C 61/128 16 Henry VI (1437-1438)

Introduction.

In this roll several offices and goods of the duchy of Aquitaine are given to Englishmen: places and revenues in the Landes, for example, were granted in perpetuity to James Harsage, lieutenant of the castle of Dax, 1 John Strangways, already captain of the castle of La Réole, was appointed in 1437 captain of the castle of Fronsac, a position he was to keep for many years, 2 the esquire Robert Holme and the vintner of London John Staple jointly obtained the office of controller of the castle of Bordeaux, 3 while Peter Bowman received several lucrative offices at Bayonne and Bordeaux. 4 An 'Anglicized' Catalan, Joan Tregurà, doctor of the University of Oxford, received the Bordelais lands of the family of Poton de Xaintrailles, the famous Gascon of the French party. 5

Of course, loyal Gascons were not forgotten and the long-standing and faithful family of the Marsan de Cauna obtained the elevation of their Landais lordship of Cauna into a barony. 6 The influential Gascon Bernat Angevin received from the king-duke the important lordship of Rauzan on becoming chancellor of Aquitaine. 7 The loyal Gaston de Foix, count of Longueville and captal de Buch, was renewed in his keepership of the city of Bazas, which he had conquered, with payment of the wages he requested and 3,000 gold saluts to build a fortalice inside it. 8 Henry VI also granted to Gaston three places previously owned by 'king’s rebels' which he already occupied. 9

Several revenues were granted to Bordeaux and Bayonne in order to help them to resist the French and the Castilians. 10

A sign of the climate of distrust and anxiety existing in Anglo-Gascon Aquitaine, the Franciscans of Bordeaux requested Henry VI that no one should have an office in their convent or in any other convent of Bordelais if he was not born in the king’s obedience and was not currently within this obedience. 11

Worthy of interest is the request of the English government for the large sum of 12,750 gold crowns, 6,954 nobles of England and 7 crowns that Henry V had granted to the count of Foix, Johan de Foix, when efforts were being made after the treaty of Troyes to win him over to the Lancastrian cause. Henry VI claimed this sum back from Gaston IV de Foix since his father Johan de Foix had rallied to Charles VII of France. This request was probably being used as a means of putting pressure on the count of Foix, one of the most powerful lords of Aquitaine-Gascony. 12

Appointment of Boweman Peter Bowman as controller of the assizes or customs in the port of Bayonne, and supervisor of woollen cloth and other goods brought from the kingdom of England and other places to the cities of Bordeaux and Bayonne, with the office of controller of wines of rebels as John Bowet held this latter office, receiving there the customary fees and wages of this office, and also the supervision of all the repairs made in these two cities by him or his sufficient deputies. With the proviso that Bowman certifies once to the treasury of England , by the advice and supervision of the constable of Bordeaux, of all the cocketed and non-cocketed goods coming to the cities of Bordeaux and Bayonne , and also the other things he has done in the king's name in this office.

Furthermore, the king grants him the possessions of Guitart in the parish of Villenawe Villenave situated in the same lordship of Brassenx and all the vicomtal revenues and fiefs of Tartas in the lordship of Aurybaut Auribat which came into the king's hands by the conquest of this lordship of Auribat, a conquest in which James Harsage was involved with 500 men-at-arms at his own cost. Any statutes or ordinances made in Parliament notwithstanding.

Licence granted to Stapyll John Stapill and William Beaufitz to buy, themselves or through deputies, 300 quarters of wheat in the kingdom of England and export them to Bordeaux for its victualling. The king orders all the admirals etc. to permit Stapill and Beaufitz or their deputies to do so, paying due customs and providing, by themselves or their deputies, letters testifying this unloading under the authentic seal of the city of Bordeaux before 24 June 1438.

Grant, with the advice and assent of the king's council, to Bernat Angevin , issued from the Burdeloys Bordelais province, chancellor [of Aquitaine] and one of the king's councillors in the duchy of Aquitaine , and his heirs born or to be born by legitimate union, of the castle , 2 land and Rouzan lordship of Rauzan with their profits, revenues and rights, with the proviso that Angevin and his heirs do the customary services due to the king. Angevin has supplicated the king that there is a castle situated on the borders with the king's enemies in the duchy of Aquitaine in the Inter duo maria Entre-deux-Mers which is called Rauzan and which is not part of the king's domain; and the late Mandonnet, Taillecavet Naudonet de Taillecavat called Marmande asserted it should own it by hereditary right and took it by treason, so Rauzan was put in the king's hands and Taillecavat was expelled by force from this castle by Angevin and some other king's officers; this castle's annual value does not exceed 30 l. and the castle requires great repairs, so Angevin requests the king to grant him in perpetuity this castle because of the great services he did to Henry V and the current king in the kingdom of France and the duchies of Normandy and Aquitaine and the fidelity he has shown in the king's council [in Aquitaine], and that he waged war in person and otherwise against the king's enemies in several places, and he continues to do it to his own great expenses.

The king wants the constable and Angevin, or one of them, to show letters under the seal of the seneschal of Aquitaine explaining how this money is going to be expended.

Sampson, Montbrun Sansson de Monbrun who had obtained by the king's letters patent the lordship and fortalice of Gamarde has returned these letters to chancery for cancellation in order to grant them to Harsage. 2

Previously, the king had granted this custom on 15 December 1377 to Fylongley Richard Fillongley for his good service to Edward of Woodstock , the king's father. Fillongley had returned this grant into the chancery, in the presence of Richard II. 1

New grant, with the advice and assent of the king's council, to the king's kinsman the Busch captal de Buch and count of Longueville , 2 of the custody of the city and town of Bazatz Bazas receiving there his wages, with full power and licence to build a castle or fortalice for the conservation of this city, receiving 3,000 gold saluts for that, by supervision of the king's council or other persons sent by this council. The captal de Buch has shown to the king and his council that he was granted in 1414 3 the custody of the city and town of Bazas, according to an indenture that he was to receive each month 150 fr. and has paid a one-off 500 fr. for this custody on order of the seneschal to Favars Menaut de Habas , previously captain and keeper of this town, who previously received for his monthly wages 200 fr. ; but thereafter the captal de Buch asked to be discharged of this custody because the town was on the enemy borders and was threatened by them, and the city walls were almost destroyed, and most of the city's inhabitants has fled elsewhere for their security. Asked by the king and his council to deal with this matter, the seneschal of Aquitaine and the king's council in Bordeaux summoned the three estates 4 and it was decided that the captal should be granted again the town of Bazas with 3,000 gold saluts to build a fortalice within the town under the supervision of the senechal, the council of Bordeaux and some experts in the matter ( scientifici ), rendering Bazas to the king after having been paid the expenses made for the building of this fortalice and his wages.

Grant to Goston, Foys Gaston de Foix, count of Longueville and Bonages Benauges , Busch captal de Buch , the king's kinsman, because of his constant good service to Henry V and the current king in the wars in the kingdom of France and in Aquitaine, and his taking of two places situated on the borders with the enemy called Chales Chalais and Lequairon , of these two places which were owned by the Grenhols lord of Grignols 1 and Jean de la Roche , 2 the king's enemies and rebels, as well as the places of Balhada Belhade and la Motte de Sounhac la Motte of Saugnacq , which were owned by Lana Amaniu de Lanne, kt , the king's enemy and rebel, and Gaston de Foix has made built a fortalice at his own cost for the safeguard of these places, of the four places with their revenues for him and heirs under the king's obedience.

Licence granted to Walter Colles, clerk , constable of Bordeaux , because of the expenses of the house ( hospicium ) he incurs due to his office, to buy himself or through his deputies, 200 quarters of wheat for the expenses of this house in the kingdom of England , where the wheat is the best and suitable, and export them to Bordeaux , paying due customs without impediment.

9 July 1438 . Westminster . Concerning a proclamation to be made .

Order to the seneschal of Aquitaine, the mayor and jurats of Bordeaux , the judge of Gascony , the procurator fiscal , the Umbraria prévôt of the Ombrière and all the king's officers of the duchy to proclaim publicly in each places of Bordeaux and Burdeloys Bordelais where they will find it suitable, that the king orders, at the request of the religious men, the guardian and convent of the friar minors of Bordeaux , that nobody can become guardian or have another office in this convent, nor in any other convent of Bordelais , if he has not been born in the king's obedience, if he is not now of the king's obedience and if he is not actually present at this convent to do his office. The religious men, the guardian and convent of the friar minors of Bordeaux have shown to the king that some offices of their convent have been often granted in the past and now to people who were not born in the king's obedience and have committed damage by revealing secrets of the city of Bordeaux and in many other ways, with the result that they have supplicated to bring them remedy on this.

Grant to the religious men, the guardian and convent of the friar minors of Bordeaux , that they and their successors born in the king's obedience and continuing to be in this obedience, be allowed to keep forever all the possessions and revenues mentioned below as they owned them since their grant, with the proviso that they do not use this letter as a pretext to have the same rights over the other lands they have bought. The religious men, the guardian and convent of the friar minors of Bordeaux, a convent founded by Edward I , 1 have shown to the king as some noble persons of Bourdeloys Bordelais have granted to the Franciscans of Bordeaux, as their convent needed constant repairs and there was a great number of brothers, in fact 64 persons, they have received several hereditary goods and revenues of wheat and wine up to the annual value of 60 l. of the money of England for the divine service, the maintenance of the brothers and the repairs to their convent, the guardian and convent and their successors giving forever for each of these grants three daily masses made for the redemption of the donors buried in their convent, these donors having specified that their grants could not be put outstide the hands of the convent.

Grant at the king's pleasure to the governor ( regens ) of the council of Bayonne and the community of Bayonne of the assize with all its profit in the same way the king's predecessors had granted to the commmunity of Bayonne , so that they keep the sums of money coming from this assize and be able to pay the expenses caused by the war in the future, any prosecution made before by any king's subjects of England in order to nullify this assize notwithstanding. The king has learned by a supplication of the governor ( regens ) of the council of Bayonne and the community of Bayonne that this city has incurred certain large expenses because of the wars, and the sieges and conquests of Guamarde Gamarde 1 and Darrion Rion , and the resistance of the king's enemy Rodigo Rodrigo[de Villandrando] , 2 and they have expended sums of silver money in which they are indebted to several merchants because of 600 men-at-arms and more being at sea for the city to fight the Hispannici Spanish . 3

Inspeximus of enrolled patent letters of King Richard II of 2 March 1390, 1 granting for lif, with the assent of the prelates, dukes, magnates and other important men and communities of the kingdom of England summoned in parliament at Westminster , the duchy of Aquitaine to John of Gaunt with all its cities, castles, towns, places, lands and provinces. Richard II granted him also the power to pardon criminals, return to them their goods and their good reputation, where, because of their crimes, they have been sentenced to death.

Inspeximus of the letters patent of John of Gaunt, duke of Aquitaine and Lancaster about the appointment of William le Scrope as seneschal of Aquitaine:

4 July 1390 . London .

Grant, with the advice and assent of the duke's council, to Lescrop William le Scrope, kt , to whom John of Gaunt has granted by his other letters patent the office of seneschal of Aquitaine, of full power:

  1. to receive into the duke's peace all the duke's enemies and rebels if they come in his obedience, whether they are English, Irish, Welsh, Scots, French, Gascon, Aquitanian and of any other nationality, and of criminal perpetrations, lese majesty, robberies, fires, lootings, murders, rapes and all other kinds of criminal cases committed in the duchy;
  2. to demolish and destroy, by the advice of the duke's council there, all manner of fortalices which are not able to be held properly, and especially those that have been conquered by the king's rebels, excepting fortalices which belong to the duke's patrimony;
  3. to exercise high and low justice, and complete and shared jurisdiction in whatsoever place in the areas where the seneschal is, and to try, and punish all and singular traitors and rebels guilty of the crime of lèse majesté or high crimes of whatever kind according to the demands of the case;
  4. and to pardon all kind of criminals according to the case.

Inspeximus and confirmation of some letters patent of Lescrop William le Scrope, seneschal of Aquitaine for John of Gaunt, duke of Aquitaine and Lancaster:

20 November 1391 . Bordeaux .

Pardon, with the advice and deliberation of the seneschal's council of Bordeaux, 2 to Castar, du Pey du Taste 3 for the murder of a man, if he has done this, as it is likely, whose body has been found in his garden and vineyard near his house situated in the Camblaries parish of Camblanes 4 in the land of Dentre deux Mars Entre-deux-Mers . And restoration to him of all his goods that may have been seized in John of Gaunt's hands and his good reputation, saving only the right of parties if they want to sue him in the future in a civil proceeding. The seneschal quashs all trials, inquiries, clamours and banishment made or to be made by the king's procurator fiscal or another ducal official. The seneschal imposes perpetual silence about this to the judge of Gascony , the Lombriere prévôt of the Ombrière , the mayor and the sub-mayor of Bordeaux , the Dentre deux Mars prévôt of Entre-deux-Mers , the procurator fiscal and all the other justices and officers of the duke, John of Gaunt, and they must respect this pardon without making impediments to Pey du Taste. After this body has been found in Taste's garden and vineyard, his body and movable and immovable goods were to be forfeited and seized in the duke's hands if he had committed this murder, but several relatives and friends of Pey du Taste have supplicated the seneschal to pardon him this murder if he was found guilty of it, and return him all his goods.

In fact, he was a member of a noble family of this province, his family name coming from the village of Tregurà de Dalt (now part of Vilallonga de Ter, province of Girona, community of Catalonia, Spain). Fort-Sans had married Indiota de Rouqueys (often named as 'Edie de Rouqueys' by genealogists), issued from a family of the Entre-deux-Mers who produced an archbishop of Bordeaux (Ramon de Rouqueys, 1380-4, see Lainé, F., Fasti Ecclesiae Gallicanae , 13, Diocese of Bordeaux (Turnhout, 2012), p.177-81, no.682). Judit de Rouqueys brought the fortified house of la Motte Verte and the house of Rouqueys -both at Carignan- to his husband and to her son Poton.

Appointment for life of Robert Holme, esquire , and John Staple, of London , vintner , as controller of the castle of Bordeaux with its customary wages in the same way the late John Bowet , former controller, received them and was allocated in the accounts of Barnebe Thomas Barneby , former constable of Bordeaux, before the king's exchequer of Westminster . Formerly, Holme had received this office at the king's pleasure by the king's letters patent, 1 but he wants to return these letters to chancery for cancellation with the intent that the king appoints him for life along with Staple.
