The roll consists of 21 membranes. There are entries on all of the faces. The roll is generally in good condition.

C 61/70 32 Edward III (1358-59)

Introduction.

There are two rolls for the 32nd regnal year of Edward III, this current roll and the following roll (71). This roll contains business for the first six months of the regnal year from January to June. The fact that two rolls were generated reflects the impact of the personal presence of the Black Prince in the duchy until April 1357. The following roll consists mainly of confirmations of grants made by the prince. The current roll contains a wide variety of topics, including several interesting legal cases. According to one entry, a married wife could not be a guardian of a ward according to the custom of the duchy of Aquitaine. 1 We also find a case about the sale of a tenement made by a woman allegedly ‘deaf and insane’ which is challenged by her children. 2 We learn of the consequences of the sentence made against Gaubert de les Fosses of Monpazier (South-West Périgord) who had been accused of murder. His possessions had been seized to the detriment of his sister. 3 Some people of La Réole had been banished because of a murder of one of its citizens, but they were still at large in the duchy of Aquitaine despite the sentence. 4 There was a pardon to Fortaner de Gayrosse who had killed the notary of Mauléon. 5 Pey de Vergnes, keeper of the gold money minted at Bordeaux, had been attacked and wounded on the head on a public road whilst he was occupied in the king’s business. 6 Because of a private war in which the father of the lord of Gayrosse was killed, the possessions of the lord of Gayrosse in the Landes had been occupied by the lord of Albret for 20 years. 7 There is a mention of the appeal by the lord of Caupenne and members of his family about the succession to the lordship of Tiran, near Bordeaux. 8 The court case on the aubergades of Soule is mentioned, as in earlier rolls. The castellan of Mauléon Ramon de Miossens had requested the king to reimburse him for the cost of the appeal of the men of Soule in the case. 9 We also find an appeal to the king as king of France of a parishioner of Le Pian-Médoc who challenged his status of serf against the chapter and canons of Saint-Seurin of Bordeaux, and claimed to have been imprisoned and tortured by them. 10 There is a story about Arnaut-Guilhem, lord of Olhaïby (in the Soule province), a rebel against the king, who had been banished because he had stood with the lord of Gramont and the French, and had tried to attack the king’s castle of Mauléon. 11 Galhart Durand, son of Ramon Durand, former seneschal of the Landes who died in the assault of a bastide (new town) of the Landes in 1332-3, complained that he had lost the baylie of Labourd. 12 Financial extortions had been made on Gauter de Rouffignac by several members of the Laroque family (South-West Périgord). 13 Rouffignac was created one the king’s councillors in the duchy. 14 He was also appointed juge-mage in the seneschalcy of Périgord-Quercy and Limousin. 15

Edward III revoked letters of marque because these were considered to harm trade and likely retaliations against them could affect his own subjects. He revoked the marque on the merchants of Agenais, who were not coming anymore to Bordeaux because of fear of the effects of the letters. The Welshmen Rhys ap Gruffudd and Hywel ap Gruffudd who had been made prisoners of war by some men of Agenais during the truces had to be the beneficiaries of these letters of marque. 16 Finally, the king revoked all marques delivered by the seneschal of Gascony and this latter had to drop all their executions. 17

The men of La Réole succeeded with those of Bazas to have confirmation, challenged by the community of Bordeaux, of the right to bring their goods into Bordeaux without paying the 6 d. per pound levied on them by the community of Bordeaux. 18 The towns of Bergerac, Sainte-Foy-la-Grande, Saint-Émilion and Saint-Macaire obtained a similar privilege. 19 The towns of Bergerac, Lalinde, Sainte-Foy-la-Grande, Gensac, Castillon and Saint-Émilion continued to complain to the king about the additional tax of 4 s.st. levied at Libourne by the constable of Bordeaux on their wines loaded there. The original complaint dated back to 1354. 20 Several important grants or confirmations were made to the community of Libourne. 21 The taxes levied on their wines and goods at Bordeaux were ordered to be returned to them. 22

A tax was granted to the community of Saint-Émilion to repair their urban enclosure. 23 There were delays in repairs and fortifications of the king’s castle of La Réole because the men of the lords of Albret and Caumont did not want to pay the toll of 20 d.bord. for each tun of wine or grain coming down the river Garonne before La Réole. 24 The king revoked the toll granted to the lord of Lesparre for the enclosure of Lesparre. 25 The king also banned the building of fortalices in Bourgeais. 26

Several orders were sent to the seneschal of Gascony and the constable of Bordeaux to implement the treaty made by the prince of Wales with Johan de Galard, lord of Limeuil. 27 Because of a treaty made between Auger de Montguyon, lord of Montguyon, and the prince of Wales, Mathe, widow of a previous lord of Montguyon, was to receive 200 crowns each year on the customs levied on the wines at the castle of Bordeaux. 28 The genealogy of the lord of Montguyon of this period is given. 29

We learn that Guilhem Aubert, originating from the region of Fronsac, had been one of the bodyguards of Prince Edward at the battle of Poitiers (19 September 1356) and was rewarded for that. 30 He also obtained for life the prévôté of Bazas. 31

Some entries inform us about the routiers of the English party and certain local nobles affected by them. Routiers of the English party took prisoner, and obtained ransoms from, the lord of Gourdon and a knight of Quercy during the truces. 32 We find a pardon granted to two routier leaders of the English party active in Périgord (Hélias d’Escodéca and Bernat de Mechmont). 33 Some malefactors, in all likelihood of the English party, had pillaged the goods and destroyed the harvests of the abbey of Brantôme (in Périgord) despite the fact that this abbey was under the king’s protection. 34 Guilhem-Sans III de Pommiers was granted the castle and castellany of Blanzac he had occupied from c.1342. If it happened that it was restored to the lord of La Rochefoucauld, who was then in the French party, Guilhem-Sans was to be fully satisfied of all the expenses he had incurred for the preservation, garrisoning and repair and fortification of the castle by the lord de La Rochefoucauld. 35 Pommiers and his wife Johana de Fronsac suffered encroachments of the lord of Albret for their possessions in the Pays de Born. 36 The king confirmed to Guillaume de Garlande the places he had captured in war. 37 We find mentions of the family of the routier captain Naudon de Bagéran about the destruction and the rebuilding of their fortalice near Castets-en-Dorthe. 38 Montasin de Bagéran, keeper of the castle of Castets-en-Dorthe, was not to deliver it to anyone apart from the constable of Bordeaux. 39

Two grants of Richard the Lionheart, when he was only duke of Aquitaine and count of Poitou (before 1189), were confirmed to the abbey of Sainte-Croix of Bordeaux. One concerned the water of the stream called ‘l’Eau Bourde’ which was necessary to make work the abbey’s mills. 40 The second was the grant of two villae and of the stream of Peyrelongue for the use of the abbey's mills. 41

An entry, which clarifies another copied on the previous roll, concerns the widow of Guilhem d’Aubiac, burgess of Bordeaux. The latter had written a will were he gave 300 crowns (or écus) to the king in order to save his soul because of his embezzlement when he was master of the king’s money at Dax. 42

Part of royal woodland in Saintonge was granted in order to repair the house and buildings of the king’s clerk Robert Gasc. 43 If peace was signed with the king of France, all Robert Gasc’s possessions and those of his father, which they had lost when they had rallied Edward III, were to be returned to them. 44

We find also the case of English and Gascon merchants who were robbed at sea by people from La Rochelle in the king of France’s obedience. 45 An English ship was chartered by the lords of Curton and Pommiers to bring their goods from England to Aquitaine. 46

The king gave a subsidy of 100 s.st. to the Carmelites of Bordeaux to organize their chapter-general. 47

Order to the seneschals of Gascony and the Landes , the Malo Leone, de castellan of Mauléon and the Aquis, de prévôt of Dax that, if it is true that no married woman can be guardian according to the custom of the duchy of Aquitaine, they have to make without delay Pey d'Osserain guardian of the ward Gassie-Arnaut d'Osserain and his hereditary goods if this Pey cannot inherit from him, and remove Maria d'Osserain from this guardianship and forbid her to interfere with it. The king orders to all his subjects to obey and attend Pey d'Osserain on this matter. Friends from the family ( parentela ) of Dousseran Gassie-Arnaut d'Osserain , ward and son of the late Dousseran Arnaut-Guilhem d'Osserain , have supplicated the king that Maria d'Osserain , who is married, is now guardian of Gassie-Arnaut d'Osserain who is the universal heir of his late grandfather Gassie-Arnaut [d'Osserain], kt , Dousseran lord of Osserain , and she administers his hereditary goods despite the fact a married woman cannot be a guardian according to the custom of the duchy of Aquitaine; and that the king should appoint Dousseran Pey d'Osserain, esquire , son of Pey d'Osserain , kinsman of this ward, as the guardian of this latter.

26 January 1358 . Westminster . For the burgesses of the town of Saint-Émilion .

Grant for twelve years from the date of these presents to the burgesses of the town of Saint-Émilion to levy 1 d.bord. for each bushel of corn measured in their town and 20 pitchers for each tun ( dolium ) sold in tavern through two worthy men they will choose, in order to help for the repair of their town's walls and for certain other works. The accounts of this levying received from these two worthy men have to be checked each year by the mayor and two jurats of this town. The burgesses of the town of Saint-Émilion have supplicated the king to have these taxes in order to repair the walls of their town which are ruined, the most part of their land being also ruined.

29 January 1358 . Westminster . Concerning licence to bring corn to Gascony .

Licence granted until next Easter 1 to Motesfont John de Mottisfont and his servants to load on ships 300 quarters of wheat in the port of Gippewicus Ipswich and bring them to Gascony. John de Montpyllers and Henry [le Baillif] , son of Roger le Baillif of Surrey mainprised in person before the king in chancery that Mottisfont will bring this corn in Gascony and not elsewhere, and that he would bring at the king's chancery letters testimonial under the seal of the constable of Bordeaux before the next feast of Easter 2 that the corn had been discharged there.

30 January 1358 . Westminster . Concerning the obedience to the castellan of Mauléon .

Order to the Soula men and people of the land of Soule directly or indirectly subjects of the king to attend and respond to the castellan of Mauléon on the aubergades and all the other customary duties and services which were levied in the king's name by the vicomtes or the castellans of this castellany [of Mauléon] before the start of this trial, 1 and if they or any of their subjects did not pay these aubergades , duties and services, they have to pay them without delay until the appeal is terminated 2 and the king orders otherwise on this matter, any letters, orders, decrees made by the seneschal of Gascony against it notwithstanding.

Letters of safeguard granted at the king's pleasure to Clarencio, de Hélias de Clérans, esquire , his men, questaux , 1 and his lands, tenements, goods and just possessions. The king orders to all his officers of the duchy of Aquitaine to maintain, protect and defend them from all injuries.

14 February 1358 . Westminster . For Johan Toscanan .

Order to the constable of Bordeaux to account with Johan Toscanan or his attorney and to pay him without delay what is due to him or find him a suitable allocation on the revenues of the duchy. Johan Toscanan has supplicated the king that this latter owed to him several sums of money for his wages from the time he was in the king's service in Gascony, so he requested to be paid.

18 February 1358 . Westminster . Concerning the ban to make fortalices in Bourgeais .

Order to the seneschal of Gascony and the constable of Bordeaux to publicly proclaim on the king's behalf in the places they will find suitable in Burgesio, de Bourgeais that no fortalice can be built in Bourgeais under pain of forfeiture without the king's special licence; and if any fortalice has been built there against this proclamation and ban, then they have to destroy it and make response to the king about those who have contravened. The king has learned that some fortalices are planned to be built in Bourgeais, and if this happened it would be to the great damage of the king and it could bring great peril to the town of Bourg .

Order to the constable of Bordeaux to fully inform himself, and if by this information it appears that Hélias de Pommiers does not receive 500 l.per. () by year from the goods and revenues which were confiscated to the king and others pertaining to the king in his seneschalcy, then he has to pay them without delay from the revenues of the duchy of Aquitaine, or make him a suitable allocation or make a suitable allocation in the places where he could easily be paid. Hélias de Pommiers, Darbenak lord of Arbanats , Petragoricen', Lemovicen', Caturc' seneschal of Périgord, Limousin and Quercy , supplicated the king that 500 l.per. were granted to him as his annual fee on his seneschalcy on the confiscated goods and revenues and the other goods and revenues pertaining to the king in this seneschalcy, but they do not amount to this sum, so Pommiers requests the king to pay him this sum or allocate it elsewhere.

Order to the constable of Bordeaux that having seen the letters [mentioned below] and if he finds that what Pagan Salvatge asserts is true, then he has to account with him for his wages from the time of the previous constables of Bordeaux, and pay him without delay his wages from the issues of the duchy of Aquitaine or make him a suitable allocation. Paganus Pagan Salvatge 1 has supplicated to the king that 18 d.st. per diem had been allocated to him for his wages by Oliver de Ingham, former seneschal of Gascony, on the issues of the duchy of Aquitaine, as appears in the king's letters patent under the seal of the court of Gascony, and these daily 18 d.st. are owed to him for a long time, so Pagan Salvatge requests the king to pay him these arrears.

Order to the seneschal of Gascony and the constable of Bordeaux, that having heard the complaint of the heirs of Mainard de Mortemart, or of their friends or proctors, and having summoned before them Peire de Léparon, if it appears that the assertion of the heirs of Mainard de Mortemart is true, then they have to make swift full justice on the return to these heirs of this tenement with its vineyards and other appurtenances, according to the local fors and customs. Phelip and Elias Hélias , Maria and Sibilla Sibilha , sons and daughters and heirs of the late Mainardus, Mortamer Mainard de Mortemart and of his wife Fauressa Bona Fauresse , have complained to the king that, as the late Faure Hélias Fauresse 1 father of Bona, has put on the marriage contract between his daughter and Mainard that only the children procreated from theirs bodies were the heirs of his lands and goods, his daughter Bona not having the right to sell or alienate them, Sparro, de Peire de Léparon, 2 esquire , has hatched to fraudulently obtain from Bona, who was and still is deaf and insane ( surda et furiosa ), a tenement called la Mayne Nuef le Maine Neuf with its vineyards and its other appurtenances, a tenement formerly owned by her father Hélias; Léparon promised to pay her a sum of money he has not yet paid to her, and he has took possession of this tenement and still unjustly occupies it to the great damage and obvious despoilment of Mainard de Mortemart's heirs who are orphans and minors, and have not enough to sustain themselves, so they request the king to provide a remedy on this matter.

Grant to the burgesses of the town of Bourg , after their complaint, that the sale and purchase ( commutatio ) of the salt and corn take place in the markets of their town as it was customary until now, and not elsewhere within the castellany of Bourg , in places being in the king's hands or in other places which pertained to this castellany. The king forbids under pain to sell and buy such salt and corn in other places than in the markets of Bourg against the tenor of these presents.

Order to the seneschal of Gascony, the constable of Bordeaux and also the juge-mage ( judex major ) of the court of Gascony that, having heard the complaint of Gauter de Rouffignac and summoned before them the heirs of Grimoart de Vélines, if they find that the letters of acquittance and some agreements were extorted without right from Rouffignac, then they have to return them to Rouffignac and cancel any agreement, and they have to satisfy without delay Rouffignac of any debts due to him by the late Grimoart de Vélines in compelling this latter's heirs to pay Rouffignac, according to the local fors and customs. Gauter de Rouffignac has complained to the king that during the truces made between the king and the king's adversary of France, 1 Bertrandus, Rok, de Bertran de Laroque , Stevenus, Rok, de Stève de Laroque and Oliverus, Rok, de Olivier de Laroque and their accomplices, 2 then obedient to the king's adversary of France, made him prisoner until they obtained from him some letters of acquittance of various debts owed to him by the heirs of Grimoart de Vélines , then in the obedience of the king's adversary of France, and force him to make some agreements with the heirs of Grimoart de Vélines; thus, as the heirs of Grimoart de Vélines has returned to the king obedience, Rouffignac requests the king to return him these letters and agreements and compel them to pay him their debts. 3

Grant to Master Villeti Johan Billet, Reula burgess of the town of La Réole , king's councillor and Vasadesio, in king's procurator in the Bazadais and his wife Contoria, Podio Boneti, de Contor de Puy Bonnet that in all the cases and trials made by them or against them in the duchy of Aquitaine, and especially in the cases concerning the king or his heirs, they will be represented by a proctor with sufficient power, any custom against it notwithstanding. The king orders to all his officers in the duchy of Aquitaine to permit that this proctor represents before them Billet and Puy Bonnet and they have not to damage these latter.

Letter to Gast Robert Gasc, king's clerk , where the king announces to him that he appoints him as one of his councillors [in the duchy of Aquitaine], receiving 30 l.st. or its value in another currency as his annual fee as long as he stays in this office. He has to deal with the king's business with the other councillors in the duchy.

10 February 1358 . Westminster . For Guillaume de Garlande .

Grant to Garlanda Guillaume de Garlande 1 to have the castles and places of Pericoul Parcoul , Coiro Coiron and Puygoyo Puygoyon with all their revenues, profits and emoluments in the same way as he has held it up to now, until the king is fully informed about it and orders on it. The king does not want that Garlande be removed from these castles and places by the seneschal of Gascony or the other royal officers without the king's special mandate. Guillaume de Garlande has supplicated the king that [Henry of Grosmont], duke of Lancaster , when he was king's captain and lieutenant in the duchy of Aquitaine, had granted that Garlande could have all the places and goods he acquired and returned to the king's obedience from the king's enemies in the duchy, and as Garlande took during the war from the king's enemies the castles and places of Parcoul, Coiron and Puygoyon, he requests the king to confirm him by his letters the possession of these places, which were harmful in this region to the king and his subjects, with all their revenues, profits and emoluments.

8 March 1358 . Westminster . For Huc Martin .

Order to the seneschal of Gascony and the constable of Bordeaux that, having summoned before them Frances Sarrazin and heard the complaint of Huc Martin and his wife Ricarda, and having obtained full information on this matter, if it appears that the annual revenue of this house is due to Huc Martin and Ricarda, then they have to compel Frances Sarrazin to pay these annual 20 l.t. and the arrears due since the grant of the prince. Huc Martin has supplicated the king that an annual revenue of 20 l.t. was granted to him and his wife Ricarda , as dowry of this latter, on the one house of Bordeaux where lived La Font Arnaut de Laffont ; and then Huc Martin and Ricarda peacefully received this revenue until [Edward of Woodstock], prince of Wales , then king's captain and lieutenant in the duchy of Aquitaine, seized this house into the king's hands because of the forfeiture of Arnaut de Laffont who joined the king's adversary of France, and gave it to Franciscus Frances Sarrazin who refused to pay this revenue to Huc Martin and his wife, so these latter requests the king to bring them remedy on this matter.

Order to the seneschal of Gascony and the constable of Bordeaux to revoke without delay the marque on the men and people of Agenais when they read the present king's letters, and they should proclaim on the king's behalf that all the merchants who are coming to Bordeaux with wines and other goods are safe and secure and are under the king's protection and can come there and return home without any impediment from the king's officers. The king has learned from a reliable source that some Agenes' merchants of Agenais who came to Bordeaux with their wines do not dare coming to Bordeaux because of a marque granted against the men and people of Agenais by the seneschal [of Gascony] at the prosecution of Resus, ap Griffith Rhys ap Gruffudd and Howelus, ap Griffith Hywel ap Gruffudd 1 who had been made prisoner of war by some men of Agenais during the truces made between the king and his adversary of France, 2 so that wine from these parts are not coming at Bordeaux to the king's and his people great damage and the loss of profits of the king on the customs he levies on it.

Order to the seneschal of Gascony to support and help the merchants [mentioned below] to recover the ship and their goods and obtain compensations for their damages. Cornyssh' William Cornish , the master of the ship Domina de Carmelo 1 of Bordeaux , Kyngeston William de Kingston , Englishmen, Plasham Arnaut de Plassan , Landa Guilhem de Lalande , citizens of Bordeaux, Jacobus James Chauntecler and Bernat Roger of Leyburn' Libourne , merchants, have complained to the king's adversary of France 2 that after the proclamation of the last truces made between this latter and the king 3 60 tuns ( dolia ) of wine had been loaded on the ship [mentioned above] with the purpose of bringing it to England, and thereafter some subjects of the king's adversary of France of Rupella La Rochelle , Vanetis, de Vannes , de Consepito 4 and from other regions of his realm, seized by force this ship near the Royen, de castle of Royan , towards the end of the Gironde river ( fluvius de Jerounde ), killed ten merchants and mariners who were there, kept the other persons being there, the ship and all the good loaded on this ship, and refused to release them though they were often required to do so; then the king's adversary of France ordered to his Xancton' seneschal of Saintonge and to his justices and officers of these parts, if they found it to be true, to compel the abductors to release these persons, this ship and these goods, if they can be returned, or at least their value, as more fully appears in the letters patent of the king's adversary of France shown in the king's chancery.

Order to the seneschal of Gascony, the constable of Bordeaux, the mayor of Bordeaux and the prévôt of the Ombrière of Bordeaux , that having summoned before them William Cornish , and if they notice that what asserts Cornish is true, they have to compel his debtors to pay him according to the local fors and customs. William Cornish has supplicated the king that Pylk Henry Pilk of Bristoll' Bristol and Saunctius Sans Juncas and other merchants of Gascony owed to him various sums because of some contracts and agreements made between them in Gascony, but they refuse to pay Cornish for this debt, so this latter requests the king to do what is necessary to recover his money.

Order to the constable of Bordeaux to stop disturbing the men, inhabitants and merchants [mentioned below] until the king is fully informed of the situation, and he has not to compel them to pay 4 s.st. for each tun ( dolium ) of wine loaded or unloaded or sold by them at Libourne above the customary customs and tolls, until the king comes to a decision. The men and inhabitants of the towns of Lyborn' Libourne , Briggeriaco, de Bergerac , Lyndia, de Lalinde , Sancta Fide, de Sainte-Foy[-la-Grande] , Gensaco, de Gensac , Castellione, de Castillon , Sancto Emiliano, de Saint-Émilion and of certain other places being on the river of Dordon' Dordogne , and the merchants coming to the port of the town of Libourne, have complained to the king that they used to load and unload their wine at Libourne without paying any custom or subsidy to the king or others, apart from the payment of the customary tolls; however the constable of Bordeaux and some other king's officers have compelled them to pay 4 s.st. for each tun ( dolium ) of wine loaded or unloaded or sold by them at Libourne above the customary customs and tolls, so they have supplicated the king to bring them a suitable remedy about it.

Order to the seneschal of Gascony, the castellan of La Réole and the Reula prévôt of La Réole to compel all the inhabitants of the lands of the Lebreto, de lord of Albret and the Cavo Monte, de lord of Caumont and the others who refuse to pay the toll [mentioned below] to pay it according to the king's letters, so that the repairs and fortification of the castle of La Réole are delayed by lack of payments to this toll. The king has learned by several accounts that, although the king had ordered a toll for the repair and the maintenance of his Reula castle of La Réole , for which 20 d.bord. had to be levied for each tun of wine or corn coming down the river Garona Garonne in front of the town and castle of La Réole, as more fully appears in the king's letters patent, the inhabitants of the lands of the lord of Albret and the lord of Caumont do not want to pay this toll to the king's contempt, causing the obvious delay of this castle repairs and fortification.

Appointment of Galopeau Galhart de Galoupeau of Aculeo, de Aiguillon as bayle of Aiguillon with its profits and emoluments to be received from the next feast of Easter, 1 to be held by him or by a sufficient proctor or attorney, for twelve years in part of compensation of the damages and injuries he suffered, any grant done to another by Edward [of Woodstock], prince of Wales , former king's lieutenant in the duchy of Aquitaine, notwithstanding. If these profits and emoluments exceeds the annual value of 10 l.st. , Galoupeau has to respond of this surplus to the constable of Bordeaux. Galhart de Galoupeau of Aiguillon has supplicated that, as the king has granted to him for ten years the baylie of Aiguillon with its profits and emoluments, in part compensation for the damages and injuries he suffered in the king's service in the past king's wars in Gascony, a baylie which is worth no more than 10 l.st. by year in peacetime, and as this period of ten years is finished and Galoupeau has not received these profits and emoluments because of the wars, so this latter requests the king to grant him again this baylie for life or for a suitable period.

Order to the seneschal of Gascony, the constable of Bordeaux and the juge-mage of the duchy of Aquitaine that having summoned the lawyers of the king's council [in the duchy] as well as the king's procurator [of the duchy] , and having summoned Garsens de les Fosses and the others who have to be summoned on this matter, and having seen the proceedings of the trial previously made, they have to hear the complaint of Garsens and consequently make her swift full justice according to the local fors and customs. Garsena Garsens de les Fosses of Montpazer Monpazier has complained to the king that her brother Gausbertus Gaubert de les Fosses , of whom Garsens is legitimate heiress, has been formerly accused by some of his enemies of the killing of Arnaut-Guilhem de Conges at Monpazier, and some commissaries appointed by the seneschal of Gascony for this case have sentenced Gaubert for this death, a decision that could not be taken according to the law and the local custom, so Gaubert has appealed on the execution of this sentence to the seneschal of Gascony, then to the king; and Gaubert's goods has been unjustly taken in the king's hands and one of the commissaries diverted these goods to his own profits, to Garsens great damage and despoilment, so this latter requests the king to bring her a remedy about it.

Faugeriis, de, Prada Guilhem-Ramon de Faugères, called de Laprade, damoiseau , has supplicated the king, as formerly an appeal of a trial made between him and Gresynhaco, de Guilhem-Ramon de Grésignac, kt , and discussed before the Umbraria court of the prévôté of the Ombrière of Bordeaux , and then appealed to the king's court of appeals ( auditorii ) of the castle of Bordeaux , and after appealed to the king as king of France, to hear this appeal and terminate this case.

Order to the seneschal of Gascony and the constable of Bordeaux that having seen the agreement [mentioned below] if it has been written in the form [also mentioned below], if they find that the lord of Albret or his men or officers have damaged and despoiled Guilhem-Sans de Pommiers and his wife Johana de Fronsac against the tenor of this agreement, then they have to correct the situation without delay and returns it to its original state, compel the lord of Albret and his men to respect this agreement, and keep and respect the same agreement in all its articles. Guilhem-Sans [III de Pommiers], Pomeriis, de lord of Pommiers and his wife Johana de Fronsac, Belyn lady of Belin and Usar Uza 1 have shown to the king that there were several dissents and debates between Edward [II] or his proctor on one hand, and Yolenda de Soler, Belino, de lady of Belin , daughter and heiress of the late Solerio, de Arnaut-Ramon de Soler, lord of Belin , on the other, and Yolenda asserted that all justice in the castrum , district ( vicus ) and all the neighbourhood of Uza and in all her lands, properties, fiefs, rear-fiefs and in all the territories of Borne, de Born belonging to her, and on all the wrecks, whales and other cases of casual revenues from the maritime coast of Biscarossa Biscarrosse , Sanctus Julianus Saint-Julien[-en-Born] or of Sart Uza that should pertain to her by right of succession of her father, while the king's procurators asserted they had to be owned by Edward II, and an agreement has been reached by the assent of both parties specifying the rights of Edward II and his heirs, and the rights of Yolenda de Soler and her heirs, 2 the rights acknowledged in this agreement to Yolenda and her heirs and the rights they had in these places before this agreement have been peacefully held by them, until the king has granted what he owned in the land of Mymysan Mimizan and Born to Bernat-Etz [V], Lebreto, de lord of Albret , and after this latter grant the lord of Albret and his officers have appropriated and occupied without right the lands and rights in this region of Guilhem-Sans [III de Pommiers] and Johana de Fronsac, inherited from Yolenda de Soler and specified in the agreement [mentioned above], so Guilhem-Sans and Johana have supplicated the king to provide them a remedy about it.

Order to the seneschal of Gascony, the constable of Bordeaux and all the king's officers in the duchy of Aquitaine to permit the Reula, Vasat', Vasadesio, de inhabitants of the town of La Réole, the city of Bazas, the towns, castles and other places of Bazadais and their jurisdictions, as well as their successors, to be forever exempted to pay from next Michaelmas 1 6 d. by pound ( per libra ) on all the goods they bring to Bordeaux , and they have not to permit them to be molested about it, any letters obtained against this notwithstanding. The jurats and the community of the town of La Réole, the city of Bazas and the other towns, castles and places of Bazadais have supplicated to the king that they have had the right from time immemorial to bring their goods to the city of Bordeaux without paying any toll or custom on them; and although Henry [of Grosmont], duke of Lancaster , former king's lieutenant in the duchy of Aquitaine, has confirmed their liberties and franchises and this right, the mayor, jurats and the community of the city of Bordeaux, under the pretext of some letters granted by the king, have demanded and extorted from the former 6 d. by pound ( per libra ) on all the goods they bring to Bordeaux to their great damage, so they request the king to revoke this tax and the mentioned king's letters.

The jurats and the community of the town of La Réole, the city of Bazas and the other towns, castles and places of Bazadais have petitioned the king before the king and his council in the present Parliament 2 that their predecessors enjoyed the right from time immemorial to bring their goods to the city of Bordeaux without paying any toll or custom on them; and although [Henry of Grosmont], duke of Lancaster , former king's lieutenant in the duchy of Aquitaine, and some other lieutenants and seneschals have confirmed their liberties and franchises and this right, the mayor, jurats and the community of the city of Bordeaux, under the pretext of some letters granted by the king, have demanded and extorted from them 2 s.t. or 6 d.st. for each tun ( dolium ) of wine they bring to Bordeaux and for other goods proportionally, to their great damage, so they request the king to maintain them in their liberties and franchise and revoke the king's letters about it.

The jurats and community of the town of La Réole have supplicated the king that their predecessors burgesses and inhabitants of La Réole have owned liberties and franchises from time immemorial allowing them to bring their wines to the port of Bordeaux , sell them on the [river Garonne] and load them on ships there, without paying anything on them, but they fear now to be impeded in doing so by some of their enemies, so they request the king to maintain and keept them in possession of their liberties.

Order to the Sanctus Emilianus prévôt of Saint-Émilion not to accept complaints ( clamores ) against the men and inhabitants of the banlieue of Saint-Émilion without making previously a legitimate information, and if it appears these complaints are true, then he has to summon the parties and make justice according to the local fors and customs, and he has to punish those making false complaints in such way it will put fear to others trying to do such complaints. The men and inhabitants of the banlieue ( balenca ) of Saint-Émilion have complained to the king that previous prévôts of Saint-Émilion, because of some false complaints, have jailed some of them and made them paid bails ( gagia ) though they were innocents, and they compelled them to pay fines with sums of money, or some amount of corn or wine, to their great damage, so that they supplicate the king to bring them remedy about it.

Order to the juge-mage of the court of Gascony , the seneschal of the Landes and the constable of Bordeaux that, if they find or prove that the people of Soule unjustly treated Ramon de Miossens, castellan of Mauléon, on the rights [mentioned below], then they have to sentence these men to pay the expenses and damages suffered by Miossens since their rebellion. The king orders to all his seneschals, proctors and officers [of the duchy of Aquitaine] to help about it Miossens or his proctor each time they are required to do so. Mille Sanctis, de Ramon de Miossens, Malo Leone, de castellan of Mauléon , has supplicated the king that he defends the king's rights pertaining to his castellany against the people ( gentes ) of Soule who try to usurp them from a long time, and the seneschal of Gascony has ordered that they be exempt from to paying these rights, Miossens having appealed of this order to the king as king of France, and requesting the king to reimburse him for the cost of this appeal or sentence these people for these expenses. 1

Pinibus, de, Besana Doat de Piis de Bassanne, Reula burgess of the town of La Réole , has complained to the king that Mota Guilhem-Ramon Lamothe , la Moleyra, Gabolh Bernat de Lamolère Gabouilh , 1 Farguas Guilhem-Ramon de Fargues, natural child ( natural ) , Grymoard Guilhem Grimoard , Johan de les Venas , Bernat Marifanh' , Dionisius Arnauton , Guilhem de Lenayt , natural child , Guinheta , Johan Gach , Bernat de Pès , Iterius, Brunhon Iter de Brugnon, natural child , Geraldus Guiraut de las Mans and Vet Johan Bet , called of Sescousse, 2 have been banished by the then prévôt of La Réole according to the local customs because they killed Pinibus, de Arnaut de Piis , Doat's son, and this banishment has been confirmed by Ralph, earl of Stafford , who was then king's captain and lieutenant in the duchy of Aquitaine; but these banished people still wander and move along in the duchy despite this banishment, committing several damages and crimes, so that Doat de Piis supplicates the king to confirm this banishment and order its execution.

Order to the seneschal of Gascony, Pomeriis, de Hélias de Pommiers , Mountaunt Peire de Montaut and the Briggerak castellan of Bergerac that, having summoned before them, or at least before three or two of them, the parties and heard them on this complaint, if it happens that this complaint is true, then they have to do full justice and due restoration to Pons de Gourdon and Hélias Guilhem for the damages according to the right and the form of the truces. Gordoun, de Pons de Gourdon, Gurdoun lord of Gourdon , and Guillelmi Hélias Guilhem, knight of the de senescalcia Petragoricensis et Cressy seneschalcy of Périgord and Quercy , has complained to the king that after and against the truces of Bordeaux made between Edward [of Woodstock], prince of Wales , on the king's behalf, and the king's adversary of France, 1 were signed, 2 Briggerak Arnaut-Amaniu de Bergerac and Daunseran Nicholet d'Osserain, captain of Nadaillac , who are of the king's obedience, caught them by armed force and brought them to the place of Nadaillac , keeping them there in a such hard detention until they obtained from them some important sums of money; and thereafter Bergerac and Osserain have took by force the house of Hélias Guilhem and occupied it until they requested money from Hélias Guilhem to recover it, but this latter cannot obtain this sum of money, so both have supplicated the king to bring them a suitable remedy about it.

Pardon granted to Hélias d'Escodéca for all pains on his body and goods pertaining to the king, and of all pain of banishment proclaimed against him, the king granting him his firm peace. The king informs all his officers of the duchy of Aquitaine about it. Because of some wars and several dissents that happened between Scodaquan Hélias d'Escodéca 1 and Bernardus, Mathmogh Bernat de Mechmont on one hand, and the Villa Regali men of the town of Villeréal in Agenes' Agenais on the other; as well as those which happened between Escodéca and Guilhem Mesclamal , then Banes lord of Bannes , several damages and war excesses were made by Escodéca to his enemies, and Guilhem Mesclamal and some of his retinue ( comitiva ) were killed.

Appointment of the constable of Bordeaux, the mayor of Bordeaux and Master Burgundus Bergunh de Lia to hear and terminate the following case. Petrus, Creissano, de Pey de Creyssan, parishioner of Donpiano de Medulco, de Le Pian-Médoc , king’s free man , has supplicated the king that he has complained against the chapter and canons of Saint-Seurin of Bordeaux because they claim to reduce him, his goods and his servants to the status of questal . 1 These latter imprisoned him, tortured him and almost killed him. Then they summoned him before the Blanquaforti, de bayle of Blanquefort on which Creyssan has appealed to the king’s court of appeals of the castle of Bordeaux before the seneschal of Gascony or the king’s judge being there, and thereafter, because of some damages he suffered in this latter court according to what he asserts, he appealed of the seneschal and this judge to the king as king of France, as more fully appears in a public instrument.

Grant to the Sancta Crux de Burdegal' abbot and convent of Sainte-Croix of Bordeaux to have forever the stream of Laigaborda l'Eau Bourde running freely from the Bardenaco, de mill of Bardenac 1 up to the Petra longa mill of Peyrelongue 2 , saving the rights of the king's subjects of this area. The king forbids anyone to make diversions on the sides of this stream situated between the mill of Bardenac and the mill of Peyrelongue and he also forbids anyone to impede its flow and its straight course towards the mill of Peyrelongue for the use of the mills of Sainte-Croix which are situated near this convent. The abbot and convent of Sainte-Croix of Bordeaux have supplicated the king that, as Richard [the Lionheart], former king of England , then count of Poitou and duke of Aquitaine , 3 granted to the then abbot and convent of Sainte-Croix that the Petra longa stream of Peyrelongue which have been built and created by their predecessors and which is flowing down to the mills of Sainte-Croix that are near the convent be not diverted; and this stream, also called l'Eau Bourde, which is flowing down straight from the mill of Bardénac to the mill of Peyrelongue, is partly owned by this abbot and convent, and is flowing from there to the mills of Sainte-Croix , and it could happen that this stream be diverted upstream of the mill of Peyrelongue by some malevolents who left these mills without enough water, and thus caused the fall of the profits of the abbot and convent's mills, so they have requested the king to grant them to keep this stream without any diversion made between the mill of Bardenac and the mill of Peyrelongue.

Order to the seneschal of Gascony and the constable of Bordeaux to remove Johan de Marceille from the houses and plots ( keye ) [mentioned below] and return them with their profits and emoluments to Walter de Mauny according to the king's grant, any grant of the prince of Wales notwithstanding. Walter de Mauny 1 has supplicated the king that this latter has granted to him and his heirs on 23 March 1350 the houses and plots with their appurtenances which were owned in Libourne by Marcell' Ramon Marceille , the king's enemy who joined the king's adversary, 2 and came into the king's hands, but Mauny was removed from their possessions when Edward [of Woodstock], prince of Wales , then king's lieutenant in the duchy of Aquitaine, gave them to Johan Marceille, son of Ramon Marceille, without being informed of the king's grant to Mauny, so this latter has requested the king to return them to him. Someone of the prince's council has confirmed to the king that the prince was not informed of the grant made by the king to Mauny.

Grant to Pomeriis Guilhem-Sans [III], lord of Pommiers , of the castle 1 and Blansak castellany of Blanzac , to have, hold and possess the same with its rents and other appurtenances to him, his heirs and successors, from the king and his heirs, for the services and dues that are owed and accustomed forever, saving only to the king his sovereignty, resort, homage and other rights. If it should happen that the castle and castellany are restored to the la Roche lord of La Rochefoucauld by the peace, 2 then the king wishes that Guilhem-Sans should be fully satisfied for all his expenses that he has been put to for the preservation, garrisoning and repair and fortification of the castle by the lord de La Rochefoucauld before he is restored to his castle and castellany.

Guilhem-Sans has requested that the king will grant the castle and castellany of Blanzac to him and his heirs and successors forever, since he captured them from the king's French adversaries, and has held it for sixteen years, 3 and has repaired and refortified the walls and fortifications, which were ruinous, without taking anything from the king or his officers. The king wishes to agree to this request for Guilhem-Sans's laudable service, and for the many damages and losses that he has sustained in that service.

28 May 1357 . Burdeg' Bordeaux .

Grant by Edward [of Woodstock], eldest son of king of England and France, prince of Wales , duke of Cornwall and earl of Chester , to the Lyburnia mayor, sub-mayor, jurats and the inhabitants and all the community of the town of Libourne in return for their faithful service to the prince, and in answer to their petition that: first that they and their predecessors, to support their fortification, enclosure, necessities and other burdens have imposed taxes on measures of corn, wine, salt and other goods sold or loaded there, and they may now impose these charges with royal permission for the next thirty years from the day of the making of these letters, provided that the money is used for the fortification and enclosure of the town and other clear necessities and the levies are collected by two law-worthy men from the town chosen by the mayor and jurats who are to swear on the Gospels to collect them well and lawfully and expend them on nothing else;

Item the prince also wishes that law-worthy men chosen by the prince's father, the prince, or the seneschal of Gascony or the constable of Bordeaux, or their deputies, are to ascertain the title and nature of the holdings in land, houses and plots in the town are held in fee from their lord, the prince's progenitor and to the prince, by what title, and what payments and rents are due from them, so that each burgess and inhabitant of the town will be bound to pay the dues and rents to the lord each year, and the lord’s right will be observed;

And also the prince grants to the mayor and jurats that they are to have jurisdiction over weights and measures of corn, wine, salt, cloth, ulnage and everything else except for the weight of coinage; the weights and measures should be reasonably set as in other towns in the area and compared to the king’s exemplar in the town;

Also the prince grants at their request, that contracts and agreements between themselves and the burgesses of Saint-Émilion which provide that no vessel or ship whatever it is called is to unload at the port of Petra fixa Pierrefitte or at any other place within the jurisdiction of Saint-Émilion to carry or load wine or any other goods except at the port of Libourne , except for their own wines or wine from the vineyards of the burgesses or inhabitants of Saint-Émilion, just as is contained in letters of the king or a decree ( arresto ) between them and the inhabitants of Saint-Émilion, or of their predecessors, and the inhabitants of Saint-Émilion or their predecessors, under the royal seals, and those of the towns, as they assert, and the letter, contracts agreements will be observed.

The prince grants to the petitioners that no subject of his of whatever rank or status can erect or make a sea coast from the above limits or elsewhere except by royal grace or that of the prince which leads to the loss or prejudice of the petitioners or their goods. The prince is aware that the sea coast extends from Solaccum Soulac and Talemone Talmont to Libourne but not further in regard to any shipwrecks or the loss of wine or other goods and merchandise, though some of the prince's subjects wish and insist, allegedly, in an insult to the prince’s majesty and usurpation of the prince’s right and jurisdiction, to erect and make a sea coast in their jurisdictions, to the manifest prejudice of the supplicants. 1

Also the prince grants to the petitioners that no royal baron nor any bayle or prévôt, nor officer or minister, nor the mayors or jurats of the towns may in future accept any false claims against the petitioners nor exercise jurisdiction over them or their goods except in cases of deeds known to have been done in their jurisdictions and the prince forbids it. All the above commands must be kept, saving the king’s majesty.

27 May 1356 . Burdeg' Bordeaux .

Grant by Edward [of Woodstock], eldest son of the king of England and France, prince of Wales, duke of Cornwall and earl of Chester, considering their past and present service and weighing their losses and expense suffered in the Gascon War, and that their town was founded on such land that within their jurisdiction for half a Gascon league and more, because of the poor land, corn and vines will not germinate and produce fruit with the fertility they need, which as a result the prince's forebears gave them the ancient liberty of trading salt, enriching and supporting their livelihoods as follows: namely that from the place called le Bec Dambes Bec d'Ambès to Libourne, and not from Libourne to Brageriacum Bergerac , salt could not be sold or unloaded except in Libourne, and at the two fairs at the feasts of Saint-Vincent at the town of Burgum Bourg . The prince makes known that he approves the petition of the mayor, jurats and inhabitants of Libourne, and allow them to use salt as above. No-one is to contravene this order. 2

Letters of Edward [of Woodstock], prince of Wales , the king's lieutenant in the duchy of Aquitaine, granting, at the request of the mayor and jurats of the town of Libourne , three fairs of 15 days each year, on Martinmas, at the beginning of Lent, and on St Nicholas day in May, if there is no such fairs at the same dates in Saint-Émilion or in other neighbouring towns. 3

Order to the mayor, jurats and community of the city of Bordeaux to stop demanding the tax of 2 s.t. on each tun of wine brought by the burgesses and inhabitants of the town of Libourne and others which have their wines growing on their vineyards situated below Saint-Macaire, 1 against the tenor of the king's grant done to them, and not permit them to be molested or damaged. And if anything has been unjustly taken to them, then they have to return it to them without delay, so that no complaint reaches the king again about it. Formerly, the king granted to the mayor, jurats and community of the city of Bordeaux to have the right to levy on all persons, good or wine coming from the town of Sanctus Macharius Saint-Macaire to their city of Bordeaux to be sold, 2 s.t.parv. for each tun ( dolium ) and on other goods according to this rate, in order to help them for the repair of their city's walls and turrets, as appears in the king's letters patent made about it, and yet the burgesses and inhabitants of the town of Libourne have complained that despite the fact that Libourne is situated below Saint-Macaire towards Bordeaux by ten miles or more, they compel them to pay this tax to their great damage and against the king's grant.

Order to the constable of Bordeaux to release the annual 16 l.st. to Saltu, de Bernat de Sault or his proctor. Bernat de Sault has supplicated the prince, as the writing office of the court of Gascony has been granted to him for life by the prince's ancestors by their letter patent, and some of his predecessors in this office have anually received 16 l.st. by some constables of Bordeaux for their maintenance in this office, to order to the constable of Bordeaux to pay him this annual sum of money.

13 April 1358 . Westminster . For the king, concerning the usurpations made by the men of Saint-Émilion on the men of the banlieue of Saint-Émilion to be cancelled .

Order to the seneschal of Gascony, the constable of Bordeaux and the juge-mage of the court of Gascony that having summoned before them the prévôt of Saint-Émilion , they have to inform themselves with his advice and other ways, and if they learn by this information that the men of the banlieue of Saint-Émilion have to be outside the jurisdiction of the mayor and burgesses of Saint-Émilion and these latter are making burgesses the men of this banlieue without right, removing them from the king's jurisdiction and appropriating without right the king's other rights, to the king's prejudice, then they have to correct it and return this situation to its original state, and have to punish the offenders so that it will convey fear to any others who might wish to attempt to usurp the king's rights. The king has learned that the Sanctus Emilianus mayor and burgesses of the town of Saint-Émilion made burgesses the men king's men living in the banlieue of Saint-Émilion and outside this jurisdiction and attracted them in the town's jurisdiction, usurping the other king's rights to the obvious great prejudice and despoilment of the king.

Grant to the nobles, consuls and community of Sainte-Foy[-la-Grande] that their town or its parts or appurtenances be forever united to the crown of England without possibility to alienate it. The king revokes by these presents all the grants made by the king or others against the tenor of Edward I's letters and their confirmations since the publication of Edward I's letters, and the situation has to be returned without delay to its original state. However, the profits and emoluments of the baylie of Sainte-Foy[-la-Grande] have to remain to Bertrandus, Duro Forti, de Bertran de Durfort, kt , as it has been formerly decided at Bordeaux by the council of Edward [of Woodstock], prince of Wales . Formerly, Edward I , the king's grandfather, because of the good service of the nobles, consuls and community of Sainte-Foy made to the king, had granted by his letters patent, which the current king has confirmed, that the consuls and community of Sainte-Foy cannot be put outside the king's hands or the hands of the king of England's heir. However, the nobles, consuls and community of Sainte-Foy[-la-Grande] have supplicated the king, as several grants of parts or appurtenances of their town have been made to several persons against the tenor of their privileges, to keep their privileges and revoke these grants.

Order to the seneschals of Gascony and the Landes, or at least one of them, to swiftly inform themselves or through commissaries delegated by them to that, on the trial [mentioned below] and hear the castellan of Mauléon, if it appears that this trial has been fairly made and has been not yet executed, then they have to capture Arnaut-Guilhem, lord of Olhaïby, and keep him in jail in the Maloleone, de castle of Mauléon without any release until they receive a king's order, and they have to satisfy the king's subjects of this area of their damages, and they have to seize for forfeiture in the king's hands Arnaut-Guilhem's goods and chattels which are in the land of Soule or elsewhere in the duchy of Aquitaine, and they have to appraise his goods and chattels and to respond to the king of the revenues of these lands and tenements as well as the price of these goods and chattels. The king orders to all his proctors and officers to execute it in the king's name and punish Arnaut-Guilhem according to the local fors and customs and the presents letters, and inform about it without delay the constable of Bordeaux. The king has learned that Arnaut-Guilhem, Holhabia lord of Olhaïby , former king's liege and subject, stood by the Degramonte lord of Gramont , 2 a manifest king's enemy, and the king's adversary of France, 3 against the king when the war broke between the king and his adversary of France, and he fortified his Holhabia castle of Olhaïby which is in the land of Soule, garrisoned it with French, and waged war with the king's enemies against the king and Mille Sanctis, de Ramon de Miossens, Maloleone, de castellan of the castle of Mauléon which is in the land of Soule , a land being at the borders with the king's enemies, tried to take by treachery the castle of Mauléon with the lord of Gramont in order to hand it to the king's enemies, and he also tried to kill its garrison. In order to do so Olhaïby made several meetings at night around this castle and his malefactors have committed at its instigation several damages, thefts and other crimes and destructions in Soule around Mauléon. Consequently, a trial has been made on Arnaut-Guilhem's treason and misdeeds before the castellan of Mauléon at the king's court of Soule , but Arnaut-Guilhem refused to appear before it, so he has been banished as public enemy and king's adversary according to the local fors and customs, but thereafter Arnaut-Guilhem with several of his accomplices banished from the land of Soule committed other worse misdeeds.

Richard's ancestors gave to Sainte-Croix from the county's domain 3 the villae of Ortolaminus Le Taillan and Mathau Macau with the adjacent island 4 and their appurtenances. Richard grants to Sainte-Croix to have the Petra longa stream of Peyrelongue 5 which is going down to the mills of Sainte-Croix situated near the monastery , without allowing any diversions on the sides of this stream. If any knight, peasant, man of any condition or a Richard's man tries to infringe this grant and make diversions on this stream, he has to compensate the church of Sainte-Croix for the damages he has done and thereafter he has to pay 1,000 s. or he has to be banished.

Formerly, the king has granted to the burgesses and inhabitants of Libourne by his letters patent that they were exempted forever to pay any taxes levied on their wines and goods in the duchy of Aquitaine, against the privileges, liberties and old customs granted to them by the king or his ancestors, yet they have been compelled to pay the custom on their wine loaded at Bordeaux and the other taxes and tolls due to the king, notwithstanding their letters of privileges; and the king had ordered to the seneschal of Gascony and the constable of Bordeaux to exempt them from these payments according to the tenor of the king's letters and not permit them to be troubled about it, but they have been forced again to pay various taxes and tolls on their wines and goods, after the king's grant and against its tenor, in various places of the duchy, and the seneschal and the constable did not bring any remedy about it even if they have been required to do so several times, so the burgesses and inhabitants of Libourne request the king to bring them remedy on this matter.

Order to the seneschal of Gascony to fully revoke all the granted marques and drop their execution, and if anything has been seized by virtue of these marques, he has to return it without delay to the person on which it has been seized, the king forbiding him to grant any marque without his special order. The king has learned from a reliable source that many damages have been done to the king and his people because of certain marques granted by the seneschal of Gascony in the duchy of Aquitaine on the goods of the subjects adverse to the king of these regions, so it has been decided by deliberation of the king's council that all these marques were revoked.

Grant for life to Alberti Guilhem Aubert , because of his good service to the king and the prince of Wales in the wars of Gascony, putting at risk his body to danger and injuries, of the Vasato, de prévôté of the town of Bazas with its revenues and emoluments, to be governed by him or his suitable attorney, any grant made until then to Arnaut Micol or anybody else, or against it notwithstanding. Formerly, the king had granted by his letters patent to Guilhem Aubert, damoiseau, the place of Cadilhaco in Fronsadesio, de Cadillac-en-Fronsadais with all its appurtenances and high and low justice, 1 which were formerly owned by Durofforti Bertran de Durfort, kt , and came into the king's hands by his rebellion. But, as a treaty has been made between the prince and Galhart de Durfort, kt, lord of Duras, 2 the prince promised, among other things, to return Cadillac-en-Fronsadais to his brother Bertran de Durfort, and Guilhem Aubert gave it up to the king and the prince returned it to Bertran de Durfort because he returned to the king's obedience.

Inspeximus and confirmation of the letters patent of Edward [of Woodstock], prince of Wales :

7 April 1357 . Burdeg' Bordeaux .

Grant by these presents to Fossato, de Amaniu du Foussat, kt , Madalhano, de lord of Madaillan , and his heirs, at his supplication, because of Foussat's long service he made to the king and the prince of Wales in the wars in Gascony and the many damages and injuries he suffered because of this war, of the place of Preyssan Prayssas in Agenesio, de Agenais , with high and low justice, and its revenues, emoluments and its appurtenances, a place which has been seized in the king's hands because of the rebellion of its co-lords, saving the superior homage and resort to the king and the prince. It is ordered to the constable of Bordeaux, the seneschal of Agenais and the treasurer of Agenais to put in possession Amaniu du Foussat or his proctor of this place of Prayssas with its appurtenances. They have to maintain and defend him in this possession and permit him to enjoy it without any opposition.

Order to Master Podio, de Guiraut Dupuch, juge-mage of the court of Gascony , Master Petrus, la Culra Peire de la Colre, official of Bordeaux and Master Gask Robert Gasc that having heard the complaint of Pey Vergnes and having summoned before them Guilhem de Bragier, and they have to fully inform them and if it happens by this information that Vergnes said the truth, then they have to punish Bragier in such way it will put fear in those wanting to do the same against the king and his officers. And they have to fine Bragier to compensate Vergnes. The king orders the mayor of Bordeaux , the Umbreria prévôt of the Ombrière and all the other king's officers to obey and attend them on this matter. They have to avoid that this cause reaches again the king by their default. Vernhes Pey Vergnes, keeper of the gold money which is minted at Bordeaux and lieutenant of Master Saltu, de Bernat de Sault, keeper of the silver money which is minted at Bordeaux , king's clerk , has complained to the king that Bragario, de Guilhem de Bragier insulted Pey Vergnes on a public road ( via publica ) when this latter was occupied with the king's business, beat him and cruely injured him on his head, and made him other wrongs, so that Vergnes was unable to perform his offices and receive their revenues for a long time to the great damage of the king and Vergnes, and against the king's peace. Pey Vergnes has prosecuted several times to obtain justice, but it had not obtained it, to the king’s amazement.

Appointment at the king's pleasure of Master Plassanis, de Arnaut de Plassan as judge appellate of the court of Gascony and auditor of the causes of this court with the emoluments and profits pertaining to this office, receiving the customary fee or wages which were received by his predecessors in this office. Order to the seneschal of Gascony that if the cause [mentioned below] is pending before him, to summon before him the parties and hear them and to terminate it according to the local fors and customs, so that no complaint about it returns to the king in the future. The Viraco, de inhabitants of the parishes of Sauros and Birac has complained to the king that these parishes are pertaining and should pertain to the Vasaten' prévôté of Bazas , and the king granted by his letters patent, when it returned to the king's obedience, 1 that the city and prévôté of Bazas with all the parishes and appurtenances formerly pertaining to this prévôté had to remain forever united with the crown of England; but Mota, de Auger de Lamothe , tutor of the daughter 2 of Fargis, de Amaniu de Fargues , his ward, as [Henry of Grosmont], duke of Lancaster , when he was earl of Derby, and king's lieutenant in the duchy of Aquitaine, granted the high and low justice to Amaniu de Fargues, claimed this justice to the prejudice of the king and these inhabitants and the grant done by the king; and a trial was made between these inhabitants and the king's proctor of Gascony on one hand, and Auger de Lamothe in the name of his ward on the other, before Edward [of Woodstock], prince of Wales , then king's lieutenant in the duchy of Aquitaine, which was not finished when this latter returned [to England] and is still pending before the seneschal of Gascony and is still not terminated because of various postponements, and it has caused various troubles and expenses to their grave damage, so they request the king to provide them a remedy.

Order to the seneschal of Gascony, the constable of Bordeaux and all the king's officers in the duchy of Aquitaine to permit the Sanctus Macharius jurats, burgesses and inhabitants of the town of Saint-Macaire and their jurisdictions, to be forever exempted to pay from next Michaelmas 1 6 d. by pound ( per libra ) on all the goods they bring to Bordeaux , and they have not to permit them to be molested about it. The jurats, burgesses and inhabitants of the town of Saint-Macaire have supplicated the king that they have the right from time immemorial to bring their goods to the city of Bordeaux without paying any toll or custom on them; and although [Henry of Grosmont], duke of Lancaster , former king's lieutenant in the duchy of Aquitaine, has confirmed their liberties and franchises and this right, the mayor, jurats and the community of the city of Bordeaux, under the pretext of some letters granted by the king, have demanded and extorted from the former 6 d. by pound ( per libra ) on all the goods they bring to Bordeaux to their great damage, so they request the king to revoke this tax and the mentioned king's letters.

This is providing that the house or fortalice should be returned to the king or his heirs at the order of the king, his heirs or their seneschals of Gascony, in times of war or peace ( iratis et pacatis ). Bagerano, de Galhart de Bagéran, kt , and his paternal uncle Montezinus, Bagerano, de Montasin de Bagéran have supplicated the king, as their house and fortalice they had in the place of Castro Endort, de Castets-en-Dorthe and the Savinhaco, de parish of Savignac in the Vasaten' diocese of Bazas has been fully destroyed to the ground by some of their enemies at the time of the wars, to rebuild their house and fortalice in the place of Castets-en-Dorthe and the parish of Savignac in the place they will find suitable.

Order to the seneschals of Gascony and Périgord , 1 the juge-mage of the king's court of Gascony and the constable of Bordeaux that having heard the complaint of the abbot of Brantôme and having summoned before them the malefactors [mentioned below], they have to swiftly inform themselves on the damages and injuries [mentioned below], and if it happens that the abbot of Brantôme tells the truth on this matter, they have to compel the malefactors to return the goods they seized and also to pay fines to compensate the damages done to the abbot and his convent, and if they continue to perpetrate these damages, they have to punish them in such way it will put fear into those trying to do the same. They have to avoid that this cause reaches again the king by their default. Hélias [de Campagnac], Brantolme abbot of Brantôme , 2 has complained to the king that some of his enemies have entered the abbey at war, have stolen his goods, 3 and have totally destroyed the harvests of the abbey on which the abbot and convent relied to live; and althought Edward [of Woodstock], prince of Wales , then king's captain and lieutenant in the duchy of Aquitaine, following the complaint of this abbot, had placed in the king's protection and safeguard the abbey of Brantôme, with its monks, servants and goods, ordering by his letters to these malefactors to stop doing these damages and injuries to this abbot, abbey and convent, these malefactors have continued to do it and continue to do so, therefore the abbot of Brantôme has supplicated the king to bring a remedy about it.

Order to the seneschal of Gascony and the constable of Bordeaux that having seen the letters made to Ramon Durand, and if by legitimate information they notice that Ramon Durand and Galhart Durand had the possession of the baylie of Labourd and its revenues mentioned in the king's letters, and Galhart has been unjustly removed, then they have to return without delay this baylie and its revenues to him, and in case this land and baylie cannot be returned to Galhart, the value of this revenue has to be given to Galhart from the issues of this baylie by the hands of the bayle of Labourd since the time Galhart has been removed from it. And if the revenues of the baylie of Labourd are not sufficient, he has to be paid on the issues of the duchy of Aquitaine or on a suitable allocation. Galhart [Durand] , son and heir of Ramon [Durand], former Landar' seneschal of the Landes , has supplicated the king, as on 26 January 1331 the king has granted to his father Ramon, 1 because of his good service towards him and Edward II, and in compensation of the lands he lost because of his service to Edward II, of 100 l.st. to be received each year from the king's issues in the baylie and land of Labourd , forever or until Ramon recovers his lands, and Ramon had this baylie and its revenues until he was killed in the assault and fight of la Reyne [Pont]-la-Reine 2 which was occupied by the king's enemies; and his son Galhart peacefully held his baylie and its revenues for fourteen years after the death of his father, but he has been removed from this office and did not receive anymore its revenues because some people of Labourd did not want to obey him, and although Galhart faithfully served Edward [of Woodstock], prince of Wales , expending large sums of money and suffering several losses in this service, and having failed to recover the baylie of Labourd despite his prosecutions, to his great damage and impoverishment, to bring a suitable remedy on this matter. 3

Order to the constable of Bordeaux to have full information on the true value of the viguerie of the market of Bordeaux and all what pertains to it, and he has to allocate it to Bertholomiu de Fayet to be held by him or a suitable delegate in part of payment or in full payment of the 12 d.st. a day granted to Fayet, until this sum is allocated to him in a suitable place. If the issues of this viguerie exceeds this daily sum of 12 d. , Fayet has to respond of the surplus to the king, and if it does not reach this daily sum, he has to swiftly pay him or allocate him a suitable allocation in a place where he will be satisfied. Formerly Fayete Bertholomiu de Fayet, king's clerk , was appointed as remembrancer ( memorandaria ) of the Burdeg' castle of Bordeaux and keeper of all papers, registers, notarial instruments and protocols of dead notaries made by the king's authority in the duchy of Aquitaine , 1 receiving for life 12 d.st. a day on the issues of the duchy of Aquitaine, 2 but the king has learned that this sum of money has been allocated elsewhere. Fayet was not paid from these issues, so the king delivered to him the office of the keepership and assay of the money of Dax, so that if the revenues of this latter office exceeded this sum of 12 d.st. a day, Fayet had to pay the surplus to the king. But Fayet has supplicated the king, as this office of keepership and assay is weak because of the wars and its profits were not sufficient to pay the daily 12 d.st. , to grant him the the viguerie of the market of Bordeaux and all what pertains to it or should pertain to it that Gaucem d'Ignac, former king's servant-at-arms, held by the king's grant when he was alive, in payment of these 12 d.st. a day if its profits reach this sum or in part of its payment.

Order to the seneschal of Gascony, the constable of Bordeaux and the juge-mage of the court of Gascony that having heard the complaint of Maria de la Trau, called before them Galhart d'Agassac and checked the charters and instruments [mentioned below], if they notice by this information that Galhart d'Agassac owed money to Maria de la Trau, then they have to compel Galhart to pay these sums of money to Maria with the damages caused by the retention of these sums and the prosecutions made by Maria, and they have to make full justice according to the local fors and costums. Latrao Maria de la Trau , widow of Matheus, Dagasano Mathiu d'Agassac , son of Dagasano Galhart d'Agassac, kt , has supplicated the king, as at the time of her wedding to Mathiu d'Agassac, a contract had been made where some sums of money were granted as her dowry to Galhart and Mathiu, these sums having to be returned to Maria and were guaranteed on the goods of Galhart and Mathiu, as appears in some charters and instruments made at this occasion. Maria has prosecuted several time Galhart d'Agassac after the death of her husband to have the restitution of these sums of money, but she was unable to obtain these sums of money to Maria's great damage and obvious impoverishment, to provide her with a suitable remedy about it.

Order to the seneschal of Gascony, the constable of Bordeaux and the juge-mage of the court of Gascony that having heard the complaint of Marquesa de Rouffignac, called before them the heirs of Gauter-Amaniu de Bergerac and checked the charters and instruments [mentioned below], if they notice by this information that Gauter-Amaniu owed money to Marquesa, then they have to compel the heirs of Gauter-Amaniu to pay these sums of money to Marquesa with the damages caused by the retention of these sums and the prosecutions made by Marquesa, and they have to make full justice according to the local fors and costums. Roffynhaco, de Marquesa de Rouffignac , widow of Gauter-Amaniu de Bergerac , has supplicated the king, as at the time of her wedding to Gauter-Amaniu, a contract had been made where some sums of money were granted as her dowry to Gauter-Amaniu and other sums of money were granted to this latter by Marquesa's brothers and some of her friends, these sums having to be returned to Marquesa and were guaranteed on the goods of Gauter-Amaniu, as appears in some charters and instruments made at this occasion. Marquesa has prosecuted several time the heirs of Gauter-Amaniu de Bergerac after the death of her husband to have the restitution of these sums of money, but she was unable to obtain these sums of money to her great damage and obvious impoverishment, to provide her with a suitable remedy about it.

Order to the seneschals of Gascony and Périgord , 1 the juge-mage of the court of Gascony and the constable of Bordeaux that, having seen the agreement ( composicio ) [mentioned below], and having on this swift information, if they notice that this agreement has been done in the [mentioned] form and has not been respected by Johan de Galard and his father, and the prévôt of Trémolat has been damaged and molested by them against the tenor of this agreement, they have to compel Johan de Galard to respect the payment of the allocations and revenues of the territory delimited in this agreement, and satisfy the prévôt of Trémolat of the arrears of these revenues and the damages done by Johan de Galard and his father to this prévôt and his predecessors against the form of this agreement, and do full restitution of the prévôt's lands and men kept by Johan de Galard and his father, and they have to compel Johan de Galard to pay to the king and the prévôt the fines specified in this agreement, and return things to the previous state according to the local fors and customs. The king forbids under pains Johan de Galard to damage in any way in the future the prévôt of Trémolat, or his monastery or his men against the form of this agreement. They have to defend and protect the said prévôt, his monastery, men and tenants from all injuries and violence made by Johan de Galard or others, and permit the prévôt, his monastery, monks and other delegated to the service of God which are under the king's protection and safeguard to do peacefully their office and enjoy the goods and revenues pertaining to this prévôt and this monastery. They have to act in such way this complaint does not reach the king again. Brother Sendreus Ramon de Cendrieux, prévôt of the Themolaco, de prévôté of Trémolat of the Order of Saint Benedict in the Petragoricen' diocèse of Périgueux 2 complained to the king, as there were formerly dissents between Peire de Galard, then Limolio, de lord of Limeuil and Clarencio, de co-lord of Clérans on one hand, 3 and the religious man Brother Benedictus, Dorvilla Benoît d'Orville , then prévôt of the prévôté of Trémolat on the other, about the complete and shared jurisdiction ( merum et mixtum imperium ) of the place of Trémolat and all its territory which were then in the king's obedience; and an agreement had been reached by some arbitrators between the two parts which specified that half of the jurisdictions of the complete and shared jurisdiction of Trémolat had to pertain forever to the prévot and his monastery, and the other half had to pertain to Peire de Galard, apart from the jurisdiction of the monastery, cloister and closure of Trémolat and some other places situated within the territory of Trémolat which had to be owned by the prévôt and his monastery, and Peire de Galard had allocated 25 l. of rent on goods and suitable fiefs to the prévôt and his monastery. Thereafter, Johan de Galard succeeded to his father and did not fully paid this sum of 25 l. to the prévôt and his monastery, and he constantly broke this agreement in levying on the men of the monastery and their vassals and tenants taxes and tallages they did not have to pay, and he continues to demand to the prévôt, his men, vassals and tenants to repair the walls and moat of his Lymolio, de castle of Limeuil and to force these latter to cultivate his vineyards and lands, and does not stop committing other damages against the form of this agreement, so the prévôt of Trémolat supplicates the king to bring him a suitable remedy on this matter.

Order to the seneschal of Gascony and the constable of Bordeaux to execute the first order of the king obtained at the prosecution of the mayor, jurats, community and inhabitants of Saint-Émilion, 1 the letters of the prince of Wales and their confirmation by the king notwithstanding. 2 Formerly, the Sanctus Emilianus mayor, jurats, community and inhabitants of Saint-Émilion and the inhabitants situated within the banlieue and prévôté of this town complained to the king that Ramon de Pellegrue , appointed by the king as prévôt of Saint-Émilion , has committed several damages, extortions and oppressions against the men of the town, banlieue and prévôté of Saint-Émilion, to their obvious impoverishment and destruction, and the king had ordered to the seneschal and the constable that having summoned before them Ramon de Pellegrue and heard the king's proctors, and if it happened by legitimate information that Pellegrue has behaved as complained and is guilty, they had to correct these excesses, then they had to remove Pellegrue and compelled him to compensate them, and they had to appoint a sufficient and suitable person at this office until the king ordered otherwise. 3 But the mayor, jurats, community and inhabitants of Saint-Émilion have informed the king that Edward [of Woodstock], prince of Wales , then king's captain and lieutenant in the duchy of Aquitaine, gave letters to Pellegrue pardoning him for all his felonies and forfeiture and protecting him from all penalties about them, letters which were confirmed by the king, 4 so they supplicate the king to provide them with a compensation about it.

Order to the seneschal of Gascony and the constable of Bordeaux that having heard the complaint of Johan Colom, having summoned before them Auger de Montguyon and checked the obligatory letters, if they notice by this inspection and other means that Sicard de Montguyon and Guillaume de Montguyon owed 500 l.t. to Miramunda Dumas, and are owed to Johan Colom, son and heir of Miramunda, by Auger de Montguyon, heir of Sicard and Guillaume, then they have to compel Auger to pay without delay this sum to Johan Colom or deliver him this sum on his goods according to the letters [mentioned below] and the local fors and customs. Colomp Johan Colom, citizen of Bordeaux , has complained that the late Sicardus, Montguion Sicard de Montguyon and the late Guillaume [de Montguyon] , his son and heir, and their goods, were bound in 500 l.t. to be paid on certain terms to Miramanda, Mas, de Miramunda Dumas , his mother, 1 as appears in the letters of Sicard and Guilhem made about it under the executory seal of Bordeaux, which sum of money is still not paid. And although Johan Colom has requested several times this sum of money to Ogerus, Montguion Auger de Montguyon , son of Sicard and heir of Sicard and Guillaume, this latter has refused to pay to Colom's damage, so Johan Colom has requested the king to bring a remedy on this matter. 2

Formerly, the king had granted for life to Bertran, lord of Montferrand, because of the damages and injuries he suffered in the king's service, the castle and castellany of Talmont with its parts which was then in the hands of the king's enemies, with complete and shared jurisdiction and with the other revenues pertaining to this castle and castellany, as soon as they went in the king's hands, as appears in the king's letters patent. Because of the advice and help Montferrand gave to Edward [of Woodstock], prince of Wales , when he was king's captain and lieutenant in the duchy of Aquitaine, on the management of the prince's business, as the prince has certified it before the king, and in compensation of the Trenna land of Latresne which went in the king's hands by the rebellion of Feriol Guilhem de Ferréol , which had been granted to Bertran de Montferrand and his wife for the lands and revenues lost by them during the wars in the duchy, and as Guilhem de Ferréol has obtained the return of his land of Latresne to him in the treaty he made with the prince of Wales, these castle and castellany of Talmont are granted for life to Montferrand.

Bertran and his heirs have to receive forever the annual 200 m.st. allocated to Bertran from these revenues, until there are allocated elsewhere to him in the duchy of Aquitaine. If the revenues of the baylie of Saujon exceed this sum, then Bertran has to respond of the surplus to the king, and if there are below this sum, then Bertran has to be satisfied of this sum in a suitable place situated elsewhere in the duchy. Bertran de Montferrand has not to be removed from this baylie until the king finds him a suitable place for this allocation situated elsewhere in the duchy. The annual rent of 200 m.st. on the issues of the duchy of Aquitaine has been granted by the king to Bertran de Montferrand in compensation of the half of the Verynes land of Veyrines which had been seized by the king on Duro Forti Galhart [I] de Durfort , because of this latter rebellion, Bertran had to return to this latter following the treaty made between Durfort and Edward [of Woodstock], prince of Wales , then king's captain and lieutenant in the duchy of Aquitaine. 1
