C 61/71
Gascon Roll for the 32nd year of the reign of Edward III
Physical condition of the roll
The roll consists of fourteen membranes. There are entries on all of the faces of the membranes, but none on any of the dorses. There has been a numbering error on the membranes with no membrane five. However, because this numbering sequence is that which has been used for all the other rolls, the numbering has been followed here. The roll is in good condition.
C 61/71 32 Edward III (1358-59)
Introduction.
This roll of the second half of the 32nd regnal year of Edward III, from June 1358 to January 1359, contains several confirmations of acts made by Edward de Woodstock, prince of Wales, whilst his father’s lieutenant in the duchy of Aquitaine (1355-7).
Several treaties were signed between the prince and local lords which confirmed their rallying to the king of England, following the Prince’s successes in Aquitaine whilst he was present in person from the autumn of 1355 to the spring of 1357, and the impact of victory over the French at Poitiers. There were also copied into the roll confirmations of certain clauses of the treaty made between the Prince of Wales and Bernat de Révignan, lord of Castelculier. 1 In this treaty the Prince had granted several places of Agenais to Révignan. 2 Révignan had been used as a middleman to rally other local lords to Edward III by giving them money. Among such lords were several members of the Révignan family. 3 Bernat de Révignan was pardoned for his actions whilst he was in the French party. 4 Furthermore, Révignan was given remission from the duty of responding to the men of Beauville and their lord (then in the English party) for his capture whilst he was ‘French’, since it was alleged he had been made prisoner in time of truces. 5
A treaty was made with the powerful Agenais lord Guilhem-Ramon, lord of Caumont. A pardon was issued by Edward III for him and his men. 6 Caumont received grants of several places in the Agenais. 7 A toll was granted to him at his possession of Caumont-sur-Garonne. 8 Caumont had to be included in a peace treaty with the king of France. 9 There was also confirmation of the treaty made between the prince of Wales and Arnaut de Montaigu, lord of Montaigu-de-Quercy, which brought the latter into the English party. 10 Following another treaty made with the Prince of Wales, Edward III returned to Galhart de Durfort, lord of Duras, the castle and lordship of Blanquefort and granted him other possessions. 11
Several clauses of the treaty signed between the Prince and Johan de Galard, lord of Limeuil (in Périgord) were confirmed on the roll. 12 Whilst he was on the French side, Johan de Galard, lord of Limeuil, had been made prisoner of war by the late Pons IV, lord of Castillon, then on the side of the English, and had been ransomed. Edward III included the costs of this ransom in the wages owed to Galard. 13 A number of people were compelled to do homage to Galard. 14 According to the same treaty Galard was to own peacefully his possessions and his rights to tolls, just as he had enjoyed them whilst in French obedience. 15 There were confirmations of other clauses of this treaty as well as an order to the seneschal of Gascony and other royal officers to implement them. 16 The king returned the goods of the companions of Johan de Galard which had been confiscated when they had followed him whilst he was in the French party. 17
Some echoes of the war led by the Prince of Wales in Aquitaine and its vicinity are to be found on this roll. We learn that Ramon Ébrard of Saint-Crépin (in Périgord) had provided corn and wines for the Prince’s army when it stood at the city of Périgueux on August 1356 during the prince’s second expedition. 18 The faithful lord of Caupenne was granted the castle and castellany of Taillebourg (in Saintonge) which he had taken over from the French, since his own possessions (in the Landes) had been destroyed by men of the French party whilst he was fighting with the Prince of Wales. 19
The Prince had allowed the Carmelites of Bordeaux to enlarge their convent, 20 which had perhaps been seen as too small to house the chapter-general of the order mentioned in the previous roll. 21 The Prince also granted for life to the powerful and faithful Johan III de Grailly, captal de Buch, the castle and town of Cognac which had been taken from the French. 22 Edward III confirmed various grants made by Edward I, when he was lord of Gascony (before 1272) and subsequently as king, which had been made to the captal's great-grandfather Jean I de Grailly. Such grants had provided the basis of the power of the Grailly family in the Bordelais and Bazadais. 23
Recently rallied local lords obtained privileges for their men. Hence the grant to the men, tenants and merchants of the lordships of Guillaume de Garlande and Boson, lord of Grignols, to be free of all new taxes and tolls in the duchy of Aquitaine. 24 Given the state of truce, trade had to be restored between the English-held parts of the duchy of Aquitaine and the French-held parts. So we find letters of safe-conduct granted to Ramon de Puy, a merchant of the part of the duchy of Aquitaine under French rule, until 21 April 1359 because of the truce made with the king of France. 25
Several entries concern the substantial advantages granted to the citizens of the city of Bordeaux, doubtless in order to make even firmer the loyalty of this key city. For instance, it was granted that no citizen of Bordeaux would need to respond before the barons of the region and their bayles in any cases, since the barons and their bayles had allegedly extorted money from them and acted brutally towards them. Such cases were to be sent before the seneschal of Gascony in the court of Gascony. 26 All new taxes demanded from the citizens of Bordeaux when they traded in the duchy of Aquitaine were to be cancelled. 27 The king also reserved to the citizens of Bordeaux, and to nobody else, the right of selling wine in the taverns of Bordeaux between Pentecost and Michaelmas. 28
Several letters of protection were granted to associates of the cardinal Talleyrand de Périgord and members of his household coming from Périgord. 29 Whilst the cardinal clearly favoured the Valois king of France, he was an influential person who needed to be well treated as he might act as a middleman between Edward III and French negotiators for a future peace treaty. One member of his household, the Catalan Carmelite Francesc Bacó, was even granted an office within Périgord. 30 The abbot of Brantôme (in Périgord), kinsman of a member of the cardinal’s household who was in the king of France’s obedience, also received letters of protection from Edward III. 31
The king sided with the inhabitants of the Soule province against Ramon de Miossens, castellan of Mauléon, who had allegedly made exactions against them, but reserving the payment of the right of ‘aubergades’ to the king. 32 Indeed, there was still an appeal pending on this right of ‘aubergades’. 33
One entry provides a narrative of an act of piracy at sea. Some Norman merchants and mariners had been attacked before Royan (at the mouth of the Gironde estuary) by English mariners, losing their ship as well as the wine they had transported from Bordeaux. 34
We also learn about Walter de Galles, a physician who cured several servants of the king, who received two houses in Bordeaux situated close to the king’s castle of Bordeaux. 35

Grant to the inhabitants of the land of Soule of all the things which have been granted to them by the seneschal of Gascony. They have to enjoy them, always saving the aubergades owed to the king. Formerly, Cheverston John de Chiverston , seneschal of Gascony and lieutenant of Edward [of Woodstock], prince of Wales , in the duchy of Aquitaine and all Languedoc, has granted to the nobles, commoners and the inhabitants of the land of Soule which is at the borders with the king's enemies, as the latter have their own lands, fiefs, lands and plots in the land and vicomté of Soule according to the form they were accustomed without having to pay any undue exactions and extortions, and furthermore they are accustomed to graze their cattle on wastelands, lands and rivers within the borders of the land of Soule, so this seneschal has granted to them that the castellan of Mauléon or his lieutenant cannot arrest them during a lawsuit before the Lexarre king's court of Licharre if they have a suitable bail according to the type of lawsuit, and he has also ordered that all the nobles and others who own mills could peacefully grind their corn into flour without impediment and without paying any exactions [to the castellan of Mauléon], and the others who do not own a mill have to grind their corn according to what was accustomed without being compelled to pay undue extortions, as more fully appears in a public instrument [made for the seneschal] and shown to the king's chancery. 1

6 July 1358 . Westminster . For Johan [de] Galard, kt .
Inspeximus and confirmation of the treaty and agreement made between Edward [of Woodstock], prince of Wales , and Johan de Galard, lord of Limeuil:
21 May 1356 . Burdeg' Bordeaux .
According to the treaty made between the prince of Wales in the name of the king and Galhard Johan de Galard, kt , Lymoylh lord of Limeuil about the coming of the latter to the king's obedience, it has been agreed that:
- As, because of Galard's obedience to the king, he has lost 4,000 l.t. of rent by year in the Tolosane seneschalcy of Toulousain , the prince will allocate him this sum in a suitable place or places with high and low justice in the duchy of Aquitaine.
- On these 4,000 l. of annuity, 2,000 will be given to the daughter of Johan de Galard if a wedding is celebrated between this daughter and one of the sons of the Lebret lord of Albret in suitable places with high and low justice, according to terms agreed between the king and the lord of Albret; and in case this wedding is not celebrated these 2,000 will return to Galard, the other 2,000 being allocated to Galard in suitable places.
- The prince has allocated to Galard and his heirs the place of Montflaquin Monflanquin in Agenois Agenais with high and low justice and all its rights, rents, emoluments, homages, profits, issues and all its appurtenances, and for the amount of 400 l. until this sum is allocated elsewhere, Johan de Galard and his heirs having to return the place of Monflanquin to the king or the prince or their officers.
- Item, the expenses needed to fortify ( fortelesces ) Monflanquin to keep it for those delegated for this keepership by the seneschal of Gascony and the constable of Bordeaux or one of them, will be satisfied to Johan de Galard, and the surplus of these 2,000 l. above the 400 l. will be allocated each year on the custom on the wines which are going down to Bordeaux on the river Dordoyn Dordogne to be received by a delegate of Galard before the constable of Bordeaux. Furthermore, the Lombriere prévôté of the Ombrière with all its emoluments is allocated to Johan de Galard. All these things being allocated in payment of the 2,000 l. .
- The prince will keep this place of Monflanquin at his cost and at the cost from the date of this treaty to 24 June 1356 and from it to 24 June 1357.
- Item, for the part of the great sums he lost, he asserts, because of his allegiance to the king, this latter has to give him 12,000 gold crowns ( escutz d'or ), on which 3,000 owed by Galard to the duke of Lancaster 1 will be deducted. And on the remaining 9,000, Galard has to have 3,000 he will use to arm himself against the king's enemies, and the remaining 6,000 crowns to be received by Galard from 24 June 1356 or towards the 24 June 1357.
- Item, a commission will be given to the seneschals of Gascony, Peregort, Caorsyn Périgord and Quercy to inform themselves on the true borders of the territories in la Lynde Lalinde in order to avoid any kind of disagreements that could happen about the borders between Johan de Galard and the people of Lalinde. No bayle or any officer of either of the parties has to exercise any jurisdiction in the power or jurisdiction of the other.
- Item, not any bastide 2 will be made within the power and territory of Johan de Galard in prejudice of his inheritance or patrimony.
- Item, Johan de Galard and his heirs will be maintained without contestation in all their possessions and tolls he was accustomed to have when he was in the obedience of the French. On that matter the king's officers are ordered to keep silent.
- Item, on the homage that Corboran, Lymulh Corbaran de Limeuil done to the Peregork count of Périgord of a parish which is claimed to depend of Seint Alvere Sainte-Alvère in prejudice of the lordship of Limeuil , of the king and the prince, as Johan de Galard asserts that from time immemorial the lord of Limeuil had to do homage to the king as duke of Guyennne for this place of Limeuil and all its appurtenances on which is to be found this parish.
- Item, the resort of Johan de Galard and all his lands of the seneschalcy of Périgord and the man living in these lands have to depend of the Beaumont baylie of Beaumont[-du-Périgord] in the Serlades diocese of Sarlat .
- Item, formerly several lords of the place of Clarence Clérans have to do homage to the Gyene duke of Guyenne 3 and now the said homages and money came into the hands of Johan de Galard or his father 4 by purchase, and because of that Johan de Galard asserts that they do not have to do homage or pay money anymore to the king as duke [of Guyenne], but they have to do these to him without any impediment.
- Item, that all grants given to Johan de Galard's father by the king of France in the castle and Clarence castellany of Clérans be confirmed to Johan de Galard.
- Item, all the people of the land of Johan de Galard have to be exempted from the payment to the duke of Guyenne or his officers of all questes , subsidies, tallages ( tailles ) and other taxes ( imposicions ).
- Item, the place and Longa castle of Longas with the high and low justice and all the rights the king and the prince have there and its appurtenances, which is worth no more than 10 l.st. of rent by year is granted to Johan de Galard who has conquested it by armed force from the French, according to what he asserts.
- Item, the king and the prince will not make any peace or truces with the king's adversary of France 5 without clearly including in them Johan de Galard, his lands and men.
- Item, that the homage Johan de Galard has to do to the king as duke of Guyenne for him and his lands has not to be removed from the hands of the king nor the prince, but would be linked forever to them.
- Item, as the place and house ( hostel ) of Grant Castain Grand Castang has formerly been put into the king's hands for certain debates which existed between the lord of Clérans and another noble ( gentil homme ) lord of the house ( hostel ) of Clérans at the instance of this noble, and thereafter this place of Grand Castang went to Seguyn, Longa Séguin de Longas and the place of Clérans went to the hands of Johan de Galard, so both of the latter want to have the lord's hands removed, as it is asserted by Johan de Galard. The prince has done it and has granted to Johan de Galard to receive from Séguin de Longas the homages and the other duties he has to do to him.
- Item, the goods and inheritances of the companions of Johan de Galard who come with him in the king's obedience will have them returned to them.
- Item, Johan de Galard and his companions and allies who return to the king's obedience are pardoned for all excesses and crimes committed and perpetrated against the royal majesty for rebellion or otherwise, will be returned to their good reputation, and they will have their hereditary goods returned to them.
- The prince orders to all the king's officers to keep and fulfil all the things mentioned above.
