Physical condition of the roll

The roll consists of thirteen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/109, 3, 4 and 5 Henry IV (1401-1404)

Introduction.

This roll, spanning several years (1401-4), shows that the problems generated by Richard II's grant of the duchy to Gaunt and by Henry IV's coup of 1399 had largely subsided. We do find, however, a further pardon to the communal government of Bayonne for its strong opposition to John of Gaunt's rule in the 1390s. 1 Henry IV continued to confirm acts issued by his predecessor Richard II and by his father as duke of Aquitaine. The reversionary right of Pons VII, lord of Castillon, to the prevôté of Dax was amongst these. 2 The most surprising, perhaps, of Henry IV's acts is confirmation of the cancellation by Richard II of the latter's earlier confirmation of the privileges of the Entre-deux-Mers region - an act contrary to the original grants by several previous kings of England (Henry II Plantagenet, Richard the Lionheart, King John, Henry III and Edward I), but justified on the grounds that such alienations were contrary to royal interests. 3

Between the autumn of 1401 and his return to England in May 1403 Edward, earl of Rutland was present in the duchy as royal lieutenant and had also been granted control of the English-garrisoned fortress of Fronsac, 4 although command of Fronsac was granted to Sir William Farringdon in September 1402. 5 A number of protections for soldiers in the retinues of Rutland and of Farringdon are found on the roll. Rutland became duke of York on 1 August 1402 at the death of his father. Other military information is found on the roll. Quite exceptionally for a Gascon Roll, we also find information on certain 'English' routier garrisons which had recently conquered fortresses situated in French-held regions. The garrison of Bessous (in Limousin) was commanded by Englishmen (James Man, William Radcliffe and Hugh Birkett) who had requested the king for official authorisation to take local resources. 6 The garrison of the castle of Chalais (in Saintonge) led by the Gascon Peyroat Dupuch has left traces in our documentation. Dupuch who, with his uncle and his companions, had previously taken this castle as well as the castle of Bouteville, had refused to rally to the French when the count of Foix (the captal de Buch, Archambaud de Grailly) surrendered Bouteville to the duke of Orléans in 1401. Dupuch was interested above all in having his right to levy a patis on the region around his castle officially recognized by Henry IV and thus, indirectly, by the local French authorities. 7

One entry on the roll is particularly interesting as we learn that the prince of Wales (the future Henry V) had received money in Cornwall (he was also duke of Cornwall) in the form of 50,000 pieces of tin, and wanted to send them with his butler to Bordeaux in order to buy wine for his household. 8 In this entry, and indeed throughout this roll and others, there is no mention of the prince's title of duke of Aquitaine granted by his father in October 1399: the prince never came to the duchy nor did he derive revenues from it, the grant of title by his father being simply a reassurance to the Gascons that the duchy would not pass out of the direct royal line.

Information is to be found in this roll about the Basque province of Labourd. Johan d'Amézqueta, lord of Saint-Pée, obtained from the king the right to raise the height of his fortalice of Saint-Pée to about double the height allowed by local custom. 9 This same lord was at the head of the armandat of Labourd, 10 a local assembly in charge of controlling crime in this province through promulgating regulations. 11

Many entries are concerned with the supplying of corn, essentially wheat, for Bordeaux and Bayonne and their hinterlands. The war with the king of France had tended to cut off traditional commercial networks with the French-held regions situated upstream on the rivers Garonne, Dordogne and Adour. Thus the duchy relied on imported grain. Englishmen and Gascon merchants constantly sought and obtained licences to transport wheat from English ports to Gascony. Occasionally this wheat came from outside England, for instance from Prussia and Ireland. 12 This supply was apparently impeded by some local royal officials based on the banks of the Gironde and Garonne who levied undue customs on victuals brought in by those coming from regions under English or French obedience. 13

The roll also shows that the administration of the duchy was financially dependent on England to a considerable degree: Henry IV was forced to pay his seneschals of Aquitaine and Agenais out of a 'voluntary' contribution of the clergy of England. 14 The roll also notes the return to England in the autumn of 1401 of Henry Bowet, the constable of Bordeaux, about to become bishop of Bath and Wells; at his return he was allowed to take all his wine with him. 15

According to Peyroat, during the wars before the last truces made between the kingdoms of England and France, the uncle of Peyroat 1 and his companions took and conquered under [the king's] legal obedience the places of Butteville Bouteville and Challes Chalais with their patis from the hands of the French and kept these places for the crown of England, until the Captal de Buch 2 had delivered Bouteville to the French, noting that he would have done the same with Chalais if Peyroat and his companions have not kept their fidelity to the crown of England.

Gaunt confirms this act, as duke of Guyenne, and grants to Johan de Béarn, that his heirs descending from him have this baylie after Béarn's death for five years, the baylie of Hastingues then having to return to Gaunt after this five years period.

Approval and confirmation of the ordinances published by the probi homines worthy men of the land of Labourd for the better government of this land. These ordinances, the tenor of which follows, have been shown to the king on behalf of these worthy men:

  1. First, an interdition to give money or security( erres ), willlingly or not, to an opponent of the armandat of the land of Labourd under penalty of 5 crowns, half for the king, half for the armandat , and on obligation of denouncing any offender to the alcalde of his parish, the armandat having to pursue the offender;
  2. Obligation for the bayle of Labourd and his companions to swear to these articles and not to commit any damage to a citizen or an inhabitant of Labourd;
  3. Fines of 2 crowns for a mischievous slap, and fines of 12 crowns for a serious wound( plaie de loi ) and of 4 crowns for less serious wounds, half for the king, half for the armandat ; no fine for unintentional wounding or murder;
  4. Obligation of denouncing thefts of money, the thief having to pay one crown or one fr. to the person who had denounced his theft; obligation, for thefts by night or burglary, to pay the double what he had taken, half to the king and the other to the armandat , but the thief should be judged according to the local civil law if he can be reached;
  5. Penalty for highwaymen, such men having to pay the double of what they have stolen,to be paid half to the king and half to the armandat ;
  6. Penalties and fines of 20 crowns for rape on a royal road ( chemyn de roi ) or outside such a road, to be paid half to the king and half to the armandat ;
  7. Penalty on adultery: the committers of adultery, if the case is notorious and the woman is married, are to be banished and to lose all their goods, movables and immovables, one third having to be given to the king, one third to the armandat and the last third to the 'cuckold';
  8. Fines on injury or death caused by an oxen or another cattle, one third to be paid to the king, one third to the armandat and the last third to the damaged party;
  9. No fine for father or mother killing his child in bed or bath;
  10. The bayle of Labourd cannot put into jail a citizen of Labourd if he gives enough guarantee; but if the bayle wants put him in jail, the armandat may help him, as he is pledged by his co-parishioner;
  11. Obligation for every men over fourteen years of age to swear to these articles.

The king accepts these ordinances, at the worthy men's supplication, for a period of 20 years, providing they are not to the king's prejudice, and the worthy men take the oath to respect these ordinances, as they did at the time of John of Gaunt 1 .

Order under the great seal to the seneschal of Aquitaine, the constable of Bordeaux, the judge of Aquitaine and also the mayor , jurats and proctors of Bordeaux and the whole king's council there to permit Trave Bertran de La Trau, kt , and his wife or their proctors, to receive all the fruits of the hereditary goods of his wife's brother who died in going against the unfaithfuls, 1 La Trau's wife having to give a sufficient guarantee on these goods, if she loses her case against her two sisters, notwithstanding any rules stili and local customs, as she had formerly been brought to court by her two sisters 2 about this inheritance, the issues of which had been sequestrated according to the custom of the country and the rules stillus of the king's courts there, and as the guarantee she had offered was denied as being contrary to the custom. 3

According to a petition of Bertran de La Trau of (1411 or January 1412) on the same topic, his wife's brother died in Hungary against 'the enemies of the Christian Faith' (the Muslim Turcs). This means that he probably died at the battle of Nicopolis (25 September 1396), or afterwards. See TNA, C 81/654/7130 and its Chancery warrant TNA, C 81/654/7129 (4 February 1412).
2.
They were perhaps the stepsisters of La Trau's wife, as La Trau specified in his petition (TNA, C 81/654/7130) that his wife was the full sister of her brother. He also asserted there that his wife's brother had named his wife as his sole legatee.
