Introduction.

This roll, a more substantial roll than its predecessors follows a broadly similar pattern of those predecessors containing entries relating to grants, inspeximus and confirmations, to justice, orders to make payments, and entries relating to trade. This was the usual fare of the Anglo-Gascon administration. Perhaps the main difference certainly from the previous roll is the large numbers of letters of protection.

The letters of protection are very numerous. In part the large numbers, predominantly for Englishmen, were granted for members of the retinues of English officials either already in post in Aquitaine, or newly appointed. Of these, one group were for John de Stratton and four of his followers. Stratton had been appointed constable of Bordeaux in 1381, and was to serve in that office until 1386. 1 Another larger group related to Richard Craddock, the captain of the castle of Fronsac. Craddock, like Stratton and also his brother David who served at mayor of Bordeaux from 1382 to 1394, was a Cheshire man who had made a career in the wars in Aquitaine, and had been given the captaincy of one of the most important castles in the duchy. The letters of protection were for himself and ten men, mostly English, but including a merchant of Almain, and a man from Bordeaux as well. 2 A third Cheshire man - Sir William Mainwaring - was also making a career for himself in Aquitaine, and served in the garrison of the castle of Monclar for which he received a protection, though on this occasion without a retinue. 3 By far the biggest English contingent was for William le Scrope. Scrope had first come to power in Aquitaine following the departure of John de Neville, the lieutenant and acting seneschal, in February 1381. However, he was not formally appointed seneschal until 28 May 1383. Since he appears to have been back in England at that time, he once again set off for Aquitaine with a sizeable contingent amounting, twenty of whom also received pardons. 4 Of Scropes contingent, two were goldsmiths, one of whom was serving as an archer, and one was a webster. Smaller numbers of protections were also granted to Gascon nobles and their retinues and supporters. Both Bertrucat d'Albret and Florimont, lord of Lesparre, received a small handful of protections. 5

Perhaps the most interesting group of protections relate to William Dale, clerk. Dale, and his two valets John Part of Frome, and Richard de Clevedon, were granted letters of protection on 20 October 1382, 6 along with one Roger Empringhale of Southwark on 7 December 1382. 7 On 20 October Dale and his valets also received a further protection and safe-conduct to go to Aquitaine on unspecified business of the king's. 8 It is revealed in two grants that Dale had promised that he could deliver the town of la Rochelle to the king from the French, and he was granted an annuity of 200 l. and the priory of île d'Aix near La Rochelle to come into effect when the town was so delivered with the consent of its people. 9 That plans for the recovery of la Rochelle were underway was revealed by several entries on roll 95, but these entries clearly indicate a more concerted effort to rest control of the port back from the French. Presumably with the intention of sealing the deal the king subsequently granted a protection and safe-conduct to several leading burgesses of la Rochelle to come to England for discussions. 10 From this it would seem that the English were placing greater emphasis on winning back support by negotiation. In addition, although it is clear in preceding rolls for both Richard II's reign and for the final few years of Edward III's, that power was being delegated to various officials, and to major Gascon supporters to receive rebel Gascons back to their English obedience, there seems to have been a greater emphasis on this from this time onwards. At this time power was not only delegated to William le Scrope, the new seneschal of Aquitaine, but also to the leading Gascon noble loyal to the English - Archambaud de Grailly, the captal de Buch. 11 Several pardons were also granted directly by the king. 12

The issuing of grants to loyal Gascons continued to be an important element of business of the Gascon Rolls as the English attempted to stem the tide of desertions to the French. Prominent among the recipients were Bertrucat d'Albret and Florimont, lord of Lesparre, both firm loyalists. 13 Albret requested and was granted the custody of the lands and goods of the alleged traitor Pey Béguey. 14 He was also granted the prévôté of the Entre-deux-Mers and the right to bring wine from the rebel lands up river in the Haut-Pays. 15 Orders were also issued on his behalf to Archambaud de Grailly to deliver the castle of Vertheuil to Albret. 16 Arnaut de Campagne, an esquire of Bertrucat d'Albret, also benefited from Albret's own favorable position, receiving a grant of the prévôté of la Réole, a grant he needed because he had been captured and imprisoned by the French. 17 Florimont, lord of Lesparre, received confirmations of grants made by John de Neville, late the king's lieutenant in the duchy, and by Edward III, the former of which was of the lands of the rebel Bérart III d'Albret, lord of Langoiran, and the latter of 80 m. per annum from goods belonging to Bernat Breutey of Bordeaux, whose possessions had been forfeit. He also received a substantial contribution for his large ransom owed to the Castilians following his capture by them. 18 Another who did well from his service was Gaillard de Frodsham. He received confirmations of three grants from John de Neville, the late lieutenant, all of which were of the lands and goods of rebels - a house in the Bordeaux confiscated from Johan Deode, of all the lands and inheritance in the Bordelais confiscated from Ramon-Guilhem de Got, kt, lord of Castets-en-Dorthe, and of all the lands and possessions of Niot Aiquart in the jurisdiction of Fronsac. 19 Some who received favour appear to have suffered for their support of the Anglo-Gascon cause. Sir Bernat Montet alleged that he had loyally served the king's grandfather and father, and had been captured by the enemy six times. The first grant was of the castellany of Saint-Macaire, and a moiety of the castle of Gontaud in Agenais. 20 However, the grant, although it seemed generous, was not apparently all that Montet might have hoped for for his service. He was subsequently forced to request a grant of 3 d. in the pound on goods passing through his castellany to enable him to repair the castle walls which had been damaged by the actions of the enemy, which he duly received from the king. 21 Another recipient of a grant was Radegonde Béchet, lady of Morthemer. She is a particularly interesting case, being the widow of the Welsh esquire Gregory Says. With the French conquest Says and his wife lost most of her inheritance. The loyalty of her and her husband, and their losses, was rewarded with the grant to her of the issac tax on wine in Bordeaux. 22 That the issue of the number of grants made in the duchy was considered problematic, and to the detriment of the running of the Anglo-Gascon administration is clear from the order for the revocation of such grants made on this roll. The concern was in reality a perrenial one, with the obligations and demands heaped on the Anglo-Gascon administration usually far outstripping its resources to meet them. The order was made for the revocation of all grants made by ducal officials in the time of Edward III and Edward of Woodstock which had not been confirmed by that king and his son. Implementing such a revocation was, of course, a different matter. 23

Trade does not form a major part of this roll. The matter of security on the seas remained an issue to Bordeaux merchants who were continuing to bring their goods to London from Flanders so that they could then ship them on to Bordeaux. As a consequence the collectors of the petty custom and subsidy of 6 d. in the pound in the port of London were ordered to permit them to do this free of custom. 24 In addition to this order there was a grant to Johan Domenge, attorney of Johan Carrer, merchant of Bordeaux, of permission to bring goods bought in Flanders to London and then on home. The roll also reveals an increase in the granting of licences to ship goods. All of these are to Englishman. One of these was granted to David Craddock, the mayor of Bordeaux, was granted 200 quarters of wheat, 100 quarters of oats, and 100 quarters of bean and peas, from Bristol to Bordeaux for his household. 25 Another was granted to Robert Cholmondeley, a king's esquire, for his service, but in his case this was to ship wine from the Haut Pays - from rebel lands along the main river valleys - which he could export from Bordeaux to England and elsewhere. 26 The remainder were to merchants, two to John Blakeney, and Roger Wade and William Bridbroke, 27 and the last to John de Beverley and Nicholas Drayton of Yarmouth, 28 all wishing to take herring to Bordeaux or Bayonne. That Bayonne in particular might have been short of victuals at this time is indicated by three orders to the admiral of the Western Fleet to allow several ships of Bayonne to depart, notwithstanding an order arresting them for transport service, so that they could go to Brittany and then take victuals bought there to Bayonne. It was alleged that the city had been hit by pestillence, and much damaged. 29

The king's responsibility to do justice to his Gascon subjects also forms an important part of this roll. One area where the king paid particular attention was matters relating to the Church, and particularly the papal schism. The bishopric of Dax was one area of contention. Juan Gutiérrez was appointed bishop of Dax, and was much employed by the English on diplomatic missions, particularly in Iberia. However, whilst he was employed on these missions the chapter of Dax, or the canons of the same violently ejected him, and his vicars, proctor, and other officers from his spiritualities and temporalities. Despite the king's orders to various local officials to restore the bishop, little had apparently been done, and further orders had to made. 30 The king also wished to intervene on the behalf of Pey d'Anglade, professor of the Sacred Page, archbishop of Auch. The archbishop of Auch was appointed by Urban VI, but much of his province was in areas under control of those who supported the Avignon papacy. The king ordered his lieutenant and seneschal to restore the archbishop, a tall order for even the most loyal official. 31 The royal castle of Fronsac was another particular bone of contention. The castle and lordship forfeited into the king's hands by the treason of Guilhem-Sans de Pommiers, vicomte of Fronsac. It would seem that Pommiers in his time, and the captains appointed after this, 32 were responsible for the oppressions of the nobles and communities, and orders were made to inquire into the matter and do justice. 33 Another complaint that continued into this roll was that of Bernat de Bielle, citizen of Bayonne, and Gracie, widow of Ramon de Malcaide, late citizen of Bayonne. This smacked of an internal feud or factionalism in the city, and had been clearly continuing for many years. Bielle and Malcaide had been on the wrong side of judgments and appeals, and had finally appealed to the king. The king could not afford to have factionalism in the duchy's second city get out of hand. 34 The king could also not afford for leading noble and military figures oyal to the Anglo-Gascon cause to be in dispute, and was forced to resolve a dispute between Bertrucat d'Albret and Florimont, lord of Lesparre, over the castle of Vertheuil. 35 This seems to have originated in the dislocations of war, with Bertrucat receiving a grant from the king, but Florimont claiming hereditary rights in the castle. 36

There are also a few interesting individual entries. The difficult diplomatic relations with Charles II d'Évreux, king of Navarre, which resulted from that king's attempts to placate both the French and English sides, had apparently not deterred the English from pushing for an accommodation. Navarre's geographical relationship between the duchy of Aquitaine and the kingdom of Castile made Charles' position very uncomfortable. The English planned for Charles to come to England for further negotiations and the mayor, jurats and good men and inhabitants of Bordeaux and Bayonne were ordered to provide shipping. 37 Pey de Laxague, lord of the house of Gentein in the land of Soule, under the castellany of Mauléon, received a grant to build a stone house of a height not previously permitted. Whether this was for defensive reasons is difficult to say, but licences related to the construction of building are not that common in the Gascon Rolls. 38 The question of the rights to burgess status in Bordeaux and the captal de Buch also continued. Archambaud de Grailly, captal de Buch, claimed the status from his ancestors, but since he was a noble, and they should not have the right to hold burgess status. Though in previous rolls the rights of the captal were upheld, these were still being resisted by the city's authority. 39

Grant to Johan de Vale of Aquitaine, that he in person, or by sufficient deputies may exercise the office of money changer throughout the king's lordship, commencing at the date of these presents, for a term of fifteen years, provided that all manner of bullion of gold and silver that he buys is made into money where he resides, and that before he commences work he swears an oath to the constable of Bordeaux to faithfully exercise his office.

Order to the constable of Bordeaux, that since Thomas Halton, king's esquire , has now done homage for the 100 l. of money current there, which the late prince of Aquitaine and Wales , the king's father, 1 granted him by his letters patent for his good service, which grant the king confirmed on 26 June 1378, 2 he is to pay him the sum with the arrears from that 26 June each year, at Easter and Michaelmas from the issues and revenue of the Burdeg' castle of Bordeaux , as was granted to him. The constable is to receive letters of acquittance from Halton attesting payment, and he will have due allowance in his account.

To all collectors of customs, and the subsidy of 6 d. in the pound, and 2 s. from each tun of wine, lately granted to the king by the community of the realm of England, in whatsoever ports in England.

Order that the merchants of Burdeg' Bordeaux be permitted to bring their goods and merchandise loaded onto ships in ports in Flandr' Flanders into England, unload it and reload it for passage to Bordeaux, according to the tenor of the king's letters patent, and that they should not be molested or harmed contrary to those letters. The king granted the permission with the assent and advice of his council by his letters patent, because he had considered how the merchants bringing their goods and merchandise from Flanders, to England for security and pleasure ( recreatio ), for them to be shipped onto Bordeaux, have, before this time, being troubled and impeded by the king's ministers, and have continued to be, to their impoverishment.

Order to the constable of Bordeaux, or the farmers or keepers of the lands, rents and possessions which were Beguer Galhart Béguey, kt , rebel of the king, whose lands are in the king's hands because of his rebellion, to pay to William Forster of Lancashire , esquire , the arrears of the 100 l. annuity which the king granted him on 10 December 1379 for his good service to Edward [III], late king of England , the king's grandfather, and to the king's father , from 10 December each year from those lands, rents and possessions according to the tenor of the king's letters; receiving from Forster his letters of acquittance attesting to the payment, and they will have due allowance in their accounts. The king granted the annuity to Forster to be paid at the terms of Easter and Michaelmas by equal portions for Forster's life, or until the king made other provision for him. 1

Order to the lieutenant or seneschal of Aquitaine, and whatsoever judges, officers and ministers of the king this concerns, or their lieutenants, to obtain full information on the complaint of Ayquart Guilhem Aiquart, esquire , that Lescrop' William le Scrope, kt , late captain of Fronsac , took corn, wine, silver and other property and goods of his to the value of 100 gold nobles from his houses and lands within the jurisdiction and castellany of Fronsac , without cause, in person or by others, which he still detains, and they are to summon before them the attorneys and proctors of Scrope who are in the castle or elsewhere in the duchy on his behalf, and hear their answers. If they find by this that the complaint is true, then they are to compel the attorneys or proctors who appear for Scrope to restore the goods and property or the value of the same according to the fors, laws and customs there. Aiquart has made the complaint requesting restitution since he has been impoverished by the seizure.

Commission of full power to at least three of them, of whom the constable should be one, to inquire into and obtain information on a grave complaint made by the king's faithful subjects, religious, noble, high-born, and communities living within the jurisdiction and district of Fronsac , Cadilhac Cadillac[-en-Fronsadais] , Guisters Guîtres , Kenak Queynac and the isles of Carnier Carney and Askes Asques 1 in the lordship of Aquitaine, concerning the unlawful usurpations of the lords and captains of Fronsac , and of the rights which pertain to the castle of Fronsac , and the truth of all and singular injuries and harm done to the complainants. Everything that they find that has been done unjustly to the complainants are to be corrected and put right speedily according to the laws, fors and customs of those parts, and they are to attend to this diligently, and do justice.

The king has received the complaint that the lords and captains of Fronsac from the time of the war have been usurping unlawful power to themselves, presumptuously, through violent means, and have oppressed the complainants by forcing them to do and make repairs, works, subsidies, tallages, impositions, extorsions of corn, wine and money, and other unusual novelties and oppressions, from which they and their ancestors and predecessors were anciently free, and punished them with greater hardships. The same lords and captains have appointed numerous prévôts, serjeants, proctors, officers and ministers within the jurisdiction and district, without the election and assent of the complainants who ought to have chosen them. They do not cease to do this, and have forced the complainants into poverty, so that without relief they will be forced to leave their country.

Commitment of power to three of them at least, the constable being one, to receive and hear all complaints and appeals made to the king as king of France in the duchy of Aquitaine and neighbouring parts, and to proceed in all causes, complaints and appeals of every civil kind, with all things relating to those cases, according to the laws, fors and customs there, in the stile of the king's court of France, determining the cases, and doing all things necessary for this. The king has granted this because of his obligations to do full justice as a ruler, and it is to endure until he revokes it. They are ordered to diligently attend to this, and the king has ordered all archbishops, bishops, dukes, counts, vicomtes, marquises, barons, seneschals, mayors, prévôts, officers, ministers and all other faithful subjects, both noble and common, to be intendant on, and obey the archbishop and others, or three of them at least, the constable being one.

Order to Menta Guiraut de Mente, clerk and sacrist of Bayonne , and Podio Alto Tetbaut de Poyloaut, esquire ( scutifer ), that they cause the goods, rights, jurisdictions and other things pertaining to the bishopric of Dax, to be administered in the name of Juan [Gutiérrez], Aquen' bishop of Dax , to his profit and honour, by whatever means they consider best. The king also wishes that the chapter and canons be compelled to render an account to Guiraut and Tetbaut, or either of them, for all that they have received individually, and of what could have been received by the bishop and his officers and ministers if they had been able to administer them, they applying what has been received to the use of the bishop as they consider expedient, and until the bishop ordains otherwise. The king, by other letters patent, has ordered the seneschal of the Landes and certain other faithful people, to compel the chapter, and the individual canons, in case that they have not obeyed the king's order, to compel them to make remedy.

While the bishop has been in the king's service, and that of John [of Gaunt], king of Castile and León , duke of Lancaster, in Spain, and is under the king's protection and safe-guard, the chapter of Dax, or the canons of the same have allegedly violently ejected him, and his vicars, proctor, and other officers from his spiritualities and temporalities, and despoiled them, in contempt of the king's majesty, and his protection, and to the grave damage and harm of the bishop, and the king wishes to provide a remedy for the bishop. 1

To all admirals, captains, castellans and their lieutenants, constables, customers, keepers of ports and other maritime places, and also sheriffs, bailiffs, minsiters and other faithful subjects of the king.

Grant of a licence to David Craddock, mayor of Burdeg' Bordeaux , that he can take 200 quarters of wheat, 100 quarters of oats and 100 quarters of beans and peas, bought near Bristol in person or by his servants, loaded onto ships in the Bristoll' port of Bristol , and take them to Burdeg' Bordeaux for the expenses of his household there. It is ordered that Craddock be permitted to take the wheat, oats, beans and peas without any impediments, first paying the customs that are due, any proclamations to the contrary notwithstanding.

Grant to Lebret, de Bertrucat d'Albret , 2 at his request, of the custody of all the lands and tenements, goods and chattels, of Beguer Galhart Béguey, kt , of Aquitaine, with the profits and revenues to the same lands and tenements, which have been taken into the king's hands because Béguey has been accused and charged with certain crimes against the king's royal majesty, and upon which the king has assigned certain faithful people to inquire into the crimes, and to hear and determine it. Albret is to answer to the king for the profits and issues if Béguey is convicted and the property forfeited, or to Béguey if he is cleared and the property restored to him.

The king granted the same, by his special grace, la Saubouère, for his life, for his good service to the king's grandfather , and father , and to the king in their wars, and for the losses that he has sustained in his inheritance and goods on account of the wars, the lands, goods and inheritance being presently in the hands of the king's adversary of France, but which forfeited into the hands of the king's father and the crown of England in Arnaut de Gabarret's lifetime for certain crimes committed by him. La Saubouère is to hold the same for the ancient and customary dues, up to the value of 100 Francs each year, provided that he answers to the king and his heirs for any sums above that 100 Francs each year. 1

Commission to John de Stratton, lord of Landirans Landiras , constable of Bordeaux , the dean of Saint-André of Bordeaux , 1 the official of the archbishop of Bordeaux , and Master Bonelly Guilhem Boneu , or at least two of them, of power to take cognizance and proceed in the cause of appeal of Master Ramon-Guilhem de Puy, one of the judges of the king's court of sovereignty in Aquitaine , concerning his ejection from lands that he was granted, and in all related matters, summoning the parties before them, hearing, considering and determining the appeal, and doing full and speedy justice to the parties, according to the laws, fors and customs, and revoking anything that has been done contrary to the appeal. Stratton and the others, or at least two of them, are ordered to proceed with this, and all are prohibited from attempting anything prejudicial to the hearing of the appeal.

On the behalf of Ramon-Guilhem de Puy it had been shown to him that Merlyn Ricart Merlin , by a certain grant fraudulently obtained from the king the lands of Mes Mées and Terses Tercis in the Landes , for his life, caused Puy to be unjustly expelled from the same without hearing the case, and wickedly despoiled him, against the laws, fors and customs there, and to his grave damage, he having been granted it by Nevill' John, lord Neville , when he was the king's lieutenant in Aquitaine, for his good service to the king's grandfather, and father, and to the king, and Puy had been in full and peaceful possession of the same by pretext of the lieutenant's grant for many years. Following the ejection, Puy feeling that he had been greatly damaged, and fearing further bad treatment from Merlin, has appealed to the king in writing within the legal time limit, as will be made clear in a public instrument shown to the king, and he requests remedy. 2

Order to the seneschal of the Landes , or his lieutenant, that if the complaints made on behalf of Juan [Gutiérrez], Aquen' bishop of Dax , are true, he is to go to the city of Aquen' Dax , and require the chapter and canons of the church of Dax to hand over the governance of the bishopric, together with all goods, fortalices, jurisdictions, rents and emoluments, to Menta Guiraut de Mente, canon and sacrist of Bayonne , the king's clerk and counsellor , and Podio Alto Tetbaut de Poyloaut, esquire ( scutifer ), or either of them if they cannot act together, until the king or the bishop will ordain otherwise. The king wishes that the bishop receive an account from Guiraut and Tetbaut, or either of them, of all that they have received, when requested by the bishop, or his proctor. If the dean and chapter refuse to act, then the seneschal is to summon various of the king's subjects, whom the king is writing to on this matter, and take the bishopric into the king's hands, together with the emoluments and rents of the same, removing the chapter and canons, and whatever other illegal detainers there are, and cause Guiraut and Tetbaut to hold and govern the diocese. The king also wishes that the chapter and canons be compelled to render an account to Guiraut and Tetbaut, or either of them, for all that they have received, or have been able to take from the emoluments of the diocese, for all the time that they have occupied it.

It has been complained on the bishop's behalf, that while he has been in the king's service, and that of John [of Gaunt], king of Castile and León , in Portugalia Portugal , and is under the king's protection and safe-guard, the chapter and canons of the church of Dax have violently ejected him, and his vicars, proctor, and other officers, with threats and terror, taking the fruits, revenues and issues of the bishopric unjustly, to the great cost of the bishop, and in contempt of the king's majesty, and contrary to the power and effect of the king's protection. They have claimed, falsely, to excuse themselves, that the bishop had been translated to the church of Ulixbon' Lisbon by the apostolic see, and a remedy has been requested. The king recognises that the bishop and his office and goods are under his protection, that the chapter and canons are striving to eject the bishop unjustly, and that the bishop is not in possession of the office, nor is likely to soon obtain it, as the king has been informed. 1

The Mainwaring (pronounced 'Mannering') family held the manor of Peover Hall situated in Over Peover (now in the civil parish of Peover Superior, Cheshire). The alabaster effigy still survives in plate armour of William Mainwaring (d. c. April 1399), lord of Baddeley (Staffs.) and Peover, in the church of Acton (Cheshire). According to his petition (TNA, SC 8/126/6262), William served for over twenty years in Gascony. In the 1370's, William Mainwaring shared the leadership of a retinue with Philippot Elis within the pays of Bordeaux. Licence granted to Lassague Pey de Laxague, Salla de Jainteyn lord of the house of Gentein in the land of Soulle Soule , under the castellany of Mauléon , by the request of Karle Carlos de Beaumont , that he or his heirs are able to build a house in stone and lime to the height of 20 cubits, though it is the custom there that it is not permitted to build such a house beyond the height of 12 cubits without a royal licence. He and his heirs are to hold the house without trouble from the king and his heirs, or the seneschals, castellans, constables or other officers or ministers of the king. 1

To all collectors of both the custom and subsidy, and the subsidy of 6 d. in the pound, lately granted to the king, in whatsoever port in England, and the keepers of crossings in all ports and places.

Grant of a licence to Domyngo Johan Domenge, attorney of Johan Carrer, merchant of Burdeg' Bordeaux 1 that he may bring merchandise that he has bought in tuns, pipes and barrels ( rondelettus ) for his master in Flanders to be taken to Bordeaux, can be brought to any port within England , to break their journey there, and then go on to Bordeaux without paying any custom or subsidy to the king. Domenge proposed to bring the ship to the port of Sandewicum Sandwich to break the journey and has requested the above licence. It is ordered that Domenge be permitted to do this without paying the custom or subsidy and without impediment, provided that the merchandise is not sold or exchanged.

Domenge has complained that he bought merchandise in tuns, pipes and barrels ( rondelettus ) for his master in Flanders to be taken to Bordeaux, and put in a ship to Sandwich to break the journey, but now the mayor and others, seekeing to extract the custom and subsidy from the merchandise have detained it under arrest, though it was not exchanged or exposed for sale.

Order to Baroniis, de Gassie d'Ibarron, bachelor of canon law , Bertholomiu de Lesbay , Menta Saubat de Mente , Sacto Johanne Bidau de Saint-Jean and Perrer Bernat de Peré , citizens of Bayonne, or three of them at least, to attend to the complaint brought by Villa, de Bernat de Bielle citizen of Bayonne and Gracie, widow of Melcay Ramon de Malcaide , late citizen of Bayonne , executrix of his testament, and administrator of his goods , proceed with the king's authority, with all reasonable speed, first assuring themselves of the truth of the allegations, and if they find that the process is good, reasonable and valid, then in the king's name they are to confirm it. If they find that the sentence and process were erroneous and invalid, then they are to quash all of the proceedings, and the king commits to them full authority to speedily hear, understand, and come to a final sentence according to the fors and customs there. The king orders them to diligently attend to this, and prohibits any of the judges and commissaries [previously involved in the case] from acting in any way prejudicial to this.

Bernat, and Melcay Ramon de Malcaide , late citizen of Bayonne in his lifetime, complained bitterly to the king and his council concerning a case or cases of appeal between them on the one part, and Daretz Bertran d'Aretz , fellow citizen, on the other, firstly brought before the mayor of Bayonne in the court there, then before the judges of appeals of Gascony in Bordeaux, subsequently before the judges of the court of sovereignty of Aquitaine, and finally before Furno, de Pey Dufour, mayor [of Dax] , and Domo Nova, de Johan de Maisonnave , citizens of Aquens' Dax , judges and commissaries specially assigned for this business because of the several appeals. Bernat and Ramon have complained that in this process the commissaries have passed a judgment against the form of their commission, and against the fors, laws and customs of the city of Bayonne, for Bertran, and against Bernat and Ramon, not having heard them, and have passed an erroneous final sentence. Further they have passed an immoderate assessment of the expenses, and distrained and alienated their goods and property, and caused them to be arrested and detained, to their great prejudice and cost. They, therefore, request a remedy against the great trouble and oppression that they have suffered, and the king wishes justice to be done. The king assigned Ibarron, Lesbay, Mente, Saint-Jean and Peré, together with Caverio Pey de Cabé , Orassio Pey de Carresse , Dartiguepan Johan d'Artiguepan , bachelors of canon law, to bring the process had between the parties before them, summon those whom they consider ought to be called, and having viewed the process and sentence, confirm or annul it. They were to proceed in the principal business and do justice to the parties, just as the king has found by inspection of his rolls of chancery.

And now the king has been given to understand on behalf of Bernat, and Gracia, widow of Ramon, that though the king's letters were shown to Ibarron and the others a long time ago, and justice ought to have been done concerning the complaint, because Ramon, one of the original complainants, and Pey de Cabé, one of the commissioners, are dead, and Johan d'Artiguepan and Pey de Carresse have gone to the Roman Curia, and still reside there, they have done nothing in this matter. Because of this the others to whom this matter was committed have not been able to proceed to the grave damage of the complainants, and the complainants request remedy. The king wishes justice to be done. 1

Commitment to Rupunta Thomas de Repuncta , doctor of canon law , 1 Calhavet Guilhem-Arnaut de Caillavet, bachelor of laws , 2 Stephanus, Ortici Estèbe Hourtic, bachelor of canon law , 3 Baroti Pey Barrot 4 and Fulcherii Pey Fouchier , 5 canons of Saint-André, the dean of Saint-André of Bordeaux , and the dean of Saint-Seurin of Bordeaux , or three of them to proceed in the appeal cause, and the principal business, with all things connected to it, brought by Lopiaco, de Mabilia de Loupiac , wife of Monte Larino, de Arnaut de Monlarin , and determine the matter, and do full and speedy justice in the case, according to the laws, fors and customs of those parts. Order to three of them at least, to diligently attend to the appeal, and the principal business, with the related business. The king prohibits the judges of the superior court from acting further in this matter pending the appeal before Repuncta and the others, or three of them.

On behalf of Mabilia Loupiac, it was explained to the king by Jordan atte Broke , her proctor, complaining that a certain case had been heard before the appeal judge of Gascony, of a lawsuit between Comitissa, Lopiaco, de Condessa de Loupiac , wife of Oliverii Johan Oliver , and Almucia, Lopiaco, de Aumus de Loupiac , wife of Bauno, de, Burdeg' Pey Duban of Bordeaux , on the one part, and the same Mabilia, sister of Condessa and Aumus, on the other part, concerning the division of the inheritance of Lopiacum Rostanh de Loupiac , and Alhano, de Mabilia d'Aillan , deceased, father and mother of Mabilia, Condessa and Aumus, for 22½ l. rent, and 50 l. in money, which Lopiacum Johan de Lupiac , their brother, in his lifetime, gave to Mabilia de Loupiac in augmentation of her dower, which sums Condessa and Aumus asserted ought to be divided amongst the sisters. The appeal judge, making a mistake, had delivered a judgment in favour of the Condessa and Aumus, and against Mabilia, and Mabilia appealed to the judges of the high court in Aquitaine, and they, delivering a lawful judgment, and said that Mabilia's appeal had been wrongly made, and condemned her in the expenses. Mabilia, feeling herself damaged by this, appealed to the king and his council in England in writing, in lawful time, and her proctor requested a remedy. The king wishes justice to be done. 6

Order to John Roches, admiral of the Western fleet , or his lieutenant, that if the ship called the Seint Marie of Bayonne , of which Pascalus, Deugy Pascau de Hégi is master, has been arrested, amongst other ships, for the passage of certain of the king's subjects overseas, then it is to be released from arrest without delay, and Hégi is to go to Brittany with it, without any impediment. Hégi has stated that Bayonne has been weakened by pestilence, and greatly devastated, is near the king's Spannish enemies, and is starved of victuals. To obtain victuals for the city he wishes to go to Brittany, and he requests that the king release his ship from arrest, it having been arrested for the above reasons, and the king is favourably inclined to the request.

Letters of protection and safe-keeping for Gutterey Juan Gutiérrez, Aquen' bishop of Dax , the king wishing to provide security for the bishop against the malice of his enemies. The pope lately provided Gutiérrez to the bishopric of Dax, by his apostolic letters, and with the king's assent, and by virtue of this was in peaceful possession of the bishopric and its fruits, rents, profits and other emoluments. Now the bishop feels threatened by damage and injury in his status and possession of the bishopric by Baffe Jean Bauffes 1 and other enemies of his. The seneschal and others are ordered to maintain, protect and defend the bishop, and his men, household and servants in collecting the fruits, rents, profits and other emoluments pertaining to the bishopric, and they are not to permit any injury, trouble, damage, violence, impediment or any harm to be done to them. If any forfeiture or injury has been suffered by them, then it is to be put right without delay.

Order sicut alias to the mayor, jurats and good men of Burdegal' Bordeaux , that if Greilly Johan de Grailly, late the Bodeo captal de Buch , and all other lords who possessed the [noble] house of Podium Paulini Puy-Paulin in Burdeg' Bordeaux , in fee and inheritance, by that possession held the status of burgess of Bordeaux, and that status pertained to the house, then they are to permit Greilly Archambaud de Grailly, Bodeo captal de Buch to enjoy that status, with all that pertains to it, just as Johan, and others before him enjoyed it, without impediment, just as the king previously directed them to do.

Lately Archambaud, uncle and heir of Johan de Greilly, late the Captal, has shown that, although he holds the [noble] house of Puy-Paulin in Bordeaux by succession, in fee and inheritance, after the death of that Johan, who held the same in his lifetime by fee and inheritance, which house was the lord of Puy-Paulin's, and that both Johan, and all other lords who have held the house in fee and inheritance from time out of mind, have been burgesses of Bordeaux in right of that house; nevertheless by colour of certain letters patent of Edward [III], late king of England , the king's grandfather, made on 30 September 1375, which granted that no noble ( generosus ), knight, or others reputed to be noble, should be burgesses of the city, and the mayor, jurats and good men have been attempting to remove Archambaud's rights to burgess status, and he requested remedy.

The king, by his council, has deliberated on these letters enrolled in the chancery rolls of his grandfather, and it was found to be quite clear that the grant referred to nobles, knight and others reputed to be nobles being barred from claiming burgess status from that 30 September onwards, and not to those who were already burgesses, or their heirs. The king, therefore, ordered the mayor, jurats and good men, that if Johan de Grailly, and all other lords who held the house of Puy-Paulin in Bordeaux, in fee and inheritance, by that possession held the status of burgess of Bordeaux, and that status pertained to the house, then they were to permit Archambaud to enjoy that status, with all that pertains to it, just as Johan, and others before him enjoyed it, without impediment, just as the inspection of the rolls found. Now Archambaud has informed the king, that notwithstanding his order, they have continued to impede him from enjoying the status of burgess, and he has again requested remedy. 1

Order to John de Stratton, Landirans lord of Landiras , constable of Bordeaux , to account with Pomers Johan [de] Pommiers, Lescuyn lord of Lescun , seneschal of the Landes , for what is owed to him for the wages of the men-at-arms that he has employed, making allowance or payment for what is found to be owed to him, from the profits pertaining to the king in the Landes , or from other revenues of the king. He is to receive from Pommiers letters of acquittance for the allowance or payment, by which testimony, and by the testimony of the controller of Bordeaux , the constable is able to have due allowance in his account at the exchequer.

On 18 February 1381, by his letters patent, the king appointed Pommiers as seneschal of Landes, during pleasure, taking the customary fees in that office. Afterwards, the king, by other letters patent, and with the assent of his council, ordained that Pommiers should be able to retain twenty men-at-arms when he considers it necessary, to permit him to exercise various aspects of his office, going from place to place in strength. The men-at-arms are to be paid the customary wages, and the king wishes that the constable of Bordeaux account with Pommiers for those wages from time to time.

Order to the constable of Bordeaux to pay Guilhem-Ramon de Madaillan, Roazan lord of Rauzan , the arrears of the 50 l. annually granted him by the king, from 18 April, and the same 50 l. from then, each year, until Madaillan recovers the lands that he has lost, or the king grants him an annuity to the same value of the sum, according to the tenor of the king's letters. Order to Passepaire Master Guilhem Passepayre, the king's procurator in Aquitaine , that if he finds that Vagueys Pey de Baquey , monk of the abbey Sainte-Croix of Bordeaux was unjustly released from prison, then he is to be recaptured, and delivered to the abbot and vicar of Sancta Crux Burdegal' Sainte-Croix of Bordeaux , to be safely kept in their prison, until the king will ordain on his delivery. The king imposes perpetual silence on this, and no-one is to intermeddle in this on Baquey's behalf. The king orders the abbot and vicar, and all the judges, officers, servants and ministers of the king, to be intendant on, consult with, answer and aid Passepayre. Because it has been attested by faithful people that Baquey committed the crime of lèse-majesté there, and was accused, taken and committed to prison, having been unjustly released, the king does not wish him to go unpunished. 1

Grant of a licence to John Blakeney, citizen of London , that he can send the ships called la George of Jernemuth Yarmouth , and la Trinite of London , of which Cherche John Church , and atte Welle Adam Attwell , are masters respectively, loaded with red herring, one to Burdeg' Bordeaux , and the other to Baion' Bayonne , the ships not being arrested for the king's service before feast of the Purification of the Blessed Mary Virgin next. The king has granted this, because Blakeney has come before the king in chancery, and personally undertaken that the ships will return from the cities before the feast of the Purification next, to go in the king's service, unless the ships are delayed by strong winds or other misfortune. It is ordered that Blakeney be permitted to take the ships to those parts, without any impediments, first paying the customs that are due, whatsoever ordinances, statutes or orders to the contrary notwithstanding.

Grant, in honour of God, and at the request of both the mayor, jurats and community of Burdeg' Bordeaux , and of Sanctus Emilianus Saint-Émilion , by their letters, to the warden and brothers of the order of the friars minor of Sanctus Emilianus Saint-Émilion , of a certain place near the head of the Braneto bridge of Branet within the walls of the town, and which is adjacent to certain places granted to the same warden and brothers by certain lieges of the king, measuring two brachia ( brachiata ) in length and breadth, to aid them in the building of their church. They are to hold the same, to them and their successors, from the king and his heirs, by the customary service forever, and the king grants them a licence, in as much as he is able, that they can build their church with a bell tower in that place, with a house, cloister, offices, and other houses and enclosures that are necessary for them to serve God, without impediment of the king, his heirs, or their ministers.

The late Pope Gregory XI , 1 by his bull, granted the warden and brothers a licence, that since their church and residence had been destroyed by the rectors of the town to prevent it being captured by the enemy, that they could transfer within the walls of the town, and build a church and other buildings in a suitable there.

Order to the king's lieutenant or seneschal of Aquitaine, and all the king's magnates, and other liege subjects, officers and ministers, in Aquitaine, the Landes , Bigorre , and Agenais , to aid Anglada Pey d'Anglade, professor of the sacred page , archbishop of Auch , 1 in getting back peaceful possession of his city, diocese and province, so that royal authority can be increased, and so that the subjects and the city, diocese and province can return to their true obedience, and be punished by both secular and ecclesiastical power. They are to provide council, aid and favour to the archbishop against the antipope and schismatics, and to provide armed power to put him in possession of his city, diocese, castles, places, jurisdictions and provinces, and to repel and take his adversary, and to compel all to be obedient to Pope Urban VI , taking and detaining persons, and by occupying and confiscating their places, castles, lands and goods, carrying this out according to the proceedings and sentences from the pope as well as the royal orders published elsewhere.

Anglade, in a petition submitted to the king, complained that a major part of his cities and diocese and province of Auch are rebellious, and favour Robert [of Geneva] , 2 the antipope, and that a certain adversary, who has been sinisterly provided to the archbishopric by the antipope, is attempting to seize his province, by favour of schismatics, in prejudice of the Church and the pontiff, and in prejudice of the king. Anglade requests remedy against the rebels and schismatics, and to restrain their malice.

Grant of full power to Juan [Gutiérrez], Aquen' bishop of Dax , Rous Robert Roos, kt , the king's chamberlain , John de Stratton, lord of Landiras , constable of Bordeaux , and Master Waldeby Robert Waldby, professor of theology , by the consent and advice of the king's council, or at least two of them, of whom Roos should be one, to treat with Johan [II], count of Armagnac , for his coming into the king's obedience, and to keep him there, because he is a vassal of the king, and holds the county of Armagnac , and many other lands of his within the lordship of Aquitaine from the king, and on that account he is obliged to recognise the king as his liege lord, and serve him. They are also to ratify whatever treaties, pacts and agreements, made between the king and his council on the one part, and certain friends and well wishers of the count on the other part, or his proctors specially appointed by him with sufficient power to negotiate anew on these matters. Order to the farmers or other receivers of the profits and revenues of the prévôté of the Ombrière of Bordeaux , to pay to the la Trave Soudan de La Trau , 1 the arrears of his 200 écu annuity from 20 May 1381, and from thence each year for the Soudan's life, from the issues and revenue of the Umbrarie, Burdegal' prévôté of the Ombrière of Bordeaux , any gift or grant by the king's lieutenant or seneschal of Aquitaine, or other officers of the king there, to any person whatsoever, made before 20 May from the prévôté, notwithstanding. It is provided that the Soudan should not take anything from these issues and revenues until he has restored other letters of the king's father to the constable of Bordeaux to be cancelled.

On the 20 May 1381 the king granted to the Soudan at his request, because he could not receive payment of an annuity of 200 écu granted to him by the king's father, that he should take 200 écu each year from the profits and revenues of the prévôté from the farmer, assessor or other receivers of profits and revenues, for all the Soudan's life in compensation for the annuity, notwithstanding any other gifts or grants of the same, provided that the Soudan has restored the letters of the king's father. Previously, on 1 January 1357 the king's father, 2 having regard to the good service that the Soudan had done in various places in Gascony, and most particularly at the battle of Poitiers in which he was assigned to the bodyguard of the prince, granted, by his letters patent, to him 200 gold écu of rent a year to be paid to the Soudan or his attorney at Easter and Michaelmas by equal portions from the first issues and revenues coming from money struck in the city of Burdeg' Bordeaux . The sum was to be paid before all other gifts and assignments on it, and notwithstanding all other gifts and assignments made on the same. 3

Order ( volumus ), made in deliberation with, and by the advice of the king's council, that since Edward [of Woodstock], late prince of Aquitaine , the king's father, only held the title of prince of Aquitaine for life, the grant that he made to Ramon-Bernat [III], lord of Castrum Novum de Tursan Castelnau-Tursan of an annuity of 200 l. from the Guissen fishery ( naasse ) of Guiche , could not be made beyond the prince's own life, since Ramon-Bernat had not obtained a confirmation from Edward [III], late king of England , the king's grandfather; and since the grant of the same fishery by the prince to Guiraut de Tartas, lord of Puyan Poyanne was confirmed by the late king, then it appears to the king and his council that Tartas's heirs of his body should hold the fishery after the death of the king's father free of the payment of the 200 l. annuity to Ramon-Bernat, and that they should continue to hold the fishery according to the tenor of the grant by the king's father, and the confirmation by the king's grandfather, and Ramon-Bernat should remain perpetually silent on this matter.

On 18 August 1369, the king's father, 1 by his letters patent granted to Ramon-Bernat, for his good service, each year during his life 200 l. of the king's father's money then current, to be taken from the issues and profits of the fishery of Guiche which was then the king's father's, from the hands of those who then held the nasse, until the king's father provided Ramon-Bernat with lands or rents to the same value. Afterwards, on 1 January 1372, the king's father, by his letters patent, and his special grace, granted the same fishery in the land of the Landes to Guiraut de Tartas, and the heirs of his body, for Tartas's good service, with its profits and emoluments. He was to do liege homage for the same, and render to the king's father, and his heirs, one falcon each year in the Burdeux castle of Bordeaux , at the feast of All Saints. On 19 March 1372 the king's grandfather confirmed the grant to Tartas, saving to his and his heirs homage, sovereign lordship and resort; and the king similarly confirmed it on 6 September 1381. Now Ramon-Bernat has shown the king the confirmation made to him by the king in his fourth year of his grant, and has requested letters executory to the heirs of Tartas for the payment to him of the arrears of the 200 l. from the time of the death of the king's father. 2

The king wishes that the tenants of the houses, lands, tenements, rents and vineyards which belonged to the Coloms, except the market and lands of Bessan, should be compelled by the seneschal of Gascony, constable of Bordeaux, and the mayor and under-mayor of Bordeaux , or their lieutenants, whom the king has appointed as his commissioners concerning the gift to the Soudan by virtue of his letters under the great seal, by arrest of their bodies and goods, and under the penalty of the forfeiture of all that they are able to forfeit to the king, to surrender to the Soudan, or his proctor, whatever they possess in the houses, lands, tenements, rents and vineyards, removing their right of appeal. If the houses, lands, tenements, rents and vineyards exceed the annual value of 1,500 l. , then the Soudan, after he has possession, is to answer for the surplus to the king and his heirs at the exchequer of Bordeaux to the constable of Bordeaux at the assigned times; and if it does not reach that value, then the king wishes that the deficiency is made up by the seneschal of Gascony and constable of Bordeaux from an assignment elsewhere on a suitable place, for all of his life, until the Soudan recovers his lands and inheritance, and those of his wife. The king further grants, that if the lands, tenements, rents, vineyards and lordships with their appurtenances which were the Coloms', excepting the market and land of Bessan, are put out of the hands of the king and the Soudan, in part or in total, then he should have other lands and tenements elsewhere in the lordship of Aquitaine in suitable places, for his life, until he recovers his lands and inheritance, and those of his wife, up to the value of those houses, lands, tenements, rents, vineyards and lordships that have been put out, up to the value of 1,500 l. , to be assigned by the seneschal of Gascony, and the constable of Bordeaux.

On 12 August 1380, the king, by his letters patent under the great seal, granted to the Soudan, for his good service, and because he had lost in the present war his land and inheritance, and those of his wife, to the value of 1,000 l. , the lands and tenements that were Galhart Béguey, and which had been confiscated into the king's hands, up to the value of 1,500 l. per annum of money current in Aquitaine; holding the same for life, until he recovered his lands and inheritance, and those of his wife. The king wished his lieutenant in Aquitaine and the constable of Bordeaux, to assign the up to the value of 1,500 l. , from the land and other possessions which were Béguey's in the city of Bordeaux, and in the banlieue of the same place. If the king restores Béguey's lands, then they are to provide the Soudan with other lands to the same value. On 18 May 1381, the king, by other letters patent, granted to the Soudan for the term of his life, for his good service, for his losses, and to provide greater security, in case the lands and tenements granted in the previous grant were recovered, the lands, tenements and vineyards which were Johan Colom's in the Gravis Burdeg' Graves of Bordeaux , and the Inter duo Maria Entre-deux-Mers , and the house, lands and tenements with appurtenances which were Columb Amaniu Colom's in Bordeaux and the Burdegalesio Bordelais , which were confiscated into the king's hands by Johan de Colom's forfeiture, up to the value of 1,500 l. per annum, holding the same until he recovered the land of his, and his wife's inheritance which have been lost, notwithstanding gifts made by the king's lieutenant and seneschal of Aquitaine, or by others of the king's ministers. The king also grants them a licence to rebuild and repair the fishery, and to hold it to them and their heirs, from the king and his heirs, rendering to the king and his heirs by the constable of Bordeaux, the rent of 15 l. each year forever, in the ancient manner that the rent was accustomed to be paid.

The children lately had all the right and dues that the heirs of Villa Per-Arnaut de Bielle, late citizen of Bayon' Bayonne , had in the fishery, from those heirs, paying the rent of 15 l. of money then current at Bordeaux, on the first Sunday after Easter ( dominica in clausum Pasche ) forever, just as Per-Arnaut's heirs were accustomed to pay it. However, the fishery is totally ruinous, and they are not able to repair it on account of the arrears of rent, and because they require a licence from the king to do so. They request that the king will remit the arrears, and grant them a licence to repair the fishery. 2

Assignment to the seneschal of Gascony and the constable of Bordeaux, and the mayor and under-mayor of Bordeaux , or their lieutenants, ordering them to compel the tenants of the houses, lands, tenements, rents, vineyards and lordships, which were Columbi Johan Colom, kt 's, and Columbi Amaniu Colom, kt 's, in Burdeg' Bordeaux , and in the Burdegalesia Bordelais , excepting those of the market of Bordeaux , and the land of Bessan, to give possession of the same to the Traue Soudan de la Trau , according to the tenor of the king's letters granting the same to him. It is provided that if the annual value of the houses, lands, tenements, rents, vineyards and lordships is more than 1,500 l. , then the Soudan is to answer for the excess after he has possession, to the king and his heirs, at the Bordeaux exchequer, to the constable of Bordeaux, each year at the customary terms by equal portions. If they are less than that value, then the seneschal and constable are to make up the deficiency until the Soudan recovers his inheritance, and that of his wife. If the houses, lands, tenements, rents, vineyards and lordships are subsequently granted to another, excepting the market and land of Bessanum Bessan , then the seneschal and constable are to compensate the Soudan with other lands and tenements elsewhere in Aquitaine to a similar value, for his life, until he recovers the inheritances.

Lately, the king, with the assent of his council, by his letters patent, granted to the Soudan, all the houses, lands, tenements, rents, vineyards and lordships, with their appurtenances, which were Johan Colom's, and also those that were Amaniu Colom's, in Bordeaux, and in the Bordelais, excepting the market of Bordeaux which the king had granted to the citizens and law-worthy men of the city , for a certain term, and the land of Bessan granted by the king to Stretton' John de Stratton, lord of Landirans Landiras , for his life, which had forfeited into the king's hands from the same Johan de Colom; to have and to hold to the Soudan for his life, with the profits, emoluments, and all the other dues pertaining to the houses, lands, tenements, rents, vineyards and lordships, from the king and his heirs by the customary service, in satisfaction of a 1,500 l. annuity of money then current in Aquitaine, until the Soudan's lands both of his own inheritance, and of his wife's are recovered, any grants or confirmations made by the king after the 18 May 1381, or by his lieutenant or seneschal of Aquitaine, of the same houses, lands, tenements, rents, vineyards and lordships, excepting the market and the land of Bessan, notwithstanding, just as more fully appears in the king's letters. Grant by John, lord Neville , lieutenant of Aquitaine , to Florimont, lord of Lesparra Lesparre , and to his heirs, for his good and agreeable service to the king and the prince, now deceased, in their wars, and to the king, of all the land, with all the dues, rents, revenues, profits, issues, questes , charges, villeins ( hommes questaux ), fenaciers , and all other things, which Lebret, de, Leguoyran Bérart [III] d'Albret, lord of Langoiran , 1 in the jurisdiction and lordship of Medouc Cussac in Médoc , the which land was in the possession of Marque, la Gassion de Lamarque , during his lifetime, and was held by homage from the lord of Lesparre, and his predecessors. And also the places of Troussans Troussas and of Deminars , which was in the padier de Landest in the Carquans parish of Saint-Jean de Carcans , which Bérart d'Albret, lord of Langoiran, enemy and rebel, in his lifetime claimed to have right. All these rights have been seized by the king because of Albret's rebellion.

It is ordered to all seneschals, judges, prévôts, mayors, under-mayors, bayles, castellans and executors, and all other justices, officers and ministers of the king, that they suffer the lord of Lesparre, and his heirs, to have possession forever. It is further ordered to all the villeins, fenaciers and tenants, that they obey the lord of Lesparre, and his heirs, and pay and make the rights, dues, rents, and services, that were accustomed to be done to the lord of Langoiran, and to Gassion de Lamarque, and to their ancestors, before they were rebels and enemies of the king, and maintain him in the same, notwithstanding all other gifts made by the king, which the lieutenant revokes. The lord of Lesparre, or his proctor or attorney is to make homage to the king, or to the constable of Bordeaux, or his lieutenant.

The king ratifies the gift and grant of the lieutenant of all the premises to Florimont for the term of his life. 2

Grant and commission of full power and authority to Lescrop' William Scrope, kt , to whom the king has committed the office and governance of the seneschalcy of the duchy of Aquitaine, to:

  1. To receive and admit to the king's peace whatever enemies and rebels who wish to come back into his obedience, pardoning, acquitting and remitting to whatever persons of whatever nation, whether they be English , Welsh , Scottish , Irish , French , Gascons , and Guyennais ( Gyenensibis ), for the honour and profit of the king, all manner of criminal cases and lèse majesté, robberies, arson, pillage, murder, rape and other criminal cases whatsoever, committed before this time.
  2. To revoke all manner of grants of the king's revenues in the duchy without authentic authority and confirmation of the king's letters.
  3. To grant and permit wine to be brought from the Haut-Pays ( Alta Patria ), 2 as far as Bordeaux, paying an imposition to be set by the advice of the king's council there, in aid of the war; saving only the privileges of the country there if they have anything contrary to this.
  4. To supervise the profits and revenues of the king there, both past and future, and compelling the king's officers to account for these profits and revenues if necessary.
  5. To impose tallages and impositions, by the advice of the king's council there, and the community of the same, the same to be applied for the salvation and defence of the country.
  6. To remove, for reasonable causes, inadequate officers who do not have letters patent of the king's appointing them for life, and to replace them with other adequate and suitable officers by the advice [of the council there], the appointment of the constable and mayor of Bordeaux only excepted.
  7. To demolish, by the advice of the king's castle, all manner of fortalices which cannot be defended, and especially those that have been recaptured from rebels, the fortalices that are part of the king's patrimony only excepted.
  8. The seneschal and his lieutenant, wherever they are in those parts, are to exercise justice, both high and low, and complete and shared jurisdiction of rebels in criminal cases and lèse majesté, and also over robbers, murderers, rapers of women, violators of Holy Church, breakers of truces and safe-conducts, and of other malefactors of whatever status and condition, according to the nature of the cases.
  9. If any town or castle is captured, and is put back in the obedience of the king, then the constable of Bordeaux is to be compelled to provide the necessary victuals for the garrisoning of those places, by the advice of the king's council in Bordeaux.

The king promises to ratify whatever the seneschal does by virtue of this grant of authority and power.

5 June 1383 . The in palacio nostro Westm' palace of Westminster . For the doing of justice [in the dispute] between the lord of Lesparre and Bertrucat d'Albret concerning the castle of Vertheuil.

Commission of power to Scrope and the others, or to three of them at least, to call before them Lebret Bertrucat d'Albret , or his proctors, and also all others whom they consider ought to be called, and examine the rights of Florimont, lord of Lesparre , examining his charters and evidences concerning his claim to the Vertuyl castle of Vertheuil , and doing full and speedy justice both to Albret and Florimont, just as according to the examinations, and the laws, fors and customs there ought to be done. Scrope and the others, or three of them at least, are ordered to attend to this business diligently and speedily.

Lately, the king granted to Albret, for his good service, and in aid of his expenses which has had sustained in the king's wars, the castle of Vertheuil, with its appurtenances, which was the Logoiran lord of Langoiran's , holding the same for his life from the king and his heirs, by liege homage, for the customary service. Afterwards the king ordered Greyly Archambaud de Grailly, the Bogio captal de Buch , late the keeper of that castle, to deliver it to Albret, or his attorneys, just as the king has found by inspection of his chancery rolls. Now Florimont, has complained bitterly to the king that the castle and its castellany are his rightful inheritance, just as appears by true evidences and public charters which Florimont has in his possession, and his grandfather and father were in full possession of the same until the grandfather of the lord of Langoiran, by cunning took the castle, expelling Florimont's father. Since that time a state of war has existed between Florimont's father and the grandfather of the lord of Langoiran, and subsequently between Florimont and the father of the lord of Langoiran. The lord of Langoiran then went over to the French, and people and friends of Florimont recovered the castle by power and force, and at the great cost of Florimont, but Nevill' John de Neville, then lieutenant of Aquitaine , put the castle into the hands of the captal, though he had no claim to the castle, and while Florimont was a prisoner in chains in Castelle Castile , his wife sought recovery, the castle being detained by the captal, and subsequently by Albret, by virtue of the king's letters patent, to Florimont's manifest disinheritance. Florimont requests that out of justice the king will restore the castle and castellany to him, and the king wishes justice to be done, both for himself and Albret who holds the castle by the king's gift, and to Florimont.

Grant to Sparre, la Florimont de Lesparre , because he has surrendered earlier letters of the king into chancery to be cancelled, and in aid of the payment of his ransom, of 20,000 Francs which Shakel John Shakell, esquire , is bound to pay to the king for the interest of the king, and of his father and grandfather, in the ransom of the Dene count of Denia , or for the deliver of his son, a hostage in his place, to be taken as a gift of the king from Shakell, either in one lump sum if the ransom is paid all at once, or in portions, if it is paid in two instalments, Shakel being permitted to take 2,750 m. first from the payment. If Florimont is released without the payment of his ransom, then he is bound to repay any sums that he has received from Shakell. The king further orders the treasurer and chamberlain of the exchequer to deliver 10,000 francs from the treasury to Florimont, to be repaid to the king by Florimont in the future.

By a certain agreement made by indenture between the king and Shakell concerning the ransom of the count of Denia, who was a prisoner of the same John, for the ransom of which the son of the count resides in Shakell's possession as a hostage, Shakell agreed and granted to the king, amongst other things, that for having the interest of King Edward [III] , the king's grandfather, and Prince Edward , the king's father, and of the king himself, in the count or his hostage, he would pay 20,000 gold Francs, so that if he received the ransom in one whole sum he would pay the king the entire 20,000 Francs, and if he received the ransom in two instalments, he was to pay a proportion of the 20,000 francs at each term of payment of the ransom according to the quantity that he received. It is provided that from the first payment that Shakell received for the ransom of the count, or the delivery of the hostage, he would take 2,750 m. for his own costs, and those of the hostage. Shakell also granted to the king another 20,000 gold Francs received by the Foiz count of Foix from the ransom, and existing in the hands of the count of Foix. Florimont, in the time of the truce was captured by the Spanish at sea, and was taken to Spain, 2 and kept in prison for a great time, but has now been released by the Spanish enemies to organise his ransom, and on the 8 March 1381, the king granted to Florimont, in aid of the payment of his ransom, 10,000 gold Francs to be taken from Shakell from the 20,000 Francs which he is bound to pay to the king for the interest of the king and his father and grandfather, and also from the 20,000 Francs in the possession of the count of Foix. 3

Pardon, by the king's special grace, to Naudinotus, Virac Naudonet de Birac, esquire , of the lordship of Aquitaine, of suit of the king's peace for residing in and his association in the subjection and obedience of the king's adversary, and also of all excesses, forfeitures and corporal punishments, both criminal and civil which he has incurred, granting to him the king's firm peace, restoring him to his goods and good name. The king imposes silence on his proctor of Bordeaux, and all others who have an interest in the matter, in perpetuity. It is provided that if the king has granted any of the goods and inheritance of Naudonet to others before the making of these presents, and also confirmed that gift, then the king wishes that the grant, to whomsoever it is made, should remain in force.

The king has granted the pardon at the request of Lebret Bertrucat d'Albret who has brought the land of Langoiran back into the king's obedience, Naudonet having submitted to the king's adversary's obedience there because of the strength of the king's enemies, to save himself and his goods.

Grant by Edward [III], king of England and France , to Bertran [I] , lord of Mons Ferandi Montferrand , of 200 m. to be taken each year from the issues of the duchy for him and his heirs, until Bertran or his heirs are provided with 200 marks worth of land and rents each year in a suitable place in the duchy, in fee and inheritance, by the king or his heirs.

The king has made the grant because the king formerly granted to Bertran a moiety of the land of Verines Veyrines , which had come to the king's hands by the forfeiture and rebellion of Duro Forti Galhart [I] de Durfort , but Bertran has restored this to Durfort at the request of Edward [of Woodstock], prince of Wales , 1 the king's firstborn son, and his captain and lieutenant in the duchy of Aquitaine, Durfort having returned to the king's obedience, has been restored by the agreement with the prince. The king has also made the grant because of Bertran's great and useful service to the king and the prince, and for the counsel and aid that he has given to the prince in the prince's direction of the king's business there, just as the prince has attested before the king and his council.

Order to Nonpar [I] de Caumont , of the lordship of Aquitaine, that having viewed these presents he cease all excuses, and under pain of the forfeiture of all that he is able to forfeit, deliver the castle and place of Caumont to Lebret Bertrucat d'Albret , or his attorney or proctor, he having the same, with its profits, commodities, emoluments and appurtenances, according to the king's letters granting him the same, and so that he has no reason to complain to the king again. Lately the king granted to Albret, amongst other castles, manors, lands and tenements, the barony, land and place of Caumont, to hold the same with the castles, fortalices, profits, lordships, commodities, emoluments and appurtenances pertaining to it, to him and his heirs male issuing from his body, from the king and his heirs, by the customary service, forever, any grant of the same by the king's lieutenants to the contrary notwithstanding. Now the king understands that Nonpar de Caumont detains the castle and place of Caumont, and he wishes Albret to have it.

Grant, by the king's special grace, to Radegonde Béchet, lady of Mortymer Morthemer , of the king's custom on wine called issac ( Ysshac ) for her life, with all profits and emoluments pertaining to it, because she has been disinherited of her lawful inheritance in those parts of Aquitaine, and has nothing to maintain herself on. It is provided that she is to satisfy all those who have received a grant of the custom, or any part of it, by the king's letters patent. 1

Grant by the king's special grace, and by the advice of the king's council, to Lebret Bertrucat d'Albret , in aid of the expenses that he has incurred in the king's service in Aquitaine, and in aid of paying his debts which he incurred in England when residing there, that, within the space of three years, beginning at the feast of St Peter ad vincula next, he is able to bring in each of those years, after Christmas, up to 1,000 tuns of wine from the Haut-Pays ( Alta Patria ), 2 which lands are in the hands of the enemy, by the rivers of Geronde Garonne and Durdoigne Dordogne , to Burdegal' Bordeaux , and then ship them to England. On one half of the wine Albret is to pay the tenth tun to the constable of Bordeaux, to the king's use, and the other dues and customs; and on the other half he is to be quit and totally discharged, saving only the liberties and privileges granted by the king and his progenitors to the city of Bordeaux, and other cities and towns, and their citizens and burgesses.

To the archbishops, bishops, abbots, priors, counts, barons, seneschals, justices, vicomtes, prévôts, ministers and all bayles and faithful subjects of the king.

Grant and confirmation, by the king's special grace, and by his charter, to Greilly Archambaud de Grailly, captal de Buch , that he and his heirs should have forever, each week in his land of Bogio Buch two markets, one on Monday at La Teste , and the other on Wednesday at Serte Certes , with all that pertains to each market, unless those markets are to the damage of neighbouring markets.

It is ordered that Archambaud and his heirs should have the markets forever on those days, and in those places, with all that pertains to those markets, unless it is to the damage of neighbouring markets.

14 June 1383 . Westm' Westminster . For Bernat de Caupenne.

Commission of full power to the seneschal of Aquitaine, the constable and Burdeg' mayor of Bordeaux , Master Ramon-Guilhem [de Puy] and Master Guilhem Boneu , or at least two of them, to summon the lord of Mussydan Mussidan , 1 and other occupiers and detainers of the land and rent of Caupena Bernat de Caupenne , or their proctors, before them at a certain day and place assigned by them, and hear and diligently examine the arguments, evidences and rights both of the lord of Mussidan, and other occupiers and detainers, that they wish to summon, and Bernat or his proctors. They are to do full and speedy justice to the parties, and if they find that Bernat does have a right to the land and rent, as alleged by his petition, then he is to be put in full and peaceful possession of the same land and rent, defending him in the same, and removing any detainers, just as reasonably ought to be done according to the fors, laws and customs there.

Bernat de Caupenne has requested remedy on his complaint to the king that whereas Ramon-Guilhem [II], lord of Caupenne , kt , his father, gave to him certain lands and rents in the lordship of Aquitaine, which lands and rents his father had peacefully held and possessed as his right and inheritance, until Bret, de la Bérart [I] d'Albret , late father of Bret, de la Bérart [II] d'Albret, lord of Ryons Rions , by power and force unjustly expelled the lord of Caupenne from possession of the land and rent, and are detained by the lord of Mussidan and other of the king's lieges of the lordship. The king wishes full justice to be done. 2

Commission to Lebret Bertrucat d'Albret, kt of full authority and sufficient power to receive and accept to the king's peace and obedience all those rebels who wish to return. He is to supply the names of those whom he has received to Lescrop' William Scrope, seneschal of Aquitaine , so that they can have charters of pardon, and remission of whatsoever forfeitures suffered by them for their crimes and rebellion committed against the king's majesty in the lordship of Aquitaine, and restitution of their goods and inheritances. The king wishes that the seneschal, by the power committed to him in other letters patent, is to make these charters of pardon for those signified by Albret, though gifts and confirmations that the king has made to others of their goods and inheritances before the date of these presents are to remain in force.

Letters of protection granted for one year to Jean Buffet , Eliotus, Berraud Eliot Barraud , Jean Roche , Caminus Pierre le Camus , Chauderer Pierre Chaudrier and Chauderer Bernard Chaudrier , burgesses of the town of la Rochelle, allowing them to come with two servants, their horses and goods in the kingdom of England and elsewhere in the king's lordship, because of certain business, and to peacefully return without impediment by land and at sea to the regions of Aquitaine, with the proviso that they behave well in England.

Grant, with the assent and by the advice of the king's council, to Mountet Bernat Montet, kt , that from the date of the making of these present letters, for the term of three years, he may take 12 d. in the pound by those for whom he is willing to answer, from merchandise passing through the Sanctus Makarius castellany of Saint-Macaire . Montet is ordered to take the 12 d. , and apply it to the repair of the fortifications of the castle of Saint-Macaire , and at the end of the term of three years he is to answer for the sums raised to the king by the constable of Bordeaux.

The king granted the castellany of Saint-Macaire to Montet for his life, with its profits and emoluments, but Montet, by a petition presented before the king and his council, on Montet's behalf, it has been complained that great parts of the walls of the castle have been destroyed by the king's enemies there, to the grave damage of the castellany and the country around. He is not able to repair and maintain the castle, and requests that the king grant him the 12 d. in the pound on the merchandise of the enemy passing through the castellany, in the same manner that Thomas de Felton, kt , had it when he held the castellany, and the king wishes to agree to this. 1

Grant for life by John, lord Neville , the king's lieutenant in Aquitaine , to Frodesham Gaillard de Frodsham , for the good service that he has done to the king, and his imprisonment and damage that he has sustained by the present wars, of all the lands, dues, rents, inheritances and possessions, and all the goods, both moveable and immoveable, which Niot Aiquart had at the time that he committed treason against the king in the jurisdiction of Fronssac Fronsac , and the Fronssadois Fronsadais , and elsewhere in the Bourdelois Bordelais , and which have forfeited to the king. It is ordered to Scrop', le William le Scrope, captain of Fronssac Fronsac , Libourne and Saint Melion Saint-Émilion , the constable of Bordeaux, the judge of Gascony , the Lombriere prévôt of the Ombrière , or their lieutenants, Prevost Guiraut Provost , Adam Diolande, burgess of Libourne , and Master Hélias Mat , 3 or two of them at least, to deliver the all the lands, dues, rents, inheritances and possessions, and all the goods, both moveable and immoveable, to Frodsham, or his proctor, and suffer him to use and enjoy them, according to the tenor of these letters patent.

The king accepts, ratifies, approves and confirms the contents of the letters, provided that both the land, taxes, rents, inheritances, possessions and goods, and all other lands, dues, rents, inheritances, possessions of households, and goods which Neville has granted to Frodsham, and which he holds by those grants, do not amount to more than 20 l.st. a year, and that he answers for any residue to the king by the constable of Bordeaux in case the same lands exceed the 20 l.st.
