Introduction.

The roll is a relatively straightforward one for it is dominated by the preparations for the departure of Edward of Woodstock to take up the governance of the newly created principality of Aquitaine. The dispatch of the prince to Aquitaine had been in the planning since 1361, and had been intended to have taken place probably in the autumn of 1362, but had been delayed for various reasons. 1

The vast majority of entries are letters of protection and attorney for the prince's followers prior to their departure, or in residence in Gascony. The majority of these letters seem to relate to men who were to make up the prince's military following or that of the principal noble accompanying the prince - Thomas Beauchamp, earl of Warwick. Many names are very familiar as longstanding brothers-in-arms of the prince, such as Gerald de Braybrooke, Baldwin Freville, Thomas de Felton and John de Hinxworth, but many are less familiar. 2 It is clear that the prince was also taking contingents of non-military personnel, who were either meeting the prince's private household needs, or who were intended to become part of the new princely government of Aquitaine, men such as Simon Clement, clerk, Master Philip de Codford, precentor of Salisbury, and Master John Silvester, archdeacon of Wiltshire, and the vintner, John de Clopton. 3 One particular individual, described as 'Nicholas de Lancaster, herald' clearly reveals that the prince took a herald with him, and the individual seems to be one of the earliest reference to the Lancaster Herald. 4 Of course, although these various letters do not necessarily mean that the individuals actually departed with the prince, they do provide an important supplement to our knowledge of those who were serving with the prince at this time. 5

A small number of entries clearly relate to the logistical difficulties that were faced in shipping the prince to Gascony. John de Ellerton and Robert de Appleby, both royal serjeants-at-arms, were assigned on 8 February to arrest ships of a 50 tun capacity or more, along the east and south coasts, and were to ensure the ships were at Plymouth for the prince's departure at Easter (Easter fell on 2 April in 1363). 6 However, the task facing them must have proved too difficult to achieve for the king issued a new assignment on 26 March to Ellerton and William del Wood, another royal serjeant-at-arms, to have the ships at Plymouth for two weeks after Easter. 7 This would suggest that the king and prince were being kept well informed by their officials of the state of the arrest of ships. However, even this new deadline seems to have proved impossible to meet, for the prince did not finally depart until 9 June. Interestingly two ships were singled out for special attention, with assignments for the recruitment of mariners to man them. 8 Both were called la Seintemarycogge , one from Winchelsea, and the other from Ipswich, and were evidently singled out for a special part in the prince's crossing. The Ipswich ship was ultimately to carry the prince himself. 9

The number of grants of licences for merchants and others to take victuals to Gascony, whilst fewer in comparison with rolls 73 and 74, perhaps unsurprisingly continue to be found in this roll. 10 That this trade was predominantly in the form of the import of wine, and the purchase of victuals with the proceeds is more clearly spelled out in the entries found on this roll. But the types of victuals being exported show a marked change from those exported in previous years, from grain to preserved fish, mainly herrings. In addition, the prince himself was given a licence to export herring 'for the sustenance of the common men residing' with him in Gascony. 11

Other business is of fairly modest volume, and is perhaps a very real indication of the delegation of powers to the prince by the king. The king's longstanding attempts to reconcile the notoriously fractious merchants of Bayonne with foreign traders finds expression in peace negotiations with the merchants of Flanders. 12 An attempt to obtain justice for a Winchelsea merchant robbed on his return voyage from La Rochelle by Breton pirates of the allegiance of Charles of Blois, foundered on the liberties granted to La Rochelle by the king himself. 13 There are prohibitions against the export of horses and falcons out of England. 14 And finally, a very longstanding dispute between the Durfort family and the citizens of Penne-d'Agenais, which had its roots in the 1330s, again reared its head, with the king seemingly no closer to an equitable resolution. 15

The king has often been very troubled by the great disputes that have, for a long time, existed between his subjects of Bayene Bayonne , and the good and faithful men of Flandres Flanders , both before and after the war with the king of France , and a peace has been desired which both sides would keep. The king has been given to understand that his dear cousin the count of Flanders , 2 and the good people of Flanders have agreed to the Bayone men of Bayonne freely coming and trading in Flanders, and have caused it to be publicly proclaimed at Lescluse Sluis , and elsewhere, as appears by the tenor of their letters close sent to the king. The king, as a result of this, agrees, for himself and his heirs, and for his men of Bayonne, that all those of Flanders are able freely and peacefully to go and trade in Bayonne, and the king's other lordships, in times of peace, without impediment, and the king wishes that this is kept.

Assignment of John de Ellerton, king's serjeant-at-arms , to arrest all ships of a capacity of fifty tuns and more, in each port from the mouth of the Thames to the north, wherever they can be found, and to cause them to be taken to Plimuth' Plymouth so that they are there by Easter next prepared to go in the king's service, at his wages, to Gascony with Edward, prince of Aquitaine and Wales , and the king's other faithful subjects going with the prince; and to arrest all those whom he finds oppose him, and put them in prison until the king otherwise ordains on their punishment. Order to the keeper of the castle and town of Rupella La Rochelle to release from arrest the two ships of the obedience of Blesis Charles of Blois , and free the mariners and others who have been arrested with the ships from arrest and prison, if they have been detained, restoring to them their goods, which were lately arrested there at the request of Salarna Simon Salerne , merchant of Wynchelse Winchelsea , 1 this being done in accordance with the vigour and form of the king's protection and safe-guard, unless they have committed different offences or made contracts in La Rochelle for which they ought to stand trial. The keeper is to ensure that all the king's faithful subjects of La Rochelle have all their privileges granted to them, and they are observed inviolate.

On the behalf of Salerne , it was alleged to the king some time ago that Salerne 's crayer ( craiera ) 2 called la Katerine of Wynchelse Winchelsea was loaded with salt and merchandise to the value of 500 m.st. in the Baya Bay [of Bourgneuf] in Pictavia Poitou , 3 and took it along the coast of Britannie Brittany during the truce, where he was robbed of his ship, and the goods and merchandise in the same by men of Brittany , and he requested a remedy from the king. The king, by his letters patent under his great seal, at the request of Salerne , ordered the keeper, and the mayor, consuls and good men of La Rochelle to arrest the goods and merchandise of the subjects of Charles of Blois, the king's kinsman, which happened to come to the town, or the bodies of the men and subjects of the same Charles found there, and cause them to be delivered to Salerne , or his proctor, without delay.

The keeper, proceeding to carry out this order, seized two vessels with the goods and people in them, of the obedience of Charles of Blois, in La Rochelle, as the mayor and échevins of the town have informed the king by their letters close, and they have added that this action is to the great prejudice of the people of La Rochelle, since it is against the tenor of their privileges lately granted to them by the king, by which it was expressly laid down that merchants coming to La Rochelle with their merchandise should be under the king's special protection and safe-guard, and that if this action was allowed to proceed, then in future merchants and others of Brittany, who bring an abundance of victuals to the town, would cease to come there to the great damage of the town, and they request that the king continue his favour and provide them with a remedy.

The king has confirmed the privileges granted to the mayor, échevins, consuls and good men of La Rochelle by inspection of the rolls of chancery, and wishes to keep them unstained. 4

Assignment of Wode William del Wood and John de Ellerton , king's serjeant-at-arms, jointly and individually, to charge all owners and masters of ships that were arrested for the passage of Edward, prince of Aquitaine and Wales , and his retinue to Gascony, that they, under the pain of forfeiture of life and limb, their ships and everything else that they are able to forfeit, have their ships, well equipped and prepared, fishing boats excepted, at Plimuth' Plymouth two weeks after Easter next, ready and prepared to go with the prince in the king's service; and to have it proclaimed that if the owners and masters do not do this, then they will suffer the aforesaid forfeitures without hope of grace from the king.

The king has also assigned them to inquire by the oaths of good and law-worthy men of the counties of Essex , Norfolk , Suffolk , Lincoln , York and Northumberland , by whom the truth can best be known, of those mayors, bailiffs and keepers of ports who have permitted horses to be taken out of the realm without the licence and order of the king following the first prohibition ( primam defensionem nostram ), and of the numbers of horses. All those that they find culpable by legal process, are to be taken and attached to appear at a day to be designated by Wood and Ellerton, to answer for this before the king for the contempt and damage of the king, and to do and receive what the king and council will ordain.

They are further assigned to have it proclaimed in every port and place where they consider it expedient, that no native or alien of whatsoever condition, under pain of forfeiture of all that they are able to forfeit to the king, is to take any falcons out of the realm, except by the king's special order under his secret seal; and to enjoin all sheriffs, mayors, bailiffs and keepers of ports in the counties cited above, that they are not to permit anyone to take falcons out of the realm, and that all falcons that come to those places for that purpose, are to be taken into the king's hands without delay, and kept safely until otherwise ordered. Wood and Ellerton have the power to appoint deputies in each town, port and place where they are not able to act in person, to do and execute the assignment. They are to inform the king in chancery from time to time of what they have done in these matters.

Lately the king caused all ships of a capacity of 50 tuns or more to be arrested for the passage of the prince, and the owners and masters of those ships were enjoined to have those ships at Plymouth at Easter next, ready and prepared to go with the prince and his retinue as above, in the king's service for the expedition of certain difficult business concerning the king and his realm; however, the owners and masters detained their ships, and refused to go, in contempt of the king, and to his grave damage, and manifestly delaying the departure of the prince, about which the king is very much disturbed, and not wishing to have his business delayed because of this, has made the assignment to Wood and Ellerton.

It is ordered, under pain of forfeiture, that they are to be intendant on, consult with and aid Wood, Ellerton and their deputies, in the execution of their assignment, when they will be warned to do so. 1

Order to the mayor and bailiffs of Novum Castrum super Tynam Newcastle upon Tyne , and the keeper of passages from the port of the town, under pain of forfeiture of all that they are able to forfeit to the king, on behalf of the king, that they are to charge all owners and masters of ships of a capacity of 50 tuns or more, to have their ships, both present and those that are absent when they return, fishing boats only excepted, sufficiently prepared and equipped at Plimuth' Plymouth two weeks after Easter next, putting aside all excuses and delays, under the pain of forfeiture of their lives and limbs, their ships and all else that they are able to forfeit to the king, and that they be ready and prepared to go with Edward, prince of Aquitaine and Wales , to Gascony in the king's service. The mayor and bailiffs and others are to attend to this, lest by their lukewarmness the passage is further delayed for lack of shipping. Lately the king caused all ships of a capacity of 50 tuns or more to be arrested for the passage of the prince, and the owners and masters of those ships were enjoined to have those ships at Plymouth at Easter next, ready and prepared to go with the prince and his retinue as above, in the king's service for the expedition of certain difficult business concerning the king and his realm; however, the owners and masters detained their ships, and refused to go, in contempt of the king, and to his grave damage, and manifestly delaying the departure of the prince, about which the king is very much disturbed, and does not wish to have his business delayed because of this.

And further, the king orders that, under pain of forfeiture, they are not to permit the export of any horses or falcons, unless by special order of the king by his letters under the secret seal, but to arrest all horses and falcons brought to the port for export without delay, and cause them to be kept safely until the king orders otherwise, and they are to inform the king in chancery of what they have done from time to time under their seals. Though the king has sent many writs of prohibition to them that they are not to permit the export of horses and falcons out of the realm under pain of grave forfeiture; however, horses and falcons have been permitted to be exported, through bribery, in contempt of and to the grave damage of the king, and his people, and contrary to the prohibitions, about which the king is much alarmed. 1

It is ordered that the merchants be permitted to go, with their ships loaded with the herring, to Gascony, or by their men or servants, not permitting them to be troubled, injured, damaged, impeded or harmed. If anything has been done contrary to this, it is to be put right without delay. 1

Order to the bishop of Agennen' Agen , 1 and Master Carris Aquis Amalvi de Caraygues, doctor of canon law in Caturcen' Cahors , to summon before them, or either of them, the king's procurator fiscal ( procurator noster fiscali ) there, and others who ought to be summoned concerning the appeal of Arnaut [de Durfort] , and hear and determine the principal business according to the fors and customs there, with the king's authority, ensuring that whatever they decree in this matter, by whatever means they choose, remains inviolate.

The king has received a serious complaint from Durfort, kinsman and heir of the late Duroforti Arnaut [III] de Durfort , deceased, that even though the king, by his letters, for the abundant services of the deceased, gave to the late Arnaut de Durfort and his heirs various lands and places with complete and shared jurisdiction, and all manner of high and low justice in Podiumpinesium Pépinès , in the district and territory of Penna Penne-d'Agenais , and in certain parishes neighbouring it in Agenais, which are under the king's lordship of Aquitaine, and both the late Arnaut and his nephew occupied the lands and places for sometime; nevertheless the consuls and community of Penna Penne-d'Agenais , have asserted that the lands and places, and the jurisdiction, ought to pertain to them and their town by right, and have impeded, and still impede Arnaut de Durfort from the enjoyment of the same, contrary to the form of the king's letters. They have also brought Durfort before Sauvage Arnold Savage, kt , then lieutenant of the seneschal of Gascony , and the late Farlee William de Farley, constable of the castle of Bordeaux , on this matter, and caused him to be removed from his possession of the same by definitive judgment of the lieutenant and constable. Durfort, feeling himself aggrieved, appealed to the king as superior lord of Aquitaine, and the king wishes full justice to be done in this matter. 2

Confirmation granted to the consuls, community and inhabitants of Penna in Agennesio Penne-d'Agenais in the king's lordship of Aquitaine, at their request, of all the liberties and franchises granted to them by whatever king of France, and which were used by them at the time of the peace made at Bretigniacum Brétigny , near Carnocen' Chartres between the king and the king of France , provided those liberties and franchises are not contrary to the articles and contents of that peace treaty. The king wishes those liberties and franchises to be observed and held inviolate according to the conditions and articles of the peace.

It is ordered that Roger be permiited to buy as much herrings as he is able for that money, and take it to Gascony, without impediment, paying the customs, whatsoever ordinances, prohibitions or orders to the contrary notwithstanding.
