C 61/67 29 Edward III (1355-56)

Introduction.

On 10 July 1355 the prince of Wales, Edward of Woodstock (the Black Prince) was appointed royal lieutenant of the duchy. ¹ This roll contains many entries relevant to the army with which he crossed to the duchy in September and which, with Gascon troops alongside, carried out a great march across Languedoc almost as far as the Mediterranean, returning to Bordeaux around 9 December. ² The roll is replete with letters of protection and letters of general attorney granted to Englishman going to the duchy in the Prince's army. We also find details about the organisation of what was the first important military expedition since 1349. Several entries are concerned with the selection of mariners from Southern England for the expedition. ³ Ships of Bayonne chartered by the king of Navarre, and certain others, were requisitioned for the same expedition. ⁴ There was also appraisal of horses before the departure of the army: their cost was then repaid by the king if they were lost during the future expedition. ⁵ Specific equipment, such as hurdles and gangplanks, had to be provided for the transport of the horses on ships. ⁶

The wine trade is not absent from the roll, however. According to the interpretation of a royal ordinance on wines which compelled English merchants loading the wines they bought to do so only in the ports of Bordeaux or Bayonne, the men and merchants of the duchy of Aquitaine were unable to go elsewhere in the duchy to load wines. ⁷ This was highly detrimental to the trade and to the economic life of other towns of the duchy. As a result, merchants of the duchy were now allowed to load wines everywhere in Aquitaine. The inhabitants of Libourne were finally allowed to sell their wines in their town directly to Englishmen who were allowed to load them there. ⁸ The community of Bordeaux was ordered to end its financial extortions on goods brought at Bordeaux by the inhabitants of Libourne. ⁹

We learn other things about Libourne, such as details of the annual ‘election’ of a mayor in the town. ¹⁰ The king confirmed a grant made by the earl of Lancaster in 1346 allowing the community of Libourne to levy taxes on several types of goods sold there in order to finance the enclosure of the town with ‘moats and walls including towers, machicolations and barbicans, and sufficiently surrounded by water’, as well as for payment of the construction of defensive war machines. ¹¹

A tax on wine was granted to the consuls and inhabitants of Aiguillon in order to repair their walls which has been damaged by a second French siege led by the count of Armagnac in 1354. ¹²

We find a confirmation of a treaty made by the earl of Lancaster with Amaniu du Foussat in 1349, rallying the latter to Edward III’s obedience. ¹³ Amaniu was allowed to build a fortalice at Condat near Libourne, ¹⁴ which had been granted to him by the king, where there had been previously only a manor which had been used by Edward I in 1289.

Edward III put his son Edward of Woodstock, prince of Wales, as his lieutenant in Aquitaine, in charge of carrying out an enquiry on two cases. The first was about the building of the enclosure of Lesparre by its lord, which had been challenged. ¹⁵ Another enquiry was to be carried out about the death sentence on Domingot de Nau, an esquire of the lord of Langoiran Amaniu d’Albret, accused of rape, issued by the mayor of Bordeaux. ¹⁶

Some judicial cases mentioned on this roll are quite informative. The king sided with the lord of Ornon against the citizens of Bordeaux about his possession of the ‘barony of Camparian’ (or the Comtau ) and jurisdiction over it, ¹⁷ which was somewhat in contradiction with the king’s decisions on the matter copied into the previous roll. Pey de Bordeaux, nephew and lieutenant of the castellan and prévôt of Bayonne, levied money in Bayonne. He was attacked and seriously wounded in this office by a citizen of the town. ¹⁸ We also find an appeal to the king from the lord of Caupenne, his brother and his sister, about the inheritance of their mother Auda de Tiran situated near Bordeaux which had been challenged by Bérart II d’Albret. This case lasted until at least 1368. ¹⁹ There were conflicts between the lord of Albret, firstly with the lord of Budos, and later with the lord of Pommiers, over the possession of the castle of Castets-en-Dorthe, as these two lords had been, according to Albret, successively entrusted by him to keep this castle after its capture, but had refused to render it to him. ²⁰ Some English merchants who had loaded their goods at Bordeaux had been made prisoners along with their goods at Saint-Mathieu in Brittany and taken as prisoners to Harfleur in Normandy. ²¹

Order to Master Stretle John de Streatley , constable of Bordeaux, to deliver to the attorney or proctor of Holand Thomas de Holland , this latter having been appointed the Brittania king's captain in the duchy of Brittany , all the issues and profits coming from the seals and brefs ¹ from the customs of the ships pertaining to the duchy of Brittany coming to Bordeaux from the next feast of Easter ² he receives, as long as Holland is the king's captain in Brittany, in order to pay his expenses there, without rendering anything to the king.

Henry of Lancaster grants to Amaniu du Foussat because he returns to the king's obedience:

A pardon for everything that Amaniu du Foussat and his men have done against the royal majesty.
Item, that the losses of his hereditary possessions be compensated.
Item, as Foussat would have lost 500 l. of annual rent in Toulousain , ¹ the duke allocates this sum on the land of Condat situated in the Entre-Dordogne [region], ² with one d. of toll at Aculeo, de Aiguillon owned by him by hereditary right, the revenues of this toll being included in these 500 l. .
Item, in case, because of royal service, he might lose the 300 l. of revenues he asserts to own in Brulhesio, in Brulhois , the duke promises him to compensate this loss.
Item, as some parishes have been granted to him by the adversary of France ³ in the jurisdiction of the city of Agen with high and low justice, the duke gives him the same parishes under the same terms.
The duke commits himself not to send him before the court of France ⁴ for the abuses he did.
Item, the duke swears he will not exclude him and his men, but include them in all peace or truces made with the adversary of France ⁵ .
Item, the duke gives to Foussat the part of Aiguillon he owns by hereditary right.
Item, the duke swears to have this agreement ratified by the king. ⁶

This is providing that the house or fortalice would be returned to the king or his heirs at the order of the king, his heirs or their seneschals of the duchy of Aquitaine, in times of war or peace ( iratis et pacatis ).

Order to the seneschal of Aquitaine, that having heard the complaint of Ramon-Guilhem [de Caupenne], Coupenna lord of Caupenne , Gombaut de Caupenne and Lugana de Caupenne, Puyolee, de lady of Poyaler , and having heard before him Lebreto, de Bérart [II] d'Albret , if he finds that the Caupennes have been unjustly removed from the possessions mentioned below, he must return them to them. And if it happens that the official or any other officers of the archbishop of Bordeaux or the dean and the chapter of Saint-André of Bordeaux or their officers, or anybody else, tries to remove the Caupennes, he should revoke their decisions and return these lands to the previous state in order to protect the king's and the Caupenne's rights. Ramon-Guilhem [de Caupenne], lord of Caupenne, Gombaut de Caupenne and Lugana de Caupenne, lady of Poyaler, have complained to the king, as their mother Tyran Auda [de Tiran], former lady of Tiran , ¹ had left to them by her will ² and divided between them her places of Cyrannum Tiran and Bussacum Bussac with their appurtenances and the Caupennes were in possession of these lands for a long time since the death of their mother, when the mayor of the city of Bordeaux , under the pretext of an order of Ralph [de Stafford], earl of Stafford , then the king's captain and lieutenant in Aquitaine, at the prosecution of Bérart [II] d'Albret, removed them from these lands without calling them before him and delivered them to Albret. Then the Caupennes appealed to the then seneschal of Aquitaine and these lands were put in the king's hands according to the local fors and customs, but Bérart d'Albret took possession of them by force without right. ³

Letters of protection granted at the king's pleasure at their request to Arnaut Martin of Macau and his brother Ramon [Martin] , their men, lands and revenues. Dorynha Ramon d'Origne and his brothers, under the pretext of certain dissent which took place between them and Arnaut Martin and his brother Ramon and certain other persons of the town of Macau in Gascony, led to Arnaut and Ramon being seriously wounded and then prosecuted without reason. And the king orders to the seneschal of Gascony and the constable of Bordeaux and all the king's officers of the duchy of Aquitaine to maintain and protect Arnaut Martin and his brother Ramon, their men, lands and revenues. And if anything has been done against them, they have to compensate them without delay and return them to their previous status. And if Ramon d'Origne or any others complain against Arnaut Martin and his brother Ramon, they must prosecute them before the court of Gascony according to the local fors and customs.

18 February 1355 . Westminster . For the inhabitants of the town of Aiguillon .

Grant to the Aculeo, de consuls and inhabitants of Aiguillon of the right to levy for six years from 29 September 1355 12 d.bord. on each tun of wine and 6 d.bord. on each pipe of wine, and following the same rate on all the other goods passing through their district by land or water, in order to restore their status and repair their walls. ¹ These tolls have to be levied by two worthy men ( probi homines ) of Aiguillon and checked by worthy men delegated by the constable of Bordeaux. The same tolls had been previously granted to them for six years by the king on 20 August 1348, to be levied from 29 September 1348, ² in compensation for their resistance against the king's enemies. ³

Order to the seneschal of Gascony and the constable of Bordeaux, that having summoned before them Pey de Bordeaux and Johan de Lesbay, and heard the complaint of Pey de Bordeaux, if it happens that a transgression has been made against this latter, then they have to compensate Bordeaux for the damage he suffered, and punish Lesbay in such way that it serves as an example for others who act badly against the king's officers. Burdeg' Pey de Bordeaux , nephew of Oliver de Bordeaux , ¹ the king's valet, has complained to the king, as Oliver had received for life the castellany and prévôté of Bayonne, and this latter had appointed Pey as his lieutenant to keep and govern this office, and delegated to him to levy the revenues and profits pertaining to this office, as well as to count the money coming from this office; La Baye Johan de Lesbay , son of Gasshe Reynald, la Baye Gassie-Reynaut de Lesbay attacked Pey de Bordeaux and hurt him, givin him a serious wound as large as half an arms' length ( brachii ), and committing other harms putting Bordeaux's life at risk.

Order to the sheriff of Cornwall to provide as soon as possible at the port of Plymouth 2,500 hurdles ( clayas ) ¹ and fifteen gangplanks ( pontes ), eight gangplanks of twenty feet in length and seven gangplanks of fourteen feet in length, for the transport of the horses of Edward [of Woostock], prince of Wales , and other king's subjects being in his retinue sent to Gascony. He has to deliver them within the period of fifteen days before the next feast of the Trinity ² or on this same day to Henry le Hewe whom the king has delegated for this task.

16 February 1355 . Westminster . For Guilhem-Bernat [d'Ornon], lord of Ornon .

Order to the seneschal of Gascony to maintain and defend Guilhem-Bernat [d'Ornon], lord of Ornon , in the possession of the barony of Camparian as he both he and his ancestors held this since an exchange with the barony of Blaye, and make to obey him the men and tenants of this barony of Camparian as they were accustomed, and if Ornon has been unjustly damaged or removed from the barony, he must correct this and return it to its previous state. Ornon has complained to the king that one of one of his ancestors king of England and duke of Aquitaine ¹ formerly gave to his ancestors and their heirs the barony of Camparian with its appurtenances in exchange for the barony of Blaynes Blaye . Guilhem-Bernat d'Ornon and his ancestors owned it without any problem until some citizens of the city of Bordeaux asserted that the main part of the barony of Camparian was within the borders of the banlieue and jurisdiction of the city of Bordeaux and not under the juridiction of Guilhem-Bernat. Consequently, these citizens of Bordeaux forbade without right on many occasions and have done recently the people of the barony of Camparian to be obedient towards Guilhem-Bernat d'Ornon.

Order to the seneschal of Gascony and the constable of Bordeaux to maintain and protect Lebreto, de Guiraut d'Albret and his heirs in the possession of the manor of Libarde. The king has formerly granted for life to Guiraut the Lyvard' manor of la Libarde that was Eymonis Arnaut Aymon 's, but which came into the king's hands by the rebellion of his heirs. Afterwards, wishing to reward Albret's good service further, the king granted that Albret and his heirs should hold the same in perpetuity, as is more fully contained in the king's letters patent.

26: 14 February 1355 . Westminster . For the moneyers of Bordeaux .

Order to the mayor, jurats and citizens of the city of Bordeaux to allow without impediment their fellow burgesses who work in the king's mint situated in the castle of Bordeaux to enjoy the liberties and privileges they have. The king does not want this complaint to reach him again, otherwise the king will use his authority on this matter ( ad hoc extendere manum nostram ). Their fellow citizens of Bordeaux working at this mint have complained to the king that although they had their home, wife and children in the city of Bordeaux and they were to enjoy the liberties and privileges of the burgesses of Bordeaux and had enjoyed the same until recently, the mayor, jurats and citizens of Bordeaux have without right impeded them from enjoying them because they have received as moneyers other liberties and privileges from the king and his ancestors.

Order to the seneschal of Gascony and the constable of Bordeaux to permit without impediment the men and merchants of the duchy of Aquitaine to load their wines on ships at the city of Bordeaux in the same way as before, and bring these ships to the towns of Lybourn' Libourne , Briggerak Bergerac , Sancto Milione, de Saint-Émilion and the other towns on the river Dordogne , as well as others in the duchy, and load their wines in these towns and the places of their wish, paying the due customs, as they were used to do before. Provided that no Englishman loads or brings wine elsewhere than in the ports of Bordeaux or Bayonne , according to the king's ordinance. Because of this ordinance [published on 23 September 1353], ¹ the seneschal and constable have forbidden, according to what the king has learned, the loading of wine on ships apart at Bordeaux or Bayonne; so the merchants and some others of the towns of Libourne, Bergerac, Saint-Émilion and others towns situated above on the river Dordogne were unable to efficiently bring their wines to their damage and to the king and his kingdom of England damage. And such a wide application of this ordinance was not the intention of the king and his council.

Grant to the inhabitants of Libourne to sell their wine at Libourne to any Englishman , and allowance to the Englishmen to buy their wine and load it there without any impediment of the king, his heirs and of their officers, any ordinance about this notwithstanding. According to the complaint of the inhabitants of Libourne Englishmen were accustomed to come to Libourne to buy and load wine there, but were now prevented to come to Libourne because of the king's ordinance published by the king allowing them to buy and unload only at Bordeaux or Bayonne. ¹

Grant to the worthy men and the inhabitants of the town of Libourne , at their supplication, that if their mayor dies within the one year period of his office, the sub-mayor of Libourne will succeed to him as mayor without any new election or presentation of another mayor or any opposition from the seneschal of Gascony, the constable of Bordeaux or their lieutenants. The worthy men and the inhabitants of the town of Libourne had received from the king's ancestors, kings of England, the right for their twelve jurats, burgesses of their town, to elect each year two worthy men for the office of mayor, these two men having to be presented at the castle of Bordeaux before the seneschal of Gascony, the constable of Bordeaux or their lieutenants on 22 or 23 July, and one of the latter choose the mayor for one year as is customary.

Order to the seneschal of Gascony and the constable of Bordeaux to make deliberation about the matter mentioned below with the members of the king's council there and to be fully informed about it, and they have to send a report about it to the English king's chancery under the king's seal in use for the duchy. The Leyborne worthy men and the inhabitants of Libourne have complained that, although they hold from the king their fiefs of this town and they have always paid to him until now 2 s. per pound ( per libra ) for the lods et ventes ( vendis et retrovendis ), ¹ and the king had the cognizance of the measures of the plots ( mensure placearum )concerned by these lods et ventes , and the king's officers of the duchy were not to interfere with these measures in any way, the seneschal and the constable have demanded 2 s. 6 d. per pound ( per libra ) for the lods et ventes of the fiefs of Libourne , have compelled them to pay this sum and have taken without right cognizance of the measures of the plots of the lods et ventes to the great prejudice of the inhabitants of Libourne.

Confirmation and grant to the Liburnia mayor, jurats and community of the town of Libourne , at their supplication, of the right to receive and levy the taxes and emoluments [mentioned below] until their town be perfectly enclosed with moats and walls including towers, machicolations and barbicans, and sufficiently surrounded by water. The earl of Lancaster confirms that the mayors, jurats and community of Libourne and their predecessors have well and legally levied these taxes for the king's use and the salvation of their town. These taxes were agreed for the payment of the enclosure of their town, and for the brides ( bridis ), ¹ the machines and the moats as well as the other works necessary for the defence of their town, and for the payment of several men-at-arms, mounted and on foot, who were in garrison fro the safekeeping of their town, and also several large amounts of money to support the business of the king and his officers. These taxes were on the sell of wines, salt and minagium , the measures of corn, salargis and on all the fish and the other goods passing through their town, and on the stalls ( super tabulis sive scannis ) of the town hall ( domus communi ) [of Libourne] and the bread.

Order to the mayor, jurats and community of the city of Bordeaux to stop their exactions when they levy on the goods of the inhabitants of Libourne 6 d. per pound ( per libra ) on the wines and goods they bring to Bordeaux, and let them be undisturbed according to the king's charter and not do them any damage against the tenor of this charter. Formerly, the king's ancestors have granted, among other privileges and liberties, to the burgesses and inhabitants of Libourne to be freed within the duchy of Aquitaine from paying any customs and maletotes on their goods and chattels to the king's ancestors and their descendants, though they still are to pay the old customs due to the king. The king has learned that the mayor, jurats and community of the city of Bordeaux have levied, according to the king's grant done to them, ¹ 6 d. per pound on all the goods passing through their town by land or water, apart from the wines of the English. And they have levied it on the wines and other goods of the burgesses and inhabitants of Libourne forcing them to pay it against their liberties and immunities, so the latter have supplicated the king to bring them a remedy on the matter.

The king has learned that several people went in the past to the town to live there and that they acquired there many goods, but they moved with these goods to remote places when war broke out, and Libourne was on the verge of being lost because of their absence. The latter came back at Libourne when peace was signed again. They did that at the expense of their town and of the citizens of Libourne who had always stayed there.

Order to the seneschal of Gascony and the constable of Bordeaux to arrest and retain all the merchants and others from the kingdom and power of the adversary of France, ¹ as well as their goods and chattels wherever they are within the duchy of Aquitaine, until the king orders otherwise, and send from time to time to the English king's chancery certification of the value of the seized goods and chattels under the king's seal in use in the duchy. Dobbesson Nicholas Dobson of Bristoll' Bristol , master of the ship called la coge Seint Savour of Bristol have complained to the king, that he, Som' Bartholomew de Somerset, merchant of Bordeaux , and Chaddre Robert de Cheddar, merchant of Bristol , as well as some other partners, had loaded at Bordeaux to bring them to the kingdom of England , some wine, woad, honey, gold and silver in ingot form ( in plata ) up to a value of 1,600 l.st. , and when this loaded ship went towards England at the port of Sanctus Matheus Saint-Mathieu in Britanny , some people from the party of the king's adversary of France went on 5 May 1355, during the truces, and they took it by force, stripping from all their goods the mariners and the others being on this ship, taking these latter ashore on the land apart from three Englishmen, Nicholas Dobson himself, Vyel Henry Viel and Gratele Henry Grateley , who were brought to Harfleu Harfleur in Normann' Normandy , the price of this ship being 200 l. and they did as they wish with their goods, and two of the Englismen were kept in a narrow prison, while the third was freed to go to England in order to pay their ransoms, so they have supplicated the king to bring remedy about it. After an inquiry ordered by the king, whose text is kept at the king's chancery, let by the mayor and bailiffs of the town of Bristol , it appears that this story is true. Furthermore, it appears by reading the letters patent of the general lieutenant of the admiral of France ² shown before the king and his council, that this ship ( cog ) of Bristol has been loaded by certain French several times at Saint-Mathieu for this admiral, to the damage of the Englishmen passing at sea.

Order to Edward [of Woodstock], prince of Wales , king's captain and lieutenant in the duchy of Aquitaine , to inform himself about the toll levied to build a enclosure for the place of Lesparre , and if it happens that what Sénebrun [V], la Sparre lord of Lesparre asserted was wrong and this place could be repaired with less significant financial help, then he has to cancel or restrain the levy of this toll, so he has to make a decision in order to defend this place in case of war and also in order to spare the men of this region who are damaged by the payment of this toll. Formerly, at the prosecution of Sénebrun [V], lord of Lesparre, the king granted him on 1 February 1353 ¹ 16 d. per pound ( de libra ) to receive on the goods sold and bought at Lesparre for a ten year period to assist with the building of the enclosure of Lesparre, as this place was situated on the frontiers against the king's enemies. But the king has learned that in fact Lesparre is situated in a region where there is peace, and which is very distant from the king's enemies, so there is no need of a enclosure and fortifications as suggested by certain king's subjects of this region who are damaged and impoverished by the payment of this toll.

Order to the seneschal of Gascony and the constable of Bordeaux to arrest, as Nicholas Dobson and his partners have lost as much as 2,266 l. 13 s. 4 d. st. because their ship, with the goods they had, have been taken by certain French and three of them have been ransomed, ¹ all the goods, men and merchants of the power of the adversary of France ² up to the sum of 1,666 l. 13 s. 4 d.st. in part satisfaction of the sum of 2,266 l. 13 s. 4 d. , and send from time to time to the English king's chancery certification of the value of the seized goods and chattels under the king's seal in use in the duchy. The king also orders to the Suthampton mayor and bailiffs of Southampton to do the same up to 500 l. , to the mayor and bailiffs of Melcombe [Regis] and the Meymuth bailiffs of Weymouth up to 100 l. .
