Physical condition of the roll

The roll consists of thirteen membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition apart from the bottom of the last membrane where a piece of it is missing.

C 61/120, 2 and 3 Henry VI (1423-1425) .

Introduction.

This roll covering the second and third years of the reign of Henry VI (1423-1425) contains, as many previous rolls, letters of protection and letters of attorney granted to Englishmen going to Gascony. These included both administrators and soldiers, especially for the garrison of Fronsac which was captained by the seneschal John Radcliffe. There are also several licences granted to Englishmen exporting English wheat to Gascony. 1 There is also a licence granted to merchants of Bayonne, a city which was then in full commercial decline because of the silting-up of the river Adour which stopped ships with a high tonnage reaching it. 3

We find some new appointments to the judicial offices of the duchy: Rampnol de Blaye as judge appellate in civil and criminal cases of the court of Gascony and Bernat Angevin as scribe of this court (1424). The latter was to have a long and successful career in the Anglo-Gascon administration until the second and final French conquest in 1453. 4 An interesting entry informs us about Johan de Lesbay, a citizen de Bayonne, who was commissioned to investigate about English cloth being exported to Bayonne without payment of the English customs and the affixing of the lead cocket seals. 5 It appears that Johan de Lesbay was seen as a trustworthy man as Henry V had already ordered him in 1418 to investigate a fraud in which Bayonne merchants were involved. The king’s council of Henry VI intended to enforce judicial judgments in the duchy but this was not an easy task in some cases. Hence Bérart de Lamothe, heir of Guilhem-Arnaut de Lamothe, tried to get back the lordship of Langon which his father had lost to the French. Menaut de Habas, an ‘English’ Gascon had later taken this town. However, despite the death of Habas, his son remained in possession of Langon. He had strong support since his father’s executors were the archbishop of Bordeaux David de Montferrand (from a cadet line of this important baronial family), Gaston de Foix, count of Longueville and captal de Buch, and Johan de Gramont, lord of Gramont and Curton. 6

The royal council of the young Henry VI also replied to requests presented by some Gascons. As a result, the community of Saint-Émilion obtained the right to levy for five years a tax on wine sold in the town’s taverns and on corn sold there in order to repair and maintain the town walls. 7 The king’s council also confirmed the statutes of the guild of the surgeons and barbers of Bordeaux proclaimed in 1415. 8

Two acts deal with the minting of money in the duchy. A new project to open a mint at Bayonne occured in 1423, but was no more successful than the previous effort of 1351. 9 Henry VI’s council confirmed privileges granted by Edward III to the minters of Bordeaux in 1354. 10

Various entries are confirmations of acts granted by previous kings of England, such confirmations being sought at or shortly after the accession of a new ruler. The town of Bourg was confirmed in its various privileges and customs granted in the 13th and the 14th centuries. 11 The annexation of Saint-Macaire to the crown of England by Edward II and the ban on appointing a local baron as castellan of Saint-Macaire were also confirmed. 12 Among the other confirmations we can note a confirmation of a charter of Richard the Lionheart (1194) which granted privileges to the order of the knights hospitaller. 13

Inspeximus and confirmation of the privileges of the Burgum mayor and jurats of Bourg since the town has lost the original titles when it has been taken by enemies. The prince grants:

  1. exemption to the burgesses of Bourg to pay any taxes when transporting their goods in the duchy except ancient customs and except the tax of 6 d. per pound granted by Edward [III] to the mayor and jurats of Bordeaux for a certain term;
  2. to the mayor of Bourg the cognizance of the burgesses of Bourg and of their goods in the district ( territorium ) of Bourg except for offences against the king and his officers;
  3. to the mayor of Bourg the cognizance of offenders ( forisfacientes ) against burgesses if they can be found and, if not, to banish them ( per viam banni );
  4. that those having houses or possessions in the town or its banlieue ( balleuca ) have to contribute to common charges;
  5. that there will be no other new bastides or fortalices ( nove bastide seu fortalicia ) in the territory of Bourg;
  6. that no new market nor fair will be granted in the district of Bourgeais except in the town of Bourg.

Grant by Prince Edward 2 to the burgesses and worthy men of the castle ( casteu ) of Bourg 3 and their heirs, mayoralty and community: 4

  1. first, that the current mayor and jurats of Bourg will continue until 10 August 1262 ( dusque a la prochan feste de Sent Laurens ), and then new jurats have to be chosen as is customary, and two persons have to be chosen and presented at the castle of Bordeaux before the seneschal [of Gascony] if the lord 5 is not present, or their lieutenant, there he will swear on the holy gospels to choose the most suitable candidate for the lord and the community, and swear to receive no gift or promises. The day of the presentation or the following day, the lord, the seneschal or the else person the lord or the seneschal has chosen to be in this castle will choose a mayor from the two presented, otherwise the representatives of Bourg sent before the seneschal or the jurats assembled together will choose the mayor, each time the lord, the seneschal or their lieutenant is be absent. And these rules will be followed each time a mayor of Bourg will be created;
  2. nobody will be chosen as mayor if he has already held this office, unless full four years have elapsed since he left this office;
  3. if when in office a mayor commits any offence against a member of the community of Bourg, the latter may complain against him to the lord or the seneschal or their lieutenant during the year of his office, the following year but not later. If the plaintiff is absent during the year the mayor is in office, he has a right to sue him if he complains before the lord, the seneschal or their lieutenant within 40 days after his arrival. And the mayor of Bourg, during the year of his office and the next year, has to answer before the seneschal about all the charges of the accuser, and the plaintiff will be exempted during the trial from the mayor's jurisdiction;
  4. on the day of his appointment, the mayor will swear in the presence of the people, on the holy gospels and the relics as it is customary at [the church of] Sent Girons Saint-Géronce [of Bourg] to maintain the lord's rights in the castle of Bourg and to warn him if some of his rights have been given up, and he will give advice to the lord at his request. Each of the jurats will swear the same oath;
  5. if the lord's rights had been given up recently or a long time ago, of which the mayor, the jurats or others may be informed, they must inform and help the lord or his deputy at Bourg in order that the lord receives satisfaction, and the mayor and jurats must swear this;
  6. if the mayor or his deputies charges someone of Bourg with forgery of the lord's seal or of his money, the accused will be prosecuted before the lord's court without any complaint by the mayor of Bourg, and the mayor, jurats and clerk of the commune must swear this;
  7. if someone of the household of the lord, or his seneschal or his castellan, insult or attack an inhabitant of the community of Bourg, the latter may complain to the lord, his seneschal or his castellan who will have to do full justice at the request of the mayor of Bourg;
  8. and if someone of Bourg who is in the lord's household insults or attacks a burgess of Bourg, the lord, or the castellan of the castle of Bourg, full justice will be given to the victim at the lord's court, according to the fors and customs of Bordales Bordelais
  9. if the offender is burgess of Bourg, he will be sentenced at the castle [of Bordeaux] before the lord, his seneschal or the mayor of Bourg who must do full justice according to the fors and customs of Bordelais,
  10. if a burgess of Bourg owes something to the lord because of a lease or rent, he has to answer for it to the lord or his deputy without claim of the mayor of Bourg,
  11. if some knights ( cavoirs ) or esquires ( donzeus ) ot their heirs want to become burgesses of Bourg, they have to obtain the permission of the lord or his seneschal,
  12. in all cases where a burgess of Bourg is called before the lord or his deputy, he has to appear at the castle of Bourg and not elsewhere, except if the lord complains against him for cases about bailiwick and farm ( bailia or assensador ) where they must appear before the lord anywhere in Gascony;
  13. the community of Bourg owes to the lord service in the ost and chevauchée ( cavaugadas ) as the community of Bordeaux does.

In the presence of Mirallo, de Gilibert de Mirail, public notary of Bordeaux , Fforton Aiquart Forton, mayor of Bourg , Gaucem Forton and Guilhem Forton , jurats of Bourg , required by the community of Bourg have said:

  1. when the king comes the first time into Gascony, or his seneschal if he is absent, he has to swear to defend Bourg from any injury and to keep its fors and customs; and the mayor and jurats have to swear an oath of faith to the lord or his seneschal;
  2. Bourg does not have common lands or possessiones as have towns in Lombardia Lombardy and several others, 7 and they cannot say their community holds any fief from the king as according to their custom there is no fief without esporle ( sporla ) nor investiture; 8
  3. that they hold from the king as lord and prince the use of their streets, squares, town walls, moats and the other things owned by the community ( universitas ) of Bourg;
  4. that they also hold from the king the use of the river 9 to fish, sail and do other useful things;
  5. that they have several liberties concerning their persons and their goods;
  6. that they have mayorality and jurade ( maiora et jurata ) with their appurtenances;
  7. they acknowledged for themselves and the community ( universitas ) of Bourg that they have to do to the king the duties ( deveria et conditiones ) contained in the privilege the king has granted to the community under his seal;
  8. that all burgesses of Bourg have to pay for all the wine of his vineyards 2 d. to the king and to the other lords of Bourg, when they are to be loaded [on boats] or to be sold in taverns;
  9. that every person coming to Bourg to buy wine in order to resell it or to load it, has to pay 1 d. to the king and to the other lord of Bourg;
  10. that some inhabitants of Bourg, for example buchers( ca[r]nifices ) owed certain duties to the king and the other lords of Bourg;
  11. that all the fief owners and tenants of the marsh of Barba Barbe perform duties to the king and to the other lords of Bourg through the castellan of Bourg , because of Bolio, de Milet du Bouilh 10 and others who own parts in this marsh.

Richard II confirms and grants that English and other merchants can sail to Bourg, buy and load there wine, paying due customs. 12

Inspeximus at the request the king's liege men of Aquitaine, of the tenor of a petition presented by them at the last parliament of Westminster , which petition has been enrolled in the rolls of this parliament. 2

The faithful liege men of the land of Guyenne make a supplication to the king and the lords of this present parliament that, because of the great oppressions, demolition of houses and destruction of goods, and disinheritances of their rightful inheritances and other rights and appurtenances, many of them have been expelled by the wars and armies of the king's enemies 3 which have lasted for a long time in Guyenne, and those desiring to keep their loyalty towards the crown [of England] have left their inheritances and goods and many of them have withdrawn to the kingdom of England , and several others have come to live there willingly, and have married there in several towns and are living and dwelling as the king's true liege men, and have acquired there houses, lands, rents, possessions and revenues there by their hard labour and work. However, many people who were born in England commit and say many injuries and evils to them day by day, such as calling them aliens ( alliantz ), and many other undesirable names. Such wrongs are committed to the great slander of the land of Guyenne and the great loyalty which it has always shown towards the crown [of England], and could lead to their permanent and final destruction, since they do not know where else to go in order to protect their lives and preserve their honour, if the king does not provide them with a remedy on this matter. The king's liege men of Guyenne request the king that all manner of people of Guyenne, whomsoever and of whatever estate or condition they may be, who at present are dwelling in your said realm, or have dwelt there, or will dwell there in future, and their heirs and successors forever, should be declared in this present parliament to be the king's faithful liege men, and that they should be able to live, sell, buy, possess and acquire lands, rents, possessions, tenements and other goods whatsoever, for themselves and their heirs and successors, within the kingdom [of England]. They should enjoy these goods as fully as the other king's liege men born within the kingdom [in England]. And they request the king to order all his justices, officers and subjects that none of his liege men of Guyenne dwelling in England will suffer any damage or impediment against their persons and goods. And if anything is done against them, the king's English officers and subjects should make amends and redress at once and without delay. The king is also requested to make proclamation in all the towns of England forbidding all the king's liege men to call the king's liege men of Guyenne aliens, or to speak any evil, injuries, or blame against them, under threat of penalty. All this should be recorded on the roll of parliament and be proclaimed throughout all the cities, boroughs and good towns of England. 4

Order to Johan de Lesbay, esquire , 2 and to the constable of Bordeaux, together and separately, to check the books of the collectors of customs of the city of Bayonne about entries and exits of goods from the time when the king came to power in the kingdom of England and to learn what was unloaded and loaded, what quantities of cloth have been brought from England to the city of Bayonne and vice versa with whoever people who brought them, and the names of the merchants and owners of this cloth as well as the names of the ships in which these cloths and goods have been unloaded, and also the names of all the masters of these ships, they are to send regularly each year such summaries of these books to the treasurer and barons of exchequer of England under their seals. The king orders the mayor, échevins, jurats and hundred peers and community of the city of Bayonne and to all the king's officers to obey and attend Lesbay and the constable who are granted power to summon any who disobey before the king and his council in England on a specific day decided by them. they have to regularly certify the king and his council under his seals about these disobediences and neglects and their circumstances and what they have done. As the king has learnt that cloths and dozens of cloths ( panni ) and other goods which have been loaded in various English ports on several ships and sent several times without being customed and cocketed to the city of Bayonne from the time when the king came to power in the kingdom of England.

Inspeximus of a transcript of letters patent written by John St John, kt , former mayor of Bordeaux , and the jurats of the city of Bordeaux, made by John Tiptoft, kt , former seneschal of the duchy of Aquitaine for Henry V , former king of England, under the seneschal's seal:

Inspeximus of the [following] letters by Asta, de Bertran d'Aste, doctor of canon law , judge of the appeals presented at the court of Gascony and auditor of other cases of this court, lieutenant of John Tiptoft, kt , seneschal of Aquitaine . John de St John, kt, mayor of the city of Bordeaux and the eight jurats of this city, and more people being in the town hall of Saint-Éloi , during a meeting of the Jurade gathered after the sound of the bell [of the town hall], have decided, following the supplication of the surgeons and barbers living and dwelling in the city of Bordeaux, that:

  1. no barber living and dwelling at Bordeaux and in its banlieues ( balleguas ), power and lordship, should dare to shave the beards ( barbeyar ) on Sundays, or in the feasts of Christmas, New Year, Epiphany, 5 Easter and the Ascension, the other feasts of the year and the four feasts of the Virgin ( las quatre festas de Nostra Dona );
  2. no barber should exercise their offices of surgery nor 'barbery' ( barberia ) or open their shop ( hobrador ) if they are not examined before by the city's deputies and found sufficient to exercise them;
  3. if the barber is found sufficient, he has to pay 4 francs to the city and the guild ( coffrayria ) of the supplicants, that is 3 francs to the city and 1 franc to the guild;
  4. if a barber do the contrary of what is decided there he should pay one silver m. , three quarters of it having to be paid to the city of Bordeaux and the last quarter to this guil.

15 July 1424 . Westminster . For the enclosure of the town of Saint-Émilion .

Grant to the mayor, jurats and burgesses of the town of Saint-Émilion at their request, with the advice and assent of the king's council, to be allowed to levy for the next five years 20 pitchers on each tun of wine sold in the town's taverns, and 1 d. of the money of the current time for each bushel of corn sold there in help of the fortification of the town walls, and nothing else. The mayor, jurats and burgesses of the town of Saint-Émilion have supplicated that the ancestors and predecessors of the king had granted that to them for a twelve-year period 1 in order to repair and fortify the town walls which, which have fallen down. 2

Licence granted to John Tyndale of London , merchant , to buy 40 quarters of wheat in Suffolk , load them in a ship or ships in the port of Gippewicus Ipswich and bring them to the city of Bordeaux for the expenses of the household ( hospicium ) of Laurence Merbury, kt , mayor of Bordeaux . The king orders to the customers, keepers of sea ports and other maritime places to permit Tyndale to do so, paying due customs and giving in chancery letters testifying he delivered them to the Merbury's household before 2 February 1425.

Order to David [de Montferrand], archbishop of Bordeaux , Fuxo, de Gaston de Foix, count of Longueville , and Johan de Gramont, kt , executors of the will of the late Favars Menaut de Habas, kt , to permit without impediment to la Mote Bérart de Lamothe, kt , son of the late Guilhem-Arnaut de Lamothe 1 to peacefully have the castle , lordship and town of Lengon Langon as his father had it by hereditary right with its prévôté, house ( hospicium ), mills, tolls and revenues when the Armaniacum count of Armagnac 2 took it; 3 then it had been taken by Henry V's liege men and remained within his obedience. And as Guilhem-Arnaut was impeded, Henry V granted him by his letters patent confirmed by Henry VI on 2 March 1423 to have Langon as he held it before the count of Armagnac. 4 And on 2 March 1423, the current king has ordered Menaut de Habas, 5 who was unlawfully occupying the lordship and town of Langon to the detriment of Guilhem-Arnaut de Lamothe, to return them to Lamothe and to permit him to enjoy them according to the king's letters, but Menaut and Guilhem-Arnaut died before the execution of this order.

Appointment, at the king's pleasure, of Stretele Hugh de Streatley 2 as captain of castellany of Saint-Macaire with the high resort ( altum dominium ) together with the issues of the castellany, as the burgesses and worthy men of Saint-Macaire have supplicated the king to appoint Streatley, already captain of Saint-Macaire, for life since they feared a great danger for the town if it was entrusted to a [local Gascon] baron since barons were always wedging war against each other. 3
