Physical condition of the roll

The roll consists of eleven membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/127, 15 Henry VI (1436-1437) .

Introduction.

As in many previous rolls, this roll contains several entries concerning the export of wheat from England to Gascony via Bordeaux and/or Bayonne. 1 Worthy of note is the association of a merchant of Bayonne with an English merchant, the two men using a Bayonnais ship with a very English name: ‘the Holy Goost’. 2

As common with the Gascon Rolls, this roll gives us interesting individual stories. These include the pardon granted to the Bayonnais Bertholomiu de Sault alias Bertholomiu Duviella who fatally injured Johan Durrieu who had seriously threatened his brother. 3 Another entry teaches us that the long-standing conflict, dating back 25 years, over possession of Langon was resolved by Bérart de Lamothe, its legitimate lord, by entering through force into this town. 4 Lamothe was not the only one experiencing difficulties in recovering his hereditary inheritance. We can also mention the powerful local lord Bertran III de Montferrand who claimed an inheritance from his uncle Bérart III d’Albret (d. 1379), who had been ‘French’ for the two last years of his life. 5 The use of force to take a place was, of course, quite usual in the case of French partisans, but it existed also among English supporters. We know the case of Francès de Montferrand who had been entrusted with the keepership of the church and parish of Salles and the castle of Castelnau-de-Cernès after their take over by the French. 6 But Montferrand had been expelled from Salles by some men-at-arms of the Landais men who refused to obey the king when ordered to return it to Montferrand. 7

The possessions of the late Amaniu Béguey were used by the king to repay money owed to the community of Bordeaux, 8 but principally to reward the faithful knight Bérart de Montferrand. 9 This grant was challenged by Guilhotin de Lansac (Guilhotin Andron, lord of Lansac) who claimed to have hereditary rights. 10 In order to compensate him, he was appointed as the king of England’s seneschal of Agenais, a meagre compensation since the majority of this seneschalcy was under the authority of Charles VII. 11 The same idea probably lay behind the appointment of Bérart de Montferrand as captain of Marmande. 12

This was not the only bone of contention. The Landaise fortress of Gamarde granted to the Gascon Landais Sansson de Monbrun in 1430, 13 and previously conquered from French partisans, was governed by the English captain James Harsage, who was also the lieutenant of the castle of Dax. Probably to compensate him for the loss of this fortress, the king granted Harsage possessions that the late Mathiu de Habas, citizen of Dax, owned at Talence near Dax, and the baylie of Capbreton. 14

The Landes province was particularly valuable within the reduced Anglo-Gascon duchy of Aquitaine as it was almost the only region where the English government could find lands to grant to faithful Gascons or Englishmen who were in Gascony. Hence Loys Despoy, also active in the defence of Normandy and northern France, obtained the confiscated lordship of Doazit from its legitimate heir the lord of Viella, as the latter was a French partisan and former captain of Montargis near Paris. 15 Augerot de Saint-Pée, a future die-hard leader of the English party in the region, was allowed to succeed after his father's death in the prévôté of the city of Dax and the baylie of Hastingues. 16 The king also confirmed the transfer made in 1408 of the numerous Landaise possessions of the late Matthew Gournay (d. 1406), who had been seneschal of the Landes several times from 1369 to his death in 1406, by his widow Philippa Talbot to her new husband John Tiptoft, who had served as seneschal from 1415 to 1422. 17 A likely parent of Matthew Gournay, Joan Gournay, widow of Aymeric de Durfort, was also allowed to become a citizen of Bordeaux. 18

Several letters granted by the king were returned to the English chancery for cancellation because their beneficiaries complained that a clause was missing or had been added, to their prejudice. They obtained new letters with the modifications they requested. 19

Two burgesses of Bordeaux (Guilhem de Gayac alias the Bougès and Guilhem Bidau) who had previously caused major trouble there in 1428 20 obtained letters of protection. 21

An order was sent to the archbishop of Bordeaux, the constable of Bordeaux and the other royal councillors of Bordeaux to start negotiations with the count of Armagnac and the lord of Albret, the ‘French’ leaders in Gascony, in order to obtain truces with them, no doubt in order to reduce danger of war. 22

Two entries concerning letters of protection have no links whatsoever with Aquitaine-Gascony. The first concerns a Genoese merchant allowed to come and go from the port of Sandwich. The second concerns an Englishman who was going to serve the king in Normandy. 23

Licence granted, at their request, to John Godfrey and Godardus Godard Pulham of Wynchelse Winchelsea to buy, themselves or through their deputies, 400 quarters of wheat in the kingdom of England , and export them from the ports of Wynchelse Winchelsea and Southampton to Bordeaux or Bayonne . Thomas Pope of Rye , gentleman , and Westburn John Westbourn of London became mainpernors personally before the king in chancery under pain of 40 l. on their goods and chattels, that this wheat will be brought by Godfrey and Pulham or their deputies to Bordeaux or Bayonne. The king orders all the admirals etc. to permit Godfrey or Pulham or their deputies to do so, paying due customs and providing by themselves or their deputies letters testifying this unloading under the authentic seal of the city of Bordeaux or the city of Bayonne before 25 July 1437.

For Francès de Montferrand.

Grant at the king's pleasure, to Montferrant Francès de Montferrand, User lord of Uza and Belin and his heirs because of his great services, of all the rights that the king owns in the Salas parish of Salles with its appurtenances, jurisdiction and baylie, which do not exceed in revenues the annual sum of 3 l. of the English money, paying the taxes ( onera ) of the parish and to the king his customary rights. 2 Around sixteen years ago, 3 Francès de Montferrand had kept and conquered at his own expenses a fortified church and a parish called Salles situated in the seneschalcy of the Landes , a church which had been occupied a long time by the king's enemies 4 and made hard war against the king's subjects, and Montferrand has since kept this church and has expended there most of his goods for its custody. 5

Grant once again at the king's pleasure to Sampson, Montbrun Sansson de Monbrun of the lordship and fortalice of Gamarde in the seneschalcy of the Landes . Formerly the king had granted him on 7 July 1430 this lordship and fortalice, then occupied by the king's enemies, 2 and having an annual value of 20 l. of the English money. And after this grant, this fortalice of Gamarde was besieged by the king's seneschal of the Landes and Monbrun was in this seneschal's company at his own expense during all this siege until its submission to the king's obedience. Thereafter, Monbrun has requested to the seneschal of the Landes the execution of the king's letters patent, but this seneschal has refused to deliver Gamarde to him, so Monbrun has requested the king to make remedy for this.

Letters of protection granted to Dominicus, Rupello, de Domenico di Rapallo , master of a ship called le Sancta Maria of Janua Genoa which is now in the port of Plymmouth Plymouth , allowing him to go with this ship, its mariners, sailors, pilots with the ship's equipment, to the port of Sandewicum Sandwich , unloading its goods, and loading other allowed goods there, then leave Sandwich to return to his country without impediment. Order to all the admirals to permit him to do so paying due customs, with the proviso that Rapallo and his mariners behave well towards the king and do not bring these goods to Flanders and other regions of the king's enemies. This protection is to last until the return of this ship to the port of Sandwich.

Order to the seneschal of Aquitaine to those who should have the lands of the late Amaniu Béguey , to repay to the jurats, the thirty and the three hundred councillors of Bordeaux the sum of 7,500 fr. of the money of Bordeaux lent by Bordeaux to Radclyf John Radcliffe , 2 less the profits received from these lands, since the city of Bordeaux is supporting on its own resources the expense for the duchy and has pledged most part of its revenues.

Grant once again at the king's pleasure to John Par, esquire , of the office of Sanctus Severus prévôt of Saint-Sever , the baylie of Tholosot Toulouzette and Sanctus Maurus Saint-Maurice , to have and hold them himself or through a sufficient deputy, with all their profits up to the annual value of 12 l.st. , with the proviso that Par pays annually the surplus to the exchequer of Bordeaux . On 3 December 1435, 2 the king had granted to him at his pleasure the office of prévôt of Saint-Sever, but John Par returned the king's letters to chancery for cancellation, as this letter was not valid as it did not mention the baylie of Toulouzette and Saint-Maurice with the prévôté of Saint-Sever.

Formerly, Robert Holme, esquire , who has received the office of controller of Bordeaux , 2 was clerk of the constable of Bordeaux by a grant of Henry IV , 3 but as these two offices cannot be occupied by the same person, as the king has been informed, so the king has granted by his letters patent on 23 November 1436 this office of clerk of the constable of Bordeaux to John Chippenham because of the good services he did in the duchy of Aquitaine. 4 But these letters were not valid because these letters did not mention the robes and daily food allowance with the room and this office's fees as enjoyed by Robert Holme in this office, nor the allocation in the accounts of the constables of Bordeaux presented to the exchequer of England as was the case for Holme, nor have the king's letters granting this office to Holme been returned for cancellation to chancery. Holme has now returned these letters before the king in chancery for cancellation. 5

Pardon granted to Saut, Vielar, de Bertholomiu de Sault otherwise known as Duviella for the murder of Deriu Johan Durrieu , for all the penalties against his body and goods, restoring him his good reputation, and order to the seneschal of Aquitaine, all the king's officers of the duchy and to the mayor, sub-mayor, prévôt, échevins, jurats, hundred peers and councillors of Bayonne to implement this pardon. As Saut Pélegrin de Sault , Bertholomiu's brother, appointed chancellor of the mayor of Bayonne had to enforce a sentence against Lasus Sansson de Lassus , kinsman of the late Johan Durrieu, the latter badly injured Pélegrin and even maimed him, and thereafter threatened him in front of his house. So to prevent him doing so, Bertholomiu de Sault alias Duviella, Jacmes de Lesbay and Daigues Domenges d'Aigues injured Johan Durrieu, who died later because of a lack of care ( ob defectum bone curie et custodie ). And Sancto Petro, de Graciana de Saint-Pée , Johan Durrieu's mother, and Condessina, Cambios Condessa de Caubios , his wife, his sons and daughters, and all his kinsmen and friends complained in the town hall of Bayonne , and as Bertholomiu de Sault has left Bayonne, he has been banished.

Grant to Montferant Francès de Montferrand, kt , 2 because of this good service in this war and others, of the custody of the place of Novum Castrum de Sarnesio Castelnau-de-Cernès in the same way as the person who had it at its surrender and holds it now, until he gets full payment of his wages and of the costs of the repairs from the person or persons who will have this place by the king's grant or some other way. Formerly, Castelnau-de-Cernès had been besieged by several lords of the duchy of Aquitaine of the king's obedience, 3 especially Foys Gaston de Foix, Longeville count of Longueville , the Montferant lord of Montferrand 4 and Francès de Montferrand, and some other king's subjects of the community of Bordeaux, and before its surrender and agreement had been settled between these lords specifying that the custody of this place would be entrusted to the lord of Montferrand with annual wages of 300 fr. , and thereafter as the lord of Montferrand would not have been able to leave vacant this custody, Francès de Montferrand undertook this custody at the request of the lord of Montferrand; and the main part of the walls of Castelnau-de-Cernès had been knocked down during its siege by cannons and other machines ( ingenia ), 5 in such way it was not possible to defend it against the enemies, so that Francès expended great sums of money in repairing it, and the most part of the men [of its garrison] were held there, sometimes without receiving any wages or rewards from the king.

For James Harsage.

Grant, at his request, to Jacobus James Harsage, esquire , issued from England, Acres lieutenant of the castle of Dax , who is governing the castle of Gamarde after having taken it, because it caused a lot of damage to the king's subjects, as it is situated where there is not a single king's captain and is at 80 miles of Bordeaux , without receiving for 10 years any fee or reward from the king. He has kept there 500 persons at his own cost for 9 weeks, of the lands, tithes, hereditary goods, mills and revenues of Talensa Talence which were owned by the late Favars Mathiu de Habas, burgess of Dax , and went into the king's hands by lack of heirs.

And the king grants him the right to incorporate this parish with its appurtenances to the lordship and castellany of Belin . The king has formerly granted to Francès de Montferrand this parish of Salles with its appurtenances which are not exceeding as revenues the annual sum of 3 l. of the English money. 2 Montferrand wants to return these letters to the king's chancery for cancellation, because it included a wrong sentence: 'solvenda onera ipsius parochie et nobis jura et onera consueta'.

They must do that diligently according to the local fors and customs. The king orders to all the king's subjects of the duchy of Aquitaine to obey and attend them on this matter. The king has been informed by a supplication of Francès de Montferrand that around 14 years ago 3 the church and Sales parish of Salles had been conquered from the king's enemies and have been granted thereafter to Montferrand. The latter owned them peacefully under the king's safeguard when Lisle Gaston de l'Isle , Johan de Mès , Lyon, de Francès du Lion , Castetia Nouel de Castéra and other of their accomplices mentioned in the trial made about it, expelled, without right, Montferrand from Salles and kept it, being desobedient to the king, and Radclyf John Radcliffe, seneschal of Aquitaine , and the other king's officers being at Bordeaux ordered l'Isle, Mès, Lion, Castéra and their accomplices to deliver Salles to Montferrand under pain of payment of a sum of silver marks and to sue them in a trial, but they continued to hold Salles notwithstanding the king's orders so they must incur the penalties decided against them. 4

Order to the seneschal of Aquitaine, the constable of Bordeaux to deliver without delay to la Mote Bérart de Lamothe, lord of Roquetaillade and Lengon Langon , 1 or his proctors the castle , town and Lengon lordship of Langon with all its appurtenances, and permit him peacefully to enjoy them as his father enjoyed them before it was taken by the king's enemies 2 Bérart de Lamothe had made long and expensive prosecutions to the king and his council in person or through proctors about the castle, town and lordship of Langon that pertained from time immemorial to his ancestors and should pertain to him by hereditary right as shown to the king's council by several letters testimonial and other sufficient evidences. Langon had been taken by the king's enemies 3 and had been recovered by Bérart's father 4 and some other king's subjects, and thereafter it had been seized in the hands of Henry V , and its custody was entrusted to Menault, Favars Menaut de Habas, kt , and Henry V granted Langon to the father of Bérart by his letters patent confirmed by Henry VI, ordering by some other letters to deliver Langon of the father of Bérart, but Menaut de Habas and his son Johan [de Habas] refused to obey Henry V. So, Bérart has taken Langon by force, but as he has been accused of having done so unlawfully, he has entrusted Langon to the constable of Bordeaux who is still keeping it to Bérart's prejudice.

Order to the constable of Bordeaux, to give to Denis Guilhem Danis , to whom the king has appointed at his pleasure serjeant-at-arms in the duchy of Aquitaine, this office paying him from time to time the customary fees and wages.

Grant for life to John Chippenham of the office of clerk of the constable of Bordeaux , in charge of the levy of the customs on the wine, ships and other goods, loaded and unloaded by ships before the city of Bordeaux , receiving there from the constable of Bordeaux his robes and daily food allowance ( bouge de court ) as did Robert Holme its previous holder, with this office's room ( camera sua ) situated inside the castle of Bordeaux . Previously on 18 March 1437, the king had granted this office to Chippenham by his letters patent for so long as he behaved well in it, 1 but Chippenham has returned these letters to chancery to be cancelled as he wanted to have this office for life. The king has taken into account the long service Chippenham did in the duchy of Aquitaine and the great expenses he incurred there, according to the letters sent by the king's council in the duchy of Aquitaine, and he has granted this request.
