Physical condition of the roll

The roll consists of 10 membranes. Entries appear on the face of the membranes only, the dorse being used solely for referencing notes. The outermost membrane doubles as a cover, with a heading on the outside. The roll is in good condition throughout, although the dorse of membrane 1 is slightly dirty and worn, as expected of a cover.

Introduction.

Like the last roll, this roll is dominated by the renewal of the war with France. In addition, like most of the rolls for the duration of the principality of Aquitaine, the roll lacks a diversity of types of entries, with the vast majority of entries being letters of protection and attorney for those going to, or staying in the principality. Amongst the letters many went or stayed in the service of three English magnates who had gone, or were going to the principality to aid Prince Edward - John of Gaunt, duke of Lancaster, and Edmund of Langley, earl of Cambridge, two of the prince's brothers, and Laurence de Hastings, earl of Pembroke. Smaller groups were recorded in the company of Walter Huet, kt, Thomas de Roos of Helmsley and Robert de Knolles, Huet and Knolles being professional soldiers from Worcestershire and Herefordshire for the first, from Cheshire for the second, and with Roos, regularly in the service of the prince in the French wars. Although Edward III formally began to use the title of 'king of France' again in June 1369, this event is only first acknowledged in this Gascon Roll for the following regnal year.

Of the small number of entries that are not letters of protection or attorney, two also clearly relate to the war, and to John of Gaunt in particular. The first is a straight forward licence for one Bartholomew Nogon to take dried and salt fish to La Rochelle or Bordeaux for Gaunt, presumably to sustain his household and retinue there. 1 The other, a grant of power to Gaunt to receive those who had deserted the English for the French and wished to return to their former obedience, and to issue pardons, is of far greater significance. 2 The grant reveals both the growing importance of Gaunt, and perhaps also the decline of Edward of Woodstock's activity. Following the death of Lionel of Antwerp in 1368, Gaunt was the eldest surviving son of Edward III after Edward of Woodstock, and his power and wealth had rapidly increased after his inheritance ultimately of the duchy of Lancaster in 1362. That the king granted him the power to receive rebels not only indicates his father's trust in Gaunt, but also must have been a recognition of the increasing incapacitation of Edward of Woodstock. But Gaunt was by far a less able general then his elder brother and turned out to be unable to efficiently fight the French. Up until this point, the Edward III had shown great restraint in his dealings with Edward of Woodstock, the Gascon Rolls clearly revealing that his only real interventions in the affairs of the principality were restricted to diplomatic affairs, and the exercise of appellate jurisdiction, both of which still pertained to the king as sovereign lord, though the king had frequently ceded the latter to the prince.

Although the preceding paragraph has suggested that there were very real concerns on the king's behalf about the incapacity of Edward of Woodstock, when it came to the matter of the hearing of appeals, matters seem to have continued in much the same way as we have seen in the preceding rolls. The ceding to the prince of the power to select the commissioners to hear appeals from the prince's jurisdiction to that of the king was repeated; 3 and the long running case brought by the Monlarin family against the officials and ministers of the prince was continued without apparent conclusion. 4

The remaining entries consist of three inspeximus and one assignment. Two of the inspeximus confirmed the appointment of Richard de Fillongley as a general serjeant of Bordeaux, and his grant of authority over all other serjeants in Bordeaux and the Bordelais, and in Agen. 5 Fillongley was an important financial official of Edward of Woodstock who appears to have served in a variety of capacities in the principality from its foundation until long after the retirement of the prince. In the appointments found on this roll, he is recorded as a subordinate of William de Spridlington, the prince's auditor of accounts in the principality. 6 The remaining inspeximus was of the significant grant made by the prince to Johan III de Grailly, captal de Buch, of the county of Bigorre. 7 The Grailly family was one of the most important and powerful families in Aquitaine, and with the desertion of the English cause by other important families such as the Albrets, the need to nurture ties with those who remained loyal obtained a greater significance. The grant of the county of Bigorre was a very significant lordship to grant to the Graillys. Coveted by the neighbouring lords and the vicomtes of Béarn in particular, who had claims to the county, 8 its location was strategically important for the English, since it lay neighbouring the county of Armagnac and the vicomté of Béarn, whose rulers were all either directly opposed to English rule in the region, or demonstrated themselves extremely opportunistic in their dealings with both the English and French. But the main purpose of this grant was essentially to defend it against the count of Armagnac who had claims on this county and who was the head of the French party in Aquitaine.

The remaining entry relates to the assignment of a hostage. In reward for the loyal service of Florimont, lord of Lesparre, in the war, and in satisfaction of a grant of 1,000 l. by the king to Florimont's late father, the king had assigned Hugh de Russy to him. 9 The assignment notes that Russy was a hostage as a guarantee of the French observance of the peace, presumably that agreed in the treaty of Brétigny/Calais of 1360, and with the French default, he was now being held, and was an asset to be disposed of for ransom.

Order to the judges of Aquitaine to summon before them the parties in the complaint originally brought by Arnaut [de Monlarin] and Montlaryn Pey de Monlarin , brothers and burgesses of Bordeaux, examine the original issues, and the alleged attempts to delay judgment in this case, and do justice according to the laws and customs of the areas concerned. Order also to all the king’s subjects, and to the prince’s serjeants and officers, that they be intendant upon the judges in all issues relating to this matter. The king had previously sent information to the abbot of La Sewa Sauve-Majeure 1 in the Bordaloys diocese of Bordeaux , the abbot of St Maxentius Saint-Maixent 2 in the Poytou diocese of Poitiers , and to Peire de Caseton, lord of Gordon Gourdon and Seriz Guillaume de Séris , knights and officials of Bordeaux , concerning certain grievances, wrongs and damages which Pey de Monlarin, now deceased, and Arnaut de Monlarin, brothers, burgesses of Bordeaux and next heirs of Arnaut de Camparian and Anna [ de Camparian ] , his daughter, had brought against the people and officials of the prince of Aquitaine , concerning certain goods, possessions and inheritances which ought to belong to them by right, but which have been seized by the prince’s people and officers. The brothers appealed the matter to the king’s court, but meanwhile other appeals were brought against them, prejudicial to their case, as outlined in earlier letters patent. By virtue of these, Peire de Caseton and Guillaume de Séris proceeded with the case, and took certain testimonies for each side. However, the people and officers of Bordeaux, seeking to delay the case, appealed to the king, for which reason Pey and Guilhem did not wish to proceed with the matter. While the case has been pending, Pey de Montlaryn has died, his son Pey being his next heir, and Pey the son and Arnaut have complained that various further attempts have been made against their case since the death of Pey the father, and have asked that all the matters relating to the case be summoned before the judges. 3

Grant to John [of Gaunt], duke of Lancaster , that, for the comfort and support of Edward [of Woodstock], prince of Aquitaine and Wales , and the inhabitants, he should admit and receive to the king's peace, obedience and grace those citizens of Aquitaine and other parts of the kingdom of France who had left the obedience of the king and prince, whether they had left through the persuasion of the king's enemies or of their own will, and who now wish to return to the prince's obedience, pardoning their crimes, even the most serious, and restoring their privileges. While it is sometimes right to punish such actions by the exercise of royal authority, it is sometimes right to temper such actions with leniency. The duke is to be able to enoble those who are not noble according to the knowledge of their abilities and merits, giving safe-conducts with the king's standards or pennons; he is to do and exercise all things with the agreement of the prince when he is present or absent, doing what the king would do if the king was personally present. 1

Commitment, under the great seal, to ... 1 , and the four of them, of whom the king wishes that the archbishop or bishop, the abbot the chancellor, and the two barons at the least being always present, 2 of full and free power, authority and special mandate in all and each appellate cause and matter, both criminal and civil, which issue or which shall issue from the court of the prince of Aquitaine , who holds the land from the king, examining and proceeding with the merits of those appeals and whatever other matters and causes, real, personal or mixed, or of whatever other nature touching this superior and resort jurisdiction as shall arise, determining them according to the laws, fors and customs of those parts, and making due execution; giving and granting safe keeping and protectors for all those appealing, as is accustomed to be given, and doing, exercising and executing all other things which shall be useful or necessary in these matters or concerning them, and which the king himself would do if he were there personally.

This has been done because it is the responsibility of rulers to establish suitable and appropriate tribunals, where wise and just judges shall sit, and hear the legal cases of their subjects, and punish the guilty, and free the innocent; and since it cannot be denied that the realm of France ought to devolve to the king, both by right heritage and according to the peace previously entered into by the king and his adversary of France, which has totally dissolved through his adversary's detestable false oath, guilt and notorious failure, as is well known, just as other peaces have done, the whole of the land of Aquitaine has been restored to the king, with the immediate, lordship, sovereignty and resort; the king wishing deeply that his people of those parts should live well in peace, and to protect them from troubles and criminals as far as possible, and wishing that sovereign and resort jurisdiction in his land of Aquitaine be exercised as pertains to him by right, has, by his favour, provides that there shall be set up [a court] for the exercise of sovereign and resort jurisdiction in this manner at his royal city of Xanctonensem Saintes , where there abounds plenty of skilled people and victuals, so that he may spare his subjects of those parts from their labours, costs and expenses; the king wishing and ordaining that each of his subjects may come to this city, concerning any sovereign or resort cases, safely and peacefully, without any impediment, as often as they wish, where, speedy justice will be reached concerning the troubles of all.

The prince, as well as his seneschals, judges, officials, servants, ministers and all other faithful people of those parts, are ordered to be obedient and intendant to them and their deputies, commissioners, servants and ministers in the execution and implementation of all these matters. However, the king does not intend or wish that these letters should revoke any earlier orders issued to other judges on these matters, by him or under his authority, unless they are expressly revoked by other letters sent to them. 3

He therefore orders the officers to defend Arnaut and Pey, their family and goods from violence and undue grievance, and to maintain them in their rightful possessions.
