C 61/115, 2 Henry V (1414-1415) .

Introduction.

The roll of the second year of Henry V contains many confirmations, not surprisingly as this was common practice at and close to the beginning of a new reign. Henry V confirmed several grants of his father, such as the grant of Cubzac to the Poitevin Hugues Brouard. 1 This grant was still being challenged by the lord of Montferrand and Brouard was in reality not able to have it. 2 Henry V re-appointed Johan du Bourdieu as chancellor of Aquitaine and granted him the office of the keepership of the seal of the superior court of Aquitaine. Henry IV had granted him the same office during royal pleasure in 1408. 3 The king also confirmed again, 4 as in the previous regnal year, 5 the long list of grants given to the predecessors and ancestors of Gaston de Foix, captal de Buch, a leading supporter of the English ducal regime. Henry also confirmed the inspeximus of his father to the abbey Sainte-Croix of Bordeaux of the confirmation by the Black Prince (4 April 1357) of exemption from payment of the great custom of Bordeaux. 6 The king also confirmed grants given to the men of the Comtau d’Ornon and the prévôté of Camparian by Edward III and the Black Prince which protected them against certain excesses of the lords of Ornon. 7 Henry also confirmed the grant of an office by his father in 1412 to the burgess of Bordeaux, Ricart Macanan, 8 as well as a yearly revenue granted in 1406 to the serjeant-at-arms, Guilhem-Pey de Cazaux. 9

It is surprising to find several other confirmations of acts of Henry V which had been made as recently as the previous regnal year and enrolled on the roll for that year: the king was keen to ensure they were secure and publicised, evidence of his interest in the area whilst he was involved in negotiations with the French and, in time, preparations for war. 10

Several entries are confirmations of acts of the two most recent king’s lieutenants in Aquitaine: the king’s brother Thomas of Lancaster, duke of Clarence, and the king’s uncle Thomas Beaufort, earl of Dorset. On 21 July 1414 was confirmed Clarence's exemption of the payment of the great custom on the wine which had been confirmed by the Black Prince to the chapter of Saint-André of Bordeaux in 1357. 11 Also confirmed on the same day was confirmation of the same exemption to the dean and chapter of Saint-Seurin of Bordeaux by Edward I in 1289. 12 Beaufort, present in the duchy at this point, granted on 21 September 1413 the keepership of all the papers and registers of all the notaries of the duchy to Philip Caxton, and the writing office of the seal and counter-seal for contracts of Bordeaux to the clerk Johan Mouliney. 13 On 24 November 1413, Beaufort created the prior of Bardanac (now in the commune of Pessac) as a burgess of Bordeaux enjoying all the privileges – particularly the exemptions on wine – of the burgesses of Bordeaux. 14 The keepership of the seal and counter-seal of Bordeaux was granted on 15 January 1414 to the English esquire William Oldhalle. 15

Some new acts of Henry V’s administration were also copied into this roll. We find there the first known official elevation of a Gascon lordship (Doazit in the Landes) into a barony. 16 The Poitevin Hugues Brouard obtained on 19 August 1414 the lands of Condat and Barbanne (now in the commune of Libourne), probably to compensate him for Cubzac which he had not been able to get from the lord of Montferrand. 17 A grant soon nullified in January 1415 by the grant of the lands and its revenues to the executors of Thomas Swinburne. 18 We learn about a conflict between the lord of Castillon-Médoc and the lord of Montferrand over the castle of Lamarque (in Médoc). 19 The French lord of La Laigne (in Saintonge), previously made prisoner by John Radcliffe, obtained letters of protection to come to England to sell wines of the region of La Rochelle in order to pay his ransom. 20 A rent was given to the English esquire Henry Wilmot because he had fallen into great poverty when he became old. 21 The burgess of Bordeaux, Arnaut Brunet, aimed at recovering his wife’s goods being in the king’s obedience which had been seized because she was living at La Réole, then under French obedience. 22

On 20 November 1413, 2 at Brouard's supplication, the current king confirmed Henry IV's letters granting him this castellany and this crossing, to have and to hold the same for life from 30 May 1407 3 as the late Greily Johan de Grailly, kt held them. 4

Commission of oyer and terminer to judge in appeal to Seint Johan John St John, kt , mayor of the city of Bordeaux , Master Bordiu Johan du Bourdieu , judge of the king's high council, 1 Thomas Felde, Hereforden' dean of Hereford , doctor of laws , 2 Master Bertran d'Aste, doctor of canon law , 3 judge of the court of appeal of Gascony , Cerpot Guilhem de Sarpout , 4 judge of the king's high council of the city of Bordeaux. 5 Furthermore, the king orders them - five, four, three or two of them - to call before them the parties, and if they do not reach an unanimous agreement on a final sentence, they must certify the king before 1 May 1415 about their inquiries concerning the articles mentioned below, so that the king may put an end to this appeal:

  1. first, if the new toll of Guiche is prejudicial to the franchises, liberties and privileges of the cities of Bordeaux, 6 Bayonne, Dax, the town of Saint-Sever and of their districts, and to the prejudice of the merchants coming with their goods and leaving these cities, and who might stop coming there because of this new toll;

On 22 August 1409, Henry IV had granted by his letters patent to Beimont Carlos de Beaumont, castellan of Mauléon , 7 at his supplication, for his lifetime, to receive in person or through his proctors a toll levied on the goods passing through the river Ladou' Adour and the Guissen fishery of Guiche : 5 hardis guyennais for each load ( sumagium ) of cloth or other good, 2 hardis guyennais and half for each pipe of wine, 7 hardis guyennais for each barrel of woad, 8 2 hardis guyennais for each cartload ( carectata ) of iron, half of a hardi guyennais for each head of cattle, 2 hardis guyennais and half for each quintal of iron ( quintallum ferri ), 5 hardis guyennais for each piece ( tractus ) of leather, each hardi is worthing half penny ( obolus ), if it not at the prejudice of anyone who has franchises or tolls in these regions. And thereafter, the mayor, échevins, jurats, consuls and hundred peers of the city of Bayonne appealed to Henry, complaining that this new power was to their prejudice, and the jurats and community of Saint-Sever and the jurats and community of the city of Dax have joined this appeal. Bayonne, Saint-Sever and Dax have pursued this appeal before Henry IV, and have now supplicated the king to appoint commissaries to issue a final decision. 9

  6. Item, Lamothe delivered to Grailly the oath which the judge ( justiciarus ) of Langon made to him to pay his fourth part of the issues of the petty justice ( parva justicia ), that is 18 ds. , and he swore to obtain from Scossam Bernat d'Escoussans, damoiseau , to deliver to Grailly the oath of the same judge for other 18 l. , etc.;
  7. In return, Grailly discharged Lamothe of any claim about his homage. And Grailly acknowledges that he held from the king half of the toll on the raw iron( ferrum crudum ) that Lamothe held in Langon

Brunet has supplicated the king that, during the time of the truces, a marriage contract was made between him and Barroilh Galharda Barrouil , daughter and heiress of Lady Pys Galharda de Piis of Reule La Réole and the marriage was performed in a church. Galharda de Piis and her daugther should have some lands and hereditary goods in Bordeaux and elsewhere in the duchy in the king's obedience and receive from them a sum of money, these lands and goods having been granted to Brunet by letters concerning them and by Galharda de Piis' will. These houses, the sum of money and hereditary goods of Galharda de Piis and Galharda Barrouil, wife of Arnaut Brunet, being in the king's obedience, should therefore pertain to Brunet according to the Bordelais law. But their profits have been granted to several liege men of the king by the king's predecessors, kings of England, because of the rebellion of Galharda Barrouil. However, these houses, lands and hereditary goods should be returned to Brunet because of his wife's reconciliation [with the king], and they must be returned in their original status, and it will be to Brunet's damage if the king is not providing him remedy.
