C 61/65 27 Edward III (1353-54)

Introduction.

Several entries of this roll concern the lord of Lesparre Sénebrun V. This powerful lord, with interests close to Bordeaux, had to be well treated. First, he obtained letters of protection for himself, his men and his possessions. 1 He complained to the king that he had been forced to relinquish to his subjects their obligation to perform corvées and watches in his lands while he was jailed in the castle of Bordeaux (the reasons for this imprisonment are not noted, but may relate to his debts). Thus he is likely in reality to have sold these rights to his subjects. 2 In 1351, he had obtained the right to compel his subjects to perform these watches. Another entry also deals with the defence of Sénebrun’s lordship: he obtained confirmation that he might levy a tax on the goods sold at Lesparre in order to finance the enclosure of the place. 3 This grant was later (in 1355) strongly opposed and refused by the inhabitants of Lesparre and by those who came to the place for trade, and finally Sénebrun was ordered in 1358 to stop levying it. War was never too far from Sénebrun’s life. An entry informs us that he had bought 22 horses from a merchant in Navarre for Lancaster’s expeditions of 1345-6, but he had received only 9 horses. 4 The profits of war were not enough: Sénebrun was heavily indebted and had to obtain from the king a delay of two years to pay his creditors. 5 As a result he was eager to receive all the sources of revenues he was entitled to have. Thus, he requested to have confirmed the wreck rights (including for stranded whales) granted to his ancestors, lords of Lesparre, by previous kings of England, the oldest grant being a charter of King John of 1202. 6 Pursuing his financial goals, he obtained from Edward III the office of the paderie of Médoc, an office in charge of the pastures in the peninsula of Médoc used by herds coming from the Pyrénées mountains for the summer as a result of the practice of transhumance. 7

The change of allegiance of Galhart I of Durfort, lord of Duras, towards the French party, was a local setback for the Anglo-Gascon government. The king granted Galhart's possessions which were under his rule in order to reward certain great local nobles of his party. Hence the lord of Albret received the important castle and lordship of Blanquefort, and the lord of Montferrand half of the lordship of Veyrines, both places being close to Bordeaux. 8

A Gascon named Per-Arnaut d’Athieu known as Pitray was appointed to supervise all works to be done on the king’s castles and fortalices in the duchy of Aquitaine that needed repairs. 9

Though Pey d’Escoutet, a devoted French partisan of Bazas, had been officially pardoned by the king on March 1352, he was suspected by some citizens of Bazas of continuing to support the French. The seneschal of Gascony, the constable of Bordeaux and the prévôt of Bazas were therefore ordered to make an investigation about him. If it appeared that the citizens' suspicions were well founded he was to be kept at bay from Bazas and its prévôté. 10

As usual, several entries deal with wheat to be brought from England for the victualling of the duchy. 11 One entry informs us that Frank van Halen, captain of the castle of Rochefort, near La Rochelle (and one time seneschal of the duchy of Aquitaine, 1349-50), supplied his castle with grain brought from Flanders, his homeland. 12

To all captains, seneschals, constables, castellans, prévôts, ministers and all other bayles and faithful subjects in the duchy of Aquitaine.

Letters of protection granted at pleasure to Sénebrun [V], Lasparra lord of Lesparre , his lands, tenements, goods and all his just possessions in the duchy, as the king has received him into his protection and safe-keeping. He, with his men in person and their goods, are to be maintained, protected and defended from injury, disturbance, damage or harm on penalty of 1,000 l.st. , and amends should be made to him without delay for any forfeitures that he has suffered according to what is considered suitable and the fors and customs of these parts. Sénebrun suffered damages in his lands and possessions both when he was absent outside the duchy and when he was present there.

Order to the seneschal of Gascony and the constable of Bordeaux to have, by the means they feel convenient, a swift information on the following matter if it happens that the agreement made between Sénebrun [V], lord of Lesparre , and his subjects when he was in prison is still persisting and the delivery of this grant on his goods has not been made, so they have to compel Sénebrun's subjects the best way they can to perform the corvées ( mannoperas ) and watches ( vigilias ) as they were accustomed to do before this said judgment ( arestum ), and according to the fors and customs of these parts, any agreement made to the king's prejudice notwithstanding, accepting as little as possible the frivolous appeals. Lately, Sénebrun requested that the king will wish to provide a suitable remedy, since when he was in prison in the Burdeg' castle of Bordeaux for certain reasons, he made an agreement with his subjects not to perform the corvées and watches in his places that are mainly situated on the border with the king's enemies, despite the fact that these subjects, as the other subjects of the lordships of these parts had for a long time been accustomed to perform these corvées and watches, and because of the removal of these corvées and watches in those places on the frontier because of this agreement, which is to the king's detriment and could lead to great danger in these parts. 1

Grant for life to Mountandre Guillaume de Montendre, kt of the duchy of Aquitaine , because of his good service, of 20 l.st. from the issues or profits of the land that was owned by Feriol Guilhem Ferréol , 1 king's enemy and rebel in the Inter Duo Maria Entre-deux-Mers in the place called la Trene Latresne that has to be granted by the constable of Bordeaux to Montendre with his consent for the maximum annual census or farm which is accepted to be paid for it receiving each year by the hands of the constable the issues of this land. So that Montendre has to be satisfied of the said 20 l.st. from the first issues or profits of this land owed to king from the remainder of the issue or profit of this land, if this has been annually accounted by the hands of the constable of Bordeaux. Montendre requested that the king will wish to grant him the land owned by Ferréol in Lastresne, land owned for life by royal grant by Thomas Cok, former seneschal of the duchy , since because of the wars in the duchy, he has suffered great damage and losses in many ways, and he cannot easily maintain his status without a suitable remuneration paid by the king. 2

And it is ordered to the constable of Bordeaux or his lieutenant that having called before him Guillaume [de Montendre] to grant this land to him for the maximum annual rent or farm which is accepted be paid for it, and to make payment for life each year by the tenants to the same Montendre of the annual 20 l. from the first issues or profits of this land, according to the tenor of the king's letters, on condition that he accounts annually to the constable of Bordeaux for the remainder of the issues or profits of this land. The constable will have due allowance in his account of the 20 l. each year.

16 February 1353 . Westminster . For Bertran [I], lord of Montferrand.

Grant to Bertran [I], lord of Montferrand Monte Ferandi, de , because of his good service, to receive by the hands of the master and keepers of the money 2 d. of each mark ( marca ) of the working or stricking of the king's money struck in the duchy, by indenture made on this, after next Michaelmas, which is the end of the king's grant of this money to the lord of Albret . Consequently, the king ordered the seneschal of Gascony and the constable of Bordeaux or their lieutenants that if the baylies of Marenne Marennes in the Yancton' diocese of Saintes and Sancto Pastore, de Saint-Pastour in Agenesio, de Agenais are still in the hands of the king's enemies, and the said money is within the period the lord of Albret has it, they should deliver after the next Michaelmas the said 2 d. of each mark, and make indenture on this, until Montferrand is fully satisfied of what the king owes to him, any other allowances made or to be made notwithstanding. And the king will make due allowance in the constable's account as well in the account of the masters and keepers [of money]. On 22 March 1348, the king made an indenture with Montferrand by which the king, in part of satisfaction of certain sums of money owed to him for the wages of him and his men at the time he stood in the king's service in the parts of Gascony after the first arrival of Ralph, earl of Stafford, seneschal of Gascony to these parts. The king has made him a suitable allowance on the king's money in the parts of Gascony: so Montferrand receives by the hands of the masters and keepers of the money for a five year period from 22 March 1348 1 d. of each mark of the king's money struck within the duchy of Aquitaine, and by indenture made between Montferrand or his attorney and the said masters or keepers, with the lord of Albret to whom the main part of this money had been granted by John Wawayn, former constable of Bordeaux and by the then seneschal of Gascony being ready to consent it; and if it happens that the lord of Albret does not consent to it and refuses that Montferrand has this 1 d. by mark due to him during these five years, then when Albret's term allocated by the seneschal and the constable is finished, Montferrand must have and receive for him and his men 2 d. for each mark from the king's minter, and by indenture made, as promised, in part satisfaction for this money, any other allowances made by the constable of Bordeaux notwithstanding. And if Montferrand is not fully satisfied of this sum of money within this term of five years, he should have and hold for what remains to be paid of his wages by reasonable account from the baylies of Marennes and Saint-Pastour which are now in the hands of certain rebels, when these baylies return to the king's hands, for himself and his men for as much as the annual rent that others would be ready to pay, until he has all the money of his wages owed to him. And if Montferrand obtains within the said terms of five years the 1 d. or 2 d. by mark according to the allowance made to him on this money, the allowance on these baylies should cease and for what he has received in excess he shoudl to the king through the constable at the time. The king ordered the seneschal of Gascony and the constable of Bordeaux to make allowance on the issues of the said money in the said form, since Montferrand requested that the king will wish to make a suitable payment of this sum of money because of the sums of money accounted to him by the then constable of Bordeaux for his wages nothing has been paid and the said baylies of Marennes and Saint-Pastour have been and continue to be in the hands of the king's adversaries.

Confirmation of the grant of 200 l.st. granted to Bernat-Etz [V], lord of Albret by Ralph, earl of Stafford , former king's lieutenant in the duchy of the castle and land of Blanca Forti Blanquefort with its appurtenances together with high and low justice with both complete and shared jurisdiction, and all the other rights pertaining to the castle and land of a value of annual 200 l.st. in part of satisfaction of 645 l. the king oweso him until he is repaid of this latter sum or Albret recovers his lost lands and places or they are returned to him, the occupation of Blanquefort by the Mussydano, de lord of Mussidan notwithstanding. The king granted by his letters patent to Albret the land of Blanquefort with its jurisdictions with all the issues pertaining in part satisfaction of 645 librates per annum of land and issues that Albret lost because of his adherence to the king, together with other places granted to him for the same reason, until he recovers his lands, issues and places, or they are returned to him, or the king provides him with this sum from a suitable place, as more fully appears in the king's letter patent. Albret requested that the king would wish to confirm Stafford's grant, as the land of Blanquefort, because of a royal grant to Duro Forti, de Galhart [I] de Durfort , 1 because he came to the king's obedience, Albret has been removed from this land; and the lord of Mussidan when he was at war with Durfort when the latter left the king's obedience, hostilely kept and still holds this castle and land of Blanquefort with its appurtenances; because Durfort broke his faith and his oath in adhering again to the king's adversary of France, 2 the earl of Stafford, former king's lieutenant in the duchy, as he testified before the king, granted to Albret this castle and land with its appurtenances which barely reached the value of 200 l. , for the 200 l.st. in part satisfaction of 645 l. to have and hold from the king and his heirs, together with high and low justice with both complete and shared jurisdiction, and all the other rights pertaining to this castle and land, until until he is repaid of the 645 l. or Albret recovers his lost lands and places or they are returned to him, the lord of Mussidan's occupation of this land and castle because of the war between Mussidan and Durfort notwithstanding. 3

1 February 1353 . Westminster . Concerning the grant of 16 d. per pound granted to Sénebrun [V], lord of Lesparre.

Grant for ten years to Sénebrun [V], la Sparre lord of Lesparre of the toll levied on all things coming to the place of la Sparre Lesparre , and its district, at 16 d. per pound ( de libra ), to receive on the goods sold and bought at Lesparre for a ten year period from the making of these presents in order to assist the building of the enclosure of the same place. So that they have to pay 8 d. for the sales and 8 d. for the purchases, provided that the money is levied for this enclosure and not for any other use by the lord of Lesparre or anyone he delegates, by the checking of certain men of the place of Lesparre chosen for this task. Lately, Sénebrun requested that the king will wish to make an appropriate support for the enclosure of Lesparre: as this place is situated on the borders of the king's enemies, it needs to be enclosed by sound walls for the salvation of the king's liege men and lands, and Sénebrun was not able to make this enclosure from his own money nor have help from any other source. The king granted to Sénebrun in assistance for the building of this enclosure, to be received until a specified time already passed, a toll on all things bought and sold in the place and district of Lesparre; and yet Sénebrun requested that the king should wish, since Lesparre is not enclosed and is subject to great dangers in the times of war, to extend the grant of this toll for longer to support the enclosure and fortifications of this place. 1

Letters of protection and safeconduct granted until the next feast of Pentescost to Gauthier [de Saint-Pern], Veneten' bishop of Vannes , and the noble men Bello Manier' Jean de Beaumanoir , Ewenus, Chairuel Even Charruel , Sancto Petro, de Robert de Saint-Père , Foucaut Pierre Foucault and Henri de Pledran , kts, Rayfredus , Redonen' archdeacon of Redon and Olivier de Morzelles , nobles from Brittany who are coming to England to deal with the release of Bloys Charles de Blois , 2 the king's prisoner, as well as their men and servants up to the number of 35 horsemen and their valets, and their goods.

13 March 1353 . Westminster . For Sénebrun [V], lord of Lesparre.

Order to the seneschal of Gascony and the constable of Bordeaux, if they notice that what Sénebrun [V], Lesparr' lord of Lesparre , asserts is true, then they must by letters under the king's seal in use in the duchy request the Navarr' king of Navarre to make swift full justice to Lesparre about the surrender of the thirteen horses according to the agreement previously made between Henry [de Grosmont], duke of Lancaster and Baudewyn Bartolomé Baldovino, Lestelle burgess of Estella in Navarr' Navarre , or their value for the satisfaction of the expenses made by Lesparre, as well as on Lesparre's damages. And if the king of Navarre defaults in doing justice, and the seneschal and constable discover the matter, the king wishes them to grant to Lesparre a marque ( marcham ) on the goods brought to the duchy by the subjects of king of Navarre up to the value of these thirteen horses, and by a reasonable estimate of the total of Lesparre's expenses and damages assessed by arbitration of themselves and by others of the king's council in the duchy, according to the fors and customs of these parts. The king has received this complaint from Lesparre: the king has learned some time ago that, when Henry, duke of Lancaster went to Gascony for its defence, he bought twenty two large horses for a great price from Bartolomé Baldovino for the cavalry service of Lesparre and others being in his retinue in the king's wars in these parts in the service of the king, and he was to be paid by the hands of Lesparre 2,000 crowns florins in silver money provided that he came to deliver these horses to Sénebrun de Lesparre in the parts of Gascony on a specific day already passed; and yet Lesparre received from Baldovino nine horses and complained about the remaining thirteen horses that were due to be delivered according to the agreement. Lesparre sent many messengers to the parts of Navarre, incurring great damage and expense, but Baldovino refused and still refuses to deliver these thirteen horses or their equivalent value to Lesparre according to the agreement, to Lesparre's great injury, on which matter he supplicated the king to bring him remedy.

To all seneschals, constables, castellans, prévôts, ministers and all the other king's liege men in the duchy of Aquitaine.

Order to maintain, protect and defend to Micolli Arnaut Micol, of Vasato, de Bazas , Burdeg' citizen of Bordeaux , in the possession of the Vasato, de, Vasaten' prévôté of Bazas and Bazadais and to have him enjoy for life all the issues, revenues and emoluments of this prévôté, according to the tenor of the letters of Henry, duke of Lancaster, and the king's confirmation, any grant, allowance or exchange made to the contrary by the king's ministers notwithstanding. Formerly, Henry [of Grosmont], duke of Lancaster, former king's lieutenant and general captain in the duchy of Aquitaine and in all lingua occitana Languedoc , granted for life to Micol by his letters patent this prévôté with all its appurtenances, to have, hold, possess and exercise by himself or by his lieutenant or his substitute. The king has confirmed and ratified this grant. 1

Confirmation and ratification of a grant by Henry, duke of Lancaster, when he was earl of Lancaster, and king's lieutenant in the duchy of Gascony. 1

Inspeximus of letters patent of Henry, duke of Lancaster, in these words:

4 March 1350

Letters issued by Henry [de Grosmont], earl of Lancaster, Derby, Leicester and Lincoln, steward of of England, lieutenant of the king of England and France and captain general in the duchy of Aquitaine and in all Languedoc , whereby he orders to the seneschal of Gascony and the constable of Bordeaux or their lieutenants to give actual and personal possession of half of the land of Veyrinas Veyrines which is the part owned in joint ownership by Duro Forti, de Galhart [I] de Durfort, Duracio lord of Duras to Monte Ferrando Bertran [I] de Montferrand, kt , his joint-tenant , with all the other places and goods of Durfort's half in any places whatsoever, and maintain and defend him, removing from that time any other holders whomsoever they may be, any royal grant of Durfort's share to the contrary notwithstanding. Lancaster understood that Durfort owns in joint-ownership the lordship of Veyrines with his joint-tenant Bertran de Montferrand, and he learned from rumours he did not want to believe that Durfort wished to adhere to the French party, should the case arrive his part of the land of Veyrines and his several other places and goods, revenues, homages, tolls, and other rights and money wherever they are in Burdegualesium Bordelais , in Medulco, in Médoc and in Bogio, in Buch and any appurtenances of this land of Veyrines would be seized and were seized for the king. Because of Montferrand's supplication and in part of payment for his good and long standing service to the king, Lancaster grants in the king's name by these presents to Montferrand and his legitimate successors this part of the land of Veyrines owned in joint ownership by Montferrand, together with Durfort's other places, jurisdictions, homages, fiefs, rivers ( aquis ), mills, laudis , pastures, revenues, fruits, issues, and all the rights and money pertaining and that should pertain to this place and land of Veyrines, to be held, possessed and exploited now and forever by Montferrand or another or others in his name and by his and heirs successors if this case arises and not before.

The king confirms the same, on behalf of himself and his heirs.

28 January 1353 . Westminster . Concerning the extension of time granted to the lord of Lesparre to pay his debts .

Grant to Sénebrun [V], lord of Lesparre of a delay of two years from these presents for the payment of his debts. The king does not want that Lesparre be summoned or be molested or damaged for two years for any debts or contracts from any person in any courts of Gascony, but he wishes that all the processes made up to now against Lesparre because of these debts and contracts be adjourned until the end of these two years. And thus the king orders to the seneschal of Gascony and the constable of Bordeaux, and also the prévôt of the Ombrière of Bordeaux and the other prévôts, officials and ministers in the duchy or their lieutenants, not to molest in any way or damage Montferrand, or permit others to molest or damage against this grant, and to maintain him according to the form of the grant, any sentences to the contrary made or to be made notwithstanding. Lately, Lesparre requested that the king will wish, as he incurred several expenses for the salvation and defence of the king's parts of Gascony, and he got into debt with several creditors for various sums of money for the king's honour as well as for the benefit of the state at the time of the king's wars and because of other reasons; to grant him a delay on the payment of these sums of money until a specific time according to a custom used in these parts.

Letters of protection granted until Pentecost to two ships, the Seynt Martyn of Lescluse Sluis whose Saierus, Corteuill' Zeger Corteville is master, and the Seynt Thomas of Lescluse Sluis whose le Reede Nicolaas de Reede is master, chartered by Hale Frank van Halen, kt , keeper of the castle of Rocheford Rochefort on the river Charent' Charente in Gascony in order to bring several kinds of grain from the parts of Flandr' Flanders to these parts of Gascony in order to supply this castle; for themselves, their mariners, the grains they bring to the parts of Gascony for the supplying of this castle when they stay there and return to their country, as the king received their ships into his protection and safe-keeping. They are to be maintained, protected and defended from injury, disturbance, damage or harm, and amends should be made to them without delay for any forfeitures that they have suffered.

Grant for life to Seguyn Ramon Séguin, the king's servant , for his good service, of the office called issac ( issak' ) or the custom called the issac ( issak' ) of Burdeg' Bordeaux 1 to have with the emoluments coming from it, in the same way that the late Godefrey John Godfrey formerly had it by the king's grant, so that this office or custom returns to the king at Séguin's death.

Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants to permit the Vasatan' jurats, consuls and the community of the city of Bazas 1 to be exempted from the great custom [of Bordeaux] for their own wines growing within one league around the city of Bazas and brought to the city of Bordeaux, without impediment or trouble, according to the tenor of the king's letters, or be molested or damaged in any way against the form of these letters. Lately, the king granted to the jurats, consuls and the community of Bazas and their successors, because of the surrender of their city to the king's obedience and other reasons, the right to be exempted forever of the great custom [of Bordeaux] on their own wines growing within one league around Bazas and brought to Burdeg' Bordeaux . So that no citizens or others of this city whatever their status or condition can put forward, under penalty of seizure and forfeiture of their wines, their liberties and privileges granted to them by the king, their own wines growing outside this league on pretence of their being wines grown within this league. All the citizens and others of Bazas have to pay to the king the custom due for their wines growing outside this league, and for the wines they might acquire, as was customary in the time of the king's ancestors, kings of England, before this city was occupied by the French, the king's adversaries. 2

Inspection and confirmation of the letters of Maurice de Craon, king's lieutenant in the duchy of Aquitaine, the king's kinsman, under Craon's seal and the seal of the court of Gascony, in these words:

Restoration by Maurice [de Craon], Credonio lord of Craon and Sabl' Sablé , king's lieutenant of the king of England in the duchy of Aquitaine returns to Arthaud, Mirambello lord of Mirambeau , guardian ( tutor ) of Ayquem-Guilhem [V], Sparre lord of Lesparre 4 of the whale caught on the sea coast and the harpoon that wounded it, and the removal of all impediments made by the king's men on the coastland and other property of the lord of Lesparre. Lately, Mirambeau had complained before Craon that he was troubled and impeded by the king's men for the possession of the sea coast and of the whale and harpoon, explaining that this coast was formerly granted to the Sparra lord of Lesparre by John, late king of England and duke of Aquitaine. Craon, having carefully examined the content of this privilege granting this coast, and examined the information that Fabri Bernat Faure, canon of Saint-Seurin Sancti Severini Burdeg' of Bordeaux, king's clerk , 5 made at Craon's order, and having swiftly deliberated with the king's council, has made the restoration and removed the impediments, saving the king's rights, and those of other men. In testimony of this, Craon has put his seal, as well as the seal of the court of Gascony.

The king confirms these letters, and does not permit that any trouble, impediment or damage be done to the lord of Lesparre or his heirs in the possession of this coast and of his other rights coming from this sea coast. These letters are patent and sealed by the king's seal. 6

The king accepts the contents of these charters and letters and confirms them, for himself and his heirs, to Sénebrun [V], now lord of Lesparre and his heirs, just as those charters and letters reasonably attest, and just as Lesparre and his ancestors have enjoyed since the making of those charters and letters.

Order to permit the Vasaten' jurats, consuls and the community of the city of Bazas 2 to hold their city forever annexed to the crown of England, together with its jurisdiction, and the baylies and parishes of Vasatesio Bazadais [linked with it]; and compel the best way they see the men and inhabitants of these baylies and parishes to keep this city and contribute to the tallages along with the citizens of this city for its salvation and defence and perform the works there each time it is necessary as they should do it by right, as more fully appears in the king's letters and the letters of John de Chiverston, former seneschal of Gascony , made on this topic. Lately, the king granted to these jurats, consuls and commune of Bazas, at their request, that he nor his elder son or apparent heir of [the kingdom of] England cannot put outside his hands by grant, sell or exchange or anything else this city or its jurisdiction or the baylies and parishes of Bazadais, but should retain them annexed forever to the crown of England, any grant or letters made against this notwithstanding. The king grants also that the baylies and parishes of Bazadais which have been annexed for a long time on the king's behalf to the baylie of Bazas; they have remained annexed since, and the men and inhabitants of the said baylies and parishes mount guard of this city both in daylight and at night, and contribute to the tallages with the citizens of this city for its salvation and defence, and perform the works there each time it is necessary as they should do by right and as they used to do in the time of the king's ancestors. And if something is unlawfully attempted against them, it should be amended without delay and returned to their previous status, as they will find suitable. Formerly, Edward [I], former king of England, the king's grandfather , granted to them by his letters patent in perpetuity, because of their frequent service to him, that neither he nor his elder son or heir apparent of the kingdom of England and the duchy of Aquitaine can put this town outside his hands by grant, sale or exchange or anyother means. So that the king confirms his grandfather's letters by which the town remains annexed to the crown of England. Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants that, if Michel Galhart Miqueu has been removed from the possession of the lands and tenements [mentioned below] promised by the king, to return them to Miqueu insofar as it is right, to hold according to the tenor of the said letters made to him the letters to Hélias de Pommiers and Regina de Got or any other grant or allowance to the contrary notwithstanding. And after the restoration made to Miqueu, they should hear the complaint of Pommiers and Got and others concerning the lands claimed, and do full and swift justice to the latter and Miqueu according to the law, the fors and customs of these parts. Lately, Galhart Miqueu has supplicated the king by his petition exhibited before the king and his council that the king will wish bring him remedy, as Miqueu has lost for 20 years or more his lands, tenements, revenues and possessions that are of his heritage and that are worth 200 l.bord. per annum, because of his service to the king in the siege of the towns of Sancto Machario, de Saint-Macaire 1 and Aculeo, de Aiguillon 2 as well as other actions in the war of Gascony and his adherence to the king's party, without any payment received from the king or his ministers; to grant for life to Miqueu, in compensation of the said damages and injuries and in remuneration of his service, the lands and tenements with their parts that were owned by Ramon [de Got] , son of Deugot Ramon-Arnaut de Got, kt , Roylak' lord of Rouillac , the king's enemy in the parish of Peyssac Pessac and in the Burdeg' diocese of Bordeaux that did not exceed 20 l.st. per annum. The king granted to him on 20 August 1348 to have and receive each year 20 l.st. for life on these lands and tenements, and he should respond of what remains to the king by the hands of the constable of Bordeaux, any grants or allowances done to the contrary by the king's ministers after the last return of Henry [of Grosmont], duke of Lancaster to these parts notwithstanding, as more fully appears in the king's letters. And now Miqueu complains that he was in peaceful possession for a long time, by virtue of the king's grant, of these lands and tenements, but the king's officers, at the prosecution of Hélias de Pommiers who asserted that Gout Bertran de Got, former Rolhak lord of Rouillac , king's enemy and rebel had in Burdegalesium Bordelais , that is in the lordship and jurisdiction of the Ornone, de lord of Ornon and Ornone, de Galhart d'Ornon, his uncle , and in the parts of Bogio Buch in the place called Aleye Lège in the Burdeg' lordship and jurisdiction of the chapter of the church Saint-André of Bordeaux where are the lands that were owned by Ramon, son of Ramon [de Got, lord of Rouillac] that were granted to Miqueu; and also Miqueu possessed it peacefully for a long time, because of the said grant, and it has been granted before to the same Pomeriis Hélias de Pommiers and his wife Regina [de Got] and each of them for life of the lands that were owned by Bertran de Got with the king's letters dated 12 June 1351, 3 and Galhart was removed without reason and unjustly from the possession of these lands whatever Hélias de Pommiers and Regina de Got obtained before in these letters where these lands were not mentioned to Miqueu great damage and the obvious impoverishment of his status.

Order to Thomas de Hampton, Landarum seneschal of the Landes and the Laburdi bayle of Labourd 1 and his lieutenant that having called the king's council of these parts and having obtained full information [on the following matter], if they find that the place of Sarburu and the lands, tenements, woods and the other things pertaining to it has been seized in the king's hand and kept some time because of Bernat de Garro's rebellion and adherence to the king's enemies, and that it has been occupied by Martin-Sans, lord of Sorhoeta or others, then they have to put back them in the king's hands without delay. So that their issues and emoluments be accounted to the king as they should, the attempted sale to Martin-Sans or another to the king's prejudice notwithstanding; and Fortet de Garro and Martin-Sans be reasonably punished because of their contempt shown in this matter and the damages they have done, according to the fors and customs of these parts, and they should account to the constable of Bordeaux of the sums of money they levied there. Previously, the king learned that the place of Sarburue Sarburu 2 and certain lands, tenements, woods and other things pertaining to it that were owned by Bernat de Garro, former Sarburue lord of Sarburu , were seized and kept in the king's hands, because Bernat joined the king's enemies and rebels of these parts, and were kept in the king's hands for a long time, and the seneschal and bayle made in the king's name public bans in various places of the baylie [of Labourd] that anybody should prevent that their issues and emoluments be levied and collected for the king as it should be done. However Fortet de Garro , being inconsiderate towards the bans done on the king's behalf and the king's rights, obtained and kept these lands, tenements, woods and the other places, and he sold them to Martin-Sans, Sarhoeta lord of Sorhoeta 3 despite the ban the seneschal and the bayle made to them on this sale, and Martin-Sans occupies them now under guise of this sale to the king's contempt and damage, and the obvious injury of the king,abouto which the king is amazed. The king does not want that these prejudices, if they have been perpetrated, go unpunished.

Order to the constable of Bordeaux or his lieutenant that having seen the papers, books, memoranda and accounts concerning his time, if he notices by their inspection that the arrears of the annual 645 l. 6 s.st. and 5 s.bord. owed to Bernat-Etz [V], lord of Albret , have not been accounted after the feast of All Saints, then he should make payment, allowance or another due satisfaction of what appears from Albret's account due from the issues of the duchy [of Aquitaine], the second king's order or suggestions made to the contrary notwithstanding. Formerly, Master Stretle John de Streatley, former constable of Bordeaux , king's clerk , certified the king that he accounted of the annual 645 l. 6 s.st. and 5 s.bord. owed to Albret for the lands, revenues and places he lost at the occasion of his adherence to the king's party, according to the form of an indenture made between the king and Albret, until the feast of All Saints 1 1349, and Albret obtained a bill dated 28 October 1351 of the constable [of Bordeaux] of the sum due up to this feast. The king ordered to the constable to account with Albret or his proctor or attorney of what is owed of this annual 645 l. 6 s.st. and 5 s.bord. , if it has not been accounted before, and of what he found in this account, he should make payment, allowance or another suitable satisfaction. Albret has let the king know that the constable, because of another letter under the king's great seal dated 12 March 1352 sent to the constable, because Albret suggested to the king that all the debts and wages that the king owed him, for the wages of Albret and his mounted men-at-arms and foot men-at-arms on foot, who were retained in the king's service until 1 May 1351 in the garrisons of the king's castles and other places situated within the duchy of Aquitaine, as well as for the chevauchées ( cavalcatibus ) and other things for the defence and salvation of these parts, and Albret requested the constable, and the constable should have accounted from time to time with Albret or his attorney or proctor and should have made payment, allowance or have found another suitable satisfaction to Albret from the issues of the duchy. The constable asserted that he did not have to account again of the arrears of the 645 l. 6 s.st. and 5 s.bord. owed before 1 May and these arrears have not been accounted after 1 May, and he had not to refuse to account these arrears mentioned in the second royal order. So Albret requested the king to bring him remedy. 2

So that Athieu has to go at the order of the seneschal of Gascony and the constable of Bordeaux to all the places in the parts of the duchy [of Aquitaine] for these works, each time a work is needed, receiving for his wages 12 d.st. by day, and Athieu has to be satisfied quickly of his wages. Order to the seneschal of Gascony and the constable of Bordeaux or their lieutenants to permit Galhart Micol to have and exercise the office of viguerie ( begaria ) of Bazas 1 with everything that pertains to this office, according to the form of the grant [mentioned below] and at the king's pleasure. Micol requested to the king, as the Vasatens' consuls and jurats of the city of Bazas considering the damages and losses that Micol suffered because of his fidelity and adherence to the king's party, and with the assent of the king's councillors of these parts, granted to Micol in help to maintain his status the office of viguerie of this city to have with all what pertains to this office, as more fully appears in this grant.

Appointment of John de Palton, sheriff of Somerset , and Richard de Park , to buy with the king's money from the issues of his county 400 quarters of wheat in Somerset in suitable places except for ecclesiastical fees, and bring them to Bristoll Bristol , and arrest at Bristol and elsewhere as much ships as necessary to bring this wheat to Gascony and as many empty tuns as necessary for the loading of this wheat. This wheat has to be delivered during the fortnight of the next Michaelmas 2 and has to be brought to Gascony by Richard de Park for the supplying of some king's castles and towns in Gascony. The king orders all his officers to obey and attend them about it.

Order to maintain, protect and defend Markys Beraut Marquès, king's valet , in possession of the baylie of Beaumont in Petragor' Périgord and have him enjoy for life any issues and emoluments of this baylie according to the tenor of the king's letters, any grant, allocation or exchange made by the king's ministers of these parts to the contrary notwithstanding. Formerly, Marquès requested that the king will wish, as he remained for a long time in the service of the current king and Edward [II] in the wars of the duchy, and he fully lost his lands, tenements and possessions that are of great value, without receiving any compensation or payment; to grant him as reward of his service and in compensation of his lost lands, tenements and possessions the baylie of Beaumont in Périgord with its appurtenances being then in the hands of his enemies and rebels, to have for life when it returns to the king's hands. The king granted to Marquès by his letters patent this baylie with its appurtenances being then in the hands of the king's enemies and rebels, to have for life as soon as it returns to the king's hands, so that this baylie with its parts fully returns to the king and his heirs, as more fully appears in the king's letters. And the king ordered the seneschal of Gascony and the constable of Bordeaux to deliver and make have this baylie to Marquès as soon as it returns to the king's hands according to the king's letters. The king has learned that Marquès regained possession of this baylie by virtue of the king's grant and order.

Order to the seneschal of Gascony and the constable of Bordeaux and also the Vasaten' prévôt of Bazas or their lieutenants, that having taken full information on the situation and condition of Master Escutet Pey Escoutet, citizen of the city of Bazas , if they notice by this information Escoutet is suspect, thus they have to impose on the king's behalf to Escoutet to remain outside the city and prévôté of Bazas during the wars and the truces, and they have to enforce this decision and have others enforce it. The king wants however that they firmly maintain the king's letters of pardon and return made to him. 1 The king has learned that Escoutet, citizen of Bazas for 25 years before this city returned to the king's obedience, and he stood in Bazas defending with force this city against the king's officers and liege men of these parts, doing against them all the evil and damages he could, and after Bazas surrendered to the king, he fled and adhered to the king's enemies against the king, and ambushed day and night the king's liege men and this city with several enemies of the king of these parts, until certain persons supporting the king suggested to the king that Escoutet wanted to come to the king's odedience and to remain faithfully in his service. And the king, at their request, has pardoned Escoutet this adherence and returned to him the lands and tenements he inherited that were seized at the occasion of his adherence and rebellion, because of the damages he perpetrated when he was in rebellion. And certain citizens of Bazas requested that the king will wish to keep at bay Escoutet from this city during these wars and truces, as they are afraid that Escoutet or some companions ( confederates ) of his followers ( amicitia ), then in rebellion against the king, might bring great danger to Bazas and its inhabitants, if Escoutet remains in this city for a long time during the wars or truces.

If they have taken or make taken by others [this prévôté] from Micol or his substitute against the tenor of these letters, then they should return it without delay, any grants made by the king's ministers of these parts to the contrary notwithstanding. Formerly, Henry, duke of Lancaster, former king's lieutenant and general captain in the duchy of Aquitaine and in all lingua occitana Languedoc , granted for life to Micol by his letters patent this prévôté with all its appurtenances, to have, hold, possess and exercise by himself or by his lieutenant or his substitute. The king has confirmed and ratified this grant on 15 April 1348. And yet the king understood that they prevented in mnay ways Micol from recieving and having the fruits and issues pertaining to this prévôté for one year and more, and they unjustly have prevented it up to now to Micol's great damage and against the tenor of Lancaster's letters and the king's confirmation. Micol supplicated the king to provide him a remedy. 1

Order to the constable of Bordeaux to permit the jurats, consuls and the community [of Bazas] and their successors Vasaten' citizens of the city of Bazas to be exempted of all the king's great and small customs on their own wines growing within one league around the city of Bazas and brought to the city of Burdeg' Bordeaux , according to the tenor of the king's letters. All the citizens and others of Bazas have to pay to the king the custom due for their wines growing outside this league and for the wines they acquired. Lately, the jurats and consuls of the city of Bazas requested the king for them and the community of this city by their petition exhibited before the king and his council that the king will wish, as among various agreements made between them and Bernat[Etz V], lord of Albret , and Master Waleweyn John Wawayn, former constable of Bordeaux , on the surrender of Bazas to the king's obedience, it has been granted and promised to the citizens of Bazas by oath of Albret and Wawayn that the latter quickly set up and dealt with towards them, to relinquish the great custom of wines these citizens paid until now at Bordeaux and that they will be exempted of it forever, as more fully appears in a public instrument made about the matter; to grant them the execution of this grant and promise. The king grants to these jurats, consuls and community and their successors citizens of this city, because of their good service at the surrender of their city, and as he wants to honour these agreements, to be exempted of all the king's great and small customs on their own wines growing within one league around the city of Bazas and brought to the city of Bordeaux. So that some citizens or others of this city whatever is their status or condition cannot put forward, under penalty of seizure and forfeiture of their wines, their liberties and privileges granted to them by the king, about their own wines growing outside this league if they want to pose them as wines being within this league. All the citizens and others of Bazas have to pay to the king the custom due for their wines growing outside this league, and for the wines they could acquire, as it was customary in the time of the king's ancestors, kings of England, before this city was occupied by the French, the king's adversaries, as more fully appears in the king's letters patent. 1
