Physical condition of the roll

The roll consists of twenty-nine membranes. There are entries on all of the recto sides, but on none of the dorses. The roll is generally in good condition.

C 61/107, 1 Henry IV (1399-1400)

Introduction.

This roll, the first of the reign of Henry IV, reveals how this king made specific efforts to ensure his control of the duchy after his coup in England in the autumn of 1399. On 11 May 1400, four highly trusted men were appointed as the king’s proctors to take possession of the duchy. As the relevant items on the roll show, their powers included full judicial authority, the taking of oaths from the king's subjects, and the pardoning of rebels as well as those who had acted against John of Gaunt. The four were the archbishop of Bordeaux, Francesco Uguccione, and three Englishmen: Hugh le Despenser, who had arrived from England with Nonpar de Caumont, seneschal of Agenais, and Galhart de Durfort, lord of Duras, seneschal of Aquitaine (who had been appointed to this post on 23 December 1399), with 60 men-at-arms and 60 archers; Henry Bowet, constable of Bordeaux and future bishop of Bath and Wells (being appointed to the see on 19 August 1401), and John Trailly, mayor of Bordeaux, who landed soon after. All of this showed the king's awareness of the delicate state of the duchy following local reactions to Richard II's donation to John of Gaunt, duke of Lancaster, and the latter's visit to the duchy. 1 A second group of men, including three of those appointed to take possession of the duchy (Durfort, Uguccione and Bowet), were also appointed to the high court of Gascony alongside four clerks from Bordeaux, three local lawyers, and the lord of Montferrand. The judge Guilhem Boneu, formerly out of favour (1388-9), was appointed to the office of judge of the criminal appeals in the court of Gascony. Several of these men were also members of the king’s council in Bordeaux, the four men appointed in May to take possession of the duchy being given authority to make such nominations.

In addition to the delicate political situation, we have to remember that at this point the duchy, since it lay within English dominions, was an isolated outpost of Urbanist obedience (i.e. under the Roman as opposed to the Avignon pope) during the Great Schism. In this context, the Italian archbishop of Bordeaux was as a highly valuable asset for Henry IV since he was a significant figure in European diplomacy. We also see from the roll that the clerk Henry Bowet and other proctors of the king had the task of dealing with the seizure of the goods of the late bishop of Dax arising out of his excesses as papal collector in Spain. 2 The Roman pope had appointed a Castilian clerk as bishop of Bayonne, but the latter had been expelled from his see by the city government. The new Lancastrian regime had to enforce allegiance in Bayonne in order to avoid possible rebellion: the city had been particularly reluctant to accept the authority of John of Gaunt, Henry IV's father, as duke of Aquitaine. 3 Many in the duchy had 'resisted fiercely' the prospect of separation from the English Crown under the rule of an English prince who was not the king's eldest son and heir 4 There can be no doubt therefore, that there was a potentially difficult inheritance for Henry IV in Gascony, as king and as Gaunt's son. His efforts at reassurance and reconciliation were notable, including the creation of his eldest son, the future Henry V, as duke of Aquitaine on 23 October 1399.

Many entries in this first roll of the new reign concern confirmations of grants given by John of Gaunt to men who have been Lancastrian retainers for many years, both Gascons and English: for instance, Arnaut Buade, from an important family of Bergerac (of which Gaunt had been direct lord thanks to a grant made by the Black Prince in October 1370); John Hull and Richard Boyton. 5 A wider and less ancient affinity had also been rewarded by John of Gaunt and was now confirmed by his son as king. But the new king did not forget those who had been liege men since the time of the principality of Aquitaine (1362-72). He rewarded, for instance, the Poitevin lady Radegonde Béchet, Per-Arnaut de Lamensans and the clerk William Langbrook. 6 As a new sovereign, Henry IV confirmed the earlier legitimization by his father John of Gaunt of a lineage of the Landes - the bastard Perrotin de Campet and his own bastards. 7 Many Englishmen were granted rents and properties in Gascony at this point too, no doubt as reward as well as to secure the English position. The most noticeable case is that of the constable of Bordeaux, Henry Bowet, who had benefices in England but who also acquired the lordship of Ornon. 8 In the past none of the constables of Bordeaux had ever tried to obtain Gascon lordships during their tenure of office. Bowet was also granted by the king numerous properties seized into the king's hands after 'rebellion' (i.e. the defection of their holders to the king of France). In reality, however, his stay in the duchy only continued until the summer of 1401 since he became bishop of Bath and Wells.

Henry IV also chose to trust a Gascon lord, Nonpar de Caumont, who had already been appointed seneschal of Agenais by Richard II, since this man from a junior branch of the powerful lineage of Caumont had been given a vast landed inheritance as well as places conquered, or to be conquered, from French supporters in Agenais. The king's appointment of Galhart de Durfort, lord of Duras, as seneschal of Aquitaine was much more unusual. 9 No Gascon lord had held this office since Amaniu du Foussat in 1318-9. Henry IV was undoubtedly trying to boost allegiance amongst the Gascons, and to rebuild confidence in the wake of the failure of Richard II's 'experiment' in the donation of the duchy to Gaunt.

Save for these matters of high policy, the roll concerns mainly local matters, and provides much useful material on landholding and local families. We find, for instance, a list of possessions in the district of Montgaillard held by a member of the gentry of the Landes (Arnaut-Guilhem de Marsan). 10 We also discover interesting topographical details on the environs of the castle of Ombrière in Bordeaux, particularly about the small shops and offices which lay in front of it. 11 The roll also mentions the first hospitaller of the new and important hospital Saint-André of Bordeaux (Johan Guibon). 12 In the city of Bordeaux, we find merchants originating from Germany living there as burgesses (Angermeier and Makenhagen). 13 This demonstrates the expansion of German trade in the Atlantic Ocean during this period. On this roll Henry IV confirmed an earlier grant to the 'worthy men' of Labourd which had been confirmed by John of Gaunt in 1395.This gave licence to the men of the parishes of Labourd to choose representatives for a judicial assembly. This was probably the origin of the bilçar (now written biltzar ) of Labourd (first known mention in 1567), the assembly of the parishes of Labourd which was in existence until 1789, and the origin of the militia of Labourd which existed in the 17th century. The grant also permitted these men to organise their own defence by forming a sworn league against evildoers. Fascinatingly, this was actually a hermandad (in Gascon armandat ) exactly as existed in Spain at this time. 14 At this time, two recipients of royal grants, Arnaud Guilhem de Marsan and Lop de Saint-Julien, were challenging each other for possession of the baylie of Labourd. Such a grant of the crown's property created difficulties for the inhabitants of Labourd, making them more determined to achieve their own rights.

The Mainwaring (pronounced 'Mannering') family owned the manor of Peover Hall situated in Over Peover (now in the civil parish of Peover Superior, Cheshire). There still survives the alabaster effigy in plate armour of William Mainwaring (d. c. April 1399), lord of Baddeley (Staffs.) and Peover, in the church of Acton (Cheshire). According to his petition (TNA, SC 8/126/6262), William served for over twenty years in Gascony. In the 1370's, William Mainwaring shared the leadership of a retinue with Philippot Elis within the pays of Bordeaux. Richard II made a life grant to Thomas Mewe 1 and John Warin, former valets of his chamber, of a basement shop under a tower in the castle of Bordeaux ( una bassa shopa sub quadam turri infra castrum nostrum Burdegale ) which had formerly been used for exchange, to an annual value not exceeding 9.5 marks. 2 This shop should revert to the king at their death.

Per-Arnaut has requested John of Gaunt to have, in exchange for the profits of the small seal and the hostages , the small baylies of Saint-Gein and Rondeboeuf situated in the seneschalcy of the Landes, of lesser value but more convenient since they are situated in his homeland and where he holds his land and inheritance ( quels sont au pais de sa nacion et out il a sa terre et son heritage ). As a result, Per-Arnaut and his son have returned into the chancery the letters patent of the Prince for cancellation. Gaunt grants these two baylies to Lamensans and his son for life.

Order to the constable of Bordeaux or the receiver of the Landes to receive the annual farm of the baylie of Labourd from its farmer or farmers, and to pay the amount of this farm to Lop, de Sancto Juliano lord of Saint-Julien and Saut Sault , for his lifetime, and after his death, to his son Johan for his own lifetime, Lop and Johan assuming the expenditure for ruling this baylie and the wages or expenses of its officers. On 15 April 1377, Edward III gave by his letters patent to Lop de Saint-Julien the baylie of Labourd for life without rendering or paying anything to the king. Richard II confirmed this, by his letters patent of the 21 July 1377, and also granted that Johan, son and heir of Lop, should receive this baylie if he outlived his father. But the inhabitants of the baylie of Labourd petitioned the king that this baylie had been united with the crown of England for a long time and they requested the king to resume this baylie into his own hands notwithstanding the grant to Lop. Then Lop petitioned the king to have this baylie for life, and after him his son Johan, for an annual farm paid to the constable of Bordeaux or the king’s receiver of the Landes. On 28 February 1381, the king granted by his letters patent, with the advice of his council, that this baylie be resumed into his hands, and ordered the constable of Bordeaux or the king’s receiver of the Landes to farm this baylie each year and to give the sum received each year to Lop during his life, and after his death to his son Johan, if he outlived his father. 1

Confirmation for 20 years, at the request of the king's subjects of Labourd, of ordinances 1 taken by the worthy men ( probi homines ) of the parishes of Labourd already confirmed by John of Gaunt, then duke of Aquitaine more than four years ago: 2

  1. First, the worthy men of Labourd are to be the king of England's liegemen, they will preserve for him his profit, honour, right and justice, they will avoid his damage and shame, and they will keep for him the land of Labourd by their loyal power;
  2. Item, these men have sworn to each other that when the king’s bayle ( baillif ) [of Labourd] will come [the first time] in Labourd, the people ( gentz ) of the parishes of Labourd who has to be summoned will be summoned, as it is the custom, and the king’s bayle will swear to them to rule them rightly as he should do, and the people of Labourd will have to swear obedience to him; and if the bayle does not want to swear this oath, these men have not to swear nor obey him until he swears this oath. And these men have to be allowed to appeal to the king, to the seneschal [of Aquitaine], the constable of Bordeaux or other king’s officers, always saving the king’s sovereignty;
  3. Item, they have sworn to each other, in life and death, to help each other against all persons wanting to cause harm to them in their bodies and goods, saving the king’s sovereignty and of his officers;
  4. Item, they have sworn to each other that if any son of a noble or another person from the land of Labourd perpetrates any robbery or another misdeed against the people of Labourd, whether the bayle is present or not, all the people of the said parishes have to pass judgment at their court, together with the bayle of Labourd or his lieutenant if it is possible, and they will have to come, together with the bayle or not, to where the malefactor is staying and they will capture him and force him to compensate for the damage and the insult; and if it happens that the malefactor or malefactors lock themselves in a noble house or another house on the land of Labourd, and the lord of this house allows to defend themselves or commit rebellion, in that case the bayle and the worthy men [of Labourd] will have to call for this lord to surrender to them the malefactor or the malefactors to carry out on them full justice; and in case that the lord who has taken in the malefactor does not want to surrender him to the lord, 3 then the bayle with the said men are allowed to fight or take by force this house and capture the lord of his house and the malefactors, and they are allowed to make full justice against them; and if the malefactor flees the land [of Labourd] and owns goods and things in the land of Labourd, these goods and things should be used to pay the damage, and the surplus be seized for the lord; 4
  5. Item, the said men have sworn to each other that if any armed man ( lacaye ) or esquire, or another person who appears to be of ill-repute, and are alien or suspicious, comes to the land of Labourd and remains there for three of four days, he has to be expelled outside this land unless a noble or another person from the land of Labourd presents warranty for him; and if after that this alien commits robberies or other crimes in the land of Labourd against its men, then these men and the bayle have to compel though justice the man who has served as security to this alien; and if the man who served as security wants to sentence this malefactor, he has to publicly denounce him to the lord 5 or in the parish church during a feast day were the main part of the people is gathered to hear the divine service, and if he does not do it he will be considered as responsible for the crime and held to be guilty;
  6. Item, they have sworn to each other they are to choose each year two worthy men ( prodomes ) per parish to be summoned in court by the bayle three times a year, to enforce this ordinance. These worthy men will have to swear to the lord 6 that they will behave well concerning the execution of this ordinance;
  7. Item, the said men have sworn to each other that if there is pillaging or robbery or any other crime in some parishes of the land of Labourd, then the two worthy men have to meet the bayle to inform him about it, they have to request him to immediately go to the malefactor or the malefactors and capture them and make justice about their crimes; and if it happens that the bayle or his lieutenant have not enough power, might or force 7 to pursue the malefactor or the malefactors, the men of the land of [Labourd] have to gather together from all the parishes of this land, they have to follow the bayle or the sub-bayle and they will go where they want to go, in order to capture the said malefactor or the malefactors, and to do justice on these crimes.
  8. Item, the said men have sworn to each other that in case of death, robbery, pillaging, prison or any other wrong committed in any part of the land [of Labourd], and the bayle is not close to this land or present there, and the bayle cannot capture the malefactors with these men, in this case the same men, or a part of them who will be gathered as soon as possible, be allowed to capture, seize and tie up the malefactors, without beating or hurting them if it is possible and if they do not resist, and bring them to the bayle or his lieutenant, in order to do justice.
  9. Item, the said men have sworn to each other that the present ordinance will be not prejudicial to the king [of England], or his jurisdiction, his sovereignty, his jurisdiction and lordship, or his lands and duties.

Confirmation and approval in perpetuity by Gaunt of the donation made by Duyre Rosa d'Oeyre , daughter and heiress of Duyre, Saint Pier Bertrucat d'Oeyre called [de] Saint-Pé , of the house of Saint-Pé of Sendos Juson Saint Pier Desendos Jusom 1 and its lands to Decosin Johan de Cousin, mayor of Dax , Cousin being allowed to buy any right from other heirs ( heritier ou prim ) of Bertrucat, notwithstanding that Bertrucat or these heirs were rebels and that this house and their other goods had been confiscated by the king. Gaunt grants Cousin this house of Saint-Pé of Sendos Juson with all its lands and rights, Cousin having to pay liege homage to Gaunt. Gaunt orders the seneschal or the receiver of the Landes and all his other officers in the seneschalcy of the Landes to deliver to Cousin or his proctor the possession and farm of the house of Saint-Pé of Sendos Juson with all its rights, appurtenances and some other lands situated in the Yregave parish of Oeyregave , and permit him to enjoy it peacefully. Cousin petitioned Gaunt that this house and its lands was owned by Bertrucat d'Oeyre called [de] Saint-Pé and was seized by Richard II, because of Oeyre's rebellion, and thereafter, this house and its lands were granted for life by the king's officers to someone called Pépet who had since died. Since his death, Rosa d'Oeyre, Bertrucat's daughter and heiress, who lives in the land and power of the Labret lord of Albret , 2 had granted this house and lands by public charter to Cousin and his heirs. Cousin requested Gaunt to have the right to buy or acquire any rights on this house and its lands owned by any other heirs, even if king's rebels, and to be granted this house and its lands, notwithstanding any grant of it by the king's officers, or Gaunt's officers who do not have enough power to grant them in such cases.

Confirmation of the judgment by Beck Anthony de Bek, bishop of Durham 20 commissioned by the king to hear and judge the lawsuit between Jean [I] de Grailly, kt , and Mota Amaniu de Lamothe, damoiseau , as Grailly claimed homage from Lamothe for his possessions in Langon and its district, and Lamothe asserted that he held most of them directly from the king, and this case was sent to the king's cognizance: 1) Lamothe delivered to Grailly his share of the toll of Langon, half of it being held from the king, the other half from Grailly, 2) Idem, Lamothe delivered to Grailly 18 d. bord. on the issues of the petty justice ( parva justicia ) of Langon; 3) Idem, his rights on another 18 d. on the same justice paid to Russeli Jean Roussel, kt , on behalf of his wife Clarmunda Clarmont[de Lamothe] ; 4) idem, he delivered the fief of Bailhey Baillet ; 5) idem, Lamothe had to assign to Grailly, within two years from the following Michaelmas, a rent of 60 l.bord. in full property ( in allodio ), or pay him 1,200 l.bord. , paying in the meantime 60 l. , any difference between them about this assignation being settled by Mirallo Ramon du Mirail, constable of Bordeaux , 21 and Ferrariis Ramon de Laferrère, clerk , etc.; 6) idem, Lamothe delivered to Grailly the oath that the judge ( justiciarus ) of Langon made to him to pay his fourth part of the issues of the petty justice ( parva justicia ), that is 18 ds. , and he swore to obtain from Scossam Bernat d'Escoussans, damoiseau , to deliver to Grailly the oath of the same judge for another sum of 18 l. , etc.; 7) In return Grailly discharged Lamothe of any claim about his homage. And Grailly acknowledge that he held from the king half of the toll on the crude iron that Lamothe held in Langon.

Confirmation to Johan [III] de Grailly, captal de Buch , of the king's rights granted on Benauges , Illats , the salin of Bordeaux, the castle of Castillon, Gurson, etc., and a further grant for his good service of the full and shared justice on these possessions as they were held by Pey [II] de Grailly , his grandfather, vicomte of Benauges and Castillon , without any impediment from the king's officers.

Approval and confirmation of the sale of the noble house of Campet by Johana de Campet to Perrotin de Campet, esquire , his bastard brother from a married man and a married woman. Gaunt legitimates Perrotin and his bastard children, and permits them to succeed to Perrotin's goods. Gaunt orders to all his officers to permit Perrotin and his children to enjoy without impediment this grace granted by him. Gaunt has heard the supplication of Perrotin according to which he bought the noble house of Campet from his sister Johana, owner of the place of Campet, with the agreement of her husband Arnaut, lord of Lartigue , of the guardians of Arnaut de Lartigue , their elder son ( filz primer ), Johan and Siot , 1 brothers of this latter. As Perrotin does not have a legitimate son, but has some bastard sons from a married woman, he requests Gaunt to permit his children to succeed him and to be his heirs to this place of Campet and his other goods, notwithstanding their bastard status, to legitimate them and to permit them to inherit from each other by will or otherwise.
