Gascon Roll for the 3rd year of the reign of Henry V

Physical condition of the roll

The roll consists of five membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/116, 3 Henry V (1415-1416) .

Introduction.

This short roll of five membranes deals largely with confirmations of acts issued by the king's father, in common with the first two rolls of the reign of Henry V. Hence the powerful Navarrese lord Carlos de Beaumont, who was to serve on the Agincourt campaign, gained confirmation of several lucrative grants, ¹ particularly the toll levied on the river Adour at Guiche, despite earlier opposition in 1413 of the community of Bayonne in alliance with other communities situated on the course of this river. ² Similarly Bernat de Lesparre, lord of Labarde in Médoc, one of the principal lords of the Bordelais, was confirmed in several grants made by Henry IV, Richard II and John of Gaunt. ³ The confirmations of Henry IV’s grant of a yearly rent to Bérart de Montferrand (1405) and the grant of the Basque hospital of Ordiarp to the chaplain Bernat de Sault (1407) are example of acts relating to Gascony which had not been copied into the Gascon rolls corresponding to these years. This demonstrates that not all of the acts concerning the duchy of Aquitaine were routinely copied into the Gascon Rolls. ⁴ The influential Master Pey de Prieret, procurator fiscal of the duchy, after payment of 40 s. to the hanaper, gained confirmation that his two sons would have the writing office of the court of Gascony after Prieret’s death. ⁵

During a period where he was present at London in May-June 1415, the merchant of Bordeaux Bénedeyt Espine obtained a wine tax as recompense for the gold and wine he had given to two servants of Henry V when the latter was prince of Wales. He was also granted the office of the keepership of the seal and counter-seal of Bordeaux. ⁶

The king also rewarded the seneschal of Aquitaine Galhart II de Durfort, one of his die-hard supporters. Durfort obtained the house of Livran which had been seized from the daughters of Fauquet de La Trau who appear to have married men of the French party, ⁷ He also seized the large and strategic lordship of Lesparre (in Médoc) from its rightful heiress and from her mother and tutor Johana d’Armagnac, first cousin of count Bernat VII d’Armagnac, who became constable of France after the battle of Agincourt. ⁸

On 8 May 1415 the English knight John Tiptoft was appointed seneschal of Aquitaine, replacing the lord of Duras who had been appointed in 1399. A position he was to hold for the whole of the reign of Henry V (and indeed to 1423), even though he was also involved in the king's second campaign to Normandy between 1417 and 1420, and was to hold office in that duchy too. He crossed to Bordeaux with 480 troops in mid August 1415 but returned to England in the following December. ⁹ Several Englishmen and Gascon accompanied the new seneschal to Aquitaine, obtaining letters of protection. ¹⁰ The sending of a small army around the same time as Henry's large army set out for northern France in the summer of 1415 in often overlooked, but it stands as evidence that the king did not ignore the duchy in his French plans. That said, there is nothing to suggest that Henry intended to visit Gascony in person as part of his 1415 campaign.

Worthy of note are the letters of marque obtained by two merchants of Bordeaux and two Englishmen against all the goods of merchants of Brittany who were in the duchy. ¹¹

Appointment, at the king’s pleasure, of Tiptot John Tiptoft, kt , as seneschal of the duchy of Aquitaine, receiving the wages agreed in the indenture made between him and the king, with power to receive the allegiance of the king's subjects and to judge civil and criminal cases as did former seneschals, and with power to grant remission except in cases of rebellion, to remove and to appoint officers except the mayor of Bordeaux, the constable of Bordeaux and persons having office for life; with cognoisance of trials by battle, power to appoint notaries in the duchy and two or three general serjeants. ¹

Grant for life to Bernat de Lesparre, la Barde lord of Labarde , because of his service to the king and the crown of England, and by deliberation of the king's council at Bordeaux, of 120 gold crowns each year to be received from the tithe of the first wines that he brings, in his own name or in the name of others, down the river Dordonha Dordogne from the Alta Patria Haut Pays , entering into the town of Leybourne Libourne or passing by it. This grant is given in compensation for the office of Lombrere prévôt of the Ombrière of Bordeaux Lesparre had obtained from Hugh le Despenser and Master Henry Bowet when they were commissaries of the king ⁵ in the duchy of Guyenne; an office that has since been given by the king to Dartasso Juanico de Artaso . Lesparre or his proctors may receive this payment from the receiver of this tithe, but neither the latter or others are to impede Lesparre or his proctor in the matter of this tithe. ⁶

Allocation to Bernat de Lesparre, kt , la Barde lord of Labarde , Dagenes seneschal of the seneschalcy of Agenais of 100 l.st. of England for his fees as seneschal, to be received by him at Agulhon' Aiguillon from the customs and tithe of the wines of the Alta Patria Haut Pays passing through Aiguillon, coming upstream and going to Bordeaux, notwithstanding that the constable of Bordeaux or his lieutenant are accustomed to receive this custom and tithe at Bordeaux . The constable of Bordeaux and his lieutenant must leave in peace the merchants and other persons having letters of acquittance from Lesparre or his proctor. The king had learned that the Bathon', Wellen' bishop of Bath and Wells ⁸ and the late Hugh le Despenser, kt , ordered, when they were ambassadors and commissaries( ambassatores et commissarii ) of the king in Aquitaine, to pay 100 l.st. of English money to Bernat de Lesparre for his fees as seneschal of Agenais, but Lesparre was not able to obtain them to pay his significant expenses. ⁹

Order to the seneschal of Aquitaine, the constable of Bordeaux, the mayor of Bordeaux, the [fiscal] procurator and consuls of the city of Bordeaux, to deliver to Edmund de la Pole, esquire , the monies mentioned there. The late Edward [of Langley], duke of York and Henry IV’s lieutenant in Aquitaine had granted for life to Master Langbroke William Langbrook all right to the monies which the king had and customarily received at the castle of Bordeaux by reason of the fronds of cypress which ships or their masters or merchants carrying wines in those ships along the river banks of the Garone Garonne or Gironde and especially in the port and castle of Bordeaux were licensed and assigned to have by custom, to attest payment for these wines, ¹ and these monies having been restored to the king, the said letters having been cancelled in chancery, so that Edmund de la Pole, esquire, can have the king’s right to the monies, the king has granted them to Edmund to have and hold for his life, exactly as specified in the said letters to William.

1.: It was a local tax levied on the wines loaded on the banks of the river Garonne. The fronds of cypress probably came from the cypress wood of the Cypressat (in commune of Cenon).

Order to the constable of Bordeaux, to pay to Spin Bénedeyt Espine, merchant of Bordeaux , the sums of money owed to him from the tithes and customs of the first wine coming to Bordeaux from the rebel country, because by reason of the king’s letters to him, when he was prince [of Wales] , ¹ Espine had delivered gold and wine to the sum of 260 l.st. to the king’s servants Edmund Ferys and Robert Rodington , to the king’s use, and had never been paid for them. ²

Order to the seneschal of Aquitaine, the constable of Bordeaux and the king's council in Bordeaux to do justice to Darmaignac Johana d'Armagnac, lady of Lesparre and Rauzan , who has supplicated to the king that whereas her husband, the late lord of Lesparre and Rauzan, ¹ demised in his final wish that their daughter, ² his sole and true heir, be in her custody, tutelage and governance, as is fully apparent in the testamentary will of the same lord of Lesparre, and after his death the same Johana offered several times before the king’s council at Bordeaux to do homage and fealty to them, in the king’s name, in the name of her daughter, as her custodian and tutor, owed as lord of Lesparre and Rauzan according to ancient custom, and the former seneschal of Aquitaine ³ and the king's council in Aquitaine , by virtue of the king’s letters and mandates to them took the land of Lesparre and put it into the king’s hands, without knowledge of the case and against right, law and custom. ⁴

Order to the seneschal of Aquitaine and constable of the city of Bordeaux, and the mayors and jurats of the towns of Libourne and Saint-Émilion, and all king's officers of the duchy, to put in corporeal possession of the lands mentioned there William Rokewode and Thomas Barton alias Thomas Hamme, executors of the will of Thomas Swinburne, or their attorneys, advocates or procurators, be put in corporeal possession of the said lands and their appurtenances, together with all issues received from them, from the time of the death of Thomas Swinburne, and also all rents, services, rights, franchises, privileges and duties, and that they permit them to have the same according to the form of the king's letters, and that they give firm mandates to the tenants of those lands concerning the payment of their farms and be obedient and attendant upon the same executors and their attorneys, advocates or procurators. Faryngdon William Farringdon, lately constable of Bordeaux had granted at farm for a certain term and demised to the late Swynbourne Thomas Swinburn, kt , lately captain of the castle of Fronsac in the duchy of Aquitaine, the lands of Condac Condat and Barbane Barbanne in the seneschalcy of Burdeloys Bordelais and Perigort Périgord , with all appurtenances, rents, services, rights, franchises, privileges and duties whatever, which came into the hands of Henry IV by the death of Aymeric de Duras, kt , ¹ who had held them, rendering annually for them at the exchequer of Bordeaux 12 m.st. , and on 1 April 1411, at the supplication of the same Thomas, Henry IV, by his letters patent, granted him the same lands with the said appurtenances to have from the following Easter for a term of 20 years in the same way that Aymeric de Duras had held them for his life, rendering for them annually at the exchequer of Westminster 12 m.st. , in equal portions at the usual terms, as specified in the said letters patent. ²

Order to the seneschal of Aquitaine and the mayor of the city of Bordeaux to arrest and capture all goods and merchandise of merchants of Brittany wherever they be found within Aquitaine, and to sell them, putting into safe custody the residue of the goods and merchandise not sold. They are then to pay the money received from the sale to the merchants named above until they are fully satisfied of both the true value of the cargo taken from them and all reasonable damages, costs and expenses sustained. They are also given the authority to order any of the king’s lieges and subjects required to assist them in the execution of this matter. Chace Pierre de Chasse, 1 merchant of Bordeaux , Bryant Jacques Briand, 2 merchant of Bordeaux , Philip Don of Honynton Honiton , and Cryse Richard Crise of Exon' Exeter have supplicated to the king that whereas they loaded certain merchandise in divers ships, both in England and in Bordeaux , and sailing the ships on the sea with the same merchandise, they were taken and abducted by certain subjects of the duke of Brittany , ³ against the form and effect of the truce had between the king and this duke, and they have often sued the duke of Brittany for restitution of their ships and merchandise, but have not been able to obtain it.

Licence to Thomas Fauconer, citizen of London , to ship 1,000 quarters of wheat from whatever port in England he wishes to Bayonne or Bordeaux , and having paid first all the customs owed to the king for them, he can trade them without any interference from the king’s officials or ministers wherever.

Announcement that the king has granted for life to Edmund de la Pole, esquire , to have the same rents that were granted to Langbroke Master William Langbrook by the letters patent of the late Edward [of Langley], duke of York and then Henry IV's lieutenant in Aquitaine . ¹

Grant for life to Espyne Bénedeyt Espine of the city of Bordeaux of the office of the keepership of the seal and counter-seal of Bordeaux , together with all rights pertaining to the office. Thomas [Beaufort], earl of Dorset , lately the king's lieutenant in Aquitaine , had granted, by his letters patent, this office to William Oldhalle, esquire , which office was vacant and had come into the king’s hands by the death of William Carbonell , to have, rule, exercise and govern the said office by himself or by another sufficient person in his place, and to receive all profits and emoluments belonging to the office for term of his life, as fully contained in the letters patent, but the king now confirms letters patent, which have been surrendered to chancery, to the intention and effect that Espine may have the said office, and grants the office to the same Espine to hold under same terms for life, express mention of the true value of the said office not having been made notwithstanding. ¹

Order to the king’s lieutenant in the duchy of Aquitaine , the seneschal of Aquitaine, the constable of the duchy and the king's councillors of the duchy , and also his fiscal procurator and all the king's officers in the duchy to allow Carlos de Beaumont, alférez of Navarre , to whom Henry IV has granted for life by his letters patent, ¹ at the supplication of Beaumont, castellan [of Mauléon] , to receive in person or through his proctors a toll levied on the goods passing through the river le Dou Adour at the fishery of Guiche situated near the castle of Guiche : 5 hardis guyennais for each load ( sumagium ) of cloth or other good, 2 hardis guyennais and half for each pipe of wine, 7 hardis guyennais for each barrel of woad, ² 2 hardis guyennais for each cartload ( carectata ) of iron, half of a hardi guyennais for each head of cattle, 2 hardis guyennais and half for each quintal of iron, 5 hardis guyennais for each bundle ( tractus ) of leather, each hardi is worthing half penny ( obolus ), as it is contained in Henry IV's letters and the current king's confirmation, to permit him and his proctors to levy this toll without impediment. ³

Order to the king’s lieutenant in the duchy of Aquitaine , the seneschal of Aquitaine, the constable of the duchy and the king's councillors of the duchy , and also his fiscal procurator and all the king's officers in the duchy to allow Carlos de Beaumont, alférez of Navarre , to whom Henry IV has granted for life by his letters patent on 10 June 1407, ¹ letters the current king confirms, the land of Noaillan with all the lands, tenements, revenues pertaining to it and with all the lands and revenues which were owned for life by Johan de Cantiran in the city of Bordeaux and in the towns and parishes of Marinach' Mérignac , Becla Bègles , Villa de Navus Villenave[-d'Ornon] and Cadaynach' Cadaujac and others in the duchy, in the same way that Johan de Cantiran held them during his lifetime. Henry IV furthermore granted to Beaumont for his lifetime the custom on the wine called issac of Bordeaux after the death of Radegonde Béchet, Mortemer lady of Morthemer who held this custom for life according to a grant of Richard II . Henry IV also granted to Beaumont the licence to bring and carry, himself or his attorneys, 120 tuns of wine coming from the rebel places of the duchy ² without paying any tithe or custom at the castle of Bordeaux or elsewhere and without bringing any wheat with this wine, and with priority before any others who had such licence, in the same way as Tolleo Guilhem de Thouil , former clerk of the city of Bordeaux , had for life by the king's grant. Beaumont had to render each year for 20 years 100 fr. at Easter and Michaelmas by equal portions; to have and enjoy these grants. ³
