Physical condition of the roll

The roll consists of nine membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/117, 7, 8, 9 and 10 Henry V (1419-1422) .

Introduction.

Although this roll covers the last four regnal years of Henry V (1419-1422), it is quite short, at only 9 membranes long. It is obvious that the attention of this king and his administration was now more highly focused on Normandy and Valois France than on Aquitaine-Gascony. Henry's conquest of Normandy, which had begun in August 1417 had been extremely successful. The Norman capital, Rouen, had fallen to him in January 1419 after a six-month siege. In the summer he began to move towards Paris. Exploiting the murder on 10 September 1419 of John the Fearless, duke of Burgundy, by the Dauphin's Armagnac supporters, Henry was able to negotiate a diplomatic settlement (the treaty of Troyes, 21 May 1420), which made him heir to the crown of France once Charles VI died, and regent of the kingdom of France in the meantime. This treaty of Troyes is not mentioned on the Gascon roll, however, because the duchy was not seen by the English or by their Gascon subjects as a part of the kingdom of France, but as a part of the English crown. That said, Henry was keen that it should pay a part in his future rule as heir and king of France, especially as a base from which expansion could be launched into Languedoc. The Gascons were to be involved in this expansion: to that end a meeting of the Estates of the duchy was called at Dax to vote taxation for this purpose.

Several acts in the roll concerned John Tiptoft, the seneschal of Aquitaine, because Henry's plans to use Gascony as a military base required Tiptoft, originally appointed in 1415, to be present in the duchy in person. He had been heavily involved in the conquest of Normandy but he arrived in Bordeaux in August 1420 and remained there until November 1421. Similarly the mayor of Bordeaux, John St John who had also been in Normandy, returned to Bordeaux in April 1420. Sir John Radcliffe was appointed constable of Bordeaux in May 1419, the post having been left vacant from the death of William Clifford on 27 March 1418, and was also present in the duchy from April 1420 onwards. Such presences indicate the importance of the duchy to Henry V in his continuing ambitions in France. Anxiety over lack of money in the duchy was obvious at this point since it was ordered to pay Tiptoft before anybody else. Since Tiptoft was to be present in person, he was commissioned to receive the customary homages and oaths from the king’s subjects in the duchy but also to receive the homage and oath of Johan I de Foix for the Béarn, Marsan and Gabardan. The latter was seen as an essential ally for the conquest of French-held Aquitaine and Languedoc. Tiptoft was also empowered to grant the king’s grace to Gascons who were in the French party and was allowed to make patis with ‘French’-held territories. The castle of Lesparre was granted to him for the residence of himself and his family. 1 Henry V wanted a tighter control over the military company of the seneschal than usual: a muster was ordered to be carried out regularly by the constable and mayor of Bordeaux. 2

The defence of the duchy remained important at this key time. We find several letters of protection for Englishmen going in Aquitaine to serve in the company of the captain of the castle of Fronsac. This important castle had housed an exclusively English garrison since 1377 when it had been seized from its lord, Guilhem-Sans IV de Pommiers. 3

Similarly, as in previous rolls, several licences to export wheat from England to Gascony (Bordeaux and Bayonne) were granted to English merchants and officers. 4 A new feature found in some licences, reflecting how events were developing in the northern campaigns of Henry V, was the possibility of exporting this wheat to Normandy, either to Rouen 5 or Harfleur. 6

A dearth of wheat in Guyenne remained a concern for the public authorities. Hence the community of Bayonne, which had suffered a recent Castilian military offensive (summer 1419), was allowed to buy 1,000 quarters of wheat in England. 7 The king had 100 quarters of wheat purchased in Norfolk and Suffolk to supply Bordeaux and the castle of Fronsac, and ordered the requisitioning of 40 mariners for this task. 8

Few acts in the rolls concern Gascons but we find in this roll the first mention of the captal de Buch Gaston de Foix as count of Longueville (in Normandy), a title granted to him by Henry V in 1419 as a reward for his service in the king's campaigns in Normandy. He was also present in the duchy along with Tiptoft in order to foster Gascon involvement in Henry's plans in the wake of the treaty of Troyes. 9 The Basque Arnaut de Zubieta was granted the office of weighing the resin produced in the region of Capbreton, 10 and Ramon-Guilhem de Lanau was granted for life the castellany of Saint-Macaire. 11

It has to be noted that the English language appears more frequently in this roll than in previous rolls. In particular, English names of professions and social ranks (such as worsted man, yeoman, gentleman, etc.) appear for the first time in this roll.

Privileges for merchant vintners of the duchy at their request:

  1. Safe-conduct everywhere in England or anywhere within the king's lordship, along with licence for wholesale trade with Englishmen ( indigene seu incole ejusdem regni ) and foreigners ( alienigene extranei ), for goods brought in or out of the king's lordship, paying customs, except for wine brought from Aquitaine which they cannot carry out of England without special royal licence.
  2. Licence to dwell where they wish with their goods.
  3. Validation of contracts between these merchants and anybody else, as soon as God's penny has been paid, evidence being provided in case of dispute according to the customs of the fair or town where the contract was made
  4. Release of the right of ancient prise ( prisa antiqua ) of each 2 tuns of wine unloaded in England or in the king's lordship for each ship, and of any other increase, without paying the market price.
  5. For each tun of wine gauged, the seller has to pay for what is missing and the buyer for any surplus, for the price at which the wine was sold.
  6. On the arrival of new vintage in each town of England and of the king's lorsdhip, a sworn commission of vintners from the duchy and of good men of this town has to test the stock of old wine and if it is deteriorated, they have to destroy it.
  7. The seller and the buyer each have to pay one half penny for every gauged tun.
  8. The officers of fairs in merchant towns have to do speedy justice to the vintners according to merchant law, the king punishing any default to do so.
  9. Except for crimes punishable by death, inquiries for lawsuits involving vintners of the duchy will be made by a mixed commission of such vintners, if they are numerous enough, and of good men of town.
  10. No other tax or exaction has to be requested for this wine.
  11. Grant in perpetuity to vintners of the duchy alone not to be prejudiced by any further grant, the vintners of the duchy paying to the king 2 s. for each tun of wine paying freightage, within 40 days after the first unloading of this wine in the king's lordship, in addition to ancient customs.
