Physical condition of the roll

The roll consists of 11 membranes. There are entries on all of the face sides, but only on three of the dorses (6d, 9d and 10d). The roll otherwise is generally clean and in good condition, though membrane one, being the outer membrane is noticeably darker.

C 61/41 3 Edward III (1329-30)

Introduction.

As in the previous rolls, many entries are concerned with financial compensation granted to certain of the king’s subjects who had suffered damages during the war of Saint-Sardos (1324-5).

Several entries deal with Bayonne and certain of its inhabitants. We find confirmation of an important regulation concerning the sale of fish in Bayonne, which dated at least from 1256 but which probably already existed before this date. 1 Probably because of this regulation, the inhabitants of Labenne, Capbreton and le Bouret had complained that men of Bayonne had attacked their fishermen and had broken up their boats. 2 The citizens of Bayonne requested the king to be free from payment of all the tolls controlled by the king in the duchy, as were the citizens of Dax. 3 More money than usual was requested from the citizens of Bayonne to seal their letters with the king’s seal and they also complained about that. 4 The powerful family of Lesbay complained that Guilhem-Arnauton de Bielle, from another influential family from Bayonne, had killed Pynot de Lesbay. He had been exiled, but was still resident in the region of Bayonne despite the sentence. 5 A state of insecurity existed around Bayonne caused by certain malefactors who had attacked and stolen good from merchants coming to Bayonne. 6

In this period the community of Bayonne was in conflict with the castellan of the king’s castle of Bayonne and the king’s prévôt of Bayonne Lop-Bergunh de Bordeaux. The latter had to come to England about this conflict. 7 Complaints against him were made by Pey de Casemajor, the representative of the community of Bayonne. 8 Consequently, the seneschal of Gascony ordered the appointment of another castellan of Bayonne. 9 Martin de Juncas, lieutenant of the castellan of Bayonne Lop-Bergunh de Bordeaux and one of his men had been imprisoned by the mayor of Bayonne, because the latter had arrested two mariners of Bayonne and put them in the castle of Bayonne, where one of them had been killed there. 10 The king appointed as successor of Lop-Bergunh de Bordeaux in this office the latter's brother Oliver de Bordeaux! 11 But Oliver was sensible enough to appoint as his lieutenant in the office a man of Bayonne (Bernat de France). 12 At the end of the day, the king returned to Lop-Bergunh de Bordeaux his goods and chattels which were in the castle of Bayonne, having been seized during the judicial proceedings between him and the community of Bayonne. 13

Various entries give us information on the burgess of Bayonne Arnaut-Sans Duluc. He had confirmed to him a grant by Edward I of the fish-weir named Lamothe situated on the river Nive at Ustaritz, near the seat of the king’s bayle of Labourd. 14 A serjeant of the king of France had been arrested and imprisoned at Bayonne in 1321. He had been there at the request of Arnaut-Sans Duluc to summon to the Parlement of Paris the bayle of Labourd or the castellan and prévôt of Bayonne Lop-Bergunh de Bordeaux. 15 Duluc had brought a great ship loaded with victuals to Newcastle Upon Tyne for the king’s war of Scotland. 16 He also owed money to Domenja de Sanguinet who obtained the seizure of his goods in Labourd by the bayle and court of the province until she was fully repaid of the sum of 4000 l.bon.t.parv. . 17

The community of Bordeaux wanted to recover some of its rights and to protect its claims. Thus it requested the king, in vain, to recover control of the office of mayor of Bordeaux, which had been seized by the future Edward I in 1261. From that point the king of England appointed the mayor. 18 The community complained that some of the king’s officers did not respect the boundaries of the banlieue (jurisdiction) of Bordeaux and had applied taxes on some of their wines, contrary to their privileges. 19

A special committee was appointed by the king to hear the account of the Gascon Aubert Mège, former constable of Bordeaux, who did not go to England to have his account audited at the Westminster exchequer because of his old age. 20 Subsequently this committee was dismissed as the king learned that Mège was perfectly able to travel to England. 21 Mège was therefore ordered to come to England for December 1328. 22

Arnaut III de Durfort and an impressively long list of members of his household were pardoned for the killing of a burgess of Penne-d’Agenais named Arnaut de Noaillac. 23 Even Bertran Assalit, the king’s castellan of Penne-d’Agenais, was pardoned for this crime. 24

In the long conflict between the lords of Bajamont and the nearby community of Agen, then in French hands, Ramfré II de Durfort, then lord of Bajamont, requested the king to have high justice over his castle of Bajamont, instead of its being under the jurisdiction of Agen. But the king was very cautious with such demands and ordered an enquiry on the matter. 25

On judicial matters, we find a complaint by Guilhem, lord of Heugas, who had been imprisoned along with some of his companions for eight years and his goods seized, because of an accusation of involvement in the murder of the lords of Amou and Athieu (all these lords and goods were in the seneschalcy of the Landes), 26 . We also see the case of the Ségur brothers who continued to refuse to do homage (this case had been active since at least 1320) to the vicomte of Benauges Pey II de Grailly for their lands situated in Loupiac. 27

As had happened previously, the king sent to Bordeaux a representative to buy there on behalf of the king 60 casks of the best wine for the royal household. 28

28 February 1329 . Westminster . For Jacmes de Lesbay and others in the writ ( brevi ).

Order to the seneschal of Gascony, or his lieutenant, to obtain full information concerning Vile, de Guilhem-Arnauton de Bielle , son of Vile, de Oliver de Bielle , residing in the region of Bayonne despite his exile and banishment, and if they find that this is the case then they are to do full justice according to the fors and customs there, so that others will fear to perpetrate such crimes. The king has received a serious complaint from Jacmes de Lesbay , Guilhem-Pey de Lesbay , Johan de Lesbay , Per-Ramon de Lesbay and Bertholomiu de Lesbay , merchants and burgesses of Baiona Bayonne that Bielle attacked, by force and arms, Pynot de Lesbay , brother of merchants, in Bayonne and assaulted, wounded and maltreated him so that he died within the following four days. Afterwards Bielle took refuge in the church of the Carmelites in Bayonne . 1 He was prosecuted by the mayor of Bayonne and other royal officers and was requested to surrender to the king's peace, and although he appealed against his felony before the mayor and the king's officers, it was decided, according to the fors and customs there, to exile and banish him, as appears by the rolls of the community of Bayonne. Now Bielle is living in the region without punishment in contempt of the king's peace and to the terror of the king's people.

Order to John de Weston, constable of Bordeaux , to inspect the bills that Audoyn Hélias Audouin, damoiseau , has for the wages that are owed to him, and if he finds that they are owed, then he should cause payment to be made without delay; receiving from Audouin his letters of acquittance, and the king will make due allowance in Weston's account. The king is bound to Audouin in 907 l. 15 s. 2 d.parv.t. of 1307 l. 15 s. 2 d.parv.t. for the wages of himself and his retinue from the time that he served Edward [II] in that king's war in Gascony with the then king of France , 1 and also in 680 l. 7 s. 2 d.t. for the wages of himself and eight mounted men-at-arms, and one hundred and three serjeants on foot for the time that he was in the king's service in the garrison of the king's castle of Podio Normanno Puynormand , in the duchy, of which he had custody, by the order of Oliver de Ingham, late seneschal of Gascony , as more fully appears in two bills under Weston's seal which Audouin claims to have in his possession. Audouin has requested a suitable payment of the sums, and the king wishes to agree to this.

The king now grants for life to Assalit by his letters patent this keepership receiving the customary wages.

Announcement that the king confirms letters patent of John de Haustede , knight, seneschal of Gascony, sealed under the king's seal in use there:

9 October 1328 . Bordeaux .

John de Haustede, knight, seneschal of the duchy of Aquitaine for the king of England, duke of Aquitaine: there is a dispute presented before him between Baiona the mayor, the jurats and the citizens of the community of Bayonne on the one hand, and the inhabitants of the places of la Bene Labenne , Capbreton and Roretus le Bouret on the other hand, about the catching of fish by some fishermen who enter the sea 1 by the canal of le Punte la Pointe 2 or a small channel of the river [Adour] to fish, and from there they return toward the region of la Pointe or Bayonne. On this matter, the said mayor and jurats [of Bayonne] produced some old letters patent sealed with a great seal, which seal was not modified but deteriorated by its age, as a checking of this seal showed, and in the centre of this seal is the mark of a lion. The mayor, jurats and many trustworthy witnesses presented [these letters patent to the seneschal] and sweared on oath that the content of these letters was true and that it was respected by all their predecessors in these regions. Because it is proved, both by trustworthy witnesses as by public instrument and other legal documents, that all the content of the said letters is true, so the seneschal confirmed them. Their content is:

The lord of the old town of Baione Bayonne 3 granted these franchises to his citizens of Bayonne who circulate on the salt sea 4 and on the fresh water sea. 5 Each man who enters on the salt sea to fish and leaves it with fish must arrive at le Punte la Pointe before the huts which are situated towards la Bord le Bouret , and must draw up, to avoid the tide, his boat on the ground, from its prow up to the stern that controls its navigation, and there he must sell in franchise his fish to all merchants; but if he wants to sell it at Bayonne , he can bring it in franchise, and if he brings it elsewhere he will loose his fish and his boat: the boat will be burned or smashed to pieces; one third of the fish will be given to the lord, 6 one third to the keepers 7 and one third will be thrown away in Bayonne. And if some merchants do not buy the fish before the said hunts as is mentioned above, they will loose the fish and the boat, the boat being burned or smashed to pieces, and one third of the fish will be given to the lord, one third to the keepers and and one third will be thrown away in Bayonne. And if someone buys the fish which is fished from the downstream side of the island of Belay to the upstream side of the island of Corbeire 8 he will loose the fish and the boat, the boat being burned or smashed to pieces, one third of the fish being given to the lord, one third to the keepers and and one third thrown away in Bayonne. And none of the merchants who buy the fish of the fishermen must make agreement with the fishermen or the citizens of Bayonne; and in the same way the fishermen must not make agreement with the merchants who buy the fishes nor with the citizens of Bayonne, otherwise they will be fined on their bodies and their possessions by the lord and will be considered as disloyal, the fish found will be thrown away and the boat be burned or smashed to pieces. If the lord of Bayonne, the king, or his son, or his seneschal is at le Bene Labenne , it is possible to sell there the fish as long as one of these people is there. And no one can buy fish, whale or dogfish which is sent to Bayonne to resell to the regions up to Sordee Sorde [-l'Abbaye] , d'Ax Dax , Forgave Horgave , Fontarabie Hondarribia , Sent Johan de Lus Saint-Jean-de-Luz , Bearridz Biarritz , otherwise he will loose the fish and the boat. And nobody must cut the fish at la Pointe except to eat it, neither here or elsewhere except at Bayonne, and the person who does this will lose as is specified above, as he can openly and fairly sell his fish there [in Bayonne]. The first sturgeon which is fished must be cut in Bayonne and if two or three others are fished in one day, one of them must be brought to Bayonne and cut there, and if someone infringes this rule, he will lose the sturgeon. Any man who brings fish at Bayonne to sell it and who arrives at the town's port after the ringing of the morning mass 9 must sell it to the people [of Bayonne] for their own consumption until the ringing of Prime [mass], 10 then he is allowed to sell it to everybody or to bring it where he wants. From the Sunday of penance 11 to the Sunday of Easter, nobody can bring fish to Bayonne excepting the religious. And nobody can buy for resale lus , 12 lampreys, young seabasses 13 and young sturgeons, 14 nor other fishes fished with fyke nets brought at the port [of Bayonne], otherwise he has to pay 6 s. to the lord [the king-duke] and the fish is given to the persons present until nothing is left. As many men did not follow these rules, because they did not know them, the mayor [of Bayonne] and the hundred peers [of Bayonne] had them written by remembrance of the worthy men ( prohomis ) 15 of Bayonne; and they had them sealed under the seal of the commune of Bayonne. This act has been written in February 1256 16 during the mayoralty of Podensagg Bertran de Podensac 17 and the lordship of Edward , eldest [son] and heir of the king of England [ Henry III ].

The name 'le punte' is in fact 'la punta', in French 'la Pointe', in English 'the Point'. It is a Gascon form of what is called 'coastal Gascon' ('gascon maritime' in French) or by his popular name 'the black dialect' (in French 'le parler noir', in Gascon 'lou parla negue') which was spoken and is still partly spoken on the coastal area of the Landes as well as in Bayonne. 'le Punte' was the main mouth of the river Adour.

There is no trace of the original charter of the vicomte Bertran de Labourd, so this charter could have been wholly or partially invented.

1 March 1329 . Eltham . On the enquiry about the death of Arnaut [de Noaillac], brother of Estèbe de Noaillac .

Order to the seneschal of Gascony to swiftly inform himself about the name of the malefactors involved who shamefully killed Nicelake Arnaut de Noaillac , brother of Nicelake Estèbe de Noaillac , 1 burgess of Penne in Agen' Penne-d'Agenais in the same town of Penne-d'Agenais, as Estèbe de Noaillac petitioned the king and asserted that no punishment had been done for this crime. The seneschal must castigate the malefactors he found guilty according to the local fors and customs, in such manner this complaint would not reach the king by reason of his neglect.

6 March 1329 . Kingston . Concerning Lop-Bergunh [de Bordeaux] going in England .

Order to Lop-Bergunh [de Bordeaux], castellan of the castle of Bayonne , to come as swiftly as he can to England, as serious dissensions have arisen between the mayor and community of the city of Bayonne and him about, they assert, the novelties, grievances and excesses inflicted by him on them, and the king wants to have full information about this because neither the mayor and community [of Bayonne] nor him have presented any articles [on that matter] before the king. Furthermore, that the seneschal of Gascony appoints, in order to assuage the harm which may arise from this dissension, a suitable man for the keepership of the said castle and the other offices in Bordeaux. Lop-Bergunh de Bordeaux has to fully obey the king's orders, and on this matter the king has ordered by his other letters.

Letter to the mayor and the community of the city of Bayonne stating that the king has received petitions from Casmadour Pey de Casemajor , 1 their deputy, showing before the king the several excesses and grievances that Lop-Bergunh [de Bordeaux] , castellan of the king's castle of Bayonne did to their prejudice causing some serious dissensions between them and Lop-Bergunh de Bordeaux, and the king also received some petitions from Lop-Bergunh de Bordeaux. The king had his petitions read and then ordered Lop-Bergunh de Bordeaux to come before him in person to answer him and to inform him about the acts he had caused to the king's and their prejudice, and the king ordered the seneschal of Gascony to nominate someone suitable for the keepership of the said castle as well as other offices held in Bordeaux until this matter reached the king or is otherwise ordered, and on that the king sent letters to the said seneschal whom they must obey. 2

The English scribe made an error as he wrote his name as Casmadour . It is the deputy of Bayonne presenting himself as 'Pierre de Casse Maiour' in his petition on behalf of Bayonne (SC 8/161/8047). There are today several versions of this family name: Casemajor (the version we have chosen, as it is the closest to the petition's name), Casamajor, Casamajou, Casamayou, Casemayou, Casemajou, Casemajor,etc... (existing also with a 'z' instead of the 's', hence Cazemajor, Cazamajor and so on).

The petition of Pey de Casemajor, deputy of Bayonne, which led to this entry seems to be TNA, SC 8/161/8047. In its first request Casemajor accused Lop-Bergunh de Bordeaux of having with others killed one person and wounded another imprisoned in the castle of Bayonne by the mayor of Bayonne. The community of Bayonne had obtained from the king that Lop-Bergunh de Bordeaux should be replaced by Ramon de Bats , but the men of the castellan refused him access to the castle of Bayonne, so the community requested the king to appoint someone else to this office and that he orders the seneschal of Gascony that the current castellan be arrested and put in jail and all his goods be seized into the king's hand as specified in the customs of Bayonne.

Firm order and enjoinder to John de Weston, constable of Bordeaux , Master Ferandi Bernat Ferrand and Thomas de Askeby , Weston's lieutenants, either two or one of them, to inspect the indentures and memoranda concerning the victuals which prove that Master Medici Aubert Mège, king's clerk , delivered them to Weston or his men, and to see to it that indentures are drawn up according to the king's previous orders so that the king is not troubled on this further through their negligence, and forced to intervene. Mège has sent a petition to the king, asserting that Weston had received victuals and other things for him and his men on the king's orders, for which Mège has indentures and memoranda to prove they were delivered, but Weston has refused to make indentures. The king ordered Weston, Ferrand and Askeby to inspect the indentures and memoranda which could prove that that Mège delivered the victuals to them, and if they were able to find that he had delivered the victuals to them, then the indentures were to be duly made. Mège has now complained bitterly and shown that neither Weston or his men have bothered to carry out the king's order and he has asked for a remedy.

Firm order and enjoinder to the seneschal of Gascony that if John de Weston, constable of Bordeaux Master Ferandi Bernat Ferrand and Thomas de Askeby , Weston's lieutenants, put off action or neglect to carry out the king's order he is to induce or compel them to act. If after this they still refuse to act, then the seneschal is to inspect the indentures which can establish that Master Medici Aubert Mège, king's clerk , delivered the victuals that the king ordered him to do, and to draw up indentures between him and Mège under the king's seal used in the duchy, so that Mège will be considered discharged of the victuals, and Weston will be justly charged for them. Mège petitioned the king, asserting that Weston had received victuals and other things for him and his men on the king's orders for which Mège has indentures and memoranda to prove they were delivered, but Weston has refused to make indentures. The king ordered Weston, Ferrand and Askeby to inspect the indentures and memoranda which could prove that Mège delivered the victuals to them, and if they were able to find that he had delivered the victuals to them, then the indentures were to be duly made. And the king ordered the seneschal that if Weston or his lieutenants failed to act, he was to induce and compel them to act in all ways and means that he could. Mège has now again complained bitterly and shown that neither Weston or his men have bothered to carry out the king's order and he has asked for a remedy, and the king has made another order to Weston and the others.

Order to the seneschal of Gascony to maintain the rightful possessions and things of Villa, de Ramon-Duran de Bielle , Baiona burgess of Bayonne , and to protect and defend him against unlawfull injuries and attacks and do him justice of this complaint according to the local fors and customs: the bayle of Laburdum Labourd unlawfully attacked and molested the possessions, goods and items of Bielle and refused to do justice to Bielle. The seneschal has to make to cease the attacks and molestations made against the said Bielle.

Order to the constable, since, because of the good service made by Bonet de Soler to Edward II and the current king in the duchy and this latter granted him 200 m.st. on which 60 m.st. has to be delivered from the king's treasury at the exchequer of England , to pay him the rest of this sum, 180 m.st. , from the revenues of the duchy. The constable has to receive from Soler the king's letters as well as his own letters of acquittance. The constable will have due allowance in his account.

Order to the seneschal of Gascony to entrust to Cassa Maiori Master Pey de Casemajor, clerk , the Florencia writing office of Fleurance 2 situated near to Lectora Lectoure under the same conditions this office was granted to him by Edward II . This latter ordered the then seneschal of Gascony to entrust this writing office to Pey de Casemajor if nobody else had been already entrusted with it, and if this is the case, then he has to give at pleasure to Casemajor another writing office in the duchy to have with all its revenues, and if the revenues of this other writing office exceed the sum of 10 l.st. per annum according to the true value, then the said Casemajor has annually to answer to the constable of Bordeaux for the remaining sum over and above the said ten pounds, and that Casemajor has to exercise this office himself or by a suitable deputy according to Edward II's letters.

Order to the seneschal of Gascony, as they were serious dissensions between the Baiona mayor and the community of the city of Bayonne on the one hand, and Lop-Bergunh [de Bordeaux], castellan of the king's castle of Bayonne on the other, and several petitions have been presented before the king and his council warning the king about the dissensions that could likely happen, and consequently the king ordered to Lop-Bergunh de Bordeaux personally to come to Anglia England to inform the king on the content of the petitions; to entrust the keepership of the said castle and the other offices held by Bordeaux to a suitable man following the advice of the mayor and community of Bayonne and others from the king's council in the duchy. He will answer for the profits to the constable of Bordeaux. And on this matter, the king orders this should be done according to the said form.

John de Haustede, seneschal of Gascony and Master John de Weston, constable of Bordeaux , are enjoined to move the faithful people in the duchy, to whom the king has also sent letters, to remain quiet and loyal, so that when the king's responses arrive concerning the seneschal's and constable's report on the state of the duchy, they will deem themselves contented. The king received the seneschal's and constable's letters from John de Burgh, king's valet , on the state of the duchy, which also contained what the constable wished to be put before the king, and they were heard and recited before the king's council, and although the matters were deliberated upon before the council, the king was not able to issue orders concerning the same because of certain impediments that intervened. And because many of the king's council were absent in distant parts when de Burgh arrived, without whose counsel in such important business no answer should be made, the king has requested that de Burgh remain in England for a month until Easter, at which time the magnates will assemble with the king, and the king will be able to give orders in relation to this through him.

Order to Master Jordani Austen Jourdain , Ferrandi Bertran Ferrand , Moleria Arnaut de Lamolère and Thomas de Askeby to audit and close the account of Medici Aubert Mège, king's clerk , when he was constable of Bordeaux by the mandate of Edward II , then governor and administrator of the goods of the current king in the duchy of Aquitaine, 1 as Aubert Mège formerly petitioned he was so much ederly that he was not able to make the travel to England . to render the account for the time he was constable of Bordeaux. 2 On this matter the king ordered to the seneschal of Gascony and the constable of Bordeaux to call those of the king's council they consider should be called on this matter and gather some king's trustworthy liege men of this region to audit and terminate Mège's account as required by the state of this account under the king's seal in use in the duchy and to certify the king under the king's seal in use in the duchy about the expenses and revenues found in Mège's account. The king orders to them to do the same as in the order of Edward II on this matter.

Order to the seneschal of Gascony to call before him the [opposite] parties on this matter: the la Bene men and inhabitants of Labenne , Capberton' Capbreton et Boret le Bouret complained to the king that for a certain redevance paid to the king they are entitle to fish in the salt sea 1 as well as in fresh waters near to their places, and there is no memory of the contrary. But some men and malefactors of the city of Bayonne made an assault on the men and fishermen of the mentioned places recently fishing, and they hit and hurt them and broke their boats and committed several other damages and grievances and still continue to commit them, threatening the life and limbs of the same men and fishermen and to burn their boats, so that the inhabitants of the said places petitioned the king to provide them with a remedy on this matter. The seneschal must hear the accounts of the said inhabitants, men and fishermen of the said places about the said transgressions and grievances and do a swift justice according to the law, the fors and customs of the said places, and if something has been attempted again against them, he must nullify it and return it to its previous state.

Order to the seneschal of Gascony and the constable of Bordeaux if it happens that what Oliver de Bordeaux asserts to be true, and especially to the constable to account with him or his attorney of the costs mentioned there: Edward II entrusted at pleasure by his letters patent to Oliver de Bordeaux the keepership of the bastides of Seint Gyen Saint-Gein , Lyans Lias[-d'Armagnac] and Frount de Boef Rondeboeuf , but thereafter, as these bastides are built in 'narrow marches' and lacked a suitable repair of their enclosure, so Edward II ordered to the seneschal of Gascony and the constable of Bordeaux to repair these enclosures when it was necessary as it is shown's in Edward II's letters. But the seneschal and the constable made nothing, so the said Oliver made the needed repairs to the enclosures of these bastides at his own cost and he has not been repaid of this expense by the king's ministers in the duchy, aobut which he petitioned the king to provide him with a remedy. After having accounted, the seneschal and the constable has to pay him from the revenues of the duchy, excepting if Bordeaux or his deputy received more than it is allowed by the customs of this baylie. The constable will have due allowance for the sum owed to Bordeaux in his account. 1

Order to the seneschal of Gascony or his lieutenant to do a swift inquiry on this matter. It has been shown to the king on behalf of Juncars Martin de Juncas , 1 lieutenant of Lop-Bergunh de Bordeaux, constable of the castle of Bayonne and Lane Bernat de Lanne , esquire of Bordeaux , that the mayor of the city of Bayonne formerly arrested two mariners of Bayonne and put them in guard in the king's castle of Bayonne, but one of the two mariners was killed because of a fight that arose between them and some men in the said castle. So the said mayor entered afterwards the castle because of the said murder and seized Juncas and Lanne, then he brought them to a certain turret in the city and still detain them in person there, not permitting them to be freed, according to the local fors and customs, so the said Juncas and Lanne petitioned the king that he should make swift justice. So the king firmly orders the seneschal to make a swift inquiry on this murder and to learn the names of those who committed this crime, to castigate and punish those who are guilty, and to make swift justice about the release of Juncas and Lanne according to the law and the local fors and customs.

Order to the seneschal of Gascony or his lieutenant to call before them the Sanctus Maurinus abbot and convent of Saint-Maurin and do to them swift justice according of the law and the local fors and customs on this matter: the abbot and convent of Saint-Maurin complained that although they and their predecessors have been for a long time in possession of the right to receive and have all the profits ( fructus ) rendered and produced by the Sanctus Ursicinus priory of Saint-Urcisse issued from the said diocese [of Agen], however Ramon de Ladumiera , monk of the said priory, asserted that he has for some time on the said profits some letters patent of safeguard under the king's seal of the duchy ordering to maintain him in his rightful possessions; and for this reason the said abbot and convent are hindered by the said monk to receive the said profits and revenues to their obvious great damage and prejudice.

Grant at pleasure to Chastilon Guilhem-Amaniu [II] de Castillon 2 for his good service to E[dward II] and the current king of the prévôté of Blagnadais in exchange of the 20 l.st. or their value in another money to be received yearly from the hands of the constable of Bordeaux from the revenues of the prévôté of Inter Duo Maria Entre-deux-Mers granted by the king in his letters patent. Castillon petitioned the king that in compensation of these 20 l. and also of the damages he suffered in the service of Edward II and the current king in the wars of Gascony against the French in the duchy [of Aquitaine] the king grant to him and his heirs the prévôté of Blainades Blagnadais 3 which value did not exceed, as Castillon asserts, the yearly sum of 12 l.st. , with all its appurtenances. The king grants, under condition that Castillon returns the previous king's letters to the chancery, this prévôté worth 12 l.st. a year to Castillon and his heirs, and they have to pay liege homage to the king for that. And if the value of the said prévôté of Blagnadais exceeds the yearly value of 12 l.st. , Castillon and his heirs have to render annually the surplus to the constable of Bordeaux.

Order to the seneschal of Gascony to check the exchange agreement made between Vallibus, de Ramon de Vaux and E[dward II] , former king of England at the instigation of Credonio, de Amaury [III] de Craon , then seneschal [of Gascony] . Ramon de Vaux exchanged with [Edward II] all the lands, tenements and issues he had at the place or territory of Vallibus, de Vaux 1 with a certain territory of Edward II named le Sort le Sord to have in perpetuity as it is shown in the charters made at this occasion. The territory of le Sord has been fully delivered to Ramon de Vaux with its rights and appurtenances as Edward II held it. And Ramon de Vaux received and had the farms and issues of some tenants of the said territory of le Sord, but some tenents of the said territory did not obey to the said Ramon de Vaux, stealing from him the farms, issues and the other benefits to the great damage of the said Vaux and against the form of the said exchange, so Ramon de Vaux petitioned the king to effect a remedy on this matter. If the seneschal of Gascony finds that the content of the agreement of exchange has still not been completed, then he has to do what is right and to compel those who do not bother to obey Vaux as lord with their services and vassalages as they used to obey to Edward II, according to law and the local fors and customs.

Although Master Aubert Mège petitioned in the past that he was too exhauted by his old age to be able to travel to England to render his account from the time he was constable of Bordeaux appointed by Edward II then governor and administrator of the possessions and goods of the current king in the duchy of Aquitaine, so the current king ordered some faithful suitable men of the king from the duchy to audit and terminate Mège's account and do things required by the nature of the account under the king's seal in use in the duchy to certify the king of its expenses and issues. But according to a reliable testimony Mège's petition hid the truth, which is that Mège has strength to travel. Consequently, the king wants because of this and other reasons that Mège's account be audited and terminated in England as the constables of Bordeaux have normally to do.

Grant for life to Audoeni Hélias Audouin because of his great services to Edward I , Edward II and the current king of the custody in the king's Burgum castle of Bourg with its appurtenances and all the issues of the castellany of the same castle in compensation for the custody of the castle of Podium Normanni Puynormand from which he has been removed. E[dward II] , former king of England, granted for life to Audouin the custody of the castle of Puynormand with its appurtenances and all the issues of the castellany of the same castle. 2 But Audouin has been removed from the said custody, and the letters patent of Edward II he had on this matter have been returned to the chancery and cancelled, so Audouin petitioned the king to feel compassion for his current state and have such regard that Audouin can continue his service to the king because his state has greatly suffered because of the wars in the duchy, in compensation of the custody of the said castle of Puynormand and because of the damages and losses he suffered at the occasions of the said wars.

Guilhem, lord of Feugas Heugas has shown by his petition exhibited before the king and his council, that he and certain of his associates were lately accused of the death of the lords of Amou and Athieu within the jurisdiction of Aquen' Dax , and that Guilhem and his associates are prepared to stand trial according to the customs of Aquitaine, if anyone wishes to accuse them of the death, and he requests that the king, if the process has begun against them for the death, will order that it be determined and a definite sentence given. 2

Order to the seneschal of Gascony, the constable of Bordeaux or their lieutenants and the constable of Bordeaux that, having called those of the king's council there whom they considered ought to be called, and having full information on the query of Sénébrun [V], la Sparre lord of Lesparre who petitioned the king before him and his council that because of the services of him and his ancestors towards the current king and his ancestors, to give to him and his heirs forever the king's high justice ( altam iusticiam ) on the paderie of Medoch' Médoc in the parishes of Lilhen Lillan and Loyrak Loirac and their appurtenances with all what is owned by the king, excepting his full authority over these parishes. The seneschal and constable have to send without delay to the king a certification where they will explain the damages or losses that may happen to him or anyone else if the king grants this petition, the nature of the high justice, the extent of its [geographical] boundaries, its annual value and all the articles concerning this high justice.

There, Sénebrun V complained to the king that the king's officers named the 'pazeis' of the Médoc use the high justice in the parishes of Lillan and Loirac to the detriment of his rights, as these places of the paderie of Médoc are traditionnaly parts of the baronny and high justice of Lesparre. Furthermore, the king does not gain more than 50 l. per annum from it.

Order to the constable of Bordeaux to account with Malo Leone, de, Monettarii Johan de Mauléon called Monéder 2 the issues of the lands, tenements with their appurtenances he holds in Marensyn Marensin , la Farie Laharie and Sambussa Saubusse which were granted by Edmund [of Woodstock], earl of Kent [king's lieutenant] in the duchy , as Mauléon petitioned the king before him and his council, the latter having to answer to the king of all sum beyond the sum allocated to Mauléon in small tournois on the allocated lands. The constable has to allocate in Mauléon's account the issues of these lands since they have been granted to him by the earl of Kent in small tournois or their value in another money provided he answers to the king for the remainder of these issues.The constable has to remove without delay all impediment put by him or any one else on these goods, lands and tenements.

Order to the constable of Bordeaux to account with Clawrie Guilhem-Ramon de Claverie , serjeant-at-arms , of the sums owed to him. This latter petitioned the king at the Parliament of Norhampton' Northampton 1 to grant him the baylies of Cyeyns Seignanx and Gounce Gosse under the same conditions enjoyed by Bernat de Pendase who previously held these baylies, in order to pay him from the issues of these baylies the 22 l. 12 s.st. owed to him by Edward II , as it is shown by bills of the wardrobe. The king ordered [the constable of Bordeaux] and the seneschal of Gascony to entrust at pleasure under the seal of Gascony the said Claverie with the said baylies for a suitable price rendering annually a certain sum to the king. Claverie explained to the king that though [the constable] and the seneschal delivered to him the said baylies, the constable postponed the payment of the owed sum of [ 22 l. 12 s.st. ], so Claverie petitioned again the king before him and his council to have allocated the sum owed on the issues of the said baylies. The king orders the constable to account with Claverie for the issues of these baylies for the time he hold them, and allocate in his account the said 22 l. 12 s.st. , receiving the said bills. The constable will have due allowance in his account for the sum owed to Bordeaux.

Order to the seneschal of Gascony and the constable of Bordeaux to check the letters under the seal of Gascony of Berkeleye Maurice de Berkeley , then seneschal of the duchy of Aquitaine for Edward II , where Berkeley promised to Lop-Bergunh de Bordeaux , former castellan and prévôt of Baionens' Bayonne , to be protected for the arrest, the imprisonment for some time and then the release of Burgundi Guilhem Bourgoin , serjeant of the king of France acting in the city of Bayonne following the orders of Berkeley. Bordeaux petitioned the king, as he had been condemned by the court of France 1 for these acts to pay 4,000 l.t. to be levied on the good and chattels of the said Bordeaux in the duchy, to be protected of this decision as it was specified in Berkeley's letters. The seneschal and the constable, after having taken advice from the king's council of the duchy, have to keep the promise of [protection made towards Bordeaux] according to the content of the said letters of Berkeley.

TNA, SC 8/282/14087 is the petition of Lop-Bergunh de Bordeaux at the origin of this entry. There Bordeaux specified that Guilhem Bourgoin was imprisoned in the castle of Bayonne. In TNA, SC 8/293/14604 Lop-Bergunh de Bordeaux explained he arrested Guilhem Bourgoin because he brought forged letters. In the Archives Nationales, Paris, J 655, no.25 and 25 bis, the king of France explained that Guilhem Bourgoin, his serjeant, was sent in 1321 to Bayonne by the French seneschal of Périgord to summon a the Parlement of Paris Arnaut-Guilhem de Mauléon , bayle of Labourd or his lieutenant Lop-Bergunh de Bordeaux , castellan and prévôt of Bayonne , at the request of Arnaut-Sans Duluc . Bourgoin was taken prisoner at night, beaten and was put during one whole night in a narrow dry hole where he was not able to lie down or sit. Thereafter, he was prisoner in a tower for twenty days.

The king wants to help to restore Marmande's status which has been much diminished, as he asserts.

TNA, SC 8/281/14040 is the petition of Ramon-Bernat de Marmande at the origin of this entry. There, Marmande complained he lost his land and that his castles of Virisiles Virazeil and Lezinan Lusignan were destroyed by the French because he was in the service of the king of England. He was not compensated until Oliver de Ingham , seneschal of Gascony, granted him the land of la Mote Pey de Lamothe in Basedes Bazadais which worthed 1,000 l. of annuity. But it has been ordained that lands won by force of arms be returned to the people of the king of France, and Oliver de Ingham has ordered him to return these lands, leaving him with no land on which to live. He asked that he might have land from which to support himself, or the Dentre Deus Mars prévôté of Entre-deux-Mers or the Seint Macari castellany of Saint-Macaire or the La Bourde baylie of Labourd , or some other thing from which he might derive profit. Marmande specified he had left his land to keep the town of Seint Melioun Saint-Émilion with Boglon Johan de Bouglon when Charles de Valois besieged la Reule La Réole [in 1325]. In the endorsement, the king grants him 100 l. .

There Guilhem-Bernat asserted his place of Salles was in the jurisdiction of the king and that he did not want to acknowledge the jurisdiction of the Biarne, de vicomte of Béarn ( Gaston II de Foix ) over this place, so this vicomte imprisoned him. And during the war between the king and the king of France, the vicomte of Béarn occupied Salles with its appurtenances, cut and destroyed his woods from which he had a lot of revenues and he has oppressed his subjects of this place and still holds them and his lordship against the form of the peace made between the king and the king of France. Guilhem-Bernat estimated his losses because of the war to the sum of 1,000 l.st. . In the endorsement, the king ordered to pay him 100 l.t. per annum until he is informed of his losses and damages.

Letters patent of Edward [II] releasing all rights that the king has in the goods of Per-Arnaut [Robert], son of Auger Robert , late citizen of the Aquensis city of Dax , and grant of the same to Tholosa Bertholomiu de Toulouse and Maria [de Toulouse] his wife, Per-Arnaut’s sister and heir , at the instance of a cardinal. Per-Arnaut had been accused of causing the death of la Baste Bonin de Labaste , and of wounding Ripperia Ramon-Arnaut de Ribeyre, citizen of Aquensis Dax . He was imprisoned by the king’s officers there, but escaped because of the dread of being in prison, and not through guilt. Afterwards he was acquitted of the crimes in the Aquensis king’s court of Dax , and his pledges were absolved, and in the sentence of affirmation of the verdict made by the seneschal of the duchy, the rights to whatever goods which belonged to him [as a fugitive] were reserved to the king. The king has now learned that the king’s minister there took the greater part of these goods to which the king was entitled upon their first entry into office, and a certain cardinal of the Roman church has requested to the king, by his letters patent, that the king will provide Toulouse and his wife with a remedy for the disturbance of their possession of Per-Arnaut’s goods and chattels. 1

The king, for himself and his heirs, ratifies, approves and confirms the release and pardon.

Order to the seneschal of Gascony and the constable of Bordeaux to check the letters of Edward I , former king of England, grandfather of the current king, owned by the town of Sanctus Severus Saint-Sever , where this latter granted to this town 3,000 l.ch.bon. , as the good men of the town of Saint-Sever petitioned the current king before him and his council, it has been ordered to pay this sum to this town, but it has not been paid up to now, so the town of Saint-Sever has complained to the king and requested the payment of this sum or have another suitable satisfaction, so the king wants to satisfy the said town if the whole sum or a part of it has not been paid. The seneschal and the constable are to check the memoranda of the time of Edward I , grandfather of the current king, of Edward II , former king of England, father of the current king and of the current king kept by the constable of the castle of Bordeaux, as it is said, and to pay or do another satisfaction without delay of what it is found to be owed, receiving the letters of Edward I as well as the letters of acquittance of Saint-Sever. Order to the seneschal of Gascony to summon the parties in the dispute between Bernat de Ségur and his brother, and the vicomte of Benauges and Castelhon Castillon 1 concerning the rendering of homage, and the king's advocate, obtain full advice with the king's council there on the dispute, and he is to retain the king's rights in the matter so that the king is not disinherited, or the brothers damaged by his failure to act. And if the vicomte has taken any goods of the Ségur brothers as a distraint, has made undue cohercion or has done anything new, then restoration is to be made to the brothers without delay, and matters returned to their original position according to the fors and customs there.

Bernat de Ségur has informed the king by his petition exhibited before the king and his council that he and his brothers hold certain lands and possessions in Lopiak Loupiac in Benauges in the duchy directly from the king, and their ancestors have always held the lands from the king and his progenitors, kings of England and dukes of Aquitaine, and have paid homage to them; however the vicomte has striven with all his power to usurp lordship over those lands and possessions to the king's prejudice, and to force Bernat de Ségur to do homage to the vicomte for the lands, though he holds them from the king, compelling him by grave cohercions and intolerable distraints unjustly, and Ségur requests remedy for the maintenance of the king's rights and for the indemnification of the brothers. 2

This vicomte at this time was Pey II de Grailly (d.1355).

The dispute had been a long standing one with the homage for these lands being transfered directly to the king in the reign of Henry III in the mid thirteenth century from the then rebellious vicomte. Pey II de Grailly made clear and concerted efforts to recover the homage during the reign of Edward II, and was clearly still attempting to force the Ségur brothers to do homage. Order to the seneschal of Gascony and the constable of Bordeaux to check the letters of Edward I , former king of England, grandfather of the current king, owned by the probi homines, Sanctus Severus worthy men of Saint-Sever as these latter petitioned the king before him and his council that Edward I granted to them 3,000 l.ch.bon. and ordered to pay this sum to this town, but it is complained by the said community that this sum has still not been paid. They have to check the memoranda of the time of Edward I, Edward II , former king of England, father of the current king and the current king kept by the said constable in the king's castle of Bordeaux, it is said, and what it will be found on this matter send without delay a certification to the king under the king's seal of the duchy.

Order to the seneschal of Gascony or his lieutenant to call before him the litigants and hear their accounts on the [following matter]: the probi homines, Sanctus Severus worthy men of Saint-Sever complained to the king that they and their ancestors were and should be in possession of the pasture of their animals and other profits received on the lands and tenements of Malo Sorde, de Mauco and Senas Cénas , 1 possession on which there is no memory of the contrary, but the vicomte of Tartas , 2 his men and servants unlawfully prevent their animals to pasture and them to receive the profits of the pastures to the damage and prejudice of these men and their obvious perilous despoliation, so they petitioned the king to provide them with a suitable remedy. If the seneschal notices that the vicomte, his men and servants unlawfully hamper the rights of the men of Saint-Sever, as it is asserted, then he has to compel them to do it and maintain and protect the men of the town of Saint-Sever in their lawful possessions and correct all attempts made against them according to the local fors and customs.

Order to the seneschal of Gascony and constable of Bordeaux, or their lieutenants, that they are not to demand or take any fee from the citizens of Baion' Bayonne for the use of the king's seal for sealing their letters contrary to the form of the ordinance of the seneschal and constable that specifies that fee. On behalf of the citizens it has been complained that they have been compelled to pay greater and intolerable sums of money than they were accustomed to do for the use of the king's seal of the duchy, and they request a remedy; and the king understands that to prevent such extortions and exactions of various sums of money for the fee for the use of the seal, an assessment ( taxatium ) was ordained by the seneschal and council specifying the fees for the use of the seal for each letter, and the king does not wish the citizens to be charged contrary to this ordinance.

Order to the same to obtain full information concerning the privileges that the inhabitants of Aquen' Dax have concerning their exemption from the payment of tolls throughout the duchy, and send what they find to the king under the king's seal used in the duchy without delay together with the writ by the proctor of Baion' Bayonne . On behalf of the mayor, jurats and all the community of Baion' Bayonne it has been requested that the king grant them and their heirs and successors will be free from the imposition of the customs and tolls which pertain to the king throughout the duchy, just as the inhabitants of Dax are quit. The king wishes to be certified of what privileges the citizens of Dax have concerning the payment of tolls, from what date they have enjoyed this, what is the reason, how was it done, and what letters they have of the king and his ancestors on this.

Commitment to Sarraller Ramon Sarraillé, burgess of Bordeaux of all the issues and profits from the lands and tenements that John de Weston when he was constable of Bordeaux levied for the service of the king. Edmund [de Woodstock], earl of Kent , former lieutenant of Edward II , former king of England, father of the current king, in the duchy during the war that arose between this latter and the king of France, who granted at king's pleasure, because of the damages and injuries that Sarraillé had suffered during this war, and his good and faithful service at this period, the lands and tenements that were of Arnaut Laffont , then adherent of the king of France against Edward II. These lands and tenements worth 50 s. 3 d.st. per annum as it is shown by the certification made by the seneschal and the constable of the said duchy at the king's mandate and recorded at the wardrobe. And the said Sarraillé made the king understood that John de Weston, former constable of Bordeaux levied for the service of the king the issues of these lands and tenements when he was constable of Bordeaux, not permitting the said Sarraillé to receive them, and this latter supplicated the king to accept and approve the grant of the said earl of Kent by his letters patent. The king accepts and approve this grant at pleasure of these lands and tenements with appurtenances without rendering to the king what another [will render on them].

Order to Pey de Galician, constable of Bordeaux , clerk to provide to his valet Philip le Taverner bearer of these presents sent to the city of Bordeaux to choose and provide to the king sixty casks of wine and bring them to the Suthampton' port of Southampton , 60 casks of the best wine than can be found in Bordeaux to the said le Taverner paid on the issued of the duchy and make bring them to the port of Southampton, making an indenture with the said le Taverner of the price of the said wines and of the freight of the ship.
