appointed in 1428 by the king rather than by the customary way where the seneschal of Aquitaine had to choose from a list of three Bayonne citizens. 7 The king’s council ordered the mayor and community of Bayonne to respect the exemptions of payment of customs granted by King John in 1199 to the citizens of London. 8 A burgess of Bayonne was granted the office of bayle of Sorde (in the Landes). 9
Of interest are the letters of safe-conduct granted to the Béarnais merchant Brunet de Bernet and his two sons for the trade of their goods in France, England and Aquitaine. 10 The office of bayle of Pouillon in the Landes was granted to a Gascon esquire, and the Gascon Sansson de Monbrun was granted in the same region the fortalice and lordship of Gamarde if he was able to recover it from ‘French’ partisans. 11 Two of the main officers of the duchy, Bernat Angevin and Estèbe de Brosses, were granted several lands and their revenues. 12

3 September 1427 . Ebor' York . Concerning licence to transport wheat . 1
Licence granted, at his supplication, to Malleverer Robert Mauleverer, esquire , to buy, himself or his deputies, 300 quarters of wheat in the kingdom of England , and export them from whatever port of this kingdom, to the city of Bordeaux . Robert Mauleverer and Robert Benne of Yorkshire , gentleman, became mainpernors before the king in chancery under pain of the loss of 40 l. on their goods and chattels and on the loss of the wheat for Mauleverer, that this wheat will be brought by Mauleverer to Bordeaux and not elsewhere, giving in chancery letters testifying the unloading of this wheat under the authentic seal of the city of Bordeaux before 15 August 1428. The king orders all the admirals etc. to permit Mauleverer or his deputies to buy and load this wheat and bring it to Bordeaux, paying due customs.

Grant at the king's pleasure, with the advice and assent of the king's council, to Radclyf John Radcliffe, seneschal of Aquitaine , of all the hereditary rights, lands, wines, revenues, services, serfs ( questales ), houses, tithes with all their appurtenances that were owned by Amaniu Béguey, kt , and went to the king's hands by the death of Béguey without heirs, up to the annual value of 200 l. , paying any surplus to the exchequer of Bordeaux , with the proviso that Radcliffe pays, before taking possession of these revenues, to Angevyn Bernat Angevin , delegated at the office of constable of Bordeaux, the sum of 400 l. of the English money, a sum Angevin paid on behalf of the king to Béguey's widow because of her owed dowry, according to the local law and custom. 2

Order to the mayor, jurats and community of the city of Bordeaux to deliver to Bertran [III], Montferant lord of Montferrand , the possessions of the late Labrit Bérart [III] d'Albret, Leguoyran lord of Langoiran , unlawfully occupied until now. They have to maintain, protect and defend Bertran III in the possessions thereof. Bertran II, former lord of Montferrand and father of Bertran III formerly held the main part of these goods because his wife was the full sister of Bérart III 1 , and as he, and the children he had with his wife, should have succeeded to Bérart III's goods, but the Labrit lord of Albret 2 unlawfully held a part of these goods, and Henry IV had granted forever these goods to Bertran II by his letters patent at the supplication of the latter. 3 And the current king has confirmed Henry IV's letters to Bertran III de Montferrand. 4

Order to the mayor and jurats of Bayonne not to interfere with the privileges of the citizens of London and to demand from them undue customs, as King John has granted them on 17 June 1199 exemption of any tonlieu ( theoloneum et lestagium ) in all the sea ports of his possessions, and Henry III has granted the same exemption from pavagium , pontagium , rivagium , grants confirmed by the current king, and as the mayor and jurats of Bayonne are requesting Londoners to pay the assizes ( assisa ) of 4 d. by pound, that is one silver quadrant accounting for 1 d.st. and 20 d.st. for 1 l. .

Order to the seneschal of Aquitaine, the judge of Gascony , the mayor and jurats of Bordeaux to proclaim in each place of the city of Bordeaux and other places of this region that anybody, whatever his status, guilty of riot or conspiracy will incur arrest and seizure of his goods and be punished according to the local laws and fors. The king orders to all his officers at Bordeaux and in the region nearby to obey and attend them about it. The king has learned that several unlawful riots, fights, tumults, meetings of people, plots and conspiracies have been made in the city of Bordeaux and outside it in several regions of Aquitaine, 1 and the liege men and king's subjects of Bordeaux and its region are afraid that several damages and trouble might happen day by day unless the king brings a remedy. 2

- In 1434, the leaders of these 'riots, fights, tumults, meetings of people, plots and conspiracies' were pardoned by Henry VI after their coming to England. They were citizens of Bordeaux who caused trouble in this city from 1428 and were named Pey Eyquart , Ayquart or Aycart ( Achart ) otherwise known as Lassalle ( le Sale ), Mathiu Olivey ( Olyver ), Guilhem de Gayac otherwise known as the Bougès (This meant an inhabitant of the Pays de Buch ), Guilhem Bidau and their 'accomplices'. See entry in C 61/125 (Westminster, 12 July 1434). The exact nature of this turbulence is not known as the Gascon Rolls are almost the only known source mentioning them. It was probably an internal strife. See some mentions of these men in the Registres de la jurade : délibérations de 1414 à 1416 et de 1420 à 1422 , Archives municipales de Bordeaux, (Bordeaux, 1883). But sadly, the registers of the community of Bordeaux are lost for the period concerned by these riots and conspiracies. It is to be noticed than the men involved in this unrest were apparently not of a very high status. Mentions of these riots were found by Étienne Baluze (1630-1718) in an 'old manuscript of the Church of Bordeaux'. According to this text, three clerks of Bordeaux were jailed by the king of England's judges because of the 'tumults' that took place at Bordeaux, then they refused to deliver them to the archbishop of Bordeaux David de Montferrand who claimed to have jurisdiction over them because of their ecclesiastic status. Consequently, the archbishop had placed Bordeaux and its suburbs under interdict. Finaly the king's judges delivered the three clerks to him and the archbishop lifted the interdict. Later, Montferrand received a letter from Henry VI summoning him to appear before him about this matter (1429). David de Montferrand died during his stay at London on 31 May 1430. Grant of a delay to introduce an appeal in the royal court ( audiencia ) to Gaston de Foix, Longa Villa count of Longueville and Bogii captal de Buch , at the petition of his proctor and ambassador Cavis Henric Cavier, 1 doctor of canon law , considering that Cavier has arrived in London on 8 January 1428 and remained in England until 8 March 1429 doing due diligence, and that the prescription period had not to be forfeited to Foix's prejudice, as Castilione Pons [VIII] de Castillon, kt , is claiming from Gaston de Foix a part of the place of Castelnau-de-Médoc , as the royal commissaries Johannis Bérart Johan, prior of Saint-Jacques of Bordeaux , 2 Croweford William Crawford, kt and Houper William Hoper, doctor of laws , have given an unjust final sentence against Foix who has appealed to the king's court by petition brought to the king and his council by Cavier, but whereas Cavier could not do it in due time, the king being involved in other business.

These letters have been lost by accident as John Dupont has swore it in chancery before the king, and this latter has made a copy of it [from its copy being in the chancery rolls]

Commission of hearing and examining, with the advice and assent of the king's council, to the abbot of Bournet , 2 Lerland Pey Berland, king's councillor , Bernat Angevin, who exercises the office of constable of Bordeaux , and Simon Sprotley, controller of Bordeaux , or at least three of them, to make full justice according to the local laws, fors and customs, having heard the parties, about the complaint of Bertran Fau and his companions burgesses and carters ( carectarii ) of the city of Bordeaux , as the mayor and jurats of Bordeaux after some years and on their own private authority have taxed them, who are, according to their complaint, poor servants of the state ( res publica ), 20 s.b. each year in addition to the taxes paid by them as the other burgesses of Bordeaux. The mayor and jurats of Bordeaux have levied this tax by force and did not hear their complaints usurping the king's lordship as king's liegemen are taxed by the king or his officers in his name and no other, to the carters' great damage and perpetual servitude if they do not obtain the king's grace about it, thus they request the king to provide them with a remedy. The commissioners have to send a certification to the king about this. The king orders to all his liege men to obey and attend them on this matter.

Letters of protection, with clause volumus, granted for one year to Walter Kelvyll , who is staying in the king's service in the regions of Aquitaine in the company of Radclyf John Radcliffe, kt , Fronsacum, de captain of the castle of Fronsac , who is staying there for the safeguard of this castle, as well as to his men, lands, revenues and other possessions. The king orders his officers to maintain, protect and defend Holme and not permit that anyone injure his person, possessions and goods. The king wants Kelvyll be deemed quit concerning any trial and complaint, excepting trials of De dote , Unde nichil habet , Quare impedit , Assisis de nova dissesine , Ultime presentationis and of Attinctis and summons for utterances by justices in eyre, until Kelvyll 's return to England if it happens he has to return there for the king's service.
