Physical condition of the roll

The roll consists of fifteen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

Introduction.

This roll covers the period up to and after the French conquest. Bordeaux surrendered on 23 June 1451, but we must first consider English actions before this date.

It is notable and obvious that English policy towards the great lordship of Lesparre had been quite erratic: on 16 October 1450, the case was dealt with between the duke of Exeter Henry Holland, son of John Holland to whom the king had granted this lordship, and Pey de Montferrand, a great great grandson of the lord of Lesparre Sénebrun V (d. 1362). Montferrand had succeeded in obtaining, after having sent several petitions to the king, the relocation of the trial at Bordeaux with an ad hoc committee. 1 Finally, on 6 June 1451, just few days before the first submission of Bordeaux to the French, the lordship was officially returned to Henry Holland, as Pey de Montferrand had taken by force in the meantime 'the town, castle and lordship of Lesparre'. 2 Being a major supporter of the Anglo-Gascon regime, Pey de Montferrand had been handled carefully. Hence he was given the office of castellan of Dax (1 October 1450), 3 but this grant was probably ineffective as the captain and prévôt of Dax was still Per-Arnaut de Saint-Cricq in December 1450. 4 The 'barony' of Maremne granted to him on 24 July 1450 5 was cancelled on the following 12 September, as the earl of Worcester John Tiptoft, son and heir of John Tiptoft, lord Tiptoft, previous holder of Maremne had complained to the king. 6 He was at least given the baylie and toll of Hastingues granted in the same act, but he had to be satisfied with only parts of it, as most of this baylie was occupied by the French. 7

Augerot de Saint-Pée, another important supporter of the English, had died in 1450. His heirs and executors had been accused, apparently wrongly, that they had rallied to the French by swearing an oath to the count of Foix Gaston IV: as a result, half of the whaleboat called le George of Bayonne which was then at Bordeaux, had been seized as well as Augerot’s goods being in this latter city. 8 In fact another entry demonstrates that the Basque Gracian de Luxe, husband of Augerot’s sister, who had succeeded Augerot as lord of Saint-Pée, was still in the English party in March 1451. 9 Another great supporter, the young Galhard IV de Durfort, was created a burgess of Bordeaux and appointed as king’s councillor at Bordeaux. 10 Galhart de Jonquière, a more modest noble of the Entre-deux-Mers, was also created a burgess of Bordeaux, probably at the request of the community of Bordeaux, as he served as a man-at-arms under the command of the jurats (town councillors) of Bordeaux. 11

We can suspect that several grants of 'rebel' lands were ineffective. For example the grants made to Loys Despoy of lands and revenues owned by people of Bergerac and Périgord (8 April 1451). 12 Some Gascons defected, as Jacmes de Brion, the preceptor of the preceptory of Bordeaux for the order of the Hospitallers of Saint John of Jerusalem: the king entrusted this preceptory to a knight of this order from England. 13

On legal matters, we can mention the authorization granted to Per-Arnaut de Saint-Cricq, captain and prévôt of Dax, to hold the ordinary court of the prévôté of Dax with a reduced quorum (December 1450). This suggest that the war had made it impossible to gather all the persons needed. 14 The attribution of the captaincy of Gensac was still a bone of contention, as Isarn de Lavergne, son of a former captain of Gensac, had occupied this function and had been in dispute with Loys Despoy for its possession when the captal de Buch Gaston de Foix took by force Gensac and expelled him. A king’s order was sent to the seneschal of Aquitaine and the constable of Bordeaux to hear and terminate this case (27 October 1450). 15

On ecclesiastical matters, we can note the appointment of the abbot of Saint-Romain of Blaye as king’s councillor being at Bordeaux and one of the judges of the superior court of Aquitaine. 16 A protection was granted by Henry VI to the abbey Sainte-Croix of Bordeaux allowing its member to resist a bastard member of the family of the counts of Foix who obtained this abbey in commendam from the pope. 17

Worthy of interest are the two letters of protection granted to the Catalan masters ('patrons') of two galleys owned by the king of Aragon Alfons V. They did not concern directly Gascony, but they were copied here probably because the two acts dealt with Southern Europe: otherwise the French (or Treaty) rolls would have been the expected place of enrollment. 18

Major changes came with the submission of Bordeaux (23 June 1451) and Bayonne (20 August 1451) to French military might. The acts copied in the rolls following these dates concern a duchy occupied by the French. The people of these two cities and the neighbouring places exiled in England after these dates were to be heard in person by Henry VI and his council on 6 May 1452 before any of them might attempt to return to the duchy of Aquitaine, otherwise they might suffer imprisonment as king's prisoner and rebel. 19

But Pey du Taste, dean of Saint-Seurin of Bordeaux, dwelling in England from 1449, was allowed to send a ship from Calais to transport to England the movable goods he still had at Bordeaux (11 August 1451). 20 Joan Tregurà, a Catalan living in England, was allowed to send a ship to Bordeaux to recover some goods and sums of money due to him which he had lost there because of the conquest of Bordeaux by the French. 21 There are similar letters for Grimon de Bordeaux, Arnaut Macanan, Ramonet Eyquem and some others. 22 Some Englishmen dwelling in Gascony lost their goods, as William Cannings and another two merchants of Bristol at Bayonne when this city surrendered to the French. They were now allowed to bring goods from there to England. 23 Licences were granted in 1451-2 to some Bayonnais exiled in England allowing them to charter English ships in order to go to Bayonne to trade there and return to England with goods bought at Bayonne. 24

The great Gascon lords Gaston de Foix and his son Johan, both members of the order of the Garter, flatly refused to submit to the French and managed to sell their Gascon possessions to the count of Foix Gaston IV, their close kinsman (nephew of Gaston, first cousin of Johan) and Jean d’Orléans, count of Dunois. With the money they received, Gaston de Foix bought a lordship in Aragon and remained there. However, he and his son Johan obtained from the king a cancellation of the sell of their possessions if the duchy was recovered by the English. 25

All hope of recovery of the duchy was not lost as is demonstrated by the English expedition led by John Talbot which succeeded in recovering Bordeaux with the help of its inhabitants (23 October 1452). Talbot had been appointed royal lieutenant on 2 September 1452 although his indenture to lead an army was issued in June of the same year. In the meantime, however, all the grants of offices and lands were empty promises. 26 One grant informs us that the unfortunate Fortaner de Serres had been made prisoner twice by the French at the surrenders of Blaye and Bayonne and was hugely indebted because of the two ransoms he had to pay. 27

Bernon and Gasc personally became mainpernors for themselves in chancery before the king swearing that themselves or their deputies will bring this wheat to Bordeaux and not elsewhere; Bernon and Gasc giving in chancery letters testifying the unloading of this wheat under the seal of the community of the city of Bordeaux before 23 June 1451.   6. summon men-at-arms and other soldiers for chevauchées and sieges, and to keep towns and castles;

The king orders the seneschal of Aquitaine, the constable of Bordeaux, their lieutenants, the judges having a superior authority, the king's councillors [being at Bordeaux] and all the king's officers of the duchy of Aquitaine to maintain and defend the abbey, monastery and convent, their brothers and religious men and all what pertains to them. They do not have to allow any trouble or impediment caused to them by anyone having received in commendam this abbey by a surreptitious appointment of the pope . 1 Now this abbey is in great trouble because of the in commendam practice, the king having written several times to the pope that it was at the obvious great prejudice of this abbey, the king and the state, and the pope should revoke this appointment. 2

And similarly, the king grants to Despoy the houses, lands, possessions, mills, wines and goods pertaining to Petrus Peyre de Chaumont , Pont, du Peyre Dupont , Saussynhac Berdot called of Saussignac , la Ryvere Peyre Laribière and their wives, 1 as they have been guilty or consenting of the loss and surrender ( composicio ) of the town of Bergerac or the castle of Montcuq , and also the Banhaux lordship of Baigneaux situated in the castellany of Blaignac belonging to the king by the rebellion of its hereditary lord, its revenues and arrears of its hereditary rights being unlawfully levied by Bost, de Monot Dubosc and Aliot, Cantelou' Heliot de Canteloup . Furthermore, the king grants him the place of Monclar Montclard situated in Petragoricum Périgord , and Gardone Gardonne and Badeffol Badefols in Sarlades Sarladais , which are fully in the king's adversaries obedience, up to the yearly revenue of 40 l.st. . And the king grants him and his heirs in compensation of the 300 fr. [mentioned below] the place, castle and lordship of Granhous Grignols in the Périgord region, which is outside the king's obedience, with all its rights, this lordship having been forfeited because of the rebellion of the current lord of Grignols 2 who has plotted the surrender of the town of Bergerac and the castle of Montcuq and then pertained to Despoy and went by force in the hands of the king's adversaries, and also grant of the lands and revenues that Beaupel Johan Beaupoil and his wife own in the lordship of Grignols 3 up to the yearly value of 100 m. , so that Despoy faithfully perseveres in the king's service. Formerly, the king had granted to Despoy, in reward of his works and service to the king, the plots, lands, fortalices and tenements of Gensac et Blaignac with their appurtenances until he was granted other similar possessions or the same value by the king, as appear in the king's letters patent granting them. 4 Then Despoy has freely delivered these letters at the king's order to Dudeley lord Dudley , 5 the king's councillor, then general commissioner in the regions of Aquitaine, because of the dispute, dissensions, quarrels and debates existing about Gensac and Blaignac, this commissioner delivering them at the king's order to the Longuille count of Longueville , Bussic captal de Buch 6 for the peace and concord made between this latter and the city of Bordeaux which otherwise could not have been settled, and it was granted in part of compensation to Despoy according to Dudley's ordinance later confirmed by the king with the advice of his council, the lands of Cairye Queyries and Roffiac Rouffiac which are worthing only half of the value of Gensac and Blaignac. And according to the same ordinance Despoy has paid the sum of 300 fr. to the count of Longueville to discharge the king, because Dudley was not able to deliver Blaignac to this latter. 7

The port of la Pointe (in English 'The Point') - called in Gascon of the Landes coast and Bayonne le Punte - had been the outer harbour of Bayonne situated at Capbreton where the river Adour flowed into the sea until c. 1400. The king entrusts to Walter Fulnetby, knight of the order [of the Hospitallers] of Saint John of Jerusalem , the king's faithful liege man, the government and administration of the Burdugalen' preceptory of Bordeaux with its rights, appurtenances and revenues to have for his use until the superior of this order or a religious man appoints him or another king's liege man as its preceptor, the king giving order to the members of his council being at Bordeaux, the seneschals of Aquitaine and the Landes , the mayor of the city of Bordeaux and also all this officers [in the duchy] to deliver without delay to him or his deputies this preceptory with its appurtenances and revenues, any trials or frivolous appeals notwithstanding. Recently, several king's liege men have informed that someone called Briant [Jacmes du] Brion, knight of the order [of the Hospitallers] of Saint John of Jerusalem , 1 obviously hold the preceptory of Bordeaux in obeying the king's adversary of France 2 , bringing the revenues of this preceptory outside the king's obedience and doing other damages. Pierre de Grailly was second cousin of Gaston de Foix, captal de Buch, and was also co-lord of Ville-la-Grand (then written as 'Villagrand'). He was proctor of Gaston de Foix and his son Johan de Foix for their lands of Savoie (within its 15th borders): Grilly (a commune in arr. Gex, dép. Ain, France), Ville-la-Grand (a commune in arr. Saint-Julien-en-Genevois, dép. Haute-Savoie, France) and Rolle (now a commune in the canton of Vaux, Switzerland). Gaston de Foix sold them on 26 August 1455 to pay the ransom of Johan de Foix, earl of Kendal, made prisoner by the French at Castillon soon after the battle of Castillon (17 July 1453). Pierre de Foix was one of the two proctors appointed at Maella (Aragon) by Gaston de Foix on 3 May 1455 present at this sell made at Geneva. See Plantin, J. Licence granted for one year, at his supplication, to Chattok William Chattock, merchant of the city of London , allowing him to charter himself or through deputies a ship of a tonnage of 300 tuns or less towards Bordeaux or Bayonne or some other regions, loaded with lawfull goods and sell them in Bordeaux or Bayonne, buy there some other goods and bring also the iron he owns there up to the kingdom of England . The king orders all the admirals etc. to permit Chattock to do it without impediment. On 28 August 1451, 1 the king had granted him by his letters patent a licence for nine months allowing him to bring on a ship of a tonnage of 300 tuns or below some wine, iron and other goods up to the value of the sums of money owed to him at Bordeaux and the surrounding places, from the parts of [Bordeaux] to the kingdom of England. With the main part of this money Chattock has bought a great quantity of iron in the regions [of Aquitaine] to be brought to England according to these king's letters patent, however Chattock was not able to bring this iron to England as the king's enemies forbade him to export this iron to England and and consequently he fears losing all this iron.

And this house and the other things have been seized to the king by the rebellion of David de Brosses . 5 Rousseu has to have all of this with a sum not exceeding the yearly value of 10 l. . With the proviso that if the king grants him a reward of the value of this grant or part of it, Rousseu must return this grant or part of it. 6
