Physical condition of the roll

The roll consists of twenty-two membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/129 17 & 18 Henry VI (1438-1440)

Introduction.

In this roll, we can see that the string of rewards continues for Bernat Angevin, one of the main officers of the king in the duchy and local man. Henry VI ordered the men of Pujols to submit to Angevin since he had been given the lordship of Pujols. 1 But the possession of this lordship and that of Rauzan, also granted to Angevin, was challenged in court by Amaniu de Madaillan, called 'the Baron', a cousin of their last hereditary lord and one of the leaders of the English party in Agenais. 2 The castellany of Lesparre had also been granted to Angevin in compensation for another grant which had been returned to a former 'rebel' who left the French party and returned to English allegiance. 3 The grant in perpetuity of Gensac to the knight Loys Despoy and his heirs made on 29 May 1439 4 was never implemented since the town's inhabitants opposed it, requesting a renewing of the annexation of their town to the crown of England. 5 They finally obtained the office of captain of their town for Isarn de Lavergne, the son of the last captain. 6 Loys Despoy also experienced many difficulties in order to receive the Landais lordship of Doazit granted to him in 1437, because the heir of this lordship, a Gascon lord of 'French' Gascony, still occupied it. 7

Worthy of interest is the ennoblement granted by the king of the Bouscat brothers who came from places around Fronsac, which included a painted coat of arms. 8 The esquire Guilhem de Boisset was rewarded for his resistance against the French by his creation as a burgess of Bordeaux. 9

Two letters of protection of interest were granted: one to a master of a ship of Danzig, the other to two masters of a Breton ship. 10

Several entries concerning ecclesiastical matters are copied into this roll. The prior and men of the convent of the Augustinians of Bordeaux had requested the king in 1439 to allow them to buy lands up to 60 librates of English money and to sell without paying customs 12 tuns of wine coming from their possessions: this was on the grounds that they had to repair their convent and they had not received recently the customary revenues of their vineyards because of bad weather and destruction caused by the French expedition of 1438 led by Rodrigo de Villandrando and Poton de Xaintrailles, the first really significant military incursion for many years. 11 The king tried, in vain as the monks later refused, to give a revenue of the abbey of Saint-Croix of Bordeaux to the Englishman Richard Logan. 12 The king was more successful in granting the priory of Saint-Martin du Mont Judaïque of Bordeaux to a Gascon who was a brother of the Franciscan order based at Rouen: the king was presumably patron of this priory and therefore able to appoint its prior. 13 An order was also sent to remove the bishop of Dax Bernat de Laplagne, who was in conflict with Pope Eugenius IV, and enforce his replacement by the Basque Guissarnaut de Laxague. 14 The abbot of La Sauve-Majeure obtained from the king confirmation of two old charters granted to his abbey by Richard the Lionheart (1190) and Eleanor of Aquitaine (1199). 15

Several entries concern the war. We learn that Robert Strangways, captain of Fronsac, the main English royal-garrisoned fortress in Aquitaine, was allowed to buy in England 100 quarters of wheat through his brother for its victualling. 16 The Gascon lord Francès de Montferrand was allowed to keep the office of captain of the castle of Castelnau-de-Cernès without rendering anything to the king as he participated in its siege against the lord of Albret and held it thereafter, repairing its wall at his own costs. 17 The esquire Johan Amanieu was charged with testing the king’s money struck at Bordeaux in compensation for his several captures by the French and his participation in an expedition to save Calais led by the duke of Gloucester in 1436. 18

The duke of Gloucester, who had already started building up his landholdings in the duchy from 1430, acquired additional lordships by obtaining several lordships in Médoc as well as the lordship of Budos and Meilhan which had been seized in the king’s hands by the death of Pons VIII de Castillon (d.1430). 19 For his part, the earl of Huntingdon John Holland, king’s lieutenant in Aquitaine, who had been appointed on 27 March 1439. He mustered with 300 men-at-arms and 2,000 archers on 29 June 1439 to cross to the duchy. The size of force indicates how important the English saw the active defence of the duchy at this time, as well as hopes of action on the frontiers which triggered French counter operations. obtained for life the great lordship of Lesparre. 20

We learn of the end of a long trial about the possession of the lordships of Rions and Gironde which had been owned by Bérart III d’Albret who had defected to the French two years before his death (d.1379). The king and his councillors decided to give the lordships to Bertran III de Montferrand, a great Bordelais lord and one of the main supporters of the Anglo-Gascon regime, despite the opposition of the king’s procurator fiscal (royal proctor) in Aquitaine. 21

Order to the men ( gentes ) of Puyus Pujols to obey Bernat Angevin, chancellor of the duchy of Aquitaine , to whom the king has granted on 21 March 1438 the castle and Roazan lordship of Rauzan and their appurtenances, 1 and pay him the due rights, duties and customs they used to pay to the lord of Rauzan when the latter was alive. 2 These castle and Puyous lordship of Pujols , situated in the Inter duo Maria Entre-deux-Mers , are adjacent to the castle and lordship of Rauzan and pertained to the lord of Rauzan 3 when he was alive. And the king has ordered the occupants of the castle and lordship of Pujols to deliver them to Angevin in the same way that the lord of Rauzan held them when he was alive.

Order to John [Holland], Huntyngdon earl of Huntingdon , king's lieutenant in Aquitaine , to expel and remove the Villa lord of Viella , the king's rebel, or others unlawful helders from the lands and Doasit lordship of Doazit , and deliver them to Loys Despoy or his deputy, receiving on behalf of the king Despoy's homage and other duties in the same way the lords of Doazit held them from the king's ancestors, dukes of Aquitaine, according to the duchy's fors and customs, and have them according to the tenor of the king's letters granting him Doazit. On 21 March 1437, the king had granted Doazit to Despoy and his heirs, 1 a lordship which had been seized by the king because of the rebellion of its legitimate heir the lord of Viella, former captain of Montargis . But Loys Despoy has informed the king that when he was at the king's service in the regions of France, Doazit has not been delivered to him, and in the meantime the lord of Viella fraudulently entered in Doazit because of the negligence in its keepership, and he still unlawfully occupies it, so Despoy requests the king to bring remedy about it.

Order to John [Holland], Huntyngdon earl of Huntingdon , king's lieutenant in Aquitaine , to really deliver the towns, castles and places of Riuoncium Rions and Gironda Gironde with their appurtenances, after removing any unlawful holder, to Monteferrando, de Bertran [III] de Montferrand, kt , and impose perpetual silence to the procurator fiscal and the other king's officers of the duchy. And the king orders his subjects and lieges to obey and attend him on this matter. Montferrand claims Rions and Gironde as nephew and heir of the late Labreto, de Bérart [III] d'Albret , and there has been a trial before the archbishop of Bordeaux and his other colleagues, 1 the report of which was entrusted to commissaries appointed by the king in the kingdom of England, and they found that the evidences shown by Montferrand against the statements of the king's procurator fiscal and others were convincing, and the Rions and Gironde belonged to Montferrand by inheritance and the king's grant. The king wants to grant Montferrand his special grace because of the great expenses he made for this trial and for the defence of the duchy at his own cost.

Order to his general governors and proctors of his lands and lordships of Guyenne, Shurtoise Gadifer Shorthose, kt , mayor of Bordeaux , and Bernat Angevin, king's councillor , that, having received the due oath of Francoys Francès de Montferrand, Duza lord of Uza and Belin , they have to deliver to him or his deputy the offices of captain and keeper of Gloucester's castle and lordship of Budos , and the office of governor and keeper of Gloucester's Pringnac lordship of Preignac , with their rents and revenues. Furthermore, Gloucester orders to all the justices, officers, men and subjects of his lordship of Preignac to obey and attend Francès de Montferrand or his deputies and pay without impediment during this latter lifetime the rents and revenues they had to pay to Gloucester. The duke of Gloucester had granted by his letters patent given at his manor of Grenwich Greenwich on 10 August 1437 the office of captain and keeper of his castle of Budos to Montferrand to be held by him or his deputy with its profits and revenues. But Gloucester has been informed by the supplication of Montferrand that these profits and revenues were very small and greatly insufficient for the expenses necessary for the keepership of the castle and lordship of Budos which are at the borders near the king's adversaries. 2 As Gloucester's lordship of Preignac is adjacent to the lordship of Budos, and because of the good services his brother Bérart de Montferrand , kt and his councillor, has made to him and the king, this latter having supplicated Gloucester on behalf of his brother Francès, the duke of Gloucester now grants for life to Francès the office of governor and keeper of the lordship of Preignac, with all its profits, rents and revenues.

And furthermore, the king grants to Francès de Montferrand and his male legitimate heirs the castle and lordship of Budos and [the lordship of] Preignac with all their revenues and rights if the duke of Gloucester dies without male legitimate heirs.

The king orders his officers to maintain, protect and defend Holme, not permitting anyone to injure his person, possessions and goods. The king wants Bolthorp to be deemed quit concerning all trials and complaints, save for trials of De dote , Unde nichil habet , Quare impedit , Assisis de nova dissesine , Ultime presentationis and of Attinctis et except summons by justices in eyre, until he returns to England for the king's service or after a period of five years. As Boteler Ralph Boteler, kt , pincerna main butler , was too occupied in the king's service to go to Bordeaux , so the king has appointed Nicholas Bolthorp by his letters patent on 29 July 1438, with the advice and assent of Boteler, to receive the wine that is due by right at Bordeaux to the king. But while Bolthorp stays at Bordeaux for the king's service, he is unlawfully sued by several king's liege men before several courts of the kingdom of England , so Bolthorp has supplicated the king to be put under the king's protection during his service [at Bordeaux].

Grant forever to Humphrey [of Lancaster], duke of Gloucester , his wife Eleanor [Cobham] and their heirs and beneficiaries, of the lands and lordships of Castilhon Castillon , la Marqua Lamarque , Moton Mouton , Saussage Sensac and Castesneff de Medok Castelnau-de-Médoc , and the towns, castles and lordships of Milham Meilhan , Budos and the Prinhag parish of Preignac with their high and low, full and shared justice, that the king had already granted to Gloucester and his male heirs on 12 February 1433 by his letters patent, 1 as they came into the king's hands by the death of Pons [VIII], lord of Castillon , 2 who held them for life. Similar grant to Gloucester, his wife and their heirs of the castles, houses and lordships of Cussac , Listrac and Montynhag Montignac with their appurtenances to be held as the late Bernat de Lesparre, Barda lord of Labarde held them, that the king had already granted to Gloucester and his male heirs on 12 February 1433 by his letters patent. 3 These letters patent have been returned to chancery for cancellation as appears in an indenture of which one part is kept by the king sealed by the seal of the duke of Gloucester.

Inspeximus and confirmation of one of the two parts of the indenture made between Radclyf John de Radcliffe, seneschal of Aquitaine , and the Genssak bayle, council and people of Gensac :

1 July 1424 . Genssak Gensac .

The Genssak bayle, council and people of Gensac put their town in the king's obedience and in the hands of the seneschal of Guyenne Radclyf John de Radcliffe and they made the fidelity oath to this latter. And Radcliffe has sworn on behalf of the king to the bayle, council and people of Gensac that if Francoys, Lebret Francès d'Albret, Senta Vazelhe lord of Sainte-Bazeille , wants to return to the king's obedience, Gensac and its baylie will be returned to him, but if he does not want to return to this obedience, Gensac and its rule will be not put outside the king's hands and crown by a grant or any other way, but they will be continually in the hands of the king and his crown because the seneschal has granted to the bayle, council and people of Gensac when they surrendered to him that they will remain forever to the crown [of England], as it was formerly the case. The seneschal swore to them to maintain their franchises and liberties and to protect them against the use of force from himself or any other person.

This indenture have been sealed by the seal of the office of the seneschal [of Guyenne] and by the seal of the town [of Gensac].

The king revokes anything made against the tenor of this indenture, and he orders that this town and lordship [of Gensac] with its appurtenances remain forever in the king's hands and the ones of his successors kings of England and dukes of Aquitaine, as other places of the king's domain, from the date of this indenture, without being granted, separated or alienated.

Order to John [Holland], earl of Huntingdon , king's lieutenant in Aquitaine , to return to Bernat Angevin , to whom the king had granted the castellany of Lesparre and Lespares Lesparrois , 1 the same castellany and permit him to enjoy it for his lifetime with all its revenues, as it was held by the late Galhardon de Marraben . The king had granted to Angevin the lands of Nailhan Noaillan and Salaunes with their revenues, because of the rebellion of Johan de Lamothe, 2 [lord of Noaillan]. 3 But as this latter has later returned to the king's obedience, the king has granted to Angevin in compensation the castellany of Lesparre on 21 March 1433, 4 with the proviso that he could not be removed of this office by a king's lieutenant [in Aquitaine] , a seneschal of Aquitaine or any other person without the special king's order. However, the king has learned that Huntingdon has granted this castellany to one of his servants to Angevin's great prejudice and against the tenor of the king's letters.

Confirmation of immunity and protection granted to the abbey of La Sauve-Majeure by the former kings Henry [II] and Richard [I] :

  1. immunity of any lay justice, either count, vicomte or prévôt, vicar or knight, and of any lordship ( advocatio vel dominatio ) without the abbot's consent;
  2. immunity to fugitives coming into the abbey's franchise ( salvitas );
  3. all the rights and justice of the duke of Aquitaine as count are granted to the abbey, and any fief of the duke given to them being an alleu ( allodialiter ) 3 under pain of 900 s.
  4. safeconduct for pilgrims, merchants and others coming and going to the franchise of La Sauve-Majeure for market or devotion or at the abbot's request;
  5. a weekly market, a fair of eight or fifteen days on 20th June;
  6. to sail every year on the river Garonne a boat loaded with 10 muids of salt for buying corn, free of right;

In May 1434, the king had granted for life by his letters patent to Johan de Lavergne, esquire, the office of captain of the town of Genssak Gensac . 2 Johan de Lavergne has several sons, particularly one called Isarn de Lavergne. This latter is 18 years old and greatly wants to serve the king as did his father Johan and their predecessors.

Grant for 30 years to Francès de Montferrand, kt , and his male heirs issued from him, of the office of captain of Chastelneuf en Sarnaiz Castelnau-de-Cernès with yearly wages of 300 fr. with the profits and emoluments pertaining to this place in compensation of the expenses he did there, without rendering any account to the king, this place of Castelnau-de-Cernès having went into the king's hands by the rebellion of the la Bret lord of Albret , a place that was held by Albret's predecessors for a long time. After the siege and took of Castelnau-de-Cernès, the keepership and office of captain of this place had been entrusted to Francès de Montferrand with yearly wages of 300 fr. , and on 22 March 1437 the king granted by his letters patent this office of captain to Montferrand until he obtained full payment of his wages and of the costs of the repairs from the person or persons who will have this place by the king's grant or some other way. 2
