Physical condition of the roll

The roll consists of seventeen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/112, 9 and 10 Henry IV (1407-1409)

Introduction.

This roll, spanning two regnal years of Henry IV (9 and 10 Henry IV, 30 September 1407 – 29 September 1409), shows the rise to prominente of Johan du Bourdieu, a Gascon doctor of laws of the University of Oxford, in Anglo-Gascon government. In July 1408, Bourdieu, already king’s procurator fiscal in the duchy, obtained the keepership of the seal of the superior court of Aquitaine. He became chancellor of the duchy of Aquitaine in August 1409. 1 The king also relied on him to control the finances of the duchy which were particularly strained by the French offensives of the previous years (1404-06). Consequently, local royal officials were not paid regularly and they made efforts to be paid first when money entered at the exchequer of Bordeaux. Hence, Bourdieu was ordered to check the accounts of the constable of Bordeaux, William Farringdon (August 1408,) and was put in charge of surveying and overseeing all the levies arriving at the exchequer of Bordeaux one year later. 2 This decision marked an innovation since the constable and controller of Bordeaux had never before been controlled locally by a third party. It demonstrates the disarray of Anglo-Gascon finances at this point. The pre-eminent role given by the king to Bourdieu obviously embarrassed several English local officers who opposed his appointment as lieutenant of the constable of Bordeaux and Bourdieu complained to the king about their attitude. 3 John Mitford, the lieutenant of the constable of Bordeaux, was amongst the indignant officers who opposed Bourdieu. 4 Mitford had been ordered by the seneschal of Aquitaine, Galhart II de Durfort, to bind himself towards some creditors in order to pay the wages of the seneschal. This was against the basic rules of Anglo-Gascon financial administration and as a result, the king cancelled this order of the seneschal of Aquitaine and of the king’s council of Bordeaux. 5 Of course, this grave breach within the governance of the duchy had to be sorted out: the king commanded the constable of Bordeaux, William de Farringdon, to compel his lieutenant, Mitford, to come into the king’s presence in June 1410 to provide answers about the situation. 6

Similar financial problems explain the refusal of the English leaders of the garrison of the castle of Fronsac (near Libourne) to deliver the castle to Thomas Swinburn, mayor of Bordeaux since 1405, who had recently been appointed its captain and constable (March 1409). They rightly feared losing the relatively lucrative revenues and patis pertaining to this castle. 7 Similarly, Bertran II, lord of Montferrand, unlawfully kept the castellany of Cubzac and the crossing of the port of Cubzac to the detriment of the Poitevin, Hugues Brouard, to whom the king had previously granted them. 8 The king had already taken drastic measures to stop these financial abuses by forbidding any grant on the revenues of the duchy of Aquitaine between 1 March 1406 and 2 December 1407. 9 The king subsequently ordered in September 1408 to all his officers of the duchy not to interfere in the collection of royal revenues which were customarily levied by the constable of Bordeaux, and the latter was ordered to pay the king’s officers first before any persons who had obtained a royal grant. 10 The king also ordered the community of Bayonne not to interfere in the levying of customs on the wine sold in the town. 11 Several offices were to be reserved for a few faithful servants of the Crown. Hence, Master Pey de Prieret, new procurator fiscal of the duchy and holder of the writing office of the court of Gascony, obtained from the king the right to transfer this office after his death to his sons Laurens and Pey. 12 Some people, including the queen of England Joan of Navarre, surrendered offices or revenues in order to give them to another person of the king's choosing. 13

One of the most vivid entries on the roll deals with an unusual topic. Two low-status burgesses of Bordeaux, named Johan Boulomer and Bertran Ozanne, were in dispute because the former accused the latter of expressing seditious opinions against the Crown of England. The petition of Boulomer to Henry IV, copied in full onto the roll, provides us with the dialogue between the two men according to the plaintiff's point of view. It gives us a better understanding of the psychological links between the Gascons and the Crown of England. Ozanne was alleged to have accused some Englishmen of cutting down fruit trees in Médoc and of unlawfully taking them into their ships, and of encouraging Boulomer to leave the English ‘lordship’. The latter reacted violently against Ozanne’s remarks by reasserting his fidelity towards the Crown of England. He also explained that the Anglo-Gascon union was essential in order to sell wine to England and to receive goods from that country. The conflict was so bitter that it was only to be resolved through a judicial duel before the king at Nottingham, on 12 August 1407. The text provides interesting insights into how the duel was staged. We hear that the constsble started it with the order 'lessez les aller! (let them go!), uttered three times. After a courageous but presumably inconclusive fight between the two men, the king ordered the duel to stop by crying 'Ho! ho! ho!' which meant 'stop'. The royal proclamation also ordered that neither party should suffer infamy as a result of the duel, but be praised for their valiance. 14 Boulomer was subsequently well rewarded by the king because of his fidelity, and obtained two houses in Bordeaux next to the castle of the Ombrière situated in the street called ‘rue Poitevine’. 15 Significantly, Ozanne was not rewarded – evidence that he was actually suspected of having spoken against the English - but he obtained letters of protection for four years; he and his son had been imprisoned when they returned to Bordeaux because they had been hugely indebted following their travel to England. 16

Another exceptional entry in the roll is the first mention of a lighthouse at Cordouan, then a tiny island situated at the entry of the Gironde estuary. A hermit lived in this precursor of the famous modern lighthouse built at the end of the 16th century and rebuilt in the 17th and 18th centuries, and maintained a fire at its summit. Customs levied on the wine passing through Bordeaux were intended for the maintenance of both the lighthouse and the hermit. 17

The king and the Anglo-Gascon government had many difficulties in enforcing compliance with the truces made with the king of France, open hostilities having ended in 1407 with the failure of the efforts of Louis, duke of Orleans to take Blaye and Bourg. 18 The captains of ‘English’ garrisons needed the money coming from the patis and souffertes paid by the region surrounding their castles, but the last truce had suppressed their right to levy them. Hence, Guilhem Bruère, captain of the castle of La Trave (in Bazadais) received financial compensation for himself and the men of his garrison. 19 At the same point, the king sent the lord of Montferrand and Thomas Swinburn as ambassadors to the king of Castile, the king’s nephew, to negotiate another truce with the Castilians who were allied with the French. 20 The king was also concerned about the strategic needs of the community of Bordeaux. He allowed it to levy for four years a new tax on the goods of ‘foreigners’ (non-citizens of Bordeaux) for the city’s fortifications and to pay off the debt of 40,000 francs the community had incurred in resisting the recent French offensive of the duke of Orléans. Similarly, Henry IV forbade Monot de Canteloup from repairing and fortifying the damaged castle of Camarsac situated close to Bordeaux which had been previously occupied by French troops. 21

Several merchants were ordered to buy ‘Gascon’ wine for the king’s household: the Bordelais Johan Macanan along with the Englishman, John Melbourne, were to buy 300 tuns of wine, while the Piedmontese Riccardo Garneri, recently appointed master of the Royal Mint, had to buy 200 tuns. 22

Ecclesiastical matters are extremely rare in the Gascon Rolls, particularly provisions to a prebend but this roll concerns such a nomination to the abbey of Sainte-Croix of Bordeaux. The roll contains the first mention of Pey Berland, the future archbishop of Bordeaux, then a simple vicar, who obtained letters of protection for one year. 23

Various entries concern Saint-Émilion and its jurisdiction. Its community obtained confirmation of Edward III’s lucrative grant to be exempted from paying any toll and custom on their goods within the duchy of Aquitaine. On the same day the community was accorded a tax on the wines and grains in order to repair its partly derelict fortifications. 24 Peter Clifford, an English esquire who had been appointed prévôt of Saint-Émilion in 1407, had encountered opposition, coming probably from the previous holder of this office, and had still to be installed in this post. In order to compensate him for this, the king gave him 100 s.st. to be taken yearly on the goods and revenues of the king’s rebels in the jurisdiction of Saint-Émilion. 25 It appears that the nobles and inhabitants living in the jurisdiction of Saint-Émilion were often opposed to the citizens of the town. They obtained the privilege not to be separated from the Crown of England in exchange for a contribution to fortify Saint-Émilion. It is likely that they had previously refused to do this. They received protection from the king in order to avoid trouble from the inhabitants of the town. They were also permitted to sell their wines, grains and other goods in Saint-Émilion, paying the usual customs, even though the inhabitants of this town would have opposed such authorisation. 26

The inhabitants of the town and jurisdiction of Bergerac, a town which had been in French hands since 1377, requested and obtained letters of protection in order to protect themselves against local ‘English’ routiers and to permit them to trade freely in the Anglo-Gascon part of the duchy of Aquitaine and in the kingdom of England. 27

This roll also show us the relationship between the king and the duke of Brittany. Following a truce lasting one year, the duke of Brittany was allowed to re-instate, as was customary, a delegate selling brefs de mer (safe conducts) at Bordeaux to English merchants. This truce stated that Breton goods seized by men of Bordeaux and Bayonne during the truce had to be returned to their lawful owners.

The king has learned that, according to the truce made between the king and the duke of Brittany , 2 the latter has sold brefs [de mer] to merchants of the kingdom of England , the truce being due to last for one year from 11 July 1407.

John of Gaunt orders to the seneschal [of Aquitaine] and the judge of Gascony to deliver this office to Bardi as soon as they are certified that Salabartan has given up it and to have him receive it from the jurés mayor and jurats of Bordeaux and the prévôt of Saint-Éloi . 20 June 1408 . Westminster . Commendation for Boulomer 1 .

Henry IV proclaims that, by his crying 'Ho! Ho! Ho!', which meant 'Stop! Stop! Stop!' ( 'Cessate! Cessate! Cessate!' ), in a duel between Johan Boulomer and Bertran Ozanne in his military court which had been ordered by the constable of England and the marshal of England and assigned at Nottingham on 12 August 1407, the king had ordered an end to this duel at the request of the king of Scots , 2 and of his own sons as well as of the other princes present at the duel, and because, after long and fierce duelling, both men had defended themselves valiantly, and neither of them will suffer infamy because of the action but, rather, honour and praise in the eyes of all men. Johan Boulomer had previously petitioned the king as follows:

Petition of Bolemere Johan Boulomer , 3 tailor and humble burgess of Bordeaux , to the king of England and France, 4 his constable and marshal of England or their lieutenants and commissaries. He is a poor man of lowly status, but would preserve the king's honour if he learned someone wanted to damage the king, otherwise he would be considered as a traitor. In the first year of the king's reign, 5 between the Christmas day 6 and the first day of Lent, 7 Boulomer met in Bordeaux in the street called 'Poitevine' 8 Usana Bertran Ozanne, merchant and burgess of Bordeaux . 9 There the latter told him: 'Master Johan Boulomer, I want to talk to you about a great and marvellous thing, forsooth'. Boulomer replied: 'I agree with that, so talk to me about what you want to talk about'. Ozanne carried on saying 'Indeed the English are bad people causing great offence, and lately they were in Margaus Margaux and Mathau Macau where they have cut down the trees laden with fruit, taking them into their ships; and know you Boulomer that we have to leave their lordship'. Boulomer reacted by saying: 'Saint Mary! Sir, this thing cannot be done as the town [of Bordeaux] has always been in the past so loyal to the crown of England and will remain so by the grace of God from now on; and how might the poor ploughmen live, and the subjects of the king [of England], our lord, when they would not be able to sell their wines nor have goods from England as it is customary?'. Ozanne retorted: 'Leave that, Boulomer, we will live well without them because we will prune half of our vineyards and yield there the double'. ‘Sir, said Boulomer, do not tell me anything more on this matter as I would prefer to keep quiet than agree to your opinion' and Ozanne 'You will accept it, whether you like it or not, or otherwise you will leave the town, you and all the others who will not accept it'. Boulomer came to a conclusion with these words 'I do not want to hear or talk anymore on this matter: I have to make my poor buttons'. And if Ozanne denies it, Boulomer will prove it with God and Saint George's help before the king in a duel. 10

Amaniu d'Arsac has supplicated the king by his petition presented before him that his aunt Assalhita Assalhida d'Arsac , the sister of his father, get married with the late Bearnio, de Johan de Béarn, kt , and she brought as a dowry all the lands, revenues and fruits she had and ought to have because of the house or lordship of Arsac in the parish of Blanquafortis Saint-Martin of Blanquefort and in the city of Bordeaux as well as its banlieue , provided that if they did not have any descendants, these goods would return fully to the house or lordship of Arsac . Assalhida and Johan de Béarn has had a son called Bearnio, de Simon de Béarn, kt , who is a king's rebel and enemy, and because of his political obedience Amaniu has requested the king to return to him and his heirs the goods of Assalhida after her death. 1

Order to the seneschal of the duchy of Aquitaine that if Conties Pey de Contis, esquire of the city of Bayonne , has been dispossessed by the lady of Mussidan 1 of the office of the gaugeator gauger within the city of Bordeaux by virtue of royal letters patent, 2 he has to return to him this office according to the form and tenor of the king's grant with the profits from the time when the seneschal seized the office into the king's hands. Contis has shown that he had been granted this office by royal letters, and by virtue of these letters he had been installed in the office and had held it quietly until the proctors of the archbishop of York 3 required from him some exactions ( impetiotiones et debite ), so that Contis was no more able to enjoy this office, which was put in the king's hands until the king decided who would have this office. Thereafter the lady of Mussidan received possession of this office and occupied it without any lawful title. The archbishop of York and Contis have made an agreement about this before the king so that the office has to return to Contis according to the form of the king's grant.

For instance, he ordered the destruction of some rocks on the river Lot in order to facilitate the movement on it of small boats towards Bordeaux. This is the first known mention of an actual lighthouse at Cordouan which was then a tiny island. This lighthouse - now destroyed - was nicknamed in the 16th century 'la tour aux Anglais' (the tower of the English). It is now known as 'la tour du Prince Noir' (the tower of the Black Prince). It was an octogonal tower of an approximate height of 16 metres on the top of which a fire was lighted, maintained by the hermit living on the island. A new lightouse has been built near the old one between 1584 and 1611. The upper part of this lightouse was destroyed in 1714 and rebuilt in 1724, providing the current lighthouse of Cordouan ('phare de Cordouan').
