Physical condition of the roll

The roll consists of six membranes. There are entries on all of the face sides, but on none of the dorses. The roll is generally in good condition.

C 61/110, 6 Henry IV (1404-1405)

Introduction.

This short roll of six membranes of the sixth year of the reign of Henry IV (1404-5) is largely concerned with the supplying of the duchy of Aquitaine with grains and other victuals, as its commercial relationship with the French-held hinterland was often subject to disruption and the area therefore was dependent upon imported foodstuffs. Entries include an official request of the community of Bayonne to obtain a licence to transport all the wheat and grains they needed from England in order to be able to sustain themselves. 1 More frequently a licence was granted to a master of a ship to transport wheat, grains, broad beans and other goods to Gascony. The majority of the Gascon ship masters came from Bayonne and were involved in supplying this city. 2 A licence to transport wheat, broad beans and peas and other victuals and goods to Bordeaux was granted to a Bordelais ship which had an English master. 3 This type of licence to bring victuals to Bordeaux or Bayonne was also granted to English merchants and ship-masters, mainly originating from London. 4 The roll also provides some interesting information on international trade through the case of Riccardo Garneri, a merchant dwelling in London but who originated from an important family of Piedmont. Through a Piedmontese proctor, Riccardo had rented a Portuguese ship and loaded onto it some goods in South Portugal (sweet wine and wax), but he accused some Bayonnais of stealing his shipment. 5 He also experienced difficulties with some other mariners of Bayonne. He accused them, along with mariners of Dartmouth, of stealing a freight of 49 tuns of oil of almonds from Seville on a Spanish ship from Biscay which they had captured at sea. 6

Several entries of this roll concern the mayor of Bordeaux, Thomas Swinburn (or Swynbourne), who had been appointed to the position on 13 March 1405. For instance, Swinburn was given the right by the king to grant letters of safe-conduct to merchants coming to Bordeaux with victuals or other goods to sell, another sign of the need to ensure the food supply. 7 We find, among the persons going in Aquitaine to serve in Swinburn's company and obtaining letters of protection, an illegitimate son of the famous routier leader, John Hawkwood. 8 One entry informs us that the resources of the Anglo-Gascon government were very low since the seneschal of Aquitaine Galhart II de Durfort had to borrow 700 francs from a London merchant to pay his own fees as seneschal. 9

The roll also contains several entries on sums of money levied on the goods of rebels which were granted to the king’s liege men in order to compensate for losses they suffered during the war with the ‘French’. 10 Sometimes these revenues were situated in the same area as their interests, as was the case for the goods granted to Guiraut de Thivras which were located around Marmande. 11 Part of the revenues of an important Saintongeais lord of the French party recently taken prisoner (Arnaud de Sainte-Maure, lord of Jonzac) were granted to Bérart de Montferrand. The latter came from one of the main noble families of the Bordelais area. 12 Bertran II de Montferrand, the head of this family, obtained from the king the right to succeed to the lordships which were owned by Bérart III d’Albret, who had died as rebel to the king in 1379. Part of Bertran's interests had been occupied by the lord of Albret, one of the French leaders of the region. 13

The king continued to reward the long fidelity of Gascon war leaders. Hence Johan de Béarn, captain of the routier garrison of Lourdes from the 1370s, obtained the lucrative rights accorded to the status of burgess of Bordeaux. 14 Henry IV continued to attract certain people originating from French-held areas such as Johan Argui born in Cognac who wanted to succeed to the goods of his late cousin, a former burgess of Bordeaux. 15

However, the king could not manage to enforce the return of the exiled Pey de Contis and his followers to Bayonne. There was little chance that the Bayonnais government accept Pey's reinstatement as mayor or vicar of Bayonne and return his and his followers' goods as they had been ordered to by the king. 16 The king was well aware of this. This explains why he ordered the seneschal of Aquitaine, the constable of Bordeaux and the bayle of Labourd to compel the community of Bayonne’s government to execute the royal order. 17 On the same day, the king ordered the delivery of some revenues of Bayonne to Pey de Contis, 18 but it is very likely that the king’s orders were not implemented in Bayonne.

Grant of full power to the seneschal of Aquitaine or his lieutenant to hear and examine the causes of the banishment of Monedier Ramon Monadey, burgess of the city of Bordeaux , and summon before himself Monadey, and others he finds suitable to summon according to law, and to make full justice, and if Monadey is innocent of what has caused his banishment, he should return to him his hereditary goods and chattels and his good reputation. The king has sent the tenor of these presents to the mayor, jurats and the other good men of the city of Bordeaux , and also to the bayles, officers and the other king's liege men [in the duchy] and ordered them to be obedient and attendant to him in this matter. Since Monadey, last year when he was sub-mayor of Bordeaux , did not agree to an evil letter sent by some jurats to the king, he was falsely accused and banished, he has petitioned the king to provide for his honour and status.

According to an inquiry of 1460, Arnaut de Sainte-Maure (d. 1448), lord of Jonzac from 1403, had been made prisoner by the 'English' twice (See Archives départementales de la Charente, Angoulême, E 116, February 1460). His first imprisonment lasted 11 or 12 years. He was probably made prisoner while serving in Saintonge in the French troops of Charles I, lord of Albret, in 1405 (possibly during the siege of the castle of Chalais starting in March 1405). See Seguin, M., 'Jonzac au Moyen Âge', Revue de la Saintonge et de l'Aunis , 37 (2011), p. 43-61. This entry is very likely linked with Sainte-Maure's recent capture.

Guilhem-Amaniu, lord of Lesparre, as heir of the late Sénebrun V, lord of Lesparre and Vertheuil , had informed the king that, when Sénebrun was in England, the captain to whom he had committed Vertheuil had delivered it by treason to Lebrit Bérart III d'Albret, kt , Logoyranum lord of Langoiran who became later a supporter of the French and installed there a French garrison; afterwards, Florimont, lord of Lesparre , Guilhem-Amaniu's uncle and Sénebrun's son, with men at his wages and with John, Lord Neville , kt , then the king's lieutenant in Aquitaine, besieged and took Vertheuil. Subsequently, Neville entrusted Vertheuil to Archambaud de Grailly, Captal de Buch, who still holds it now, to Guilhem-Amaniu's disinheritance. 1

Grant in perpetuity to Bertran II , Montferant lord of Montferrand , at his supplication, to himself and his heirs, of the all the goods of the late Labrit Bérart [III] d'Albret, Legoyran lord of Langoiran at the time of his death, if it is not to the prejudice of others who had received previous grants from the king. Bertran II de Monferrand holds the main part of these goods because his wife was the sister of Bérart III, 2 and as he and the children he had with his wife should have succeeded to Bérart III's goods, but the Labrit lord of Albret 3 unlawfully holds a part of these goods, and as John of Gaunt had granted in perpetuity to Montferrant and his heirs the goods of Bérart III.

Inspeximus and confirmation of some other letters patent of Duraffort Galhart [II] de Durfort, seneschal of Aquitaine , under the red seal of his office, showed by Johan Argui. The seneschal has inspected and read these letters to know if their contents are valid and they have been transcribed word by word, at Argui's request, before the seneschal, by Maderano Arnaut de Madéran , by the order of the seneschal and the king's council in Bordeaux:

10 September 1404 . Bordeu Bordeaux .

Authorization granted by Galhart [II] de Durfort, seneschal of Aquitaine , with the assent of the king's council in Bordeaux, to Johan Argui, son of Guilhem Argui, inhabitant of Bardeu Bordeaux , born in Conhac Cognac in Semonge Saintonge which is now a place rebel to the king 1 , to succeed to some of the goods of his late first cousin Arguy Aymeric Argui, burgess and inhabitant of Bordeaux . The seneschal has received Johan Argui's oath of fidelity to the king of England, at his request, as this latter wants to remain in Bordeaux. The seneschal orders to all the king's officers, sergeants and subjects [in the duchy] not to trouble Johan Argui in his inheritance despite his rebel birthplace which might have banned him from inheriting. Johan Argui has always faithfully served his cousin who had asked him to come to serve him in Bordeaux about nine years ago 2 when he was dwelling in Cognac, his birthplace, he remained for his cousin and master two years in Anglaterra England . In Aymeric's last will he received only a grant of 40 gold fr. , while Arguy Johan Argui the elder , another first cousin of Aymeric, received some of his goods as did others who were not kinsmen of Aymeric, despite the fact Aymeric had several times told Guilhem he would be his heir. 3

Cognac submitted to the French in 1375. Cognac was in English hands from 16 October 1361 to 1 June 1375, so Johan Argui was born there during this period. It is likely his father worked for the court of Edward of Woodstock, prince of Aquitaine ('the Black Prince'), as this latter had often set up his court in Cognac in 1369-70, and that Johan Argui was born in Cognac during this more specific period.
